MAY/24/2023/WED [|:33 AM Polk County Clerk PAX No, 423 338 4551 F001 ‘Resolution # 97.22 RESOLUTION OF THE GOVERNING BODY OF POLK COUNTY, TENNESSEE TO REGULATE BIO-SOLIDS IN POLK COUNTY WHEREAS, The county of Polk has « fundamental right and duty to safeguard and protect the health ad elas ofits ctcen, jut us te Sate of Tennessee has the same responsibly tall he ctzens of the State and; WHEREAS, the science supporting Bio — Solids is inadequate to make substantial claim as to the value ‘of such product in relation to health, ailments, afflictions and cost and some studies even point to respiratory and skin irritation and infection irom the production of bio fertilizers, and; WHEREAS, the State of Tennessee Department of Environment and Conservation (DEC) is belleved by the commission, the citizens of Polk and as it is peresived, any State of Tennessee Citizen to be lacking in operational procedures by not inclading a public hearing and notification system when application is made or notification of award of such license is received for « Commercial Fertilizer License and for any ‘area designated in which such license can be used, and: WHEREAS, There has been no Economic Impact Study done in the Copper Basin Tennessee area in conjunction with the use of Bio-Solids in the area, this being in a county which has its primary revenue stream as tourism and where the smell of such bio-solids not only effect the local residence ability to enjoy their own property but bas brought complaints such as “it really smells bad here” and questions such as "does it always smell like this around here?” to Jocal businesses and citizens from tourist, and WHEREAS, there is not any information as to the specifics of the Copper Basin area in terms of it unique land situation — specific to former Copper mining which has left land cracks and allows for water and drainage run off in un-mappable directions (ever changing with micro-shifts and fall ins) and the impact of man made prescription type drugs believed to be contained in Bio- Solids and its reaction to heavier doses of metal and natural occurring highly concentrated amount of elemental minerals such as asbestos found in mining areas, and; ‘WHEREAS, by their own admission, T.D-E.C. does not regulate smel] or general auisance, NOW THEREFORE, BE IT RESOLVED by a vote of the Board of County Commissioners of Polk County, ‘meeting in regular session on this 15th day of September, 2022, that the following is being requested by TDEC. and the state of Tennessee 41), That all Bio-Solid disbursement oa public and private property be stopped immediately thru the ‘certificate / licensing program and any other measures available to the State of Tennessee until such time as all above items can be examined ind an opinion of majority of county residence can be taken in the affirmative to allow such actions to resume in the form of public hearing or referendum, and 2), That the State of Tennessee implements a ban of Bio-Solid and Bio-Sludge application to land use ‘throughout the State of Tennessee, ands 3), That if #2 above does not occur, that the State of Tennessee and 7,D.E.C. create andlor implement a public hearing and notification system for the issuance of or upon receipt of notice of al licensing and certificates inside the Great State of Tennessee “23 Page 1 of 2 MAY/24/2023/VED 11:33 AM Polk County Clork FAX No, 423 338 455!
