Director or DGCA. The Director of the Directorate General of Civil Aviation, or any
person authorized to act on his behalf.

Approved. Accepted by a Directorate General of Civil Aviation as suitable for a


particular purpose.

Person. Means an individual, firm, partnership, corporation, company,


association, joint stock association, or governmental entity. It includes a trustee,
receiver, assignee, or similar representative of any of them.

Maintenance. The performance of tasks required to ensure the continuing


airworthiness of an aircraft, including any one or combination of overhaul, inspection,
replacement, defect rectification, and the embodiment of a modification or repair.

Preventive maintenance. Means simple or minor preservation operations and the


replacement of small standard parts not involving complex assembly operations.

Major repair means a repair:
(1) That, if improperly done, might appreciably affect
weight, balance, structural strength, performance, powerplant operation, flight
characteristics, or other qualities affecting airworthiness; or

(2) That is not done according to accepted practices or cannot be done by elementary
operations.

Minor repair means a repair other than a major repair.

Major alteration means an alteration not listed in the aircraft, aircraft engine, or
propeller specifications –

(1) That might appreciably affect weight, balance, structural strength,


performance, powerplant operation, flight characteristics, or other qualities
affecting airworthiness; or

(2) That is not done according to accepted practices or cannot be done by


elementary operations.

Minor alteration means an alteration other than a major alteration.

Category:
(1) As used with respect to the certification, ratings, privileges, and limitations of
airmen, means a broad classification of aircraft. Examples include: airplane;
rotorcraft; glider; and lighter-than-air; and
(2) As used with respect to the certification of aircraft, means a grouping of
aircraft based upon intended use or operating limitations. Examples include:
transport, normal, utility, acrobatic, limited, restricted, and provisional.
Class:
(1) As used with respect to the certification, ratings, privileges, and limitations of
airmen, means a classification of aircraft within a category having similar
operating characteristics. Examples include: single engine; multiengine; land;
water; gyroplane; helicopter; airship; and free balloon; and
(2) As used with respect to the certification of aircraft, means a broad grouping of
aircraft having similar characteristics of propulsion, flight, or landing. Examples
include: airplane; rotorcraft; glider; balloon; landplane; and seaplane.

Rating.
An authorization entered on or associated with a licence and forming part
thereof, stating special conditions, privileges or limitations pertaining to such
licence or means a statement that, as a part of a certificate, sets forth special
conditions, privileges, or limitations.
Type:
(1) As used with respect to the certification, ratings, privileges, and limitations of
airmen, means a specific make and basic model of aircraft, including modifications
thereto that do not change its handling or flight characteristics. Examples include:
DC-7, 1049, and F-27; and Boeing 737-200.
(2) As used with respect to the certification of aircraft, means those aircraft which
are similar in design. Examples include: DC-7 and DC-7C; 1049G and 1049H; and
F-27 and F-27F.
(3) As used with respect to the certification of aircraft engines means those engines
which are similar in design. For example, JT8D and JT8D-7 are engines of the same
type, and JT9D-3A and JT9D-7 are engines of the same type.

SUBPART A GENERAL
21.1 Applicability.
(a) This part prescribes –

(1) Procedural requirements for issuing and changing -


(i) design approvals;
(ii) production approvals;
(iii) airworthiness certificates and;
(iv) airworthiness approvals.

(2) Rules governing the holders of any certificate specified in


paragraph (a)( 1) of this section; and
(3) Procedural requirements for the approval of certain materials,
parts, processes, and appliances.

SUBPART B TYPE CERTIFICATES

21.11 Applicability.
This subpart prescribes –
(a) Procedural requirements for the issue of type certificates for
aircraft, aircraft engines, and propellers; and
(b) Rules governing the holders of those certificates.

21.13 Eligibility.

Any interested person as prescribes in Sub Part J Design Organization


Approval (DOA) may apply for a type certificate.

21.15 Application for type certificate.

(a) An application for a type certificate is made on a form and m a


manner prescribed by the DGCA and is submitted to the DGCA
office.
(b) An application for an aircraft type certificate must be
accompanied by a three-view drawing of that aircraft and
available preliminary basic data.
(c) An application for an aircraft engine type certificate must be
accompanied by a description of the engine design features, the
engine operating characteristics, and the proposed engine
operating limitations.

21.16 Special Conditions.

If the DGCA finds that the airworthiness regulations do not contain


adequate or appropriate safety standards for an aircraft, aircraft
engine, or propeller because of a novel or unusual design feature of
the aircraft, aircraft engine or propeller, he prescribes special
conditions and amendments thereto for the product. The special
conditions are issued in accordance with CASR Part 11 and contain
such safety standards for the aircraft, aircraft engine or propeller as
the DGCA finds necessary to establish a level of safety equivalent to
that established in the regulations.

21.19 Changes requiring a new type certificate.

Any person who proposes to change a product must make a new


application for a type certificate if the DGCA finds that the proposed
change in design, configuration, power, power limitations (engines),
speed limitations (engines), or weight is so extensive that a
substantially complete investigation of compliance with the applicable
regulations is required.

21.20 Compliance with applicable requirements.

The applicant for a type certificate, including an amended or


supplemental type certificate, must-

(a) Show compliance with all applicable requirements and must


provide the DGCA the means by which such compliance has
been shown; and
(b) Provide a statement certifying that the applicant has
complied with the applicable requirements.

21.21 Issue of Type Certificate:

1. Normal, Utility, Acrobatic, Commuter,


2. Transport Category Aircraft;
3. Special Classes of Aircraft;
4. Aircraft Engines;
5. Propellers.

21.31 Type Design.

The type design consists of –


(a) The drawings and specifications, and a listing of those drawings and
specifications, necessary to define the configuration and the design
features of the product shown to comply with the requirements of this Part
applicable to the product;
(b) Information on dimensions, materials, and processes necessary to
define the structural strength of the product;
(c) The Airworthiness Limitations section of the Instructions for Continued
Airworthiness as required by CASR PART 23, Part 25, Part 27, Part 29,
Part 31 and Part 33; and as specified in the applicable airworthiness
criteria for special classes of aircraft defined in Sec. 2 l. l 7(b); and
(d) Any other data necessary to allow, by comparison, the determination
of the airworthiness, noise characteristics, fuel venting, and exhaust
emissions (where applicable) of later products of the same type.

21.41 Type certificate.
Each type certificate is considered to include the type design, the
operating limitations, the certificate data sheet, the applicable
regulations with which the DGCA records compliance, and any other
conditions or limitations prescribed for the product.

21.51 Duration.
A type certificate is effective until surrendered, suspended, revoked,
or a termination date is otherwise established by the DGCA.

SUBPART H AIRWORTHINESS CERTIFICATES

21.181 Duration.
(a) Unless sooner surrendered, suspended, revoked, or a termination
date is otherwise established by the DGCA, airworthiness
certificates are effective as follows:

(1) Standard airworthiness certificates and special airworthiness


certificates issued for primary, restricted or limited category
aircraft are effective for one year after the date of issue or
renewal as long as the maintenance, preventive maintenance,
and alterations are performed in accordance with CASR Part 43
and Part 91, and the aircraft are registered in the Republic of
Indonesia.

(2) A special flight permit is effective for the period of time specified in
the permit.
(3) An experimental certificate for research and development, showing
compliance with regulations, crew training, market surveys, amateur
built, exhibition and air-racing are effective for one year after the date of
issue or renewal unless a shorter period is prescribed by DGCA.
(4) A special airworthiness certificate in the light-sport category is
effective as long as-

(i) The aircraft meets the definition of a light-sport aircraft;


(ii) The aircraft conforms to its original configuration, except for
those alterations performed in accordance with an applicable
consensus standard and authorized by the aircraft’s
manufacturer or a person acceptable to the DGCA;
(iii) The aircraft has no unsafe condition and is not likely to
develop anunsafe condition; and
(iv) The aircraft is registered in the Republic of Indonesia.

SUBPART J DESIGN ORGANIZATION APPROVAL

21.231 Applicability and definition.


This subpart establishes the procedure for the approval of design
organizations and rules governing the rights and obligations of
applicants for, and holders of, such approvals.
Design Organization means an organization responsible for the
design of products, parts and article or for changes or repairs thereto
shall demonstrate its capability in accordance with applicable CASR.

SUBPART N ACCEPTANCE OF AIRCRAFT ENGINES,
PROPELLERS, ARTICLES FOR IMPORT

21.500 Acceptance of Aircraft Engines and Propellers.


An aircraft engine or propeller manufactured in a foreign country meets
the requirements for acceptance under this subpart if-

(a) The holder or licensee of a ROI type certificate for that product
furnishes with each such aircraft engine or propeller imported into
Republic of Indonesia, an export airworthiness approval issued by
the country of manufacturer certifying that the individual aircraft
engine or propeller-
(1) Conforms to its ROI type certificate and is in condition for safe
operation; and
(2) Has been subjected by the manufacturer to a final operational
check.
(b) That product is marked in accordance with CASR part 45.

SUBPART 0 TECHNICAL STANDARD ORDER AUTHORIZATIONS

21.601 Applicability and Definitions.

(a) This subpart prescribes –


(1) Procedural requirements for the issue of Technical Standard
Order authorizations;
(2) Rules governing the holders of Technical Standard Order
authorizations; and
(3) Procedural requirements for the issuance of a letter of
Technical Standard Order design approval.

(b) For the purpose of this subpart –
(1) A Technical Standard Order (referred to in this subpart as "TSO")
is issued by the DGCA and is a minimum performance standard for
specified articles (for the purpose of this subpart, articles means
materials, parts, processes, or appliances) used on civil aircraft.

(2) A TSO authorization is an DGCA design and production approval


issued to the manufacturer of an article which has been found to
meet a specific TSO.

(3) A letter of TSO design approval is a DGCA design approval for an
article which has been found to meet a specific TSO in accordance
with the procedures of Sec. 21.621.
(4) An article manufactured under an TSO authorization, a DGCA
letter of acceptance as described in Sec. 21.613 (b), or an article
manufactured under a letter of TSO design approval described in
Sec. 21.621 is an approved article for the purpose of meeting the
regulations of this CASR that require the article to be approved; and
(5) An article manufacturer is the person who controls the design and
quality of the article produced (or to be produced, in the case of an
application), including the parts of them and any processes or
services related to them that are procured from an outside source.

(c) The DGCA does not issue an TSO authorization if the
manufacturing facilities for the product are located outside of the
Republic of Indonesia, unless the DGCA finds that the location of the
manufacturer's facilities places no undue burden on the DGCA in
administering applicable regulations.

21.611 Issuance.

If the DGCA finds that the applicant complies with the requirements of
this applicable CASR, the DGCA issues a TSO authorization to the
applicant (including all TSO deviations granted to the applicant).

21.613 Duration.

(a) A TSO authorization or letter of TSO design approval is effective


for two years until surrendered, withdrawn, or otherwise
terminated by the DGCA.
(b) If a TSO is revised or canceled, the holder of an affected DGCA
letter of acceptance of a statement of conformance, TSO
authorization, or letter of TSO design approval may continue to
manufacture articles that meet the original TSO without obtaining
a new acceptance, authorization, or approval but must comply
with applicable CASR.

21.616 Responsibility of holder.

Each holder of a TSO authorization must-


(a) Amend the document required by Sec 21.605 as necessary to
reflect changes in the organization and provide these amendments
to the DGCA
(b) Maintain a quality system in compliance with the data and
procedures approved for the TSO authorization;

(c) Ensure that each manufactured article conforms to its approved


design, is in a condition for safe operation, and meets the
applicable TSO;

(d) Mark the TSO article for which an approval has been issued.
Marking must be in accordance with CASR part 45, including any
critical parts;
(e) Identify any portion of the TSO article (e.g., sub-assemblies,
component parts, or replacement articles) that leave the
manufacturer's facility as DGCA approved with the manufacturer's
part number and name, trademark, symbol, or other DGCA
approved manufacturer's identification;
(f) Have access to design data necessary to determine conformity and
airworthiness for each article produced under the TSO
authorization. The manufacturer must retain this data until it no
longer manufactures the article. At that time, copies of the data
must be sent to the DGCA ;
(g) Retain its TSO authorization and make it available to the DGCA
upon request; and
(h) Make available to the DGCA information regarding all delegation of
authority to suppliers

IDENTIFICATION AND REGISTRATION MARKING

45.1 Applicability
This part prescribes the requirements for:
a. Identification of aircraft, and identification of aircraft engines and
propellers that are manufactured under the terms of a type or
production certificate;
b. Identification of parts that are manufactured under the terms of a type
or production certificate;
c. Identification of certain replacement and modified parts produced for
installation on type certificated products; and
d. Nationality and Registration marking of Indonesian registered aircraft.

45.11 General
a. Aircraft and aircraft engines.
Aircraft covered under Section 21.182 of the CASRs must be identified,
and each person who manufactures an aircraft engine under a type or
production certificate shall identify that engine, by means of a fireproof
plate that has the information specified in section 45.13 of this Part marked
on it by etching, stamping, engraving, or other approved method of
fireproof marking.

The identification plate for aircraft must be secured in such a manner that it
will not likely be defaced or removed during normal service or lost or
destroyed in an accident.

