To whom it may concern,

Paragraph 6.5 of the RESS 2 Terms and Conditions states –

The Regulatory Authority will then determine appropriate final competition


ratios “Final Competition Ratios” for each Preference Category (“FCRp”)
taking into account the results of a competitive analysis that the Regulatory
Authority will undertake on the aforementioned data. The competitive analysis
undertaken by the Regulatory Authority for this purpose may consider certain
factors including the distribution of ownership and commonality of control,
pivotal supplier considerations, other market concentration considerations,
and other factors as the Regulatory Authority in its sole discretion deems
appropriate. The Final Competition Ratios will be published by the Regulatory
Authority prior to the submission of Offer Prices by Qualified Applicants
unless the Regulatory Authority determines there is insufficient competition
within a Preference Category with which to conduct an auction, in which case
a statement to this effect will be published instead for the Preference
Category(ies) concerned.

Pursuant to paragraph 6.5 of the RESS 2 Terms and Conditions, the CRU have
determined the following Final Competition Ratios.

p = a (all projects) p = c (community)

Final Competition Ratio 1.37 1.82

The Final Competition Ratio for the Community preference category in RESS 2
(1.82) is higher than that of the Community preference category in RESS 1 (1.3) due
to common ownership of a large proportion of projects within the Community
category.

The target volumes as set by the application of these Final Competition Ratios may
be exceeded by virtue of the fact that all bids with Deemed Offer Prices within 5% of
the highest winning bid are also accepted, up to Rmax, as set out in paragraph 6.7.6
of the RESS 2 Terms and Conditions.
