Whereas, the Govemment of Maharashtra has sanctioned the Unified Development Control
and Promotion Regulations (UDCPR) (hereinafter referred to as "the said Regulations") for the state
except Municipal Corporation of Greater Mumbai, other Planning Authorities / Special Planning
Authorities / Development Authorities within the limits of Municipal Corporation of Greater
Mumbai, MIDC, NAINA, Jawaharlal Nehru Port Trust, Hill Station Municipal Councils, Eco-
Sensitive/ Eco-Fragile region notified by MoEF & CC and Lonavala Municipal Council and Area
under CIDCO's jurisdiction as Planning Authority, PCNTDA, MIHAN, MADC, MSRDC, in
Maharashtra under the provisions of the Maharashtra Regional & Town Planning Ac! 1966
(hereinafter referred to as "the said Act") vide Notification No.TPS- 1818/CR .238ll8lDP. &
RP./Sec.37 (lAA) (c) & sec.20(4)tuD-13, dated 0211212020;
And whereas, to make applicable the Regulations for the area of CIDCO as Planning
Authority, for the area of Pimpri-Chinchwad New Town Development Authority, for the area of
Multi-Model Intemational Hub Airpon Notified area @IHAN), for Shirdi Airport Notified area of
Maharashha Airport Development Company Ltd. (MADC) as Special Planning Authority and for
notified area of Maharashtra State Road Development Corporation as Special Planning Authority, the
Govemment has published Notices under section 37(1AA) & section 20(3) of the said Act, bearing
No.TPS-1818/CR-236118/Sec.37(lAA) & Sec.20(3)ruD-13, d^ted 0211212020 and No.TPS-
l8l8/CR-236/l 8/Sec.20(3)/UD- 13 , d^ted 02/1212020 respectively along with directives under section
154 of the said Act, 1966 vide resolutions No.TPS-1818/ CR-23 6/ l8/Sec.37( I AA) & Sec.20(3)fuD-
13, dated 0211212020 and No.TPS- I8l8lCR-236/ l8/Sec.20(3)tuD- 13, dated 02112/2020
respectively;
And whereas, Government has issued Corrigendum / Addendums to the said Regulations vide
various resolutions;
And whereas, the said regulations have come into force from 0311212020 and are applicable to
Navi Mumbai Municipal Corporation (hereinafter referred to as "the said Corporation") and whereas,
before the said regulations, the then Development Control Regulations were in operation from
27112/2007 for the the said Corporation; and whereas, there was a provision regarding 'permissible
FSI for Public Utility Plots' in Regulation 38.1(g) of the then Development Control Regulations of
the said Corporation; and whereas, Govemment in Urban Development Department vide notification

d^ted 07 /1212013had modified the Regulation 38.1(9) along with Appendix-VIII (hereinafter
modification") and as per said modification, the Bus Depot, Bus Terminal and
referred to as "the said
for the land belonging to Maharashtra State Road Transport Corporation (hereinafter referred to as
'MSRTC") and Navi Mumbai Municipal Transport (hereinafter referred as *NMMT") were allowed
to be developed with additional 0.5 FSI, over and above the permissible FSI and out of total FSI
maximum 1.00 FSI was allowed to be developed for commercial use;
And whereas, Clause 7.0 ofthe said Regulations (UDCPR) stipulates about "Higher F.S.l. for
certain uses" and table 7-A, Sr. No.E provides for the higher FSI for the Buildings of Govemment
and Semi-Govemment O{fices, Local Authorities and Public Sector Undertakings/the land in
possession of MSRTC, City Transport/Metro Stations and Depot etc. and whereas, as per provision
given in Column No.S(ii) of Sr. No.E, for the land in possession of MSRTC, maximum 2/3 FSI out of
Maximum building potential can be utilized for Commercial use (hereinafter referred as "the said
provision");
And whereas, a letter dated 13/1012022 is received fiom the said Corporation wherein it is
stated that, as there is no provision in the said regulations just like the provision inserted as per said
modification in the then Development Control Regulations of the said Corporation, the said
Corporation is facing problems in developing the land under possession of NMMT and further
requested the Govemment to modiS the said provision ofthe said regulations to make it applicable
also in respect of the lands in the possession of NMMT just like in case of lands in possession of
MSRTC;
And whereas, considering the request of the said Corporation, the Government in Urban
Development Department is satisfied that in the public interest it is expedient to modiry the said
provision given in Table No.7-A Sr.No. E ofthe said regulations more specifically described in the
schedule appended to this notice (hereinafter referred to as "the proposed modification");
Now, therefore, after considering the above facts and circumstances and in exercise of the
powers vested in it under sub-section (lAA) of Section 37 of the said Act, and all other powers
enabling it in this behalf, the Govemment hereby publishes a Notice for inviting objections /
suggestions from any persons with respect to the Proposed Modification, as required by clause (a) of
sub-section (lAA) of Section 37 of the said Act, for information of all persons likely to be affected
thereby. The Govemment is further pleased to inform that any objections/ suggestions in respect of
Proposed Modification mentioned in the schedule given below may be forwarded before expiry of one
month from the date of publication of this Notice in the Maharashtra Govemment Gazette to the Joint
Director ofTown planning, Konkan Division having his oflice at Sakaram Patil Marg, Sector-6, CBD
Belapur, Navi Mumbai-400 614. Any objections/suggestions, which may be received within the said
period shall be dealt with in accordance with the provisions of sub-section (lAA) of section 37 ofthe
said Act by the Joint Director of Town planning, Konkan Division, who is hereby authorised under
Section 162(l) of the said Act as an "Officer" on behalf of the Government to hear.