The aircraft identification plate must be secured to the aircraft fuselage


exterior so that it is legible to a person on the ground and must be either
adjacent to and aft of the rearmost entrance door or on the fuselage
surface near the tail surfaces.

For aircraft engines ;
The identification plate must be affixed to the engine at an accessible location
in such a manner that it will not likely be defaced or removed during normal
service or lost or destroyed in an accident.

b. Propellers and propeller blades and hubs.


Each person who manufactures a propeller, propeller blade, or propeller hub
under the terms of a type or production certificate shall identify his product by
means of a plate, stamping, engraving, etching, or other approved method of
fireproof identification that is placed on it on a non-critical surface, contains
the information specified in Section 45.13, and will not be likely to be defaced
or removed during normal service or lost or destroyed in an accident.

c. Manned free balloons.
For manned free balloons, the identification plate prescribed in
paragraph a. of this section must be secured to the balloon envelope
and must be located, if practicable, where it is legible to the operator
when the balloon is inflated. In addition, the basket and heater assembly
must be permanently and legibly marked with the manufacturer’s name,
part number (or equivalent) and serial number (or equivalent).

d. On aircraft manufactured before December 27, 1993,
the identification plate required by paragraph a. of this section may be
secured at an accessible exterior or interior location near an entrance, if the
model designation and builder’s serial number are also displayed on the
aircraft fuselage exterior.
The model designation and builder’s serial number must be legible to a
person on the ground and must be located either adjacent to and aft of the
rearmost entrance door or on the fuselage near the tail surfaces.
The model designation and builder’s serial number must be displayed in
such a manner that they are not likely to be defaced or removed during
normal service.

45.13 Identification data
a. The identification required by Sections 45.11 a. and b. shall include
the following information:

1) Builder’s name.
2) Model designation.
3) Builder’s serial number.
4) Type certificate number, if any.
5) Production certificate number, if any.
6) For aircraft engines, the established rating.
7) For aircraft engines specified in Part 34 of the CASRs, the date of
manufacture as defined in section 34.1 of that Part, and a
designation, approved by the DGCA,
8) Any other information the DGCA finds appropriate.

b. Except as provided in paragraph d.1) of this section, no person may
remove, change, or place identification information required by
paragraph a. of this section, on any aircraft, aircraft engine, propeller,
propeller blade, or propeller hub, without the approval of the DGCA.

c. Except as provided in paragraph d.2) of this section, no person may


remove or install any identification plate required by Section 45.11 of
this Part, without the approval of the DGCA.

d. Persons performing work under the provisions of Part 43 of the
CASRs may, in accordance with methods, techniques, and
practices acceptable to the DGCA.
1) Remove, change, or place the identification information required
by paragraph a. of this section on any aircraft, aircraft engine,
propeller, propeller blade, or propeller hub; or
2) Remove an identification plate required by Section 45.11 when
necessary, during maintenance operations.

e. No person may install an identification plate removed in


accordance with paragraph d.2) of this section on any aircraft,
aircraft engine, propeller, propeller blade, or propeller hub other
than the one from which it was removed.

45.14 Identification of critical components

Each person who produces a part for which a replacement time, inspection
interval, or related procedure is specified in the Airworthiness Limitations
section of a manufacture’s maintenance manual or Instructions for Continued
Airworthiness shall permanently and legibly mark that component with a part
number (or equivalent) and a serial number (or equivalent).

45.15 Replacement and modification parts
a. Except as provided in paragraph b. of this section, each person
who produces a replacement or modification part under a Parts
Manufacturer Approval issued under Section 21.303 of the CASRs
shall permanently and legibly mark the part with :
1) The letters “DGCA - PMA“;
2) The name, trademark, or symbol of the holder of the Part
Manufacturer Approval;
3) The part number; and
4) The name and model designation of each type certificated
product on which the part is eligible for installation.

b. If the DGCA finds that a part is too small or that it is otherwise
impractical to mark a part with any of the information required by
paragraph a. of this section, a tag attached to the part or its
container must include the information that could not be marked
on the part.
If the marking require extensive that to mark it on a tag is
impractical, the tag attached to the part or the container may
refer to a specific readily available ed by paragraph a.4) of this
section is so manual or catalog for part eligibility information.

45.20 General

a. Except as provided in Section 45.22, no person may operate an


Indonesian - registered aircraft unless that aircraft displays
identification marks in accordance with the requirements of this
section and sections 45.21 through 45.33.
b. Unless otherwise authorized by the DGCA, no person may
place on any aircraft a design, mark, or symbol that modifies or
confuses the nationality and Registration Marks.
c. The name of an aircraft and the name and emblems of the
owner of an aircraft may be displayed on the aircraft if the
location, size, shape and color of the lettering and signs does
not interfere with the easy recognition of and is not causing
confusion with the identification marks of the aircraft.

45.20 General

d. Aircraft nationality and Registration Marks must :


1) Except as provided in paragraph d. of this section, be
painted on the aircraft or affixed by any other means
insuring a similar degree of permanence;
2) Have no ornamentation;
3) Contrast in color with the background; and
4) Be legible.
e. The aircraft nationality and Registration Marks may be affixed to
an aircraft with readily removable material if :
1) It is intended for immediate delivery to a foreign purchaser;
2) It is bearing a temporary registration number; or
3) It is marked temporarily to meet the requirements of Section
45.22 c.1. of this part.

45.21 Assignment of identification marks
a. Identification marks
The identification marks of an aircraft registered under this part shall
consist of a Nationality Mark and Registration Mark. The Nationality
shall precede the Registration marks and shall be separated from it by
a hyphen.
b. Nationality marks
The Nationality Marks shall be the letter PK.
c. Registration Marks
1) The Registration Marks shall be assigned by the DGCA and shall
consist of three letters.
2) Combination of letters designed for the Registration Marks shall not
be used which might be confused with the five-letter combinations
used in the International Code of Signals. Part II, the three letter
combinations beginning with Q used in the Q-code, and with the
distress signal SOS or other similar urgency signals, e.g. XXX.
PAN and TTT.

45.22 Exhibition, antique, and other aircraft: Special rules

a. When display of aircraft nationality and Registration Marks in


accordance with Sections 45.20, 45.21 and 45.23 through 45.33
would be inconsistent with exhibition of that aircraft, an Indonesian -
registered aircraft may be operated without displaying those marks
anywhere on the aircraft if :
1) It is operated for the purpose of exhibition, including a motion
picture or television production, or an air show;
2) Except for practice and test flights necessary for exhibition
purposes, it is operated only at the location of the exhibition,
between the exhibition locations, and between those locations
and the base of operations of the aircraft; and

3) For each flight in Indonesia

a) It is operated with the prior approval of the DGCA, in the case


of a flight within the designated airport control zone of the
takeoff airport, or within 5 miles of that airport if it has no
designated control zone.
b) It is operated under a flight plan filed under either Section
91.153 or Section 91.169 of the CASRs describing the marks
it displays, in the case of any other flight.

b. A small Indonesian - registered aircraft built at least 30 years ago or an
Indonesian - registered aircraft for which an experimental certificate has
been issued under Section 21.191 d. or 21.191g. for operation as an
exhibition aircraft or as an amateur built aircraft and which has the same
external configuration as an aircraft built at least 30 years ago may be
operated without displaying marks in accordance with Sections 45.20,
45.21, and 45.23 through 45.33 if:

1) It displays in accordance with Section 45.20c., marks at least 15
centimeters (6 inches) high on each side of the fuselage or
vertical tail surface and 25 centimeters (10 inches) on the wings
consisting of the Roman capital letters “PK” followed by:
a) The Indonesian registration letters of aircraft; or
b) The symbol appropriate to the airworthiness certificate of
the aircraft (“C”, standard; “R”, restricted; “L”,
limited; or “X”, experimental) followed by the
Indonesian registration letters of the aircraft; and

2) It displays no other mark that begins with the letters “PK”


anywhere on the aircraft, unless it is the same mark that is
displayed under paragraph b.1) of this section.

c. No person may operate an aircraft under paragraph a. or b. of this
section :

1) In a military zone unless it temporarily bears marks in


accordance with Section 45.20, 45.21 and 45.23 through
45.33;
2) In a foreign country unless that country consents to that
operation; or
3) In any operation conducted under Parts 121, 133, 135, or 137
of the CASRs.

d. If, due to the configuration of an aircraft, it is impossible for a
person to mark it in accordance with Section 45.20, 45.21 and 45.23
through 45.33, he may apply to the DGCA for a different marking
procedure.

45.23 Display of marks: General

a. The nationality and Registration Marks shall be in Roman


capital letter.

b. When marks that include only the Roman capital letters “ PK”
and the registration letters are displayed on limited, restricted
or light-sport category aircraft or experimental or provisionally
certificated aircraft, the operator shall also display on
that aircraft near each entrance to the cabin or cockpit, in
letters not less than 5 centimeters (2 inches) nor more than 15
centimeters (6 inches) in height, the words “limited”,
“restricted”, “light-sport”, “experimental”, or” provisional
airworthiness, “ as the case may be.

45. 24 Display of Indonesia Nationality Flag

a. Aircraft, helicopter, airships, spherical balloons, non-spherical


balloons, powered parachutes, and weight-shift-control aircraft have
an Indonesia nationality and registration marks shall display
Indonesia nationality flag.

b. The nationality flag shall appear on any surface of fuselage exterior or


vertical stabilizer that is eligible to a person on the ground.

c. The height of nationality flag shall be at least 30 centimeter (12 inches)


and the width shall be 3/2 of the height.

45.25 Location of marks on fixed wing aircraft
a. The marks on fixed wing aircraft shall be displayed as prescribed in b.
and c. of this section on the wings and either on the fuselage or on the
vertical tail surface(s).
b. The marks shall appear once on the upper surface of the wing
structure and once on the lower surface of the wing structure. They
shall be located on the right half of the upper surface and on the left
half of the lower surface of the wing structure unless they extend
across the whole of both the upper and the lower surfaces of the wing
structure. So far as possible the marks shall be located equidistant
from the leading and trailing edges of the wings. The tops of the marks
shall be toward the leading edge of the wing.

c. The marks shall appear on each side of the fuselage (or
equivalent structure) between the wings and the tail surface. Or
on the upper halves of the vertical tail surfaces. When located on
single vertical tail surface they shall appear on both sides. When
located on multi-vertical tail surfaces they shall appear on the
outboard sides of the outer surfaces.

45.29 Type and size of marks

a. General:
1) The letters shall be capital letters in Roman characters without
ornamentation. Numbers (if used) shall be Arabic numbers without
ornamentation.
2) The width of each character (except the letter I and the number 1)
and t he length of the hyphen, shall be two-thirds of the height of a
character.
3) The characters and hyphens shall be formed by solid lines and
shall be of a color contrasting clearly with the background. The
thickness of the lines shall be one-sixth of the height of a character.

4) Each character shall be separated from that which it
immediately precedes or follows by a space of not less than
one-quarter of a character width. A hyphen shall be regarded
as a character for this purpose.
5) The characters in each separate group of marks shall be of
equal height.

b. Fixed wing aircraft:

1) The height of the identification marks on the wings shall be at


least 50 centimeters (20 inches).
2) The marks on the fuselage (or equivalent structure) or vertical
tail surfaces shall be as large as practicable, but shall not
interfere with the visible outlines of the fuselage (or equivalent
structure ) and shall leave at least a margin of 5 centimeters (2
inches) along each edge of any vertical tail surface.
3) The height of marks on the fuselage or vertical tail surfaces
shall be at least 30 centimeters (12 inches).

45.30 Additional marking requirement

In addition to the identification requirements of Subpart B, an aircraft


shall carry an identification plate inscribed with its Nationality Marks
and Registration Marks and such other details as the DGCA requires
from time to time, in accordance with the ICAO Convention.

The plate shall be made of fireproof metal or other fireproof material


of suitable physical properties and shall be secured to the aircraft in a
prominent position near the main entrance.

45.31 Marking of export aircraft

A person who manufactures an aircraft in Indonesia for delivery


outside thereof may display on that aircraft any marks required by the
state of registry of the aircraft.

However, no person may operate an aircraft so marked within


Indonesia, except for test and demonstration flights for a limited
period of time, or while in necessary transit to the purchaser.

45.33 Sale of aircraft: Removal of marks

When an aircraft that is registered in Indonesia is sold, the holder of the


Certificate of Aircraft Registration shall remove, before its delivery to
the purchaser, all Indonesian marks from the aircraft, unless the
purchaser is –

a. A citizen of Indonesia;

b. When the aircraft is to be based and primarily used in Indonesia ,


a corporation lawfully organized and doing business under the
laws of Indonesia.

47.31 Pencatatan Pendaftaran Pesawat Udara Sipil

Direktur Jenderal melakukan pencatatan pendaftaran pesawat


udara sipil berisi informasi tentang Pesawat Udara yang terdaftar di
Indonesia, antara lain:

a. nomor pendaftaran;
b . tanda pendaftaran dan tanda kebangsaan;
c. model pesawat udara menurut pembuat;
d. nomor seri pesawat udara;
e. tahun pembuatan pesawat udara;
f. nama dan alamat pemilik pesawat udara;
g. nama dan alamat operator pesawat udara;
h . nama dan alamat pemberi sewa Uika ada); dan
i. tanggal penerbitan sertifikat pendaftaran pesawat udara.

