Check List for Disciplinary Proceedings and holding Domestic Enquiry.

Preliminary Enquiry/recordings/filing of
evidence/photographs/documents/check clause of Standing Orders violated.
Show Cause and Charge Sheet Calling for Explanation. Attaching complaints
received. Suspension if deemed necessary.
Examination of Explanation and reply from Delinquent Workman and
decision by Management to proceed with Enquiry.
Since Explanation not found satisfactory:
-Inform as above and intimate in writing intension to hold domestic enquiry.
-Inform name of Enquiry Officer.
-Notice of domestic enquiry. Giving details of date/time/place/seeking name
of co-workers who will defend him/witnesses to be produced by him.
Preparation for Domestic Enquiry, decide on MR, MR to be conversant with
subject, documents, witnesses.Mgt.Witnesses to be briefed.
Preparation of the Enquiry Venue-Table/Chairs/papers/witnesses/co-
workers/translators/independent observers.
Domestic Enquiry to be held in conformity with principles of Natural Justice.
Enquiry Officer to submit finding along with the proceedings of the Enquiry
duly signed in all pages by all.
Examination of the proceedings and Findings of the Enquiry Officer.
Application of the Management’s mind, check past records of delinquent
workman.
Decide on quantum of punishment/warning etc. in conformity with the
provisions of the Standing Order.
Draw up Management’s Findings and vet by all concerned.
Examine whether application under Sec 33(2) due and file application before
the relevant Court/Tribunal etc. if due.
Provide a copy of the Enquiry Proceedings, E.Os findings and intimate the
Management’s intention to the Delinquent Workman of the punishment
proposed and allow opportunity to show cause and bring out anything further
in his defense.
Examine Delinquent Workman response to the last show cause and his final
statement. Apply Management’s mind and decided on final action with
regard to punishment/warning etc.
Draw up Advice of Punishment. Check whether one months wages due in
compliance with Sec 33(2) of the I.D Act.
Check arrears and legal dues payable or recoverable from Delinquent
Workman. Check whether Subsistence Allowance paid. Advice accounts.

Issue Dismissal letter.

Inform PF Trust, Advice Gratuity and other settlements.
