Article 1895 of the Civil Code of the Philippines deals with the concept of solidarity in agency.

Ito ay
nagsasaad na kung ang solidarity ay napagkasunduan ng dalawa o higit pang mga agents, each of them is
held responsible for the non-fulfillment of agency and for the fault or negligence of their fellow agents.

Solidarity is a legal concept that holds multiple parties jointly responsible for a particular obligation or
liability. In the context of agency law, ito ay nangangahulugan na ang mga agents ay sumang-ayon na
magbahagi ng responsibilidad sa pagpuno ng kanilang tungkulin bilang agents, and that they are jointly
liable for any breaches of their obligations.

Under Article 1895, each agent is responsible not only for their own actions but also for the actions of
their fellow agents. Ito ay nangangahulugan na kung may isang agent na hindi nakapagpuno ng kanilang
tungkulin, all the other agents in the group will be held responsible for the failure, even if they
personally did everything correctly.

However, there is an exception to this rule. Kung ang mga kasamang agent ay lumabag sa kanilang
awtoridad, the agent will not be held responsible for their fault or negligence. This means that if one
agent goes beyond the agreed-upon scope of their authority and causes harm or damage, the other
agents will not be held responsible for their actions.

For Example.

may isang grupo ng mga agents sa real estate na sumang-ayon na magtrabaho nang magkasama upang
magbenta ng isang property. They signed an agreement that includes a clause on solidarity, which
means that each agent ay jointly responsible for fulfilling the agency duties and for the fault or
negligence of their fellow agents.

One of the agents, Agent A, fails to disclose a material defect in the property to a potential buyer, which
leads to a lawsuit against the group of agents. In this case, lahat ng agents sa group, including Agent A,
will be held responsible for the non-disclosure and for any damages resulting from the lawsuit.

However, if one of the other agents, Agent B, acted beyond the scope of their authority by making
unauthorized changes sa property ng walang consent ng owner, the other agents will not be held
responsible for Agent B's actions. In this case, si Agent B lang ang solely responsible for any damages
resulting from his/her actions, and the other agents will not be held liable.

So, as you can see, Article 1895 of the Civil Code of the Philippines establishes the principle of solidarity
in agency, which means that each agent is jointly responsible for fulfilling ng kanilang duties and for the
fault or negligence of their fellow agents, except in cases where the fellow agents acted beyond their
authority