Permohonan pendaftaran pesawat udara dapat diajukan oleh pemilik

47.39 Persyaratan Pendaftaran

a. Pesawat Udara dapat didaftarkan setelah dilakukan pemeriksaan oleh


Direktur Jenderal dan ditetapkan telah memenuhi persyaratan sebagai
berikut:
1. bukti kepemilikan pesawat udara asli atau salinan yang dilegalisir
oleh notaris publik, penjual (seller) at au instansi yang
mengeluarkan;
2. bukti penghapusan tanda pendaftaran atau tidak
didaftarkan di negara lain;
3. salinan bukti asuransi Pesawat Udara;
4. persetujuan pengadaan Pesawat Udara; dan
5. memenuhi ketentuan persyaratan batas USia Pesawat
Udara yang ditetapkan oleh Menteri Perhubungan.

b. Bukti kepemilikan pesawat udara sebagaimana dimaksud pada
huruf a angka 1 antara lain:

1. bill of sale;
2. hibah;

5. putusan pengadilan yang telah memperoleh kekuatan
hukum tetap; atau
6. bentuk lainnya yang disetujui oleh Direktur Jenderal.

c. Persyaratan sebagaimana dimaksud huruf a angka 4 dan angka 5
dikecualikan untuk pendaftaran Pesawat Udara Tanpa Awak.

d. Dalam hal pendaftar bukan pemilik Pesawat Udara, selain harus


memenuhi persyaratan sebagaimana dimaksud pada huruf a, pendaftar
harus menyam paikan salinan bukti penguasaan Pesawat Udara.

47.45 Masa Berlaku dan Perpanjangan Sertifikat Pendaftaran
a. Sertifikat pendaftaran berlaku selama 3 (tiga) tahun.

b . Permohonan perpanJangan sertifikat pendaftaran dapat diajukan oleh:

1. operator Pesawat Udara; atau


2. pemilik atau yang diberi kuasa dalam hal operator Pesawat
Udara sudah tidak aktif.

c . Perpanjangan sertifikat pendaftaran dapat diajukan dengan
melampirkan persyaratan sebagai berikut:

1. salinan bukti kepemilikan pesawat udara;


2. dalam hal pemohon bukan pemilik Pesawat Udara maka harus
menyampaikan bukti penguasaan pesawat udara yang masih berlaku;
3. salinan bukti asuransi pesawat udara;
4. pemenuhan ketentuan persyaratan batas usia pesawat udara yang
ditetapkan oleh Menteri;
5. salinan sertifikat pendaftaran; dan
6. salinan sertifikat kelaikudaraan.

d. Perpanjangan sertifikat pendaftaran tidak dapat diajukan untuk


Pesawat Udara yang tidak bisa mempertahankan sertifikat
kelaikudaraan selama 3 tahun berturut turut.

121.0 Regulatory Reference

This Civil Aviation Safety Regulation (CASR) Part 121 sets forth the
implementing rules for Certifications and Operating Requirements
for Domestic, Flag, and Supplemental Air Carrier as required by
Aviation Law No. 1 Year 2009, Chapter VIII “Airworthiness and Aircraft
Operations”, Article 41, 42, 45, 46 and 47, and Chapter X “Air
Transportations”, Article 136.

121.3 Applicability
This part prescribes the rules governing:
(a) The domestic, flag and supplemental certification and operations of each
person who holds or is required to hold an air Carrier Operating
Certificate under this part who is utilizing airplanes having a passenger
seating configuration of more than 30 seats, excluding any required
crewmember seat, or a payload capacity of more than 3,409 kilograms
(7,500 pounds)
(b) Each person employed or used by a certificate holder conducting
operations under this part including maintenance, preventive maintenance,
and alteration of aircraft.
(c) Each person who is on board an aircraft being operated under this part.
(d) The rules in this part are applicable to all air carriers certified under this
Part.
(e) This part also establishes requirements for operators to take actions to
support the continued airworthiness of each airplane.

121.4 Certification Requirements: General

(a) No person may engage in scheduled air transportation within


Indonesia without, or in violation of an air carrier operating
certificate and appropriate operations specifications issued
under this part. An air carrier whose operations specifications
authorize operations within Indonesia is hereafter referred to as
a “domestic air carrier”.

(b) No person may engage in scheduled air transportation outside


of Indonesia without, or in violation of an air carrier operating
certificate and appropriate operations specifications issued
under this part. An air carrier whose operations specifications
authorize operations outside of Indonesia is hereafter referred
to as a “flag air carrier”.

(c) No person may engage in charter or all-cargo operations
without, or in violation of an air carrier operating certificate
and appropriate operations specifications issued under this
part. An air carrier whose operations specifications
authorize charter or all-cargo operations is hereafter
referred to as a “supplemental air carrier”.
(d) A domestic air carrier may, in the case of segments of
routes extending outside of Indonesia, be authorized to
conduct operations over those route segments under the
domestic air carrier certification and operation rules. A
domestic air carrier whose route structure has expanded
to include operations outside of Indonesia must conduct
those routes under the flag air carrier certification and
operation rules.
(e) The Director may authorize the air carriers described in
paragraphs (a) and (b) of this section to conduct charter
and/or all-cargo operation with the appropriate revisions
to their existing operations specifications.

(f) The rules in this part that do not specifically refer to flag or
domestic or supplemental air carriers are applicable to flag
and domestic and supplemental air carriers.

(g) No holder of an air operator certificate may operate or list on


any required listing of its aircraft any aircraft listed on any
operation specifications issued to another air operator
under this part.

121.26 Application for Air Carrier Operator Certificates

Each application for an air carrier operator certificate shall be made in the
form and manner and contain information prescribed by the Director. Each
applicant must submit his application at least 60 days before the date of
intended operation.

121.29 Duration of Validity and surrender of Air Operator certificate
and Operations Specifications.
(a) An Air Operator Certificate or Operating Certificate issued under this Part is
valid for a period not exceed 24 (twenty four) calendar months from the
month of the AOC is issued or renewed, unless –
(1) The certificate holder surrenders it earlier to the DGCA; or
(2) The DGCA suspends, revokes, or otherwise earlier
terminates the Certificate due to the violation by the
certificate holder to the provision of this Part; or
(3) The certificate holder does not conduct or cease all
operations for which it holds authority in its Operations
Specifications for more than the time specified in section
121.32a.
(4) The certificate holder violates the provision of Aviation Act No. 1
Year 2009 as the basis for granting of the certificate, or violate
requirements to conduct operation of its organization in
accordance with authority granted,limitation imposed and
procedures approved as they are specified on its Operation
Specifications concerning; or
(5) The certificate holder apply for renewal of validity of his Certificate.

121.32a Suspension and Revocation of Air Operator Certificate or
Operating Certificate of a Certificate Holder which does not Conduct
Operations for which It Holds Authority for More Than a Specified
Time

The Air Operator Certificate or Operating Certificate of a certificate holder


who does not conduct or cease operations for which it holds authority in
its Operations Specifications for certain number of consecutive calendar
days, will be suspended and revoked as follows :
(a) Domestic and flag operations.
(1) If a certificate holder does not conduct or cease operations for
30 consecutive calendar days, the certificate holder will be
issued three (3) consecutive warning letters, each at interval of
maximum of one (1) month;
(2) If the certificate holder does not respond to the warning
letters, the certificate will be suspended for a maximum of three
(3) months;
(3) If the suspension period is over and there is no effort made for the
resumption of the operations, the certificate will be revoked.

(b) Supplemental operations.

(1) If a certificate holder does not conduct or cease operations


for 90 consecutive calendar days, the certificate holder will
be issued three (3) consecutive warning letters, each at
interval of one (1) month;

(2) If the certificate holder does not respond to the warning


letters, the certificate will be suspended for a maximum of
three (3) months;

(3) If the suspension period is over and there is no effort made


for the resumption of the operations, the certificate will
be revoked.

121.32b Renewal of Validity of Air Operator Certificate

A certificate holder who wishes to renew his validity of his Certificate


shall:

(a) Apply in a form and manner acceptable to the DGCA;

(b) Forward the application to the DGCA at least 60


consecutive calendar days before expiration of his
Certificate, to allow sufficient time for the DGCA to conduct a
quality audit to determine whether the certificate holder
remains in compliance, in conformance and in adherence
with appropriate regulations, in order to be able to conduct a
safe operation.

121.59 Management Personnel Required

(a) Each applicant for a certificate under this subpart must show that it has
sufficient qualified management personnel to provide adequate
direction in all operational matters and ensure an acceptable level of
safety is being maintained. Such personnel must be employed on a full
time basis in at least the following or equivalent position:

(1) Managing or President Director


(2) Safety Management System:
(a) Accountable Executive
(b) Safety Manager (reporting directly to Accountable Executive)
(3) Director of Operation
(4) Director of Maintenance
(5) Chief Pilot
(6) Chief inspector

SUBPART H - AIRCRAFT REQUIREMENTS
121.151 Applicability
This subpart prescribes aircraft requirement for all Air Operator
Certificate holders.
121.153 Aircraft requirements: General
(a) In addition to CASR part 91.25, except as provided in paragraph (b) of
this section no air operator certificate holder may operate an
aircraft unless there has been issued with respect to and carried
on board that aircraft:
(1) A certified true copy of Air Operator Certificate and a copy
Operations specifications relevant to the aeroplane type
(2) A current weight and balance document.

(b) An Air Operator Certificate holder may use an approved weight and
balance control system based on average, assumed, or estimated weight
to comply with applicable airworthiness requirements and operating

(a) Unless approved by the Director in accordance with Appendix P of


this part and authorized in the air carrier's operations
specifications, no air carrier may operate a turbine-engine-
powered airplane over a route that contains a point—
(1) Farther than a flying time from an Adequate Airport (at a one-
engine-inoperative cruise speed under standard conditions in
still air) of 60 minutes for a two-engine airplane or 180
minutes for a passenger-carrying airplane with more than two
engines;
(2) Within the North Polar Area; or
(3) Within the South Polar Area.

(b) No certificate holder may operate a land airplane in an extended
overwater operation unless it is certificated or approved as
adequate for ditching under the ditching provisions of Part 25 of
the CASRs.
In the case of aircraft certified prior to the enactment of Part 25,
the Director may issue operations specifications that allow
deviation from the requirements of this paragraph if standards
of safety allow such a deviation.

121.363 Responsibility for Airworthiness


(a) Each certificate holder is primarily responsible for –
(1) The airworthiness of its aircraft, including airframe, aircraft
engines, propellers, appliances, and parts thereof;
(2) The performance of the maintenance, preventive
maintenance, and alteration of its aircraft, including
airframes, aircraft engines, propellers, appliances,
emergency equipment, and parts thereof, in accordance with
its manual and the related regulations; and
(3) Obtaining and assessing the continuing airworthiness
informations and recomendations from the organizations
responsible for the type design.

(b) A certificate holder may make arrangements with another person


for the performance of any maintenance, preventive maintenance, or
alterations. However, this does not relieve the certificate holder of the

121.365 Maintenance, Preventive Maintenance, and Alteration
Organization

(a) Each certificate holder that performs any of its maintenance (other
than required inspections), preventive maintenance, or alterations,
and each person with whom it arranges for the performance of that
work must have an organization adequate to perform the work.
Additionally, the housing, facilities, equipment, materials, and data
shall comply with CASR 145 subpart C.

121.367 Maintenance Program.

(a) Each certificate holder shall have a maintenance program for each
aircraft type including foreign registered aircraft, approved by the DGCA,
or state of registry, containing the following:

(1) maintenance tasks and the intervals at which these are to be


performed, taking into account the anticipated utilization of the aero
plane;
(2) when applicable, a continuing structural integrity program;
(3) procedures for changing or deviating from (1) and (2) above;
(4) when applicable, condition monitoring and reliability program
descriptions for aircraft systems, components and engines; and
(5) maintenance task as required inspection items.

121.371 Required Inspection and Appropriate Personnel

For the purpose of these regulations Required Inspection are items


of maintenance and alteration that must be inspected, includes those
that could result in a failure, malfunction, or defect endangering the
safe operation of the aircraft, if not performed properly or improper
parts or materials are used.

(a) No person may use any person to perform required


inspections unless the person performing the inspection is
appropriately licensed, properly trained, qualified, and
authorized to do so.
(b) No person may allow any person to perform a required
inspection unless, at that time, the person performing that
inspection is under the supervision and control of an
inspection unit.

(c) No person may perform a required inspection if he performed
the item of work required to be inspected.

(d) Each certificate holder shall maintain or shall determine that


each person with whom it arranges to perform its required
inspections maintains, a current listing of persons who have
been trained, qualified, and authorized to conduct required
inspections.

121.375 Maintenance and Preventive Maintenance Training Program

(a) Each certificate holder or person performing maintenance or preventive


maintenance functions for it shall have a training program to ensure
that each person (including inspection personnel) who determines the
adequacy of work done is fully informed about procedures and
techniques and new equipment in use and is competent to perform his
duties.

(b) The training program shall ensure all maintenance personnel receive
initial training and continuation training appropriate to their assigned
tasks and responsibilities, and shall include training in knowledge and
skills related to human performance, including co-ordination with other
maintenance personnel and flight crew.

