PARTNERSHIP IN PRIVATE BASIC EDUCATION ACT

LEGISLATIVE HISTORY:
 Filed in the 18th and 19th Congresses

OBJECTIVES:

 To strengthen the partnership between the government and private basic education
institutions in addressing the gap on the complementary roles of public and private
basic education institutions in the educational system through the exercise of
reasonable supervision, regulation, and collaboration
 To enhance the role of private basic education through the creation of mechanisms
to support their institutional development

KEY PROVISIONS:

 Creates the Partnership in Private Education Board, attached to the Department of


Education, which is mandated to lead in establishing policies, priorities, and
objectives and in the implementation of programs and projects in line with the
government’s comprehensive effort to establish, maintain, and strengthen
partnership with private basic education institutions
 Provides for the composition of the Board to be headed by the Secretary of
Education and the following, as members: (a) Secretary of Science and
Technology; (b) Secretary of Budget and Management; (c) Director-General of
National Economic and Development Authority; (d) Chairperson of the Commission
on Higher Education; (e) Director-General of Technical Education and Skills
Development Authority; (f) Two (2) representatives of a nationwide association of
administrators of private basic education institutions; (g) Two (2) representatives of
a nationwide association of teachers employed by private basic education
institutions; and (h) A representative of a nationwide association of teachers
employed by private basic education institutions
 Prescribes specific functions of the Board
 Creates a Partnership Fund for Private Education as a special trust fund for the
purpose of financing the assistance and partnership programs with private basic
education institutions, provided that the Fund shall not be used to fund personal
services and other operational expenses of the Board
 Provides specific uses of the Fund, as follows: (a) Service contracting payments
using a student voucher program; (b) Salary subsidy for teachers in private
education institutions; (c) Subsidies for loans made from government financial
institutions to finance capital investments, including lot acquisition, infrastructure,
and equipment; and (d) Other projects eligible for financing such as continuing
faculty development, in-service trainings, purchase of library materials and
laboratory equipment, and other institutional development programs
 Sets criteria for assistance to private basic education institutions
 Grants assistance to the programs of private basic education institutions in the form
of subsidies, grants, or loans from government financial institutions, provided that
such programs shall meet certain defined educational requirements and standards
and shall contribute to the attainment of national development goals

 Grants government assistance, through the Fund, to


(a) Students in private basic education in the form of tuition fee supplement
through the voucher system;
(b) Teachers in private basic education as subsidy to support their living
conditions; and
(c) Teachers in private basic education in the form of scholarships for graduate
degree, degree or non-degree programs, workshops, seminars or for in-
service training to upgrade their knowledge and teaching competencies in
critical subject areas and for the modernization of teaching techniques and
strategies
 Sets penalties for violation of the provisions of this Act and its implementing rules
and regulations
 Creates a Joint Congressional Oversight Committee Composed of five (5)
members each from the Senate and the House of Representatives composed of:
(a) Chairpersons of the Senate and House Committees on Basic Education; (b)
Chairpersons of the Senate Committee on Finance and House Committee on
Appropriations; (c) Three (3) other members each from the memberships of the
Senate and House Committees on Basic Education with at least one (1) member
each from the Minority to be chosen, respectively, by the Senate President and the
House Speaker
 Appropriates funds for the implementation of this Act to be included in the
Department of Education budget in the annual General Appropriations Act
