DEMAND LETTER TO COMPLY


WITH JOINT AFFIDAVIT OF UNDERTAKING

Sir:
Please be informed that on August 26, 2022, complainant XXXXX went to
the our office and manifested that you have not been faithfully complying with
your Joint Affidavit of Undertaking dated __________. Note that you have
committed that you will also give your share on the extraordinary and occasional
expenses with respect to the needs of your children, such as medical/hospital
expenses, academic/school/tuition and other fees, among others. Further, you have
also agreed that the amount of P5,000.00 as agreed upon in the said undertaking is
not final and can increase/decrease/modified depending on your financial capacity
and the respective needs of your children. Such status shall be properly
communicated with the other party. However, you have failed and continues to fail
to comply with the provisions of the said undertaking considering that at present,
both of your children are of school age and that their respective needs have
changed. Additionally, you have blocked complainant from all possible avenues of
communication which is detrimental to the best interest of your children.

Please be reminded that you have undertaken to provide financial support for
your minor children, communicate the status of your employment with the
complainant, and that you will provide additional support for extraordinary
expenses of your children.

Please be reminded that failure to provide the support deprives the right of
your child to basic needs including education, health, and other incidental expenses
under R.A. 7610 (Anti-Child Abuse Act of 1992).

Furthermore, deliberate refusal when your means permit you to do so to give


financial support of a minor child may give rise to a CRIMINAL LIABILITY for
violation of R.A. 9262 (Anti- Violence Against Women and Children Act of 2004),
such cases are necessary to protect her interest and the best interest of your minor
children.

Therefore, kindly coordinate with the complainant XXXXXX with respect


to financial support of your children and how to regularly comply with the same.
Otherwise, complainant will have no other choice but to resort to other legal
remedies, such as filing of case in proper Courts and lodging the same
complaints with other administrative agencies.