121.377 Maintenance and Preventive Maintenance Personnel Duty
Time Limitations

Within Indonesia, each certificate holder (or person performing


maintenance or preventive maintenance functions for it) shall relieve each
person performing maintenance or preventive maintenance from duty for a
period of at least 24 consecutive hours during any seven consecutive days,
or the equivalent thereof within any one calendar month.

(5) air ambulance,
(6) flight inspection or calibration of air navigation facilities, and
(7) any other air transportation service considered by the Director

145.0 Regulatory Reference


This Civil Aviation Safety Regulation (CASR) Part 145 sets forth the

145.1 Applicability
This part describes how to obtain an Approved Maintenance
Organization (AMO) certificate. This part also contains the rules a
certificated AMO must follow related to its performance of
maintenance, preventive maintenance, or alterations of an aircraft,
airframe, aircraft engine, propeller, appliance, or component part to
which Part 43 applies. It also applies to any person who holds, or is
required to hold, an AMO certificate issued under this part.

145.3 Definition of terms

For the purposes of this part, the following definitions apply:

(a) Accountable manager means the person designated by the


certificated AMO who is responsible for and has the authority over
all AMO operations that are conducted under Part 145, including
ensuring that AMO personnel follow the regulations and serving as
the primary contact with the DGCA.

(b) Article means an aircraft, airframe, aircraft engine, propeller,


appliance, or component part.

(c) Directly in charge means having the responsibility for the work of
a certificated AMO that performs maintenance, preventive
maintenance, alterations, or other functions affecting aircraft
airworthiness. A person directly in charge does not need to
physically observe and direct each worker constantly but must
be available for consultation on matters requiring instruction or
decision from higher authority.

(d) Line maintenance means:

(1) Any unscheduled maintenance resulting from unforeseen


events; or
(2) Scheduled checks that contain servicing and/or inspections
that do not require specialized training, equipment, or
facilities.

145.5 Certificate and operations specifications requirements.

(a) No person may operate as a certificated AMO without, or in


violation of, an AMO certificate, ratings, or operations
specifications issued under this part.

(b) The certificate and operations specifications issued to a


certificated AMO must be available on the premises for
inspection by the public and the DGCA.

145.51 Application for certificate

(a) An application for an AMO certificate and rating must be made in a


format acceptable to the DGCA and must include the following:

(1) An AMO manual for approval by the DGCA as required by


section 145.207;
(2) A quality control manual for approval by the DGCA as required
by section 145.211(c);
(3) A list by type, make, or model, as appropriate, of each article
for which the application is made;

(4) An organizational chart of the AMO and the names and titles
of managing and supervisory personnel;
(5) A description of the housing and facilities, including the
physical address, in accordance with section 145.103;
(6) A list of the maintenance functions, for approval by the
DGCA, to be performed for the AMO under contract by another
person in accordance with section 145.217; and
(7) A training program for approval by the DGCA in accordance
with section 145.163.
(8) A safety management system manual for acceptance by
DGCA as required by section 145.211(f);

(b) The equipment, personnel, technical data, and housing and
facilities required for the certificate and rating, or for an additional
rating must be in place for inspection at the time of certification or
rating approval by the DGCA. An applicant may meet the equipment
requirement of this paragraph if the applicant has a contract
acceptable to the DGCA with another person to make the equipment
available to the applicant at the time of certification and at any time
that it is necessary when the relevant work is being performed by the
AMO.

(c) In addition to meeting the other applicable requirements for an
AMO certificate and rating, an applicant for an AMO certificate and
rating located outside the Republic of Indonesia must meet the
following requirements:
(1) The applicant must show that the AMO certificate and/or
rating is necessary for maintaining or altering the following:
(i) Indonesian registered aircraft and articles for use on
Indonesian registered aircraft, or
(ii) Foreign-registered aircraft operated under the provisions
of Part 121 or Part 135, and articles for use on these
aircraft.

(d) An application for an additional rating, amended AMO certificate,


or renewal of an AMO certificate must be made in a format
acceptable to the DGCA. The application must include only that
information necessary to substantiate the change or renewal of
the certificate.

145.53 Issue of certificate

(a) Except as provided in paragraph (b) of this section, a person who


meets the requirements of this part is entitled to an AMO
certificate with appropriate ratings prescribing such operations
specifications and limitations as are necessary in the interest of
safety.

(b) If the person is located in a country with which the Republic of


Indonesia has a bilateral aviation safety agreement, the DGCA
may find that the person meets the requirements of this part
based on a certification from the civil aviation authority of that
country. This certification must be made in accordance with
implementation procedures signed by the DGCA or the DGCA's
designee.

(c) Before an AMO certificate can be issued for an AMO that is
located within the Republic of Indonesia, the applicant shall
certify in writing that all “hazardous material employees” for the
AMO, its contractors, or subcontractors are trained.

(d) Before a AMO certificate can be issued for an AMO that is


located outside the Republic of Indonesia, the applicant shall
certify in writing that all employees for the AMO, its contractors,
or subcontractors performing a job function concerning the
transport of dangerous goods (hazardous material) are trained
as outlined in the most current edition of the International Civil
Aviation Organization Technical Instructions for the Safe
Transport of Dangerous Goods by Air.

145.55 Duration and renewal of certificate

(a) A certificate or rating issued to :


(1) The AMO located in the Republic of Indonesia shall remain in
force for such period as determined by the DGCA but shall
not exceed two (2) years from the date of issue, unless the
AMO surrenders the certificate or the DGCA suspends or
revokes it.
(2) The AMO located outside the Republic of Indonesia shall
remain in force for such period as determined by the DGCA
but shall not exceed 2 (two) years from the date of issue,
unless the AMO surrenders the certificate or the DGCA
suspends or revokes it.
(b) The DGCA may need to issue temporary extension validity up to
90 days due to unusual circumstances

(c) A certificated AMO that applies for a renewal of its AMO certificate
must:

(1) Submit its request for renewal no later than 30 days before
the AMO's current certificate expires. If a request for renewal is
not made within this period, the AMO must follow the application
procedures in section 145.51.
(2) Send its request for renewal to the DGCA.

(3) Submit to DGCA a maintenance service provides to


Indonesian costumer within years of reports.

(d) The holder of an expired, surrendered, suspended, or revoked


certificate must return it to the DGCA.

145.57 Amendment to or transfer of certificate.

(a) The holder of an AMO certificate must apply for a change to its
certificate in a format acceptable to the DGCA. A change to the
certificate is necessary if the certificate holder:
(1) Changes the location of the AMO, or
(2) Requests to add or amend a rating.

(b) If the holder of an AMO certificate sells or transfers its assets, the
new owner must apply for an amended certificate in accordance with
section 145.51.

145.59 Ratings

The following ratings are issued under this subpart:

(a) Airframe ratings.


(1) Class 1: Composite construction of small aircraft.
(2) Class 2: Composite construction of large aircraft.
(3) Class 3: All-metal construction of small aircraft.
(4) Class 4: All-metal construction of large aircraft.

(b) Powerplant ratings.


(1) Class 1: Reciprocating engines of 400 horsepower or less.
(2) Class 2: Reciprocating engines of more than 400 horsepower.
(3) Class 3: Turbine engines.

(c) Propeller ratings.


(1) Class 1: Fixed-pitch and ground-adjustable propellers of wood,
metal, or composite construction.
(2) Class 2: Other propellers, by make.

(d) Radio ratings.

(1) Class 1: Communication equipment.

Radio transmitting and/or receiving equipment used in an aircraft to


send or receive communications in flight, regardless of carrier
frequency or type of modulation used. This equipment includes
auxiliary and related aircraft interphone systems, amplifier
systems, electrical or electronic intercrew signaling devices, and
similar equipment. This equipment does not include
equipment used for navigating or aiding navigation of aircraft,
equipment used for measuring altitude or terrain clearance, other
measuring equipment operated on radio or radar principles, or
mechanical, electrical, gyroscopic, or electronic instruments that
are a part of communications radio equipment.

(2) Class 2: Navigational equipment.

A radio system used in an aircraft for en route or approach


navigation. This does not include equipment operated on radar or
pulsed radio frequency principles, or equipment used for measuring
altitude or terrain clearance.

(3) Class 3: Radar equipment.

An aircraft electronic system operated on radar or pulsed radio


frequency principles.

(e) Instrument ratings.

(1) Class 1: Mechanical.


A diaphragm, bourdon tube, aneroid, optical, or mechanically
driven centrifugal instrument used on aircraft or to operate
aircraft, including tachometers, airspeed indicators, pressure
gauges drift sights, magnetic compasses, altimeters, or
similar mechanical instruments.

(2) Class 2: Electrical.


Self-synchronous and electrical-indicating instruments and
systems, including remote indicating instruments, cylinder
head temperature gauges, or similar electrical instruments.

(3) Class 3: Gyroscopic.
An instrument or system using gyroscopic principles and motivated
by air pressure or electrical energy, including automatic pilot control
units, turn and bank indicators, directional gyros, and their parts, and
flux gate and gyrosyn compasses.

(4) Class 4: Electronic.


An instrument whose operation depends on electron tubes,
transistors, or similar devices, including capacitance type quantity
gauges, system amplifiers, and engine analyzers.

(f) Accessory ratings.

(1) Class 1: A mechanical accessory that depends on friction,


hydraulics, mechanical linkage, or pneumatic pressure for
operation, including aircraft wheel brakes, mechanically driven
pumps, carburettors, aircraft wheel assemblies, shock absorber
struts and hydraulic servo units.

(2) Class 2: An electrical accessory that depends on electrical


energy for its operation, and a generator, including starters,
voltage regulators, electric motors, electrically driven fuel pumps
magnetos, or similar electrical accessories.

(3) Class 3: An electronic accessory that depends on the use of an


electron tube transistor, or similar device, including
supercharger, temperature, air conditioning controls, or similar
electronic controls.

145.61 Limited ratings

(a) The DGCA may issue a limited rating to a certificated AMO that
maintains or alters only a particular type of airframe, powerplant,
propeller, radio, instrument, or accessory, or part thereof, or
performs only specialized maintenance requiring equipment and
skills not ordinarily performed under other AMO ratings. Such a
rating may be limited to a specific model aircraft, engine, or
constituent part, or to any number of parts made by a particular
manufacturer.

(b) The DGCA issues limited ratings for:

(1) Airframes of a particular make and model;


(2) Powerplants of a particular make and model;
(3) Propellers of a particular make and model;
(4) Instruments of a particular make and model;

(5) Radio equipment of a particular make and model;
(6) Accessories of a particular make and model;
(7) Landing gear components;
(8) Floats, by make;

(11) Rotor blades, by make and model; and
(12) Aircraft fabric work.
(c) For a limited rating for specialized services, the operations
specifications of the AMO must contain the specification used to
perform the specialized service. The specification may be:

(1) A civil or military specification currently used by industry


and approved by the DGCA, or
(2) A specification developed by the applicant and approved
by the DGCA.

145.101 General
A certificated AMO must provide housing, facilities, equipment,
materials, and data that meet the applicable requirements for the
issuance of the certificate and ratings the AMO holds.

145.103 Housing and facilities requirements

(a) Each certificated AMO must provide:


(1) Housing for the facilities, equipment, materials, and personnel
consistent with its ratings.
(2) Facilities for properly performing the maintenance, preventive
maintenance, or alterations of articles or the specialized services
for which it is rated. Facilities must include the following:
(i) Sufficient work space and areas for the proper
segregation and protection of articles during all
maintenance, preventive maintenance, or alterations;
(ii) Segregated work areas enabling environmentally
hazardous or sensitive operations such as painting,
cleaning, welding, avionics work, electronic work, and
machining to be done properly and in a manner that does
not adversely affect other maintenance or alteration articles
or activities;

(iii) Suitable racks, hoists, trays, stands, and other
segregation means for the storage and protection of all
articles undergoing maintenance, preventive maintenance,
or alterations;
(iv) Space sufficient to segregate articles and materials
stocked for installation from those articles undergoing
maintenance, preventive maintenance, or alterations; and
(v) Ventilation, lighting, and control of temperature, humidity,
and other climatic conditions sufficient to ensure personnel
perform maintenance, preventive maintenance, or
alterations to the standards required by this part.

(b) A certificated AMO with an airframe rating must provide suitable
permanent housing to enclose the largest type and model of aircraft
listed on its operations specifications.

(c) A certificated AMO may perform maintenance, preventive


maintenance, or alterations on articles outside of its housing if it
provides suitable facilities that are acceptable to the DGCA and meet
the requirements of section 145.103(a) so that the work can be done
in accordance with the requirements of CASR Part 43.

145.105 Change of location, housing, or facilities

(a) A certificated AMO may not change the location of its housing
without written approval from the DGCA.
(b) A certificated AMO may not make any changes to its housing or
facilities required by section 145.103 that could have a
significant effect on its ability to perform the maintenance,
preventive maintenance, or alterations under its AMO certificate
and operations specifications without written approval from the
DGCA.
(c) The DGCA may prescribe the conditions, including any
limitations, under which a certificated AMO must operate while it
is changing its location, housing, or facilities.

