First of all, the letter starts and ends saying it comes on behalf of and | am accused and investigated by ESET Software ‘Australia Pty Ltd., the company | was responsible as a Director. | am confused as | have always assumed the Investigation Is conducted by ESET spol 5.0, The envelope has written on a lawyer company name, King & Wood Mallesons. AAs | said, the letter addresses me like Managing Director (so Director and Country Manager) being investigated by ESET Software Australia Pty Ltd. since 12/06/2019. At that time | was the only active Director and given the fact a lawyer company cannot start any action without being engaged and paid, | do not recall any contract, engagement letter or payment made to them until 27/06/2019 when | was removed as Director. On the other hand, if the lawyers ‘were engaged and/or paid by ESET spol, s.ro. they must represent ESET spol, s.r. and this needs to be made very clear in all the correspondence as | the right to know who is accusing me and who | am defending against. The suspension email was sent also on behalf of ESET Software Australia Pty Ltd but It was signed by Lukas Raska as COO APAC. Everything looks confusing, please clarify this for me. Secondly, the letter says | have to send a written response until midday Monday 8 July to “me”. I do not know who “me” is as there is a signature with no name written next to it. There is also no information where | have to send the response. Please advise, Thirdly, given the extent of the letter’s allegations is so huge, it requires lots of time to answer. The deadline imposed by the letter is extremely short and | really need more time to properly respond. | not trying to extend it deliberately as | have been always mentioning this during the discussions with John, Michal, Lukas and Charlotte. | simply cannot answer in less than 1.5 working days. Even if | was told by phone that | should remember everything from memory, this is impossible. | am not a computer ‘to remember and answer to questions that go so far back in time (e.g. questions about Microbe’s order in 2017). | would definitely need more time given my health status, the weekend where | must be with my family, the current stressful house environment after my wife has read the letter and not having access to any files, systems and emails Some questions can be answer only in a general way because in order to provide a qualified and precise answer, apart from the access | would also need to talk/ask current and former employees such Accountant, Admin, Sales Directors, Sales Managers et. that are or were responsible at those times for particular departments. | oversce most of the company marketing and sales functions and the day-by-day operations but not in such detail Ths is why | have under myself managers and a team. Please also let me mention that by law I have several rights during a workplace investigation. The first most important one is that | must get a reasonable time to respond to the complaint. In order to be able to answer, the second most important right is to receive particulars of the complaints and sufficiently detailed summaries of all the adverse information, that | may be relied on win determining whether or not | was engaged in the alleged misconducts. ‘To support this more, John Swinson also mentioned many times during our call about these two rights that | have and will be respected. Firstly, he clearly said that the written allegations will be all covered by clear proves because he, as a lawyer, won't accept any fictive or crazy ones. He even gave me a few concrete examples. Secondly, trying to calm me, he has underlined a few times that | will 100% have the correct, fair and necessary time to respond back. ‘Accordingly, there are several allegations without supporting documents so | look forward to receiving them, especialy Sor the allegations that sre not affecting only my job But actually having @ huge Impact on my personal ie. ‘As a husband of a wonderful wife and father of an incredibie 13 years old gir, please tell me how I can look into my daughter eyes after she has seen, live, my wife's reaction and heard the tense discussions after my wife read the letter? | must prove myself not guilty especially to my family. The way this, investigation was conducted so far, the collateral events created and the way the letter has been designed, itis no longer about my employment at ESET but about my personal life. I see it now as an execution, a vendetta ignited and fueled by some that manufactured allegations and the whole story only to see me, Florin the human being, not the Managing Director, down, in loss and suffering.
