1. If the bidder is a Micro or Small Enterprise as per latest definitions under MSME rules, the bidder shall be
exempted from the requirement of "Bidder Turnover" criteria and "Experience Criteria" subject to meeting of
quality and technical specifications. If the bidder is OEM of the offered products, it would be exempted from the
"OEM Average Turnover" criteria also subject to meeting of quality and technical specifications. In case any
bidder is seeking exemption from Turnover / Experience Criteria, the supporting documents to prove his eligibility
for exemption must be uploaded for evaluation by the buyer.
2. If the bidder is a Startup, the bidder shall be exempted from the requirement of "Bidder Turnover" criteria and
"Experience Criteria" subject to their meeting of quality and technical specifications. If the bidder is OEM of the
offered products, it would be exempted from the "OEM Average Turnover" criteria also subject to meeting of
quality and technical specifications. In case any bidder is seeking exemption from Turnover / Experience Criteria,
the supporting documents to prove his eligibility for exemption must be uploaded for evaluation by the buyer.
3. The minimum average annual financial turnover of the bidder during the last three years, ending on 31st
March of the previous financial year, should be as indicated above in the bid document. Documentary evidence in
the form of certified Audited Balance Sheets of relevant periods or a certificate from the Chartered Accountant /
Cost Accountant indicating the turnover details for the relevant period shall be uploaded with the bid. In case the
date of constitution / incorporation of the bidder is less than 3-year-old, the average turnover in respect of the
completed financial years after the date of constitution shall be taken into account for this criteria.
4. Experience Criteria: In respect of the filter applied for experience criteria, the Bidder or its OEM {themselves or
through reseller(s)} should have regularly, manufactured and supplied same or similar Category Products to any
Central / State Govt Organization / PSU / Public Listed Company for number of Financial years as indicated above
in the bid document before the bid opening date. Copies of relevant contracts to be submitted along with bid in
support of having supplied some quantity during each of the Financial year. In case of bunch bids, the category of
primary product having highest value should meet this criterion.
5. OEM Turn Over Criteria: The minimum average annual financial turnover of the OEM of the offered product
during the last three years, ending on 31st March of the previous financial year, should be as indicated in the bid
document. Documentary evidence in the form of certified Audited Balance Sheets of relevant periods or a
certificate from the Chartered Accountant / Cost Accountant indicating the turnover details for the relevant period
shall be uploaded with the bid. In case the date of constitution / incorporation of the OEM is less than 3 year old,
the average turnover in respect of the completed financial years after the date of constitution shall be taken into
account for this criteria.
6. Preference to Make In India products (For bids < 200 Crore):Preference shall be given to Class 1 local supplier
as defined in public procurement (Preference to Make in India), Order 2017 as amended from time to time and its
subsequent Orders/Notifications issued by concerned Nodal Ministry for specific Goods/Products. The minimum
local content to qualify as a Class 1 local supplier is denoted in the bid document. If the bidder wants to avail the
Purchase preference, the bidder must upload a certificate from the OEM regarding the percentage of the local
content and the details of locations at which the local value addition is made along with their bid, failing which
no purchase preference shall be granted. In case the bid value is more than Rs 10 Crore, the declaration relating
to percentage of local content shall be certified by the statutory auditor or cost auditor, if the OEM is a company
and by a practicing cost accountant or a chartered accountant for OEMs other than companies as per the Public
Procurement (preference to Make-in -India) order 2017 dated 04.06.2020. Only Class-I and Class-II Local suppliers
as per MII order dated 4.6.2020 will be eligible to bid. Non - Local suppliers as per MII order dated 04.06.2020 are
not eligible to participate. However, eligible micro and small enterprises will be allowed to participate .In case
Buyer has selected Purchase preference to Micro and Small Enterprises clause in the bid, the same will get
precedence over this clause.
7. Purchase preference to Micro and Small Enterprises (MSEs): Purchase preference will be given to MSEs as
defined in Public Procurement Policy for Micro and Small Enterprises (MSEs) Order, 2012 dated 23.03.2012 issued
by Ministry of Micro, Small and Medium Enterprises and its subsequent Orders/Notifications issued by concerned
Ministry. If the bidder wants to avail the Purchase preference, the bidder must be the manufacturer of the offered
product in case of bid for supply of goods. Traders are excluded from the purview of Public Procurement Policy for
Micro and Small Enterprises. In respect of bid for Services, the bidder must be the Service provider of the offered
Service. Relevant documentary evidence in this regard shall be uploaded along with the bid in respect of the
offered product or service. If L-1 is not an MSE and MSE Seller (s) has/have quoted price within L-1+ 15%
(Selected by Buyer)of margin of purchase preference /price band defined in relevant policy, such Seller shall be
given opportunity to match L-1 price and contract will be awarded for 25%(selected by Buyer) percentage of
total QUANTITY.
8. Past Performance: The Bidder or its OEM {themselves or through re-seller(s)} should have supplied same or

similar Category Products for 20% of bid quantity, in at least one of the last three Financial years before the bid
opening date to any Central / State Govt Organization / PSU / Public Listed Company. Copies of relevant
contracts (proving supply of cumulative order quantity in any one financial year) to be submitted along with bid
in support of quantity supplied in the relevant Financial year. In case of bunch bids, the category related to
primary product having highest bid value should meet this criterion.

