AGREEMENT FOR LEAVE AND LICENCE

LICENSORS LICENSEE

LICENSED PREMISES: As described in the schedule.

PERIOD OF LICENCE: 11 (Eleven) months commencing and/or with effect

from _____________ and ending on ________________.

LICENCE FEES FOR USE AND OCCUPATION:

Monthly Licence fees of Rs. 800/- (Rupees Eight Hundred only) for the car

parking space payable by cash within the 10 th of each current month, month by

month according to English Calendar.

TERMS AND CONDITIONS ON WHICH THE LICENSORS AND THE

LICENSEE AGREE:

(a) The agreement is that between the Licensors and the Licensee and not

between Landlord and tenant and should never be construed to create

tenancy.

(b) The car parking space given out on Licence is to be used for the purpose of

parking the Chevrolet Spark car bearing no- of the licensee to

his will and not for any other purpose. The right being a personal right is

neither transferable nor heritable and the licensee will not be entitled to

transfer the benefit of this agreement or give sub- licence to anybody else.

(c) The car parking is to be kept in good condition. The Licensee undertakes

further, not to make any addition to or alteration of the licensed space

without obtaining prior written permission of the Licensors.

(d) The possession being permissive is not exclusive. But the Licensors assure

that they or none on their behalf will never during the continuance of the

Licence interfere in the peaceful use and enjoyment of the car parking

space as described in the schedule by the licensee.

(f) Provided however, that notwithstanding anything hereinbefore contained, it

is hereby expressly agreed by and between the parties hereto that in default

of any payment of Licence fee, for consecutive 3(Three) months to the

licensor or such other appropriate or authorized agent the licensors shall be

at liberty to revoke the Licence.

(g) That under no circumstances shall this agreement be impliedly or expressly

be considered to be an agreement for tenancy creating any interest of any

form or manner whatsoever in favour of the Licensee. Be it explicitly

understood by the licensee that the instant agreement is for the purpose of

creating a temporary license / permissive grant in his favour for all intents

and purpose and shall ipso facto come to an end on the expiration of the

period of 11 months.

(h) That the Licensee hereby keeps with the Licensors a security deposit of Rs.

800/- (Rupees Eight hundred only) to be refunded without any interest by

the licensors to the licensee at the time of expiration of period of license

and on delivery of khas vacant possession by the licensee in favour of the

licensors.

(i) That in case of termination of the period of license prior to the agreed

period of 11 months, either party shall give three months’ notice to the

other under registered post with acknowledgement due.

(j) That the licensee hereby agrees not to park the said car in any manner so as

to cause any hindrance or obstruction to the egress and ingress of other cars

in or out of the car parking space or car parking space owners to and from

the garage.

(k) On prior termination of the Licence or on the expiry of the period of the

Licence, the licensee shall make over vacant possession of the scheduled

car-parking space to the Licensor.

(l) The licensee may wash his car in the car-parking space if he so desires and

shall be provided with running water for the purpose of the same only.

(m) The licensee shall put his own lock on the gate and shall keep one key with

himself and the other one with the care-taker of the building for opening

and closing the gate for the purpose of parking or taking the car in and out

from the car-parking space.

SCHEDULE ABOVE REFERRED TO

ALL THAT car parking space on the ground floor at and being premises no. 21/4,

Central Park , Kolkata – 700 032, P.S. – Jadavpur, District – 24 Parganas (South),

approximately covering 120 Sq. feet more or less for parking one car(LMV).

IN WITNESS WHEREOF the parties hereto have set and subscribed the

respective hands and seals on the _______ day of NOVEMBER, 2010.
