QUESTION:

Read section 65 of the constitution and summerise it.


section 65 of the constitution of Zimbabwe speaks about the rights of workers.It emphasizes that
every person employed has a right to fair and safe labour practices.It speaks of the health and
safety of workers at work places and also the remunerations they receive at the end of the month
which should be able to support an average family.Employers and employee representatives
should agree on a living wage for the workers.All workers should be compensated for the work they
do and there should be no discrimination of workers based on pay.Workers should work the
required number of hours and any extra hours should be treated as overtime.

The constitution also says that workers must be provided with protective clothing during the
discharge of their duties and should also work in an environment which should not affect their
health.Rooms should be well ventilated to allow fresh air to enter and also they should have
adequate lighting.

The constitution emphasizes also that every worker has a right to join a union of his/her choice.No
one should coerce anyone to be a member of a union but people should freely join.Section 65 of
the constitution of our country gives the workers the right to go on strike,stage a sit in or even
withdraw labour if their demands are not met as long as proper procedures are followed.

One of the issues addressed by this section of the constitution of Zimbabwe is that the employer
should provide conditions that meet the minimum required standards and that contractual
agreements should be respected.Any other assignments should be related to the contractual
agreements.It speaks of equal pay for equal work for people doing the same job irrespective of
gender.It says employers should avoid variation of ones duties,benefits and place of work as this is
regarded as unfair labour practise.