1. Generic

Running Contract for long term staggered delivery: The Purchaser reserves the right to increase the order
quantity against this bid by

% of the bid quantity. This bid is created for a long term staggered delivery requirement and hence the
Contract Price will be Valid for a period of

Months from the date of placement of contract. Total estimated requirement for all bid items during
contract validity period is therefore = bid quantity plus option clause %. The buyer commits to order a
minimum 50% of the quantity under option clause during the contract price validity period and the child
contracts would be largely spread evenly over the contract validity period unless in exceptional
circumstances. Orders for the additional quantity under this modified option clause will be issued by the
buyer in the form of separate child contracts and will have to be executed by the seller as per delivery
timelines stipulated by the Buyer in Child Contracts. Option of issuing child contracts may be exercised by
the buyer more than once (any number of times) during the Contract Price validity period. Bidders are
bound to accept the child contracts accordingly. GeM Transaction charges will be calculated based on the
total value of all orders placed including the main contract and all child contracts. The same shall have to
be paid by the seller when the main/ child contracts are placed.

1. The purchase the 200000 nos of cukture packets Rhizobium and 2
00000 nos /PSB on FOR basis through inviting short term e- bidding
at GeM portal for a period of 7 Days following the GeM terms & Con
ditions.
2. The actual quantity and destination will be received after the aloo
cation of Minikits by MOA & FW, GOI.
3. Rate shall be quoted in Rs ……. Per Packet. FOR- All India basis fo
r the net packed quantity in 200 gm Packing (exclusive of packing
weight). The rate shall be all inclusive and no other claim on taxes
etc. if any shall be entertained.The rates offered will be valid till 31.

4. The tender shall be accompanied by interest free EMD Rs.25000/-
in the form of Demand Draft drawn in favour of National Seeds Cor
poration Ltd., Jaipur or through NEFT/RTGS after generating E-chall
an from https://indiaseeds.enivida.com. Tenders without EMD may
be rejected. EMD of unsuccessful Tenderers except the lowest thre
e will be returned through RTGS/NEFT within 60 days of tender ope
ning. EMD of the lowest three will be returned within four months o
f tender opening. Outstanding amount, if any, of the supplier with
NSC will not be considered for the EMD purpose.

6. The successful tenderer shall / remit interest free Security Deposit
of Rs. 25000 . This deposit shall be remitted within five working da
ys from the date of receiving the NSC’s purchase order / intimation
or shall be deducted from the initial payments to be made to the s
uccessful tenderer. EMD of the successful tenderer can be adjusted
in the security amount. Failure to remit the Security / Deposit will i
mply forfeiture of EMD.
7. NSC/ Dept of Agriculture might draw representative samples of th
e final culture packets offered by the supplier and have them analy
zed in NSC’s Quality Control Laboratory (QCL-N) or any other labor
atory identified by NSC and only the lot cleared by the lab will be fi
nally be accepted by NSC. If such lot does not meet the prescribed
standard, NSC may refuse to make payment of the said lots quantit
y.
8. NSC will only provide the destination to the successful tenderer.
9. NSC may increase/decrease the final requirement of the quantity i
n the NIT. It may be 100% increase/ decrease of the NIT quantity.

10. .90% payment will be released through RTGS within 30 day
s after the receipt of challan from Area Office / Department of Agric
ulture subject to fulfilling the requirements set out in the Terms & c

