The legislature wants to promulgate a law in order to monitor student representative bodies on campuses. In
terms of the Student Representative Bodies Monitoring Act, a board has to be established that will be
responsible for the activities in terms of the Act. The Act is promulgated and will come into force on
15 October 2019.

Jo saw an advertisement in the newspapers of 2 August 2017 where people are invited to nominate others to
be part of the board. She wants to know how it is possible that people are invited to nominate candidates,
when the Act is not in force yet. Advise her using legislation and case law.

Mr Nko, a legal practitioner, appears before the High Court of South Africa on behalf of his client Mr Pimpo.
After making his submissions, he argues that the court should confine itself to the literal meaning of the law in
dispute to make a correct fact finding, because that is the only applicable theory of interpreting legislation in
South Africa. The presiding officer holds that there is another theory of interpretation in South Africa, which
authorises the presiding officers to consider other factors to determine the purpose of legislation.

In light of the above, explain the two theories advanced by Mr Nko and the presiding officer.

Vraag 3 [10]

Die wetgewer wil ʼn wet promulgeer om studenterade op kampusse te monitor. Ingevolge die Wet op die
Monitering van Studenterade moet ʼn raad gestig word om verantwoordelikheid te neem vir aktiwiteite
ingevolge die Wet. Die Wet word gepromulgeer en sal in werking tree op 15 Oktober 2019.

Jo sien die advertensies in die koerante op 2 Augustus 2019 waar mense uitgenooi word om ander te nomineer
om deel van dié raad te vorm. Sy wil weet hoe dit moontlik is dat mense genooi kan word om mense te
nomineer as die Wet nog nie in werking is nie. Adviseer haar met verwysing na wetgewing en regspraak.

Mnr. Nko, ʼn regspraktisyn, verskyn in die Hooggeregshof van Suid-Afrika namens sy kliënt, Mnr. Pimpo. Nadat
hy sy voorleggings gemaak het, beweer hy dat die hof hom moet beperk tot die letterlike betekenis van die
betrokke wet om ʼn korrekte feitebevinding te maak, want dit is die enigste toepaslike teorie van wetsuitleg in
Suid-Afrika. Die voorsittende beampte beweer dat daar ʼn ander interpretasieteorie in Suid-Afrika is wat die
voorsittende beamptes magtig om ander faktore in ag te neem om die doel van wetgewing te bepaal.

In die lig van bogenoemde, verduidelik die twee teorieë wat deur Mnr. Nko en die voorsittende beampte
genoem is.