145.107 Satellite AMO

(a) A certificated AMO under the managerial control of another


certificated AMO may operate as a satellite AMO with its own
certificate issued by the DGCA. A satellite AMO:

(1) May not hold a rating not held by the certificated AMO with
managerial control;
(2) Must meet the requirements for each rating it holds;
(3) Must submit an AMO manual for approval by the DGCA as
required by section 145.207; and
(4) Must submit a quality control manual for approval by the
DGCA as required by section 145.211(c).

(b) Unless the DGCA indicates otherwise, personnel and equipment
from the certificated AMO with managerial control and from each of
the satellite AMOs may be shared. However, inspection personnel
must be designated for each satellite AMO and available at the
satellite AMO any time a determination of airworthiness or return to
service is made. In other circumstances, inspection personnel may be
away from the premises but must be available by telephone, radio, or
other electronic means.

(c) A satellite AMO may not be located in a country other than the
domicile country of the certificated AMO with managerial control.

145.109 Equipment, materials, data and aeronautical product
requirements

(a) Except as otherwise prescribed by the DGCA, a certificated AMO


must have the equipment, tools, and materials necessary to perform
the maintenance, preventive maintenance, or alterations under its
AMO certificate and operations specifications in accordance with Part
43. The equipment, tools, and material must be located on the
premises and under the AMO's control when the work is being done.

(b) A certificated AMO must ensure all test and inspection equipment
and tools used to make airworthiness determinations on articles are
calibrated to a standard acceptable to the DGCA.

(c) The equipment, tools, and material must be those recommended


by the manufacturer of the article or must be at least equivalent to
those recommended by the manufacturer and acceptable to the
DGCA.

(d) A certificated AMO must ensure that the procurement of


aeronautical products are obtained from the source as required by
section 145.111.

(e) A certificated AMO must maintain, in a format acceptable to the
DGCA, the documents and data required for the performance of
maintenance, preventive maintenance, or alterations under its AMO
certificate and operations specifications in accordance with Part 43.
The following documents and data must be current and accessible
when the relevant work is being done:
(1) Airworthiness directives,
(2) Instructions for continued airworthiness,
(3) Maintenance manuals,
(4) Overhaul manuals,
(5) Standard practice manuals,
(6) Service bulletins, and
(7) Other applicable data acceptable to or approved by the DGCA.

SUBPART D – PERSONNEL
145.151 Personnel requirements

Each certificated AMO must:


(a) Designate an AMO employee as the accountable manager;
(b) Provide sufficient number and qualified personnel for
managers or supervisors, certifying personnel, auditors,
mechanics and specialized work personnel to plan,
supervise, audit, perform, and certify or approve for return
to service the maintenance, preventive maintenance, or
alterations performed under the AMO certificate and
operations specifications;
(c) Establish and control the competence of personnel involved
in quality audits in accordance with a procedure and to a
standard acceptable to the DGCA;

(d) Ensure it has a sufficient number employees with the training
or knowledge and experience in the performance of
maintenance, preventive maintenance, or alterations

(e) Determine the abilities of its non-certificated employees


performing maintenance functions based on training,
knowledge, experience, or practical tests.

145.153 Manager or Supervisory personnel requirements

(a) A certificated AMO must ensure it has a sufficient number of


managers or supervisors to manage or supervise and direct the work
performed under the AMO certificate and operations specifications.
The managers or supervisors must oversee the work performed by
any individuals who are unfamiliar with the methods, techniques,
practices, aids, equipment, and tools used to perform the
maintenance, preventive maintenance, or alterations.

(b) Each manager or supervisor must:
(1) If employed by an AMO located inside the Republic of
Indonesia:
(i) Be licensed under CASR Part 65 when direct and/or
oversee the work performed as explained in 145.153 (a);
(ii) Be trained in safety management system and human
factor.
(2) If employed by an AMO located outside the Republic of
Indonesia:
(i) Have a minimum of 18 months of practical experience in
the work being performed; or
(ii) Be trained in or thoroughly familiar with the methods,
techniques, practices, aids, equipment, and tools used to
perform the maintenance, preventive maintenance, or
alterations.

(c) A certificated AMO must ensure its managers or supervisors


understand, read, and write English.

(c) A certificated AMO must ensure its inspectors understand, read,


and write English.

145.157 Certifying Personnel to approve an article for return to
service
(a) A certificated AMO must ensure each certifying personnel to
approve an article for return to service under the AMO certificate and
operations specifications are familiar with the applicable regulations
in the CASRs and proficient in the use of the various inspection
methods, techniques, practices, aids, equipment, and tools
appropriate for the work being performed and approved for return to
service, and:
(1) If employee by a certificated AMO located inside the Republic
of Indonesia:
(i) Be licensed under CASR Part 65.
(ii) Be trained in safety management system and human factor.
(2) If employee by a certificated AMO located outside the Republic of
Indonesia must be licensed and meet the requirements of ICAO Annex 1.

(b) A certificated AMO must ensure each person authorized to approve an


article for return to service understands, reads, and writes English.

145.161 Records of management, supervisory, inspection, and
certifying personnel

(a) A certificated AMO must maintain and make available in a format


acceptable to the DGCA the following:
(1) A roster of management and supervisory personnel that
includes the names of the AMO officials who are responsible for
its management and / orthe names of its supervisors who
oversee maintenance functions.
(2) A roster with the names of all inspection personnel.
(3) A roster of certifying personnel authorized to sign a
maintenance release for approving a maintained or altered
article for return to service.

(4) A summary of the employment of each individual whose
name is on the personnel rosters required by paragraphs (a)(1)
through (a)(3) of this section. The summary must contain
enough information on each individual listed on the roster to
show compliance with the experience requirements of this part
and must include the following:
(i) Present title,
(ii) Total years of experience and the type of maintenance
work performed,
(iii) Past relevant employment with names of employers
and periods of employment,
(iv) Scope of present employment, and
(v) The type of license held and the ratings on that license,
if applicable.
(b) Within 5 business days of the change, the rosters required by this
section must reflect changes caused by termination, reassignment,
change in duties or scope of assignment, or addition of personnel.

145.163 Training requirements

(a) A certificated AMO must have an employee training program


approved by the DGCA that consists of initial and recurrent
training.

(1) An applicant for an AMO certificate must submit a training


program for approval by the DGCA as required by section
145.51(a)(7).
(2) The training program shall include training in knowledge and
skills related to human performance, including co-ordination with
other maintenance personnel.

(b) The training program must ensure each employee assigned to


perform maintenance, preventive maintenance, or alterations, and
inspection functions is capable of performing the assigned task.

(c) A certificated AMO must document, in a format acceptable to the
DGCA, the individual employee training required under paragraph (a)

145.209(e).

145.165 Hazardous materials training.

(a) Each AMO that meets the definition of a hazmat employer under
Appendix A point 2 must have a hazardous materials training
program that meets the training requirements Appendix A point 3.

(b) An AMO employee may not perform or directly supervise all job
functions for transporting hazardous material on an aircraft
operated by a Part 121 or Part 135 certificate holder.

SUBPART E – OPERATING RULES
145.201 Privileges and limitations of certificate

(a) A certificated AMO may:

(1) Perform maintenance, preventive maintenance, or alterations


in accordance with Part 43 on any article for which it is rated and
within the limitations in its operations specifications.
(2) Arrange for another person to perform the maintenance,
preventive maintenance, or alterations of any article for which
the certificated AMO is rated. If that person is not certificated
under CASR Part 145, the certificated AMO must ensure that the
non-certificated person follows a quality control system
equivalent to the system followed by the certificated AMO.
(3) Approve for return to service any article for which it is rated
after it has performed maintenance, preventive maintenance, or
an alteration in accordance with CASR Part 43.

(b) A certificated AMO may not maintain or alter any article for which
it is not rated, and may not maintain or alter any article for which it is
rated if it requires special technical data, equipment, or facilities that
are not available to it.
(c) A certificated AMO may not approve for return to service:
(1) Any article unless the maintenance, preventive maintenance,
or alteration was performed in accordance with the applicable
approved technical data or data acceptable to the DGCA.
(2) Any article after a major repair or major alteration unless the
major repair or major alteration was performed in accordance
with applicable approved technical data; and
(3) Any experimental aircraft after a major repair or major
alteration performed under section 43.1(b) unless the major
repair or major alteration was performed in accordance with
methods and applicable technical data acceptable to the DGCA.

145.203 Work performed at another location

A certificated AMO may temporarily transport material, equipment,


and personnel needed to perform maintenance, preventive
maintenance, alterations, or certain specialized services on an article
for which it is rated to a place other than the AMO's fixed location if
the following requirements are met:
(a) The work is necessary due to a special circumstance, as
determined by the DGCA; or
(b) It is necessary to perform such work on a recurring basis, and
the AMO's manual includes the procedures for accomplishing
maintenance, preventive maintenance, alterations, or
specialized services at a place other than the AMO's fixed
location.

145.205 Maintenance, preventive maintenance, and alterations
performed for certificate holders under parts 121, 135, and for
foreign air carriers or foreign persons operating an Indonesian
registered aircraft in common carriage under CASR Part 129

(a) A certificated AMO that performs maintenance, preventive


maintenance, or alterations for an air carrier or commercial
operator that has a continuous airworthiness maintenance
program under CASR Part 121 or Part 135 must follow the air
carrier's or commercial operator's program and applicable
sections of its maintenance manual.
(b) A certificated AMO that performs maintenance, preventive
maintenance, or alterations for a foreign air carrier or foreign
person operating an Indonesian registered aircraft under CASR
Part 129 must follow the operator's DGCA approved
maintenance program.

(c) Not withstanding the housing requirement of section 145.103(b),
the DGCA may grant approval for a certificated AMO to perform line
maintenance for an air carrier certificated under Part 121 or Part 135,
or a foreign air carrier or foreign person operating an Indonesian
registered aircraft in common carriage under CASR Part 129 on any
aircraft of that air carrier or person, provided:
(1) The certificated AMO performs such line maintenance in
accordance with the operator's manual, if applicable, and
approved maintenance program;
(2) The certificated AMO has the necessary equipment, trained
personnel, and technical data to perform such line maintenance;
and
(3) The certificated AMO's operations specifications include an
authorization to perform line maintenance.

(a) A certificated AMO must prepare and follow an AMO manual


approved by the DGCA.
(b) A certificated AMO must maintain a current AMO manual.

use by AMO personnel required by subpart D of this part.
(d) A certificated AMO must provide the DGCA with the current AMO
manual in a format acceptable to the DGCA.
(e) A certificated AMO must notify the DGCA of each revision of its
AMO manual in accordance with the procedures required by section
145.209(j).

145.211 Quality and Safety system

(a) A certificated AMO must establish and maintain a quality control


system acceptable to the DGCA that ensures the airworthiness of
the articles on which the AMO or any of its contractors performs
maintenance, preventive maintenance, or alterations.

(b) AMO personnel must follow the quality control system when
performing maintenance, preventive maintenance, or alterations
under the AMO certificate and operations specifications.

(c) A certificated AMO must prepare and keep current a quality
control manual in a format approved by the DGCA that includes the
following:

(ii) Performing preliminary inspection of all articles that are
maintained;
(iii) Inspecting all articles that have been involved in an
accident for hidden damage before maintenance, preventive
maintenance, or alteration is performed;

(iv) Establishing and maintaining proficiency of inspection personnel;
(v) Establishing and maintaining current technical data for

(vii) Performing final inspection and return to service of maintained
articles;
(viii) Calibrating measuring and test equipment used in maintaining
articles, including the intervals at which the equipment will be
calibrated; and
(ix) Taking corrective action on deficiencies;

(2) References, where applicable, to the manufacturer's inspection
standards for a particular article, including reference to any data
specified by that manufacturer;

separate forms manual; and

(4) Procedures for revising the quality control manual required under
this section and notifying the DGCA of the revisions, including
how often the DGCA will be notified of revisions.

(d) A certificated AMO must notify the DGCA of revisions to its quality
control manual.

(e) A certified AMO shall establish a quality assurance system that


includes:
(1) an independent internal audits in order to monitor compliance
with required aircraft/aircraft component standards and
adequacy of the procedures to ensure that such procedures
invoke good maintenance practices and airworthy
aircraft/aircraft components.
(2) A quality feedback reporting system to the accountable
manager that ensures proper and timely corrective action is
taken in response to reports resulting from the internal
independent audits established to meet paragraph (e)(1).

(f) A certified AMO shall have in place a Safety Management System
(SMS) that is acceptable to DGCA. The SMS of a certified AMO
shall:
(1) be established in accordance with the following framework
elements:
(i) Safety policy and objectives;
(ii) Safety risk management;
(iii) Safety assurance; and
(iv) Safety promotion.
(2) be commensurate with the size of the certified AMO and the
complexity of its capability.
(g) In order to be acceptable to the DGCA, the SMS shall
meet the requirements set forth in Appendix B of this Part.

145.213 Inspection of maintenance, preventive maintenance, or
alterations

(a) A certificated AMO must inspect each article upon which it has
performed maintenance, preventive maintenance, or alterations as
described in paragraphs (b) and (c) of this section before
approving that article for return to service.

(b) A certificated AMO must certify on an article's maintenance


release that the article is airworthy with respect to the
maintenance, preventive maintenance, or alterations performed
after:
(1) The AMO performs work on the article; and
(2) An inspector inspects the article on which the AMO has
performed work and determines it to be airworthy with respect to
the work performed.

