LAWS AND PRACTICES PERTINENT TO LIBRARIANSHIP

Republic Act No. 8981, otherwise known as the PRC Modernization Act of 2000 was
approved on Dec. 5, 2000. It expressly repealed Republic Act No. 546, Presidential
Decree No. 223, Presidential Decree No. 657, Republic Act No. 5181 and Executive
Order No. 226 (1995). It is the law that provided for the modernization of the
Professional Regulatory Commission (PRC).

The salient features of the new PRC law:

 The term of office of the PRC Commissioner is seven (7) years without reappointment.
 Commissioner must at least be forty (40) years old
 With a valid certificate of registration and has had five (5) years of executive or management
experience.

The composition of the PRC?

 Three (3) man commission to be headed by one full-time Chairperson with the
rank of Secretary and two (2) full-time Commissioners.
 Provided that one of the Commissioners must be a past Chairperson / member
of a Professional ·Regulatory Board.

The latest law on Philippine Librarianship

Republic Act No. 9246 - An Act Modernizing the Practice of Librarianship in the
Philippines Thereby Repealing Republic Act No. 6966, entitled "An Act Regulating the
Practice of Librarianship and Prescribing the Qualifications of Librarians,
Appropriating Funds Therefor and for Other Purposes."

Republic Act No. 9246 is implemented by Resolution No. 5, s. 2004 otherwise known
as the Implementing Rules and Regulations of Republic Act No. 9246.

Professional Regulatory Board for Librarians (PRB)

The Professional Regulatory Board for Librarians is composed of a Chairperson and


two (2) members appointed by the President of the Philippines from among the list of
recommendees submitted by the PRC from among the list of nominees submitted by the
accredited integrated national professional organization of librarians from among the
librarians of recognized standing who qualify under Section 7.

What are the qualifications of members of the PRB for Librarians?

At the time of their appointment, they shall possess the following:

 A natural born citizen and resident of the Philippines


 Of good reputation and moral character
 Active in the practice of librarianship for at least ten (10) years, five (5) years of which is in a
managerial position
 Must not be a member of the faculty of a university, college, school or institution conferring the
academic degree of librarianship or offering review classes for librarian licensure examination nor a
person who has a direct or indirect pecuniary interest in any such institution
 Must not be an incumbent officer of the accredited integrated national professional organization of
librarians

A librarian who is below 40 years of age is qualified as member of the PRB for Librarians

Under Republic Act No. 9246, age is no longer one of the qualifications of members of the
PRB for Librarians. Unlike under Republic Act No. 6966 where a member should at least be
40 years of age at the time of appointment

The Chairperson and members of the Board shall hold office for a term of three (3)
years renewable for another term of three (3) years but in no case shall the whole term
exceed six (6) years.

The qualifications of applicants to the licensure examinations for librarians

 Citizen of the Philippines


 Foreign citizen (on the basis of reciprocity)
 Of good health and good moral character
 Graduate of a Bachelor’s Degree in Library Science and Information Science or Master's Degree in
Library and Information Science
Within five (5) years from the effectivity of the law, graduates of the following
degrees are also qualified. (March 16, 2009)
► Bachelor of Science in Education or Elementary Education
► Bachelor of Arts with Major or Specialization in Library Science
► Master of Arts in Library Science or Library and Information Science
► Any masteral degree with concentration in Library Science

Ergo : After March 16, 2009, only those BSLIS / MLIS Graduates can take the Librarians
Licensure Examination (PRC Legal Opinion dated July 18, 2008 Re: Legal Interpretation of
Section 15 Article Ill of Republic Act No. 9246)

The passing grade for the licensure examination

To pass the examination, an examinee must obtain a weighted general average of


75% with no grade lower than 50% in any subject.

Note : (Republic Act No. 6966 did not provide any grade requirement in its provision,
instead it was provided in its Implementing Rules and Regulations - WGA of 75% and a
disqualifier of below 60%.) However, in Republic Act No. 9246, the passing grade and
disqualifier grade is mandated in the law and not in the Implementing Rules and
Regulations.

The frequency of an examinee to take the examination

As many times one likes to take it. The law deleted the provision on repeaters under

Republic Act No. 6966 which was three (3) to four (4) times.

