Child Pornography Law - a child shall also refer to:
1. A person regardless of age who is presented, depicted or portrayed as a
child; 2. Computer-generated images or graphics of a person who is represented or made to appear to be a child.
RA 7610 - expressly mentions “adult” as an offender in sexual abuse. As
to other crimes, the law is silent as to the age of the offender.
Maltreatment in child abuse, is whether habitual or not.
Inflicting injuries upon a child constitutes physical injuries under the
RPC. But if the infliction constitutes cruelty or psychological and physical abuse against a child, which debases, degrades or demeans the intrinsic worth or dignity of a child as a human being, the crime committed is child abuse.
Neglect - unreasonable deprivation of a child’s basic needs for survival.
Like food, shelter; or failure to immediately give medical treatment to n injured child resulting in serious impairment of his growth.
Child trafficking - trading, dealing. Buying and selling for money or for any other consideration, or barter.
Child Prostitution - child whether male or female. For money or profit or
any other consideration indulge in sexual intercourse or lascivious conduct. Habituality not an element.
Offender - customers, pimps and owners of the house of prostitution.