(c) For the purposes of paragraphs (a) and (b) of this section, an
inspector must meet the requirements of 145.155.

(d) Except for individuals employed by an AMO located outside the


Republic of Indonesia, only an employee licensed under CASR
Part 65 is authorized to sign off on final inspections and
maintenance releases for the AMO.

145.215 Capability list

(a) A certificated AMO with a limited rating may perform maintenance,


preventive maintenance, or alterations on an article if the article is
listed on a current capability list acceptable to the DGCA or on the
AMO's operations specifications.

(b) The capability list must identify each article by make and model or
other nomenclature designated by the article's manufacturer and
be available in a format acceptable to the DGCA.

(c) An article may be listed on the capability list only if the article is
within the scope of the ratings of the AMO's certificate, and only after
the AMO has performed a self-evaluation in accordance with the
procedures under section 145.209(d)(2). The AMO must perform this
self-evaluation to determine that the AMO has all of the housing,
facilities, equipment, material, technical data, processes, and trained
personnel in place to perform the work on the article as required by
CASR Part 145. The AMO must retain on file documentation of the
evaluation.

(d) Upon listing an additional article on its capability list, the AMO
must provide the DGCA with a copy of the revised list in accordance
with the procedures required in section 145.209(d)(1).

145.217 Contract maintenance

(a) A certificated AMO may contract a maintenance function


pertaining to an article to an outside source provided:

(1) The DGCA approves the maintenance function to be


contracted to the outside source; and
(2) The AMO maintains and makes available to the DGCA, in a
format acceptable to the DGCA, the following information:
(i) The maintenance functions contracted to each outside
facility; and
(ii) The name of each outside facility to whom the AMO
contracts maintenance functions and the type of certificate
and ratings, if any, held by each facility.

(b) A certificated AMO may contract a maintenance function
pertaining to an article to a non-certificated person provided:
(1) The non-certificated person follows a quality control system
equivalent to the system followed by the AMO;
(2) The certificated AMO remains directly in charge of the work
performed by the non-certificated person; and
(3) The certificated AMO verifies, by test and/or inspection, that
the work has been performed satisfactorily by the non-certificated
person and that the article is airworthy before approving it for
return to service.
(c) A certificated AMO may not provide only approval for return to
service of a complete type-certificated product following contract
maintenance, preventive maintenance, or alterations.

145.219 Recordkeeping
A certificated AMO must retain records in English that demonstrate
compliance with the requirements of CASR Part 43. The records must
be retained in a format acceptable to the DGCA.
(b) A certificated AMO must provide a copy of the maintenance
release to the owner or operator of the article on which the
maintenance, preventive maintenance, or alteration was
performed.
(c) A certificated AMO must retain the records required by this section
for at least 2 years from the date the article was approved for
return to service.
(d) The records specified in this section shall be retained for a
minimum period of 90 days after the unit to which they refer has
been permanently withdrawn from service.

inspection by the DGCA and the National Transportation Safety

145.221 Reports of failures, malfunctions, or defects

(a) A certificated AMO must report to the DGCA within 96 hours after
it discovers any failure, malfunction, or defect of an article. The report
must be in a format acceptable to the DGCA.

(b) The report required under paragraph (a) of this section must include
as much of the following information as is available:

(1) Aircraft registration number;


(2) Type, make, and model of the article;
(3) Date of the discovery of the failure, malfunction, or defect;
(4) Nature of the failure, malfunction, or defect;
(5) Time since last overhaul, if applicable;
(6) Apparent cause of the failure, malfunction, or defect; and
(7) Other pertinent information that is necessary for more complete
identification, determination of seriousness, or corrective action.

(c) The holder of an AMO certificate that is also the holder of a CASR
Part 121 or 135 certificate; type certificate (including a
supplemental type certificate); parts manufacturer approval; or
technical standard order authorization, or that is the licensee of a
type certificate holder, does not need to report a failure,
malfunction, or defect under this section if the failure, malfunction,
or defect has been reported under CASR Part 21, 121 or 135.

(d) A certificated AMO may submit a Service Difficulty Report for the
following:

(1) A CASR Part 121 certificate holder under Part 121, provided
the report meets the requirements of Part 121, as appropriate.
(2) A CASR Part 135 certificate holder under Part 135, provided
the report meets the requirements of Part 135, as appropriate.

(e) A certificated AMO authorized to report a failure, malfunction, or
defect under paragraph (d) of this section must not report the
same failure, malfunction, or defect under paragraph (a) of this

this section must be forwarded to the certificate holder.

145.223 DGCA inspections

(a) A certificated AMO must allow the DGCA to inspect that AMO at
any time to determine compliance with the CASRs.

(b) A certificated AMO may not contract for the performance of a


maintenance function on an article with a non-certificated person
unless it provides in its contract with the non-certificated person that
the DGCA may make an inspection and observe the performance of
the non-certificated person's work on the article.

(c) A certificated AMO may not return to service any article on which a
maintenance function was performed by a non-certificated person if
the non-certificated person does not permit the DGCA to make the
inspection described in paragraph (b) of this section.

145.233 Recognition Requirements


DGCA may, upon application, issue a recognized of the foreign Approved
Maintenance Organization (AMO) certificate issued by an ICAO
Contracting State provided the applicant:

(a) Complies with the requirements of this part


(b) has an Approved Maintenance Organization (AMO) Certificate
issued by the origin Civil Aviation Authority
(c) has a letter of intent from the Indonesian costumers requesting
maintenance service

145.235 Scope and Limitation

DGCA may accept, in whole or in part, a recognized of the foreign

Within 30 working days after completing the application package, the


DGCA will issue the recognition certificate to the foreign Approved

APPENDIX A – HAZARDOUS MATERIALS

1. Purpose, scope and applicability

a. Purpose.
This Appendix prescribes requirements for training hazmat
employees.

b. Scope.
Training as used in this Appendix means a systematic program
that ensures a hazmat employee is able to recognize and identify
hazardous materials, has knowledge of specific requirements
applicable to functions performed by the employee, and has
knowledge of emergency response information, self-protection
measures and accident prevention methods and procedures.

2. Definitions

For the purposes of this Appendix, the following definitions apply:


Hazardous Material means,

A substance or material that is capable of posing an


unreasonable risk to health, safety, and property when
transported in commerce. The term includes hazardous
substances, hazardous wastes, marine pollutants, elevated
temperature materials, materials designated as hazardous, and
materials that meet the defining criteria for hazard classes and
divisions in accordance the International Civil Aviation
Organizations (ICAO) Technical Instructions.

Hazmat Employee means,

a. A person who is:

(1) Employed on a full-time, part time, or temporary basis by a


hazmat employer and who in the course of such full time, part
time or temporary employment directly affects hazardous
materials transportation safety;

(2) Self-employed (including an owner-operator of a motor vehicle,


vessel, or aircraft) transporting hazardous materials in commerce
who in the course of such self-employment directly affects
hazardous materials transportation safety.

b. This term includes an individual, employed on a full time, part time,
or temporary basis by a hazmat employer, or who is self-employed,

maintains, reconditions, repairs, or tests a package, container or
packaging component that is represented, marked, certified, or
sold as qualified for use in transporting hazardous material in
commerce;
(3) Prepares hazardous materials for transportation;
(4) Is responsible for safety of transporting hazardous materials;
(5) Operates a vehicle used to transport hazardous materials.

Hazmat Employer means,

a. A person who employs or uses at least one hazmat employee on a

1.1 Management commitment and responsibility


The AMO shall define its safety policy in accordance with international and national
requirements. The safety policy shall:
a. reflect organizational commitment regarding safety;
b. include a clear statement about the provision of the necessary resources for
the implementation of the safety policy;
c. include safety reporting procedures;
d. clearly indicate which types of behaviors are unacceptable related to the
AMO’s aviation activities and include the circumstances under which
disciplinary action would not apply;
e. be signed by the accountable executive of the organization;
f. be communicated, with visible endorsement, throughout the organization; and
g. be periodically reviewed to ensure it remains relevant and appropriate to the
AMO.

1.2 Safety accountabilities

The AMO shall:


a) identify the accountable executive who, irrespective of other
functions, has ultimate responsibility and accountability, on behalf of

b) clearly define lines of safety accountability throughout the
organization, including a direct accountability for safety on the part of
senior management;
c) identify the accountabilities of all members of management,
irrespective of other functions, as well as of employees, with respect
to the safety performance of the SMS;
d) document and communicate safety responsibilities,
accountabilities and authorities throughout the organization; and
e) define the levels of management with authority to make decisions
regarding safety risk tolerability.

2.1 Hazard identification

The AMO shall develop and maintain a process that ensures that
hazards associated with its aviation products or services are
identified.
Hazard identification shall be based on a combination of reactive,
proactive and predictive methods of safety data collection.
2.2 Safety risk assessment and mitigation
The AMO shall develop and maintain a process that ensures
analysis, assessment and control of the safety risks associated with
identified hazards.

3. Safety assurance

3.1 Safety performance monitoring and measurement


The AMO shall develop and maintain the means to verify the safety

SMS.
3.2 The management of change
The AMO shall develop and maintain a process to identify changes
which may affect the level of safety risk associated with its aviation
products or services and to identify and manage the safety risks that
may arise from those changes.
3.3 Continuous improvement of the SMS
The AMO shall monitor and assess the effectiveness of its SMS
processes to enable continuous improvement of the overall

4. Safety promotion

4.1 Training and education


The AMO shall develop and maintain a safety training programme

The AMO shall develop and maintain a formal means for safety
communication that:
a) ensures personnel are aware of the SMS to a degree
commensurate with their positions;
b) conveys safety-critical information;
c) explains why particular safety actions are taken; and
d) explains why safety procedures are introduced or changed.

43.1 Applicability.

(a) Except as provided in paragraph (b) of this section, this part

(1) Aircraft having an Indonesian airworthiness certificate;
(2) Foreign−registered civil aircraft used under the provisions of
part 121 or 135; and
(3) Airframe, aircraft engines, propellers, appliances, and
component parts of such aircraft.

(b) This part does not apply to any aircraft for which an experimental
airworthiness certificate has been issued, unless a different kind
of airworthiness certificate had previously been issued for that
aircraft.

43.2 Records of overhaul and rebuilding.
(a) No person may describe in any required maintenance entry or
form an aircraft, airframe, aircraft engine, propeller, appliance, or
component part as being overhauled unless.
(1) Using methods, techniques, and practices acceptable to the
DGCA, it has been disassembled, cleaned, inspected, repaired as
necessary, and reassembled; and
(2) It has been tested in accordance with approved standards and
technical data, or in accordance with current standards and
technical data acceptable to the DGCA, which have been
developed and documented by the holder of the type certificate,
supplemental type certificate, or a material, part, process, or
appliance approval under part 21 section 21.305.

(b) No person may describe in any required maintenance entry or
form an aircraft, airframe, aircraft engine, propeller, appliance, or
component part as being rebuilt unless it has been disassembled,
cleaned, inspected, repaired as necessary, reassembled, and tested
to the same tolerances and limits as a new item, using either new
part tolerances and limits or to approved oversized or undersized
dimensions.

43.3 Persons authorized to perform maintenance, preventive
maintenance, rebuilding, and alterations.

(a) Except as provided in this section, no person or no organization


may maintain, rebuild, alter, or per-form preventive maintenance
on an aircraft, airframe, aircraft engine, propeller, appliance, or
component part to which this part applies. Those items, the
performance of which is a major alteration, a major repair or
preventive maintenance are listed in Appendix A.

(b) The holder of an aircraft maintenance engineer license may


perform maintenance, preventive main-tenance, and alterations as
provide in part 65.

(c) A person working under the supervision of a holder of an aircraft
maintenance engineer license may perform the maintenance,
preventive maintenance, and alterations that his supervisor is
authorized to per-form, if the supervisor personally observes the work
being done to the extent necessary to ensure that it is being done
properly and if the supervisor is readily available, in person, for
consultation. However, this paragraph does not authorize the
performance of any inspection required by part 91 or any inspection
per-formed after a major repair or alteration.

(d) The holder of an approved maintenance organization certificate


may perform maintenance, preven-tive maintenance, and alterations
as provided in part 145.

(e) The holder of an air operator certificate issued under part 121 or
135, may perform maintenance, preventive maintenance, and
alterations as provided in part 121 or 135.

(f) A manufacturer may−


(1) Rebuild or alter any aircraft, aircraft engine, propeller, or
appliance manufactured by him under a type or production
certificate;
(2) Rebuild or alter any appliance or part of aircraft, aircraft
engines, propellers, or appliances manufac-tured by him under a
Technical Standard Order (TSO) authorization, a Parts
Manufacturer Approval (PMA), or product and process
specification issued by the DGCA; and
(3) Perform any inspection required by part 91 on aircraft it
manufactures while currently operating un-der a production
certificate or under a currently approved production inspection
system for such aircraft.