onditions.
11. NSC will retain 10% payment along with Security Deposit a
s retention money for 120 days.
12. In the event of any dispute / complaint with reference to th
e culture quality, if the responsibility of the supplier is proved / esta
blished, he shall bear the loss / damage, if any, sustained by NSC t
o the relevant extent. The tenderer shall, at his cost, take back par
t or full quantity of such stock proved defective on receipt by NSC /
delivery to NSC.
13. NSC reserves the right to accept / reject any or all the tend
ers without assigning any reason what-so-ever.
14. In case any dispute arise between NSC and the other party
due to any term or matter, both the parties will opt to resolve it thr
ough mutual understanding and discussion. In case, dispute remai
ns even after discussions, then it shall be binding upon parties to r
esolve issue under the provisions of Arbitration & Conciliations Act,
1996 as amended from time to time. Under this provision, the Chai
rman-cum-Managing Director, National Seeds Corporation Limited
with concurrence of both the parties shall appoint Sole Arbitrator to
resolve the issue and both the parties will have to abide by the dec
ision. The parties will bind to resolve the dispute through arbitratio
n before going to court of law. The Arbitration shall be conducted a
t New Delhi and shall in English Language. The court of Delhi shall
have the jurisdiction.
15. The party who is under litigation with NSC or arbitration cas
e pending in this office or has issued / got issued a legal notice in t
he past is not liable to participate in the tender.
16. Conditional offers shall not be accepted and the tender shal
l not impose any additional term / condition.
17. NSC shall not be responsible for fluctuation of the market r
ate of the ordered culture packets. The tenderer shall be required t
o supply the culture packets at agreed rate only. The agreement c
an be terminated at any time due to non-performance of any of the
terms & conditions of the agreement to the satisfaction of the Corp
oration.
18. NSC reserves the right to accept or reject either in full or p
art of the tender or all the tenders without assigning any reason

19. In case of dispute arising out of the contract, the party / par
ties shall have to agree to the decision of the sole arbitrator appoin
ted by NSC whose decision will be binding on both the parties.
20. The court of law situated at Delhi will have the jurisdiction i
n matter related this tender or dispute during the performance of t
he contract.
21. The tenderer shall be responsible for State Sales Tax / Cent
ral Sales Tax / VAT and income tax liabilities, if any. NSC will not c
arry any tax liability related with the transaction.
22. NSC will not responsible for the losses incurred to the suppl
ier / tenderer due to charge in Govt. decisions, natural calamities,
which are beyond the control of NSC.
23. Quality Control Inspectors of the concerned State may draw
the samples of stocks. In case the stocks failed in sampling the ten
derer will be responsible for the consequences of violation of Act a
nd Laws.
24. The quantity of the culture packets shall be checked at any
point of transaction and in case shortage found in the container, NS
C will not pay any cost against such supplies and the tenderer shall
be responsible for the legal consequences of Weights & Measures
Department, if any.
25. The tenderer will have to give name of the firm, name of th
e processing plant, godowns their postal addresses, and telephone/
Fax Nos. E-mail, name of the responsible person in the tender form
itself so as to make further communication.

Disclaimer/अ वीकरण

The additional terms and conditions have been incorporated by the Buyer after approval of the Competent
Authority in Buyer Organization, whereby Buyer organization is solely responsible for the impact of these clauses
on the bidding process, its outcome, and consequences thereof including any eccentricity / restriction arising in
the bidding process due to these ATCs and due to modification of technical specifications and / or terms and
conditions governing the bid. Any clause(s) incorporated by the Buyer regarding following shall be treated as
null and void and would not be considered as part of bid:-

1. Definition of Class I and Class II suppliers in the bid not in line with the extant Order / Office Memorandum
issued by DPIIT in this regard.
2. Seeking EMD submission from bidder(s), including via Additional Terms & Conditions, in contravention to
exemption provided to such sellers under GeM GTC.

3. Publishing Custom / BOQ bids for items for which regular GeM categories are available without any
Category item bunched with it.
4. Creating BoQ bid for single item.
5. Mentioning specific Brand or Make or Model or Manufacturer or Dealer name.
6. Mandating submission of documents in physical form as a pre-requisite to qualify bidders.
7. Floating / creation of work contracts as Custom Bids in Services.
8. Seeking sample with bid or approval of samples during bid evaluation process.
9. Mandating foreign / international certifications even in case of existence of Indian Standards without
specifying equivalent Indian Certification / standards.
10. Seeking experience from specific organization / department / institute only or from foreign / export
experience.
11. Creating bid for items from irrelevant categories.
12. Incorporating any clause against the MSME policy and Preference to Make in India Policy.
13. Reference of conditions published on any external site or reference to external documents/clauses.
14. Asking for any Tender fee / Bid Participation fee / Auction fee in case of Bids / Forward Auction, as the
case may be.

Further, if any seller has any objection/grievance against these additional clauses or otherwise on any aspect of
this bid, they can raise their representation against the same by using the Representation window provided in
the bid details field in Seller dashboard after logging in as a seller within 4 days of bid publication on GeM. Buyer
is duty bound to reply to all such representations and would not be allowed to open bids if he fails to reply to
such representations.

In terms of GeM GTC clause 26 regarding Restrictions on procurement from a bidder of a country which shares a land border with India, any bidder from a country which
shares a land border with India will be eligible to bid in this tender only if the bidder is registered with the Competent Authority. While participating in bid, Bidder has to
undertake compliance of this and any false declaration and non-compliance of this would be a ground for immediate termination of the contract and further legal action

गलत घोषणा कए जाने व इसका अनुपालन न करने पर अनुबंध को त काल समा करने और कानून के अनुसार आगे क कानूनी कारवाई
का आधार होगा।
