Why do people do fundraising

- To diversify funding, which means not becoming too dependent on a single funder.
- To have the necessary resources for the advice centre to meet its objectives
- To ensure the sustainability of the organisation since funding is required not only to sustain
current projects but also to ensure the long- term survive of the organisation, especially as
far as its most treasured resource, namely, its employees is concerned.

What do your understanding of fundraising?

Fundraising is the organized gathering voluntary contributing funds to support a campaign carried
out by non- profit-making organisation.

What would you say is the key to successful fundraising?

- Identifying potential funders


- Submitting a good proposal
- Building a good relationship with funder
- Instilling confidence

2.1

- Two certified copies of the founding document such as a voluntary association has a constitution, a
trust has a trust deed, and a non- profit company has an MOL.

- Complete application form.

The process of applying for registration as an NOP.

- An application for registration as an NOP is free and should be sent to the director of NOP.
- It must include a covering letter explaining which documents are attached according to the
requirements for registration.
- It is advised that the application be sent by registered mail and copies be kept of the
application and the covering letter together with proof that the application was sent by
registered post or delivered by hand at the HSRC building.
- The director of NOPS has two months to consider the application should the director of
NOP turn down the application the applicant has one months to appeal the decision.
- The appeal must be heard by the arbitration tribunal within three months of their receipt of
the appeal documentation.

Non – compliance by a registered NOP with its constitution and its obligations in team of the NOP
act may result in deregistration. It is a criminal offence to make a material misrepresentation in any
document or narrative, financial or other report submitted to the director of NOP who may refer
such matter to the south African police service for criminal investigation.

The advantages of registering a paralegal advice centre as a non-profit organisation under the non-

- In terms of certain statutes, for instance, the public finance management act 1 of
1999 and the public finance management amendment act 29 of 1999, only those
organisations that are registered as NOP can apply for the government funding.
- Some structures, like voluntary associations, provide for the legal status off an
organisation to be a separate legal person, which means that the organisation’s legal
identity is separate from that of its member and that:
 The assets belong to the organisation and not to its member
 The organisation as a legal person is responsible for the debts incurred. Members
or office bearers are therefore not liable for debts, unless they committed fraud
or were grossly negligent
 The organisation has perpetual succession, meaning that it continues even if
members or the office bearers leave.
- Registration as NOP compels as paralegal advice centre to adopt binding rules
governing the management and running of the organisation. This, in turn, provides
greater clarity to the staff and management of the paralegal advice centre, the
community it serves, its funders and the businesses from which it purchases goods
and services.
- The financial intelligence centre act 38 of 2001 (FICA) has made NOP registration a
prerequisite for voluntary associations to open a banking account.
- Registration results in great accountability to the advice centre’s stakeholders,
including the community it serves, funders and the government. Accountability
necessarily instils greater trust in the ability and willingness of the centre’s
management to run the organisation according to recognised management
principles.
