SUMMARY OF VIDEO SYARAHAN SAINS ISLAM – KESEPADUAN ILMU DALAM FATWA

Firstly, Fatwa is a term that refers to everything that comes from the authorities. The
fatwa is also well-known knowledge since the period time of the prophet Muhammad SAW,
and it is still considered valid today. The fatwa institution's scope includes not only
management, but also a wide range of human-related issues. In our country, the fatwa
institution has progressed in lockstep with Islam. A well-managed fatwa can serve as a guide
for society as well as an official position for the country.

According to Tan Sri, Fatwa in terms of understanding and the physical institution
must be enhanced on a regular basis. The institution's authority are also established. This is
because a poorly handled fatwa will have a harmful impact on society. Furthermore, whether
a fatwa is issued, it has the potential to affect the Muslim community. Nonetheless, it differs
from a judge in a courtroom. Because they only delivered a decision to a person or a certain
group of people engaged in a case. This is not the case with fatwas. If a fatwa is issued
incorrectly, it may cause dissatisfaction among Muslims. As a result, fatwas must not be
treated lightly.

Furthermore, In Malaysia, fatwas can be found in two sources. The Fatwa committee
or Muzakarah committee is the source at the national level. This is a national situation, and
the fatwa given is not legally binding. Since only states in Malaysia have the authority to
issue binding fatwas, they get the right to discuss fatwas, make religious decisions, and so
on. The state committee makes up the second official source. Because each state has its
own fatwa committee. They have the authority to issue fatwas that are legally binding for the
residents of the state.

In terms of adjustment or major concerns, such as deciding on fasting or the Raya


celebration, it is generally done together with an agreement to do clarification or explanation.
In other cases, the conclusion is a distinct perspective from different Muftis, although this
has no bearing on the community. Each state committee has its own version of the statute.
Every judgement made by the committee and Mufti is relayed to the governing King, and the
fatwa issued is obligated to the community as well as the Syariah court. Any individual who
rejects the fatwa will face legal consequences.

Other than that, in this instance, there are no halal constituents. Is it possible to
identify whether anything is halal or haram? In this circumstance, we must seek the advice of
a professional. To determine if it is permissible or not, we must consult with experts in the
relevant subject. Islam is a religion that promotes rules based on scientific factors and
reliable fundamentals taken from Islam's origins. At the same time, a fixation on specific
scholars must be avoided. Obsession with a specific scholar has a lot of implications when
deciding on a fatwa. A person is also required to have the moral of honesty when issuing
fatwas or judgements.

According to Prof Emeritus Tan Sri Dato Dr Abdul Syukor Hj Hussin, Malaysia’s
fatwa instituition can be sustained by the including the experts in various field into the fatwa’s
committee such as medical, economy and astronomy field. Hence, the committee must not
be limited to only religion field. The biggest reason to include these experts in fatwa
committee because of the knowledge they have in their specific field. Other than that, Prof
Emeritus also mentioned the research method used by the Mufti’s to make fatwa is important
wether they use traditional or modern method (empirical method). At the end of the
interview, Prof Emeritus Tan Sri Dato Dr Abdul Syukor Hj Hussin suggested the establisment
of Islamic research centre that bring altogather the experts in various fields.

Hence, the community understands that a fatwa that is well-managed and can help
the community flourish will serve as a guide. It can be used as the official opinion of the
country or the government even if it is done according to protocol. Since Malaysia is an
Islamic country, and the government is open to allowing people to practise their faith in some
way. As a result, fatwas must be developed on a regular basis, not only in terms of
knowledge and physical institutions, as well as in regards of members who are associated
with the institution's philosophy. Fatwas that are poorly administered would have a negative
impact. A fatwa issued publicly or informally, for example, may have an impact on the
person, a community, or perhaps the whole ummah. The judge or Mufti will only make a
decision based on the facts of the case. In contrast to the fatwa, if it was really incorrect, it
will cause hardship to the society and the ummah.
