RESOLUTION

The above complaint does not require the conduct of preliminary

investigation. Hence, this resolution is borne only of the evidence submitted
by the complainant.

Complainant alleged that at January 1, 2023 at around 4:00 pm in the

afternoon I was walking along tubod highway in front of Land
transportation office. I saw JUAN DELA CRUZ, sitting on the corner while
staring at me. He approached me and asked for my number but I declined.
When I am about to walk away, he suddenly pulled by hair hard and he
started dragging me, and he pushed me hard causing me to hit the road.

Complainant alleged that she suffered several bruises, wounds, and a

broken wrist because of such incident.

Complainant’s witness, Juan Luna, of the jeepney driver who saw the
incident, executed an affidavit and materially corroborated complainant’s
allegations.

Attached to the complaint are the following documents, namely: extract

of the police blotter entry regarding the incident, Certification to File Action,
minutes of the mediation proceeding before the barangay captain of
barangay Tubod, and the medical certificate issued to the complainant.

The medical certificate shows that the complainant was examined on

January 3, 2023 and was found to have suffered soft tissue injury,
specifically abrasion on her right legs, arms, and left foot and a broken wrist
which will heal in a week’s time.

The evidence-at hand supports a finding of probable cause for one

crime of slight physical injuries.

Wherefore, premises considered, the investigating prosecutor find

existence of probable case for crime of SLIGHT PHYSICAL INJURIES and
respondent is probably guilty of thereof and should be held for trial and
most respectfully recommends the filing of corresponding information
before the Municipal Trial Court of Iligan City.