The grandfather clause

A grandfather clause is a provision in a new law or regulation exempting those already in or a


part of the existing system which is being regulated.
The section in Rep. Act No. 9426 that is being referred to as a grandfather clause

Section 19, which states, that upon application and payment of the required fees,
certificates of registration as librarian shall be issued without the necessity of licensure
examination to qualified applicants, is being referred to as a grandfather clause.

Application to avail of this section had lapsed since March I 6, 2007 because the law.
stated three (3) years from the effectivity of this law which was March 16, 2004.

An examinee be refused issuance of certificate of registration and Professional .ID Card


even if he passed the licensure examination if :
Convicted by a court of competent jurisdiction of any criminal offense involving moral
turpitude
Found guilty of immoral or dishonorable conduct after investigation by the Board
Declared to be of unsound mind

The grounds for revocation and suspension of 'certificate of registration and Professional
ID Card or cancellation of temporary/ special permit.

The Board has the power, after due notice and hearing, on grounds per Sec. 22
 Unprofessional or dishonorable conduct
 Malpractice
 Incompetence
 Serious ignorance or negligence in the practice of librarianship
 Fraud
 Deceit or falsification in obtaining a Certificate of Registration, or Prof. ID or Temp.
/ Special permit
 Abatement of illegal practice by allowing illegal use of his / her Certificate of
Registration, or Prof. ID or Temp. / Special permit
 Practice of profession during the period of suspension
 Any violation of Republic Act No, 9246, Implementing Rules and Regulations, Code of
Ethics, Code of Technical Standards for Librarians or Board policies.

The roster of librarians

The Board and the Integrated Professional Organization of Librarians shall maintain a roster of
librarians which is :

 Up to date
 Complete properly organized
 Arranged alphabetically by surname with addresses and license number

 Arranged numerically by license number
 Copies of which shall be provided as permanent record of The National Library
(TNL), Civil Service Commission (CSC) and the Accredited Integrated National
Organization of Librarians

Illegal practice of librarianship constitutes the following:

When a person practices or offer to practice librarianship or assume any position which
involve performing the scope or function provided in Section 5 of Republic Act No. 9246 and
does not have a valid certificate of registration, Professional ID Card or temporary / special
permit from the Commission.

Librarians registered under Rep. Act No. 6966 are automatically registered under
the new law of Section 29 of RA 9246.

The Integrated and Accredited National Organization of Librarians?

All registered librarians shall be integrated under a single organization recognized


and accredited by the Board and approved by the Commission. Membership in this
organization shall not be a bar to membership to any other association of librarians.

The provision of the new law as regards government librarians especially those in
local government libraries/ public libraries?

The law stressed that all librarians working in government libraries including public
libraries must be licensed librarians. This requirement must be complied with by local
government units beginning February 19, 2004 until three (3) years thereafter or February
19, 2007 which had already lapsed.

The penalty for illegal practice of librarianship and other offences

 Fine of not less than 30,000.00 nor more than


100,000.00, or
 Imprisonment of not less than one (I) mo. nor more
than three (3) years.

Note : Under Rep. Act No. 6966

 Fine - not less than 500.00 nor more than 2000.00 or


 Imprisonment of not less than one (I) mo. nor more than two (2) years.

The present law/authority on CPE

Resolution No. 2008-466, s. 2008 repealing Resolution 2004-179, s. 2004 entitled


standardized Guidelines and Procedures for the Implementation of the CPE System for all
Professions and Implementing the Revised Standardized Guidelines and Procedures for

the Implementation of CPE for all Registered and Licensed Professionals.

The Continuing Professional Education (CPE)

Continuing Professional Education refers to the inculcation, assimilation and


acquisition of knowledge, skills, proficiency and ethical and moral values after the initial
registration of a professional that raise and enhance the professional's technical skills and
competence. (Sec. I of the CPE Guidelines)

The objectives of the CPE

I) To provide and ensure the continuous education of a registered


professional with the latest trends in the profession brought about by
modernization and scientific and technological advancement.
2) To raise and maintain the professionals capability for delivering
professional services.
3) To attain and maintain the highest standards- and quality in the practice of
his/her profession.
4) To comply with the professionals continuing ethical requirements.
5) To make the professional globally competitive.
6) To promote the general welfare of the public.

The rationale of CPE

Compliance with the CPE Program is deemed a moral obligation of each


professional and within the context of the concerned profession's code of ethic and is
considered a necessary, effective and credible means of ensuring competence, integrity
and global competitiveness of the professional in order to allow him/her to continue the
practice of the profession.

