This notice is in accordance with the clarification requests received relating to the Mediation
Problems of the Preliminary Rounds (Prelims I & II), Quarter-Finals, Semi-Finals & the Final
Round of XMC'23. Thus, the following clarifications are hereby issued for the participating
teams:-

PRELIMS - I
Lakerfields Private Limted (LPL) vs. Oil Management
Indraprastha Company Limited (OMICL)

1. Page 4 of 19 - 3rd Paragraph - Date Change: December 2019 instead of December 2020.

2. Pages 3-5 of 19. What is the content of the Preliminary Data provided by OMICL?
Clarification: Preliminary data would include:
(i) Mathematical calculations of construction of Turret Mooring System,
(ii) Approximate height of the hull,
(iii) other preliminary engineering specifications.
3. Pages 3-5 of 19. Did LPL commence any construction of the Turret Mooring System?
Clarification: Yes, they did but they were behind the schedule even with the
Preliminary Data.

1. Page 6 of 19. The name of the establishment; Salamanca or Sahibullah (SE)?

Clarification: Salamanca, throughout the Mediation Problem.
2. Pages 6-7 of 19. Are there any force Majeure or cancellation clauses in the agreement?
If yes, what do they say?
Clarification: Force majeure clause is not relevant to the problem.

QUARTER-FINALS
VSN Hospitality Private Ltd. vs. Domus Airlines

1. Pages 8-11 of 19. How many days before the payment would cancellation be possible?
Clarification: The minimum commitment order cannot be cancelled for any operating
flight as per the existing Catering Agreement

SEMI-FINALS
Vagabond Travel Company Limited vs.
Nomad Tours and Travel Company Limited

1. Pages 12-14 of 19. Was there any time duration between the parties i.e., is it a time bound
contract? If yes, what is the time?
Clarification: The contract was for 10 years, however it had an automatic renewal
clause and will not be terminated unless specifically done so by either of the parties by
providing 3 months’ notice.

Mombi Mavericks vs. Mombi State Government

1. Pages 15-16 of 19. Who owns and who finances the Wakdy Stadium?
What is the status of the breakup of ownership and funding?
Clarification: The Wakdy Stadium is owned and financed by the Mombi Cricket
Association (MCA), which is recognized by BCCI. The primary sources of income of
MCA for funding purposes is through subsidies, income from sports activities like hosting
matches, ticket sales and other earmarked funds.

GENERAL CLARIFICATION
Q. When & where does the Mediation take place?

Clarification: The mediation is taking place in India, and the jurisdiction is Kolkata.

Any further clarification/s shall be issued in furtherance to any queries or otherwise, as and
when required.

University, Kolkata, in April 2023.
