BACKGROUND: Every ten years following the enumeration by the U.S. Census Bureau, the Council ward boundaries of the City of Salem are adjusted to equalize the population represented by each ward. This equalization of representation is known as reapportionment. On June 27, 2011, the City Council authorized staff to move forward with the council wards reapportionment process, appointed Mayor Peterson as the council liaison for wards reapportionment, and directed staff to retain the Mid-Willamette Valley Council of Governments (COG) to assist the City Council in the development of these new ward boundaries (Attachment B). On July 11 and 12, 2011, City Councilors attended interviews with COG redistricting staff, providing feedback regarding reapportionment criteria, potential ward boundary changes, and identifying additional considerations to be taken into account in the reapportionment process. A City Council work-session was held at the Salem Main Library on August 8, 2011, to provide an informal opportunity for the public and members of the City Council to review and discuss alternatives for the ward boundaries and ask questions of staff and COG redistricting staff prior to a formal meeting. Through the interviews and work-session the Council provided considerations and suggestions to COG redistricting staff regarding potential ward boundary changes Council Ward Boundaries Page 1 September 12,2011 including but not limited to the following: the treatment of ward boundaries with respect to the downtown core and Ward 8 (West Salem), maintenance of communities of common interest and adherence to neighborhood, urban renewal area and current Council ward boundaries where practical. Feedback from the councilor interviews and work-session was used by COG staff to prepare three alternative ward boundary scenarios for consideration at a public hearing set for September 26, 2011. It is anticipated that the alternative ward boundary scenarios contained in 'Attachment A,' or modifications to them as determined by City Council, will be presented for consideration at a public hearing before City Council on September 26, 2011. FACTS AND FINDINGS: 1. The U.S. Census Bureau released their redistricting data files from the 2010 Census in March, 2011, facilitating updates to Oregon legislative and congressional district boundaries, which concluded in July, 2011. 2. Upon completion of state legislative boundary redistricting, local governments and special government bodies are directed by the Oregon Secretary of State to reapportion ward and/or election district boundaries. 3. City Councilors attended interviews with COG redistricting staff on July 11 and 12, 2011, to discuss the wards reapportionment criteria and the reapportionment process. 4. A City Council work-session regarding the wards reapportionment criteria and process was held on August 8, 2011. 5. Based on the considerations identified in the councilor interviews and at the work-session, COG redistricting staff has prepared three alternative ward boundary !:;cenarios. 6. The three alternative scenario maps and tables containing demographic information (population by ethnicity, deviation from current wards) for the existing and proposed ward boundaries are attached herein (Attachment A). 7. Following the September 26, 2011, public hearing it is anticipated that the City Council will select a new wards boundary map. 8. The new ward boundaries must be finalized and submitted to the County Elections offices by November 1, 2011. RECOMMENDATION: Staff recommends that City Council direct city staff to move forward with the council ward reapportionment, appoint Mayor Peterson as the council liaison and approve COG staff to perform the council ward reapportionment services. BACKGROUND: On January 11, 2011, the City Council was provided with an "information only" report which outlined the reapportionment process (Attachment A). In order to move forward with the reapportionment process City Council action is required for the following: 1. Appointment of Mayor Peterson as the council liaison to serve as a single point of contact between the City Council and the COG, and 2. Approval of consultant services to perform the council ward reapportionment services. In December 1975, the Congress passed Public Law (P.L.) 94-171 which requires that the federal Census Bureau make special preparation to provide redistricting data. The P.L. 94-171 data is used by each state to redraw legislative district boundaries and used by local governments to redraw ward and/or election disfrict boundaries. This equalization of representation or balancing of population between ward and/or election districts is known as reapportionment. Ward Reapportionment Page 1 June 27, 2011 ATTACHMENT 8 The current Salem city council ward boundaries were developed in 2001 following the 2000 Census. The 2010 census population information is now available. Analysis of the ward boundaries has been performed to determine where population needs to be balanced due to population growth or decline over the past decade. In order to determine the optimum population for each council ward, the total population (154,637) for the city is divided by the number of council wards (8), and the resulting number (19,329) becomes the target population. Below is a table which summarizes the current population of each ward and the deviation from target population (Attachment B- Current Wards Chart). In general, the reapportionment services provided by COG included preparation of draft reapportionment plans, maps and data describing that plan, staff report, access to software and data, and attendance at several public meetings including an informal public open house, City Council meetings and public hearing. FACTS AND FINDINGS: . 1. COG is uniquely qualified to perform the services because they are familiar with the past project; has special access to redistricting data prepared by the Census Ward Reapportionment Page 2 June 27, 2011 Bureau, and has the technical expertise to utilize redistricting software. 2. The ward reapportionment process begins after the state legislative district boundaries are updated in July 2011. Therefore, it is anticipated that the ward reapportionment activities will take place during July, August, and September 2011. 3. One of the initial steps of the reapportionment process is the City Council review and adoption of the criteria utilized as a guideline for readjusting the ward boundaries. 4. The COG's ward reapportionment services will include: Develop the draft criteria to be utilized for readjusting the ward boundaries; Facilitation of a work session to brief the City Council on the reapportioning process, review the draft criteria, and address any questions or concerns; Preparation of three redistricting plan alternatives, including maps and summary data; Presentation ofthe alternatives at a City Council meeting; and Preparation of the final plan maps and tables in electronic format. 5. Following the work session staff will present the criteria for adoption by the City Council. 6. Special efforts will be made by staff with assistance from COG to identify Title VI populations, formulate public involvement strategies, and report outreach efforts to and participation by Title VI communities. One of the initial steps of the reapportionment process is the City Council review and adoption of criteria utilized as a guideline for readjusting the ward boundaries. In the past, the following criteria contained in the Oregon Revised Statue (ORS) 188.010 formed-the basis for reapportioning the City Council ward boundaries: ,. 1. Each district, as nearly as practicable, shall: (a) Be contiguous; (b) Be of equal population; (c) Utilize existing geographic or political boundaries; (d) . Be connected by transportation links. 2. No district shall be drawn for the purpose of favoring any political party, incumbent legislator or other person. 3. No district shall be drawn for the purpose of diluting the voting strength of any language or ethnic minority group. . . As part of this reapportionment process, the City Council will be asked to provide guidance on the following issues: 1. Approval of consultant services to perform the ward reapportionment services; 2. Appointment of Mayor Peterson as the council liaison to assist with the reapportionment efforts;. 3. Review and adoption of the criteria to be used in updating the ward boundaries; 4. Approval of protocols for individual councilor input and/or briefing; 5. In general, the primary reapportionment services provided by COG include the assistance in the development of criteria; and preparation of draft reapportionment plans, maps and data describing that plan. FACTS AND FINDINGS: 1. The MWVCOG has expressed an interest to again work with the City of Salem to update the City's ward boundaries utilizing the 201 0 Census Data. 2. The ward reapportionment process begins after the state legislative district' boundaries are updated in July 2011. Therefore, it is anticipated that the City Council be involved in wa'rd reapportionment activities during July, August, and September 2011. 3. The new ward boundaries must be finalized and submitted to the Marion County Elections by .November 1, 2011.
