(Made under Rule 5) In exercise of powers conferred upon the Chief Justice by Rule 5 of the Labour Court Rules, rT AUGUsTINO RAMADHANI, the Chief Justice of the United Republic of Tanzania make the following Rules: ’ Citation GN. No. 106 of 2007 Establishment of High Court Division Zonal Centers Register Jurisdiction of the Zonal Centers inal These Rules may be cited as the High Court of the United Republic of Tanzania Labour Court (Labour Division) (Zonal Centres) (Establishment) Rules, 2010 . 2.-(1) There shall be established in each region in Mainland Tanzania, as set out in the Schedule to these Rules, a High Court Division Zonal Centre. (2) In addition to the main Registry situated at Dar es Salaam, there shall be a Labour Division (Zonal Centre) for the region of Dar es Salaam. 3. There shall be kept and maintained at every High Court Labour Division (Zonal Centre) a Register whereby all labour cases opened in that region shall be registered. 4.-(1) A labour dispute, revision, review, reference or application may be instituted in the Labour Court (Zonal Centre) for the region in which the cause of action arose or where the employer ordinarily reside or where he conducts his trade or at his head office or where all the parties agree to 37 Scanned with CamScanner Format for application 1 (Labour Division) (Zonal Centres) (Establishment) » Court (Le mies the labour dispute determined: ; i judice to sub-rule (1), @ party shall be at Tee Pe eiice and institute his proceedings at the Labour Court main Registry. : (3) The Registrar may allow a party to file pleadings abour Court (Zonal Centre) which ought ordinarily to have been filed inal abour Court one Sone) where the cause of action arouse ifhe is satisfied that it is more convenient for the party or his advocate or representative to file the proceedings at that particular centre. e (4) Where a labour dispute. revision, review, reference or application is filed in the Labour Court main Registry or Labour Court Dar es Salaam Zonal Center, the Registrar shall forthwith transmit the same to the appropriate Labour Court (Zonal Centre) and such labour dispute, revision, review, reference or application shall be deemed to have been filed in the Labour Court Zonal Center on the date when the same was filed in the main Registry of Labour Court Dar es Salaam Zonal Center. (4) The Registrar may, at any time or on application, transfer any proceedings from one registry to another, in a particular L 5. No. 209 (contd) sealed with the seal of the Court, (2) Every order of the Labour Court shall be dated as the date on which the judgment was given or order made and shall, in addition, indicate the date on which the order was extracted. 7.1) There shall be a Labour Court tripartite eee committee at every Labour Court Zonal Centre constituting of a Judge, Registrar or Deputy Registrar form the Labour Court, a State Attorney in-charge of the Zone or Region or his representative, a representative of the Labour Commissioner, two members nominated by the Tanzania Employers Association members nominated by the Trade Union Organisations and two Advocates nominated by the Tanganyika Law Society.