The PCCA and NCCA

Presidential Commission on Culture and Arts was created by Executive Order No.
118 s. 1987 mandated to formulate and maintain the national policy, support, and
dissemination of frameworks for culture and the Arts.

This Commission has for its successor-in-interest the National Commission for
Culture and Arts by virtue of Republic Act No. 7356. I t formulates policies for the
development of culture and arts and implement these policies in coordination with affiliated
cultural agencies.

The organizational units of NCCA

It is composed of the Commission, Subcommissions, National Committees. The


Commission has Board of Commissioners, Subcommissions has subcommission-Heads
and the National Committees has Heads. These 19 Heads of National Committees from
the National Advisory Board (NAB).

The National Committee on Libraries and Information Services (NCLIS)

This is a committee under the Sub-Commission on Cultural Heritage of the NCCA


which is tasked to formulate policies for the development of culture and arts by libraries,
librarians and library educators.

The law that provides for the establishment of public libraries?

Rep. Act No. 7743 provides that the National Library in coordination ·with the DlLG
shall undertake the establishment of additional public libraries to serve all congressional
districts, cities and municipalities in the Philippines and reading centers in every barangay.

Congress of Southeast Asian Librarians ( CONSAL )

The Congress of Southeast Asian Librarians (CONSAL) was formed in August 1970.
Current members are Brunei, Indonesia, Laos, Myanmar, Malaysia, Philippines, Singapore,
Thailand, Vietnam and Cambodia. CONSAL convenes a general conference at least once in
three (3) years in each member country by rotation. CONSAL II (1973), CONSAL VII
(1987) and CONSAL XIII (2006) were held in the Philippines. CONSAL XV will be held in
Indonesia in 2012.

Republic Act No. 8047

On June 7, 1995 Republic Act No. 8047, the Book Publishing Industry
Development Act was signed into law. The law is geared at promoting the growth and
development of book publishing. It envisions the promotion of book readership among
Filipinos, particularly the young through book fairs, exhibits or programs which enhances
literacy and good reading habits.

Philippine Book Development Month

In 1997 and 1998, Proclamation 1014 and Proclamation No. 1222, respectively,
were issued to declare the month of June in 1997 and 1998.as the Philippine Book
Development Month. But on June 25, 1999, Proclamation No. 120 was issued declaring
the month of June 1999 and every year thereafter as the Philippine Book Development
Month.

The intentions behind the celebration of the Philippine Book Development Month

Its intention is to conduct an annual national celebration to focus national attention on


the important contribution of books in the economic and social growth of the country.
During this period the National Book Development Board established pursuant to Republic
Act No. 8047 is tasked to adopt measures and implement activities.

The agencies tasked to spearhead the celebration of the Library and Information Services
Month?

The National Library and the National Committee on Library and Information
Services (NCLIS) of the National Commission on Culture and Arts (NCCA).

The accredited professional organization the library profession belong?

The Philippine Librarians Association (PLAI)

Philippine Librarians Association, Inc. (PLAI) e

PLAI was established on October 23, 1923. It was legally incorporated in 1958 and
has since then amended its By-laws. On June 20, 2008, SEC has approved a New PLAI By-
laws.

How are the members of the different regulatory boards selected?

Executive Order No, 496, s. 1991 instituted procedures and criteria for the selection and
the
recommendation of nominees for appointment to vacant position in the Professional Regulatory
Board.

The professions presently under the regulation of the PRC

There are at present forty-three (43) professions regulated by the PRC. PRC is
directly under the supervision of the Secretary of the Department of Labor and Employment
(DOLE) pursuant to Executive Order No. 565, 565-A, series of 2006.

The law that regulates the ethical practices of librarians

The Code of Ethics for Registered Librarians or Res. No. 6, s. 2006 regulates the
ethical practices of librarians.

The organizational structure of PLAI

The regular member of the Association is grouped into Chapters representing the
sixteen (16) regions covering the entire archipelago.

The governing structure of PLAI

Each regional council has seven (7) members of the Board of Trustees (Council
Board). The Council Officers are elected from among themselves. The Council President
and Vice-President and a Representative represent the Council in the House of Delegates.

The National Board of Trustees

The members of the House of Delegates, a deliberative body of the Association,


elects the members of the National Board of Trustees in an Annual Convention held
every 4th Friday of November in a place decided by the National Board of Trustees.

