Sub: Appointment as Engineer (Projects). With reference to your application for employment and subsequent interview, we are pleased to appoint you as Engineer (Projects) at any of our site offices in India on contractual basis, for a fixed period from 07.07.2017 to 30.06.2019, on an honorarium of Rs.29,500/- per month, in Vindhya Telelinks Limited EPC Division subject to the following terms and conditions:- 1.Be it clearly understood and agreed that your appointment is being made on contractual basis for a fixed period which will automatically end on the expiry of the specified period and no notice or retrenchment compensation will be payable to you by the management. 2. As a fixed term and contractual employee, you will not be entitled to any other privileges or benefits including wages or fixed hours of work, Retention amount equivalent to one month honorarium shall be deducted at the rate of 20% of your honorarium for first five months of employment. This amount will be retained by the company and will be paid to you after completion of contract period or at the time of leaving the service of the company subject to fulfillment of the terms and conditions of your appointment and obtaining No Dues clearance certificate from all departments of the company. 3. Since your appointment is being made for a specified period, you will neither have any right nor a lien on the job held by you either during the specified period or extended period or after its expiry. Also you will not claim regular employment even if there is such a vacancy for the post held by you or otherwise. 4. Your duties will include efficient, satisfactory and economical operation in the area of responsibility which may be assigned to you from time to time. TERMINATION OF SERVICE: (a) This appointment is terminable by Company without assigning any reason whatsoever, by giving one month notice or on payment of equivalent salary in lieu thereof. Except one month notice or an equivalent amount of honorarium in lieu of one month notice, no compensation or remaining honorarium for unexpired period of contractual and fixed period of appointment will be payable by the management if your services are terminated before the aforesaid specified period. The same condition will apply in case you quit the employment but the acceptance of notice amount in lieu of notice period on resignation will be at the discretion of the Management. During notice period, you will not avail any leave. (b] In case of following eventuality your services shall be deemed to be terminated without any obligation on the part of the company for issuing any notice to you:- 0 i) (iv) Material Breach: If you commit a material breach of any of the obligations of the Appointment Letter. Incompetence or Negligence: Ifyou are duly investigated and found guilty of incompetence or negligence in the performance of your dutics. Unsatisfactory Work Conduct: Ifyou are duly investigated and found to have exhibited work conduct that is not found satisfactory by the Company, including insubordination, dishonesty, insobriety, theft, intimidation, sexual harassment, ‘ethical infractions, committing acts or omissions which are detrimental to the reputation and/or business interests of the Company, or other behaviors identified and prohibited in Company policies. Alcohol or Substance Abuse: If you consume alcohol or other prohibited substance during duty or within proscribed timeframes prior to a duty period in contravention to policies established by the Company. il Vindhya Telelinks Limited [3] (v) Authenticity of Particulars Submitted: If you violate the provisions of Clause 8, “Authenti Particulars Submitted”. (vi) Absenteeism: Incase you absent yourself for more than 7 days without approval of the appropriate authority then you shall be considered to have voluntarily abandoned your services from the company. ty of 6. The Management will be within its rights to transfer you for work or loan your services to any other unit/division/department/site where the company has an office or branch or unit or site for work either at present or may have at any time in future. On transfer, loan or deputation, the terms and conditions of your employment will remain as specified in this letter. 7. You will devote your whole time and attention in the interest of the Company and will not engage yourself in any other work either paid or in honorary capacity. 8.Your appointment is being made on the basis of your particulars such as qualifications ete. as given by you in your application for employment and in case any information as given by you is found false or incorrect, your appointment will be deemed void ab initio and liable for termination without any notice or compensation in licu of notice. 9. You will be bound by the certified standing orders, rules, regulations and office orders in force and framed by the company from time to time in relation to your service conditions, which will form part of your terms of employment. 10. In case there is any change in your residential address, you will intimate the same in writing to the HR Department within three days from the date of such change and get such change of address recorded. 11. Any dispute of whatsoever nature between you and the Company shall be subject to the exclusive jurisdiction of courts at Rewa only, whether it be civil courts, labour courts, industrial tribunals or any other courts or authority of whatsoever nature.
