Red Notice in relation to Extradition

An International Police Commission (Interpol) Red Notice is an


instrument akin to an international arrest warrant issued upon persons
who are wanted for a crime. A notice is circulated upon member
countries who are duty-bound to report the location of the persons
under the list in order to notify the country who sought the listing. 1 The
Interpol is the world’s largest police organization, there being 195
member countries, including the Philippines where we became a
member on June 12, 1952. A National Central Bureau (NCB) is located
in every member country which serves as a link with the global network.
The NCB in the Philippines is located in Manila. 2

Upon request by the Secretary General in Lyon, France, a red


notice is issued to the members of Interpol. The Red Notice contains
pertinent description of the party in question, as well as the necessary
details which may also depend upon the extradition treaties. 3 A Red
Notice, before issued, must be checked first by competent members of
the Interpol or a specialized task force created for such purpose. 4
The
effect of a Red Notice is to request law enforcement in that area to
provisionally arrest the person in the listing pending other legal actions.

Red Notice in relation to Extradition

In relation to extradition, the Red Notice serves as an effective


mechanism to capture the accused who has fled the country in order to
avoid prosecution, especially in countries where there are no
extradition treaties existing. Under pacta sunt servanda, member-
countries are duty-bound to comply with their obligations under the
Interpol and must apply the necessary actions such as provisional
arrest pending appropriate legal remedies. Red Notice serves as an
effective remedy in those countries who do not have an existing
extradition treaty, and is in need of a much speedy remedy against
fugitives. Hence, member-countries can find recourse in the Interpol via
Red Notice in order to aid extradition proceedings.
