During the 1° Council session of each month: male members ~ strictly Barong Tagalong, long sleeves; female members ~ any formal dress attire; During other sessions: male members - coat and tie or Barong Tagalog, long sleeves: female members ~ formal or long sleeves, with sleeve blouse; 3. The wearing of sleeveless clothes, phuaging neckline, mini skirts, jeans are not allowed for a women. Maong pants, jackets t-shirts, and use of rubber shoes shall not be allowed. The City Council shall ascertain for violation hereon on a case to case basis.” ‘Thereafter. Coun, Coseteng requested that the City Secretary send notice to all councilors and the Presiding Officer as well, to comply with the provision of the dress code. Malaya brought to the attention of the Body item Lof the informational matters, letter of the chairman of the SIC relative to the case of Mr. Renato Agito vs Bernardo Sanchez of Bgy. Kaunlaran. ‘As chairman of the Committee on Justice, where the case was also referred to, Coun. Malaya informed the Body that there is a current order from the Ombudsman to implement the suspension of Bey. Captain Sanchez, Bey. Kaunlaran, However, as per document submitted to the legal office, there was a discrepancy with regard to the case number being investigated by the ‘Committee on Justice. In this sight, she requested that an investigation be conducted pertinent to the case filed by Mr. Agito against Bgy. Capt. Sanchez as soon as possible in the interest of justice and fair play. Coun, Malaya clarified that as Chairwoman of the Committee on Justice, she is just standing a fact that there was no investigation conducted as to the numbered case as stated under the informational matter and that her request for a re-investigation is not prejudicial to any existing order of the Ombudsman. She stressed that she has no intention of defying any order from any legal agency with regard to the case being submitted to her committee. And lastly, her request of investigation is only to shed light on the issue, ‘The motion, having been seconded, was adopted: the Committee on Justice was directed to conduct an investigation to expedite the matter, without prejudice to the orders of the Ombudsman. In line with the points raised by Coun, Malaya, Coun, Malafigen, also, on @ point of personal privilege, clarified that there are two cases being filed against Byy. Capt. Sanchez. A one-month suspension has already been served by Bgy. Capt. Sanchez for one case. However, another one- ‘month suspension was executed for his another case without being investigated, which is unfair to the respondent. ‘The order of execution was already signed by the Hon. City Mayor. For this reason, he appealed that the Body send communication to the Executive Department for a joint re-investigation of the case with the Committee on Justice. ‘The Hon, Presiding Office remarked that proper justice should be accorded to Bgy. Captain Sanchez, but yet the order has to be executed, of which the City Council cannot do anything ‘about. Castelo brought to the attention of the Body the letter he received from the President of Commonwealth Marker, Bagsakan Arca Section Incorporated, Ms. Evelyn Castillo, pertaining to @ vending site being erected by the Triple A Boys Corporation along Commonwealth Avenue comer Villongco Street without the necessary franchise from the City Council. He recalled that in November 2005, said property owned by the Housing Regulatory Corporation has successfully bidded out to the Triple A Boys Corporation for purposes of puiting up a mall, Unfortunately, such mall has not yet been established. Instead, a vending site was erected at the arca which affects the legitimate vendors of Commonwealth Market. Hence, he requeste¢ that the matter be referred to the Committee on Markets for an investigation to be attended by Mr. Lina, Head of the Market Department, and Mr. Quimpo. Head of Hawkers. Duly seconded, the motion was adopted. Coun. Coseteng acceded to the request for an investigation of the matter. He suggested to invite the head of the private market division of the MDAD. Further, he stressed that the Market Code should be complied with. As chairman of the Committee on Markets , Coun, Pumaren stated that a public hearing shall be ‘conducted. All existing markets or applicants, he said, shall first secure a franchise from the City Council. Likewise, he suggested to investigate as to who issued the permits to “Guerilla Market” to operate as market. Coun, W. Castelo. in addition, requested the Chairman of the Committee on Markets to issue a subpoena to the Home Guarantee Corporation, former owner of the property for that purpose. He pointed out that when the area was bidded out, there is a term of reference and masterplan on ‘what the winning bidders would intend to construct in the property. ‘Thereupon, the City Secretary was directed to invite all the requested person for a public hearing on October 20, 2006, 10:00 a.m. at the Session Hall Coun. Malangen, who again stood on a point of personal and collective privilege recounted his experience with a representative of DPOS when he was prevented to park his ear at the parking slot of Coun, Medina at the back of the city hall. He Iamented that inspite of being a councilor for many years he was not recognized by said member of the DPOs. On that account, he requested that Mr, Sanchez or Mr. Sabalza appear before the Body and explain and inform the City Council what are the systems being instituted by their office as regard parking at the city hall ‘compound and the rules and instructions being enforced to recognize elected officials ‘The foregoing manifestation was duly noted, efterwhich the Committee on Public Order & Safety was directed to look into this matter. Another councilor who rose on a poist of personal and collective privilege was Coun. Herrera-Dy. The Lady Councilor recalled that way back in 2003, Solomon Park and Leisure Corporation was granted franchise te establish for 25 years as sports center arena; but they could also operate as a cockpit (as specified likewise in one of the provision of Ordinance SP-1233), However. it was not specifically provided in the mentioned ordinance the schedule of cockfight just like La Loma Cockpit wherein their schedule is stipulated in the franchise granted which is évery Thursdays, Fridays, Saturdays and Sundays. The speaker reminded the Body that there is a cockfighting law which states that there should be just one city to implement such schedule. She then inquired whether such frenchise granted to Solomon Park and Leisure Corp. is tantamount to operate cockpit anytime or should the City Council issue another permit as to their schedule of cocktighting. ‘The Hon. Vice-Mayor clarified that franchise to operate is different from permit to operate. 7 IN, LY, 01 Asa rejoinder, Coun, Ferrer explained that what the City Couneil has approved is a franchise for the operation on Sta. Monica Cockpit on a regular basis. However, it was not really stipulated as to the schedule of cockficht. It is legal for a cockpit to operate during Sundays and Iegal holidays; other than that it requires special permit from the City Council. In view of that. Coun. Ferrer made of record the following points: 1) that Sta. Monica Cockpit should secure special permit as to the number of days they will operate just like the one issued to Araneta and La loma Cockpits; 2) the operaion of cockpit is done every Thursdays, Fridays and Saturdays; 3) in all nearby municipalities all over the country, they are not allowed to operate cockpits in same days. Furthermore, the councilor remarked that La Loma Cockpit has been in operation for 103 years and it was granted permit to operate every Thursdays, Fridays and Saturdays. ‘Thus Sta, Monica (which is located within Quezon City) should not conduct cockfight on scheduled days for La Loma Cockpit. ‘With that, Coun, Dy proposed that the City Secretary write a formal letter to Sta, Monica Cockpit to secure permit from the City Council for the schedule of their cockfight. The Hon. Presiding Officer, in that regard, directed the City Council to prepare an information/communication to the concemed entities, and the Committee on Games and Amusements look into this matter for clarity: and to put order to the issuance of special use permit and franchise to gaming entities as soon as possible.
