What is non est factum?

A Latin term and a doctrine of law literally meaning "it is not the deed"
What is it's purpose?
To allow someone induced into a contract fraudulently or by way of misrepresentation to exit the contract
without issue.
It can also be used as a "plea" during a "special appearance"
How is non est factum relevant in a "criminal" proceeding?
Is your case a civil case?
Of course it is
Is there an injured party?
No
Therefore no victim no crime.
No "crime", meaning it's a civil matter between you and the NZ police, 180 molesworth street wellington.

Those who make a statement must bear the burden of substantiating it.
In other words if you make a statement you have to prove it, right?
If you ask a question, the burden is then passed on to those who must answer.
And if they can't answer or knowingly withold information, then they have created an estoppel and you are
barred from going any further in the proceedings!

The general division of the court has an equitable jurisdiction, they just choose not to be equitable unless
you bring it up