SECTION 4.

respond to clientelo's need for adequate, releva'r1t and timely infonnation;

delivery of information;

(3) . Development of cmnputer-assisted/computer backe<l infomiation


systems which would permit on-line and network services;

provisions of this Act;

necessary, adopt such measures as may be deemed proper for the en'hancement and

(t) To. adopt policles· and set the star1dards for all types of libraries,
lihrarians and _the practice of librarianship;

(g) To ensure, in coordination with tbe Commission on Higher Education (CHED), that all
institutions offering library, archives and information science eilucation comply with
prescribed standards for curriculum, faculty and facilities for course offerings of library
science, o.r: library and information ,5cicncc;

(h) ., To adopt and prescribe a Code of Et ics and a Code of Technical Stahel!lrds for
Librarians;

(i) To hear and decide·adminisirative cases involving violations of this Act, its lrnplernenti

Secretariat and qther support services to implement the pnwisi'ons of this /\ct.

A II records of the Flonrd including the exarnii'1ation papers, rnim1tes of deliben11ions, nnd
records of adminisrrative proceedings and investigations shall be kept by the Commission under the
direct custody of the Secretary,

SEC'rTON 13. Annual Report. -- 111c Board shall submit to the Commission at\-.er the
close of each calendar year, its annual report of accomplishments which shall include rr detailed
account of the operation ()f the Boar<l for the year and the aprropriate recommendation on issues or
problems affecting the profession.

(5) organization, management and development and maintenance of multi-media based

SECTION 22. Refwal to Issue Certificate of Registration and Professional

The Board shall not register any successful exam:inee nor any applicant for
registration without !!'Xamination if he/she has been convicted by a court
of competent jurisdicLion of any criminal offense involving moI1J.! turpitude or has been found
guiJt;y nf immoral and dishonorable conduct after investigation of the Board, or }{as been
declared to be of unsound mind. Tbe reason for the refusal shal1.be set forth in writing.

SECTION 23. Revocation and Suspension.of Cert(ftcate qf Registration and Professional


Identification Card or Cmtcell.atlon of Temporaryl'. oecial Permit.
-- The Board has the power, after due notice and hearing, to reYoke or suspend the Certificate of
Registration or cancel a temporarJ or special pennit of any librarian on any ground stated under
Section 22 of this Act, or for ariy of the following: unprofessional or dishonorable conduct;
malpraL1:ice; incompetence;·serious ignorance·
or negligence in the practice of librarianship; fraud; deceit or falsification in obtaining 'i

integrated n;:i.tlonal orgnnization of librarians, shall maintain an up--to-date, complete and proper_ly
organized Roster, which shall include those who had been issued Certificates of Registration under
Rep1Jblic Act No. 6966 and those who shall qualify under this Act, to contain the following. data:

(a) alphabetical list by surname of libmrians with their addresses and license numbers; 1.

(b) the list of licensees, numerically arra:ag cl by license numbern; and

(c) such o/.her lists which the Board may deem necessary.

Copies of the Roster, which shall be provided to the National Library, the Civil Service
CornmisRion, and the accredired national organization of librarians, sha11 be kept as pemianent record.

ARTICLE IV

· Practice ofLibrwianshtp
SECTION 26. Illegal Practice of Librarlanship, -A person who does not have a_yalid
Certificate of Registration and Professional Jdentiticntion Card or a temporary7special pemiit from the
Comtnisslon shall not practice or offer to practice
librarianship in the Philippines or assume any position, which involve performing the fimction fa librarian
as provided under Section 5 of this Act.· ·

and the Code of Technical Standards for Librarians which shall take effect fifteen (15) days following
publication _in the Official Gazette or newspaper of general" circulation.

SECTION 36. Separability Clause. -· Tf any clause, provision, paragraph or part hereof
shail be declared unconstitutional or invalid, such judgment shall not aftect, invalidate or irnpail' any
other part hereof, but such judgment shall be .merely
confined to the clau e. provi ion·, paragr ph or part directly involved in the
controversy in which such judgment has been rendered.

SECTION 37. Repealing Clause. --- Republic Act No. 6966 fa hereby repealed and all
ot.her laws, qecrees, orders, rules, regulations,. ordinances or parts thereof which are inconsistent
with this Act are hereby repe.aled or amended accordingly.

SECTION 38. EjJectiviLy. -- Tbis Act shall take effect fifteen (15) days
following its publication in the Official Gazette or a national newspaper of general
· circnlation.
