Powers and functions- The Central Government shall appoint a Registrar of Copyrights and may appoint one or more Deputy Registrars of Copyrights A Deputy Registrar of Copyrights shall discharge under the superintendence and direction of the Registrar of Copyrights such functions of the Registrar under this Act as the Registrar may, from time to time, assign to him and shall include a reference to a Deputy Registrar of Copyrights when so discharging any such functions The Central Govt u/s 11 of the Act constitutes a Copyright Board which has the power to regulate its own procedure, including fixing of places and the tomes of the sittings. However, it shall ordinarily hear any proceedings instituted before it under this Act, within the zone in which, at the tome of the institution of the proceedings actually and voluntarily resides or carries on business or personally works for gain. The Copyright Board may exercise and discharge its power and functions through benches constituted by the chairman of the Board (appellate board) from amongst its members, each Bench consisting of not less than 3 members. The Copyright Board may authorise any of the members to exercise any of the powers conferred to it u/s 74 and any order made or act done in exercise of these powers by the members so authorised shall deemed to be the order or Act as the case maybe, of the Board. No act done or proceeding taken by the Appellate Board or the Copyright Board under this Act shall be questioned on the ground under this Act, merely of the existence of any vacancy in or defect in the constitution of the Board. The Copyright Board shall be deemed to be a Civil Court for the purposes of section 345 & 346 of the CrPC and all proceedings to be judicial proceedings within the meaning of Section193, 228 of IPC1860. Copyright Board is an appellate authority against the orders of the Copyright Registrar. The Copyright Board can rectify the register maintained by the Registrar of Copyright High Court is empowered to entertain and hear appeals against order of the Copyright Board.