43.5 Approval for return to service after maintenance, preventive
maintenance, rebuilding, or alteration.

No person may approve for return to service any aircraft, airframe,


aircraft engine, propeller, or appliance, that has undergone
maintenance, preventive maintenance, rebuilding, or alteration
unless−
(a) The maintenance record entry required by section 43.9 or section
43.11, as appropriate, has been made;
(b) The repair or alteration form authorized by or furnished by the
DGCA has been executed in a manner prescribed by the DGCA;
and
(c) If a repair or an alteration results in any change in the aircraft
operating limitations or flight data contained in the approved
aircraft flight manual, those operating limitations or flight data are
appropriately re-vised, approved and set forth as prescribed in
part 91 section 91.9.

43.7 Persons authorized to approve aircraft, airframes, aircraft
engines, propellers, appliances, or component parts for return to
service after maintenance, preventive maintenance, rebuilding,
or alteration.

(a) Except as provided in this section, no person, other than the


DGCA, may approve an aircraft, air-frame, aircraft engine,
propeller, appliance, or component part for return to service after it
has undergone maintenance, preventive maintenance, rebuilding,
or alteration.
(b) The holder of an aircraft maintenance engineer license may
approve an aircraft, airframe, aircraft engine, propeller, appliance,
or component part for return to service as provided in part 65.
(c) The holder of an approved maintenance organization
certificate may approve an aircraft, airframe, aircraft engine,
propeller, appliance, or component part for return to service as
provided in part 145.

(d) A manufacturer may approve for return to service any
aircraft, airframe, aircraft engine, propeller, appliance, or
component part which that manufacturer has worked on under
section 43.3 (f). However, except for minor alterations, the work must
have been done in accordance with technical data approved by the
DGCA.

(e) The holder of an air operator certificate issued under part 121
or 135, may approve an aircraft, air-frame, aircraft engine, propeller,
appliance, or component part for return to service as provided in part
121 or 135 as applicable.

43.9 Content, form, and disposition of maintenance, preventive maintenance, rebuilding,
and alteration records (except inspections performed in accordance with part 91 and 135
sections 135.367(b)(1).)

(a) Maintenance record entries. Except as provided in paragraphs (b) and (c) of this section,
each per-son who maintains, performs preventive maintenance, rebuilds, or alters an aircraft,
airframe, aircraft engine, propeller, appliance, or component part shall enter the following into
the maintenance record of that equipment:
(1) A description (or reference to data acceptable to the DGCA) of work performed.
(2) The date of completion of the work performed.

(3) The name of the person performing the work if other than the person specified in
paragraph (a)(4) of this section.

(4) If the work performed on the aircraft, airframe, aircraft engine, propeller, appliance, or
component part has been performed satisfactorily, the signature, license number,
and category of license held by the person approving the work. The
signature constitutes the approval for return to service only for the work
performed.
In addition to the entry required by this paragraph, major repairs and major
alterations shall be entered on a form, and the form disposed of, in the manner
prescribed in Appendix B, by the person performing the work.

(b) Each holder of an air operator certificate issued under part 121 or 135, that is required by
its ap-proved operations specifications to provide for continuous airworthiness maintenance
program, shall make craft engines, propellers, appliances, or component parts which it
operates in accordance with the applicable provisions of part 121 or 135, as appropriate.
(c) This section does not apply to persons performing inspections in accordance with part 91
or 135 sections 135.367(b)(1).

43.12 Maintenance records: Falsification, reproduction, alteration and retention.

(a) No person may make or cause to be made:


(1) Any fraudulent or intentionally false entry in any record or report that is required to
be made, kept, or used to show compliance with any requirement under this part;
(2) Any reproduction, for fraudulent purpose, of any record or report under this part; or
(3) Any alteration, for fraudulent purpose, of any record or report under this part.

(b) The commission by any person of an act prohibited under paragraph (a) of this section is
a basis for suspending or revoking the applicable license, operator, or production certificate,
Technical Standard Order Authorization, part Manufacturer Approval, or Product and
Process Specification issued by the DGCA and held by that person.

(c) The maintenance records shall be retained for a minimum period of 90 days after the unit
to which they refer has been permanently withdrawn from service.

APPENDIX A TO CASR 43 − MAJOR ALTERATIONS, MAJOR REPAIRS, AND PREVENTIVE
MAINTENANCE
(a) Major alterations.
(1) Airframe major alterations. Alterations of the following parts and alterations of the following
types, when not listed in the aircraft specifications issued by the Authority, are airframe major
alterations:
(i) wings; (ii) tail surfaces; (iii) fuselage; (iv) engine mounts; (v) control system; (vi) landing
gear; (vii) hull or floats;
(viii) elements of an airframe including spars, ribs, fittings, shock absorbers, bracing, cowling,
fairings, and balance weights; (ix) hydraulic and electrical actuating system of components;
(x) rotor blades; (xi) changes to the empty weight or empty balance which result in an
increase in the maximum certificated weight or center of gravity limits of the aircraft;
(xii) changes to the basic design of the fuel, oil, cooling, heating, cabin pressurization,
electrical, hydraulic, deicing, or exhaust systems; and,
(xiii) changes to the wing or to fixed or movable control surfaces which affect flutter and
vibration characteristics.

(2) Powerplant major alterations. The following alterations of the powerplant when not listed in
the engine specifications issued by the Authority, are powerplant major alterations:

(i) conversion of an aircraft engine from one approved model to another, involving any
changes in compression ratio, propeller reduction gear, impeller gear ratios or the
substitution of major engine parts which requires extensive rework and testing of the
engine;
(ii) changes to the engine by replacing aircraft engine structural parts with parts not
supplied by the original manufacturer or parts not specifically approved by the DGCA;
(iii) installation of an accessory which is not approved for the engine;
(iv) removal of accessories that are listed as required equipment on the aircraft or engine
specification;
(v) installation of structural parts other than the type of parts approved for the installation;
and,
(vi) conversions of any sort for the purpose of using fuel of a rating or grade other than that
listed in the engine specifications.

(3) Propeller major alterations. The following alterations of a propeller when not
authorized in the propeller specifications issued by the Authority are propeller major
alterations:
(i) changes in blade design;
(ii) changes in hub design;
(iii) changes in the governor or control design;
(iv) installation of a propeller governor or feathering system;
(v) installation of propeller deicing system; and,
(vi) installation of parts not approved for the propeller.
(4) Appliance major alterations.

SUBPART A – GENERAL

65.1 Applicability

This part prescribes the requirements for issuing the following


certificates, licenses and associated ratings and the general
operating rules for the holders of those certificate, license and
associated ratings:
(a) Basic certificate
(b) Aircraft Maintenance Engineer License
(c) Certificate of maintenance approval
(d) Certificate of validation

65.3 Definitions

(a) Aircraft rating. An authorization entered on or associated with a


license and forming part thereof, stating special conditions,
privileges or limitations pertaining to such license.
(b) Aircraft type rating. An aircraft rating for a specified individual
aircraft.
(c) Approved for return to service. Applies to the person who has
performed maintenance or maintenance preventive in accordance
with Part 43, including the requirement to record the work.
(d) Basic certificate. Certificate issued by Director General to
persons who has demonstrated an acceptable degree of
competency.
(e) Competency. A combination of skills, knowledge and attitudes
required to perform a task to the prescribed standard.

f) Human factor. Human capabilities
(h) License. The means by which DGCA authorizes a license holder to
perform specific activities which, unless performed properly, could jeopardize
the safety of aviation. The license provides evidence that the DGCA is
satisfied that the holder has demonstrated an internationally acceptable
degree of competency.

(i) License category. Classification of license according to specified basic


qualifications, include airframe, engine and avionic.
(m)Psychoactive substances. Alcohol, opioids, cannabinoids, sedatives
and hypnotics, cocaine, other psychostimulants, hallucinogens, and volatile
solvents, whereas coffee and tobacco are excluded.

65.5 Aircraft Groups

For the purpose of ratings on aircraft maintenance engineer license,


aircraft shall be classified in the following groups:
(a) Group 1: complex turbine-powered aircraft as well as multiple engine
helicopters, pressurized airplanes, aircraft equipped with fly-by-wire
systems and other aircraft requiring an aircraft type rating when
defined so by the DGCA.
(b) Group 2: aircraft other than those in Group 1 belonging to the
following subgroups:
(1) sub-group 2a: single turbo-propeller engine airplanes;
(2) sub-group 2b: single turbine engine helicopters;
(3) sub-group 2c: single piston engine helicopters.
(c) Group 3: piston engine airplanes other than those in Group 1 and 2.

65.7 Application and Issue

(a) Each applicant for the grant of a license or certificate under


this subpart must be made on a form and in a manner as
prescribed by Director and submit it to the Director General Civil
Aviation with a payment of the appropriate application fee
prescribed by regulations made under the Act.

(b) Each applicant who meets the requirements of this part


entitled to an appropriate certificate and license.

(c) Unless the order of revocation is provided, a person whose


Aircraft Maintenance Engineer License is revoked may not apply
license for 1 year after the date of revocation.

65.9 Use of Psychoactive Substances
(a) The holder of licenses or certificate provided under this part shall
not exercise the privileges of their license or certificate while
under the influence of any psychoactive substance which might
be render them unable to safely and properly exercise these
privileges.
(b) The holder of licenses or certificates provided under this part
shall not engage in any problematic use of substance.

65.11 Test: General Procedure

(a) Tests prescribed by or under this Part are given at times and
locations, and by persons, designated by the Director General.

(b) The minimum-passing grade for each test is 70 percent.

(c) An applicant for a written, oral or practical test for a license or


certificate, or for an additional rating under this Part, may apply
for re-test not less than 30 days after the date the applicant failed
the test.

65.13 Written Test: Cheating or Other Unauthorized Conduct

(a) Except as authorized by the Director General, no person may:

(1) Copy, or intentionally remove an examination paper, or any


portion of an examination paper, which is intended for use under
this Part;
(2) Give to or receive from another person any part or copy of an
examination;
(3) Give help on an examination to, or receive help on an
examination from, any person during the period that examination
is being given;

(4) Take any part of an examination on behalf of another person;
(5) Use any unauthorized material or aid during the period that
examination is being given; or
(6) Intentionally cause, assist, or participate in any act prohibited
by this paragraph.

(b) No person who commits an act prohibited by paragraph (a) of this


section is eligible for any License or certificate rating under this Part
for a period of 1 year after the date of the act. In addition, the
commission of that act is a basis for suspending or revoking any
License or certificate and rating held by that person.

SUBPART C – AIRCRAFT MAINTENANCE ENGINEER LICENSE

65.51 Eligibility Requirement: General

A license and associated category may be issued to a person who


meets the following requirements:

(a) Is not less than 21 years of age;


(b) Is able to read, write, speak and understand the technical
English as used in manufacturers manuals;
(c) Has passed the oral and practical test within the period 24
months specified in section 65.55; and
(d) Hold appropriate basic certificate which is currently effective
and has been in effect for a total of at least 18 months.

65.53 Category

(a) The following license category are issued under this Subpart:
(1) Category A - Airframes and Engines;
(2) Category C – Avionic.

(b) The Category A are subdivided into subcategories relatives to


combinations of basic certificate category airplane, helicopter, turbine
and pistons engine. The subcategories are:
(1) A1.3 : Airframe, airplane (A1) and piston engine (A3);
(2) A1.4 : Airframe, airplane (A1) and turbine engine (A4);
(3) A2.3 : Airframe, helicopter (A2) and piston engine (A3); and
(4) A2.4 : Airframe, helicopter (A2) and turbine engine (A4).
(c) After December, 31st 2017, The Category C has only one
category that included basic certificate category radio (C1),
instrument (C2), and electrical (C4).

65.55 Skill Requirements

Each applicant for a license or category must pass an oral and a


practical test on the category or rating he/she seeks. The tests cover
the applicant's basic skill in performing practical projects on the
subjects covered by the written test for that category or rating.

65.57 General Privileges and Limitations
(a) The holder of a category A aircraft maintenance engineer
license may perform or supervise the maintenance, preventive
maintenance or alteration, and approved for return it to service
(excluding major repairs and major alterations) of:
(1) an aircraft structure, powerplants, and mechanical and
electrical system;
(2) avionic system requiring only simple test to prove their
serviceability and not requiring a troubleshooting;

(b) The holder of a category C aircraft maintenance engineer


license may perform or supervise the maintenance, preventive
maintenance or alteration, and approved for return it to service
(but excluding major repairs and major alterations) of:
(1) an avionic and electrical system;
(2) an electrical and avionics tasks within powerplant and
mechanical systems, requiring only simple tests to prove their

(c) Unless as specified in section 65.59(c) of this part, the holder of an
aircraft maintenance engineer license may not exercise the approval for
return to service privileges of his license on specific aircraft type unless
his/her license endorsed with the relevant aircraft rating prescribed by
section 65.61.

(d) The holder of an aircraft maintenance engineer license may not


exercise the privileges of his license unless he understands the current
instructions of the manufacturer, and the maintenance manuals, for the
specific operation concerned.

(e) The holder of an aircraft maintenance engineer license may not exercise
the approval and return to service privileges of his license on specific aircraft
type unless within preceding 24 months, he conducts recurrent aircraft
type training, or for at least 6 months:

(1) Serve as engineer under his privileges of the license or rating; or


(2) Technically supervised other engineer; or
(3) Supervised, in an executive capacity, the maintenance or alteration
of aircraft; or
(4) Been engaged in any combination of subparagraph (e)(1), (2), or (3).

65.59 Additional Privileges
(a) The holder of an aircraft maintenance engineer license Category A
with particular aircraft rating may sign maintenance release or aircraft
log entry in accordance with CASR 121.709 or CASR 135.709.

(b) The holder of an aircraft maintenance engineer license Category A


with particular aircraft rating may perform the annual and 100-hour
inspection required by CASR part 91 on an aircraft, or any related part
or appliance, and approve for return it to service.

(c) The holder of an aircraft maintenance engineer license Category A


may sign maintenance release or aircraft log entry in accordance with
CASR 121.709 or CASR 135.709 following minor scheduled line
maintenance and simple defect rectification within the limits of tasks
specially authorized by certificate holder issued under CASR part 121
and 135, and shall be restricted to work that the license holder has
personally performed in the organization that issued the authorization.

65.63 Validity of Aircraft Maintenance Engineer License

(a) Unless it is revoked, suspended or cancelled by the Director


General, an aircraft maintenance engineer license shall remain
valid for the period specified in the document and such period
shall not exceed 3 years from the date of issue or previous
renewal of the document.

(b) The holder of aircraft maintenance engineer license issued under


this part that is suspended, revoked, or no longer valid shall
return it to the Director General.

65.65 Renewal of Aircraft Maintenance Engineer License

(a) Upon application to the Director General, and showing compliance


with this section, the period of validity of aircraft maintenance
engineer licenses may be renewed for a further period not
exceeding 3 years.
(b) To be eligible for renewal of an aircraft maintenance engineer
license, an applicant must present evidence to the DGCA to show
completion of the recurrent human factor training and one of the
following activities within preceding 24 months:
(1) Performed at least one annual inspection or 100-hour inspection
required by CASR part 91 on an aircraft and approve and return it
to service, for which he is rated; or
(2) At least 6 months, perform or supervise the maintenance,
preventive maintenance or alteration, and approved and return it to
service, for which is rated, under CASR part 121, 135 and 145.

(c) An aircraft maintenance license holder who does not complete one
of the activities set forth in paragraph (b) of this section within
preceding 24 months, may be eligible for renewal after passing a
written test from the DGCA to determine that the applicant's
knowledge of the applicable regulations and standards are current.

SUBPART D – CERTIFICATE OF MAINTENANCE APPROVAL

65.71 Eligibility Requirement:

General A certificate of maintenance approval may be issued to a


person who meets the following requirements:

(a) Is not less than 20 years of age;

(b) Is able to read, write, speak and understand the technical English
as used in manufacturers manuals;

(c) Has specially qualified in accordance with section 65.73 of this part,
to perform maintenance on aircraft or component thereof,
appropriate to the job for which he is employed;

(d) Is employed for specific job requiring those special qualifications
by approved maintenance organizations issued under CASR part
145, or by certificate holder issued under CASR part 121, and
135, to provide continuous airworthiness maintenance program
according to its maintenance manual;

(e) Is recommended for certification by his employer, to the


satisfaction of the DGCA, as able to satisfactorily maintain the
aircraft or components, appropriate to the job for which he is
employed.

65.73 Personnel Qualification

(a) Unless as specified by paragraph (b) of this section, each


applicant for a certificate of maintenance approval must:

(1) satisfactory completion of the training that is specifically


designed to qualify the applicant for the job on which the
applicant is to be employed, conducted by aircraft
maintenance training organization certificated under CASR
147 or manufacturer; and

(2) present the documentary evidence, satisfactory to the


DGCA, of at least 6 (six)months of practical experience on the
type of aircraft or component thereof for which is specially
designed to quality the applicant for the job on which the
applicant is to be employed.

(b) The aircraft certificate of maintenance approval may also be
issued to person who meets the following requirements:

(1) has satisfactory completion of the training that is specifically


designed to qualify the applicant for the job on which the
applicant is to be employed, conducted by the holder of
certificate issued under CASR parts 121, 135, and 145, in
accordance with their approved training program; and

(2) present the documentary evidence, satisfactory to the DGCA,


of at least 12(twelve) months of practical experience on the
type of aircraft or component thereof for which is specially
designed to quality the applicant for the job on which the
applicant is to be employed.

PART 39 AIRWORTHINESS DIRECTIVES

39.1 Purpose of this regulation


The regulations in this part provide a legal framework for DGCA
system of Airworthiness Directives.

39.2 Definition
a. DGCA airworthiness directives are legally enforceable rules
that apply to the following products: aircraft, aircraft engines,
propellers, and appliances.
b. An unsafe condition will exist when:
(1). Evidence is found during the evaluation of failures,
malfunctions, defects, service difficulties or further analysis or
test, that the design does not comply with the applicable
airworthiness requirements and this noncompliance reduces
the safety level required for that product,
(2). Evidence is found during the evaluation of failures,
malfunctions, defects, service difficulties or further analysis or
test that the design although complying with the airworthiness
requirements exhibits characteristics that reduce the safety
level required for that product.

39.5 Issuance of airworthiness directive

DGCA issues an airworthiness directive addressing a product when we


find that an unsafe condition exists in the product and the condition is
likely to exist or develop in other products of the same type design.
DGCA may issue an airworthiness directive based on:
a. Airworthiness directive issued by DGCA on a product where
Republic of Indonesia as the State of Design.
b. Airworthiness directives issued by foreign airworthiness authorities
as the State of Design on a product being operated under
Indonesian registration, will be adopted without further technical
investigation. However DGCA may add additional information by
communicating with the State of Design or the State of Manufacture
regarding continuing airworthiness information due to local
operation. The compliance time may be reconsidered, taking into
account domestic concerns.

c. When an unsafe condition exists and the State of Design has not
issued mandatory corrective information, an airworthiness directive
will be issued to correct that unsafe condition. Every effort shall be
made to reach a common position with the State of Design.

39.7 Compliance with airworthiness directives

No person may operate a product to which an airworthiness directive


Applies.

39.11 Actions required by airworthiness directives.

Actions required by airworthiness directives shall:


a. Specify inspections to be carried out;
b. Specify conditions and limitations must comply with;
c. Resolve an unsafe condition.

39.14 Variation to the compliance requirements

An alternate method of compliance with the requirements of an


airworthiness directive or adjustments to the compliance times specified
in an airworthiness directive, may be approved by the DGCA,provided:

The applicant provides the DGCA with acceptable substantiation to


ensure a level of safety equivalent to that provided by the airworthiness
directive.

39.15 Airworthiness directive application

a. An Airworthiness directive applies to each product identified in the


airworthiness directive, even if an individual product has been
changed by modifying, altering, or repairing it in the area addressed
by the airworthiness directive.

b. DGCA approval of an alternative method of compliance is required if


a change of product affect the ability to accomplish the actions
required by airworthiness directive. Unless it can be shown that the
change has eliminated the unsafe condition, the request should
include the specific actions proposed to address the unsafe
condition.

39.29 Compliance Records.

Compliance with an airworthiness directive shall be recorded in


appropriate aircraft, aircraft engine, or propeller logbooks. The log
entry shall refer to the airworthiness directive by number and date of
compliance.

THE MMEL AND THE MEL
Definitions

>> MMEL

The Airbus MMEL is a dispatch document that is produced by the


aircraft manufacturer and approved by the certification authorities.
The MMEL is used as a reference by the Operators to create their
own MEL, which will permit the dispatch and operation of an aircraft
with one or more inoperative equipment or unavailable system
function while maintaining an acceptable level of safety.

>> MEL

The MEL is a dispatch document developed by the Operator based


on the aircraft manufacturer’s MMEL. The MEL must be as restrictive
as or more restrictive than the MMEL and must be approved by the
Operator’s national airworthiness authorities. The MEL permits the
Operator to assess the impact on their operations (flight schedule,
route, environmental conditions,...) while operating an aircraft with
systems, functions or components inoperative, thus, to optimize
aircraft dispatch reliability and profitability without impairing safety.

How is the MMEL developed ?
The MMEL provides a list of items with associated conditions for
dispatch. For every item, Airbus must demonstrate that the
associated dispatch conditions are compliant with the certification
requirements as specified by EASA. The major steps of this
demonstration are the following:
Step 1: Assessment of the MMEL item to identify any operational
impact or impact on other system functions, and check if there is
any influence on the safety level of the aircraft.

Step 2: Identification and assessment of the operational and


safety impact of the next critical aircraft system failure which
may occur during subsequent flights.

Step 3: Definition of any maintenance actions or operational
procedures that may be necessary as a means of mitigation for
the assessed impacts of the MMEL item. Based on the above
assessments, a dispatch status is defined for each MMEL item
as either:
-“GO” when the dispatch is permitted for a limited period of time
without specific dispatch condition, or
-“GO IF” when the dispatch is permitted for a limited period of
time with specific dispatch conditions, or
-“NO GO” when the dispatch is not permitted and corrective
maintenance action must be undertaken before the aircraft can
continue operations.

How is the MEL developed ?

The Operator’s MEL is a dispatch document which should be tailored


according to the Operator’s routes, procedures and applicable local
regulations, and within the constraints defined by the aircraft
manufacturer’s MMEL.

When does the MEL apply ?

As per regulations, when there are failures or defects that cannot be


rectified, and which are covered by an MEL item, the MEL must be
applied prior to departure and accepted the Captain. The “departure”
corresponds to the “commencement of the flight”.

“The commencement of the flight” is defined as the moment when the


aircraft starts to move under its own power for the purpose of takeoff
(i.e. the taxi phase).EASA and FAA require Operators to define
procedures in their MEL for the management of any failure that
occurs during the taxi-out phase.

MINIMUN EQUIPMENT LIST (MEL) as required by CASR Part 121.628 and is
a guidance for dispatching an aircraft in such condition with inoperable
instruments or equipment within acceptable safety level be maintained by
appropriate design redundancies, procedures and limitations.

This MEL is issued by authority of the DFO and administrated by manual


and documentation unit. This MEL has been compiled to assist Pilot In
Command and Licensed Aircraft Maintenance Engineer on duty in deciding
weather to dispatch or not, an aircraft with an inoperative, system items or
missing part, aircraft may be dispatch within allowable standard
airworthiness requirement.

The Civil Aviation Safety Regulations ( CASR ) 121 require all equipment
installed on an aircraft in compliance with the Airworthiness Standards and
the Operating Rules must be operative.

This MEL must be deviate from the Aircraft Flight Manual Limitations,
Emergency Procedures or with Airworthiness Directives.
It is important to remember that all equipment related to the airworthiness
and the operating regulations of the aircraft list on MEL must be operative.

If dispatch within the limitations of the MEL is not possible, consult


Maintenance Control Center ( MCC ) or Chief Pilot to obtain dispatch
authorization for conditions, limitations and procedures.

rectified at or before the expiration of the repair interval that is
established by the following letter designators given in the "Repair
Interval" column.
Repair Interval A : No standard interval is specified, however,
items in this category shall be rectified in accordance with the
dispatch conditions stated in the MEL.
Where a time period is specified in calendar days, it shall start at
00:01 on the calendar day following the day of discovery.
Where a time period is specified in number of flights or flight
hours, it shall start at the beginning of the first flight following the
discovery of the failure.

Repair Interval B : Items in this category shall be rectified within
three (3) consecutive calendar days, excluding the day of discovery.
For example, if it were recorded at 13:00 on January 26th, the 3-day
interval begins at 00:01 on January 27th and ends at 23:59 on
January 29th.
Repair Interval C : Items in this category shall be rectified within ten
(10) consecutive calendar days, excluding the day of discovery.
For example, if it were recorded at 13:00 on January 26th, the 10-day
interval begins at 00:01 on January 27th and ends at 23:59 on
February 5th.
Repair Interval D : Items in this category shall be rectified within one
hundred and twenty (120) consecutive calendar days, excluding the
day of discovery.

REPAIR INTERVAL

Each dispatch condition has an associated repair interval. The preamble of


this MMEL defines the repair interval categories. Refer to MI-00-05 Repair
Interval.

A dash symbol replaces the repair interval in the following cases:


For dispatch conditions that refer to another manual (Weight and Balance,
CDL…). The MMEL is not the appropriate manual for this dispatch
condition.

For dispatch conditions that refer to one or more item(s) for which there
are several dispatch conditions with different repair intervals. In this case,
the initial repair interval is left with a dash symbol as it will be driven by the
repair interval of the referred MMEL item dispatch condition(s).

For NO-GO items.

CDL
Configuration Deviation List

Operation of the aircraft without certain secondary airframe and engine


parts is possible as indicated in Configuration Deviation List.

Any part not included in this list must be considered as necessary. It is


important to repair the aircraft at the first airport where repairs or
replacements may reasonably be made, since additional malfunctions may
require the airplane to be taken out of service.

Letter (m) associated to an item indicates that maintenance action is


necessary to permit flight with these parts missing

It is the Operator's responsibility to:


➢ Define the task sharing between the flight and maintenance crews
➢ Ensure that all maintenance procedures are performed

When items require high-speed tape, the MCDL dispatch conditions are
assessed considering that the tape is in the correct position and in good
condition. The Operator must use an appropriate process to ensure that the
dispatch conditions are satisfied. The Operator must define this process in
accordance with its specific operations.

Note:
Unless otherwise specified in the MCDL item or the relevant AMM task, a
visual inspection of the high-speed tape must be made at a regular interval
that must not exceed 3 calendar days.
