Reference: Memorandum from JCSUPT SIMEON S DOLOJO JR, DSC, MPA, Director for Intelligence, re: Reiteration re Guidelines on PDL Visitation by Foreign Entities, dated May 17, 2023. 2. It has been observed by the higher office that there are foreign antities who visit persons deprived of liberty (PDL) for interview, research, and other related purposes. These entities include foreign embassy officials and employees, represzntatives of international organizations such as organs of the United Nations, or private individuals of foreign nationality. During visits, various issues may arise such as, but are not limited to, unauthorized visits, encroachment to PDL’s privacy, and unauthorized disclosure of or access to classified information. 3. While embassy officials and employees are allowed seamless visits to their nationals, there is a need to regulate those made to PDL who are not their citizens, including those visits made by non-embassy personnel to any PDL. You are hereby directed to observe the following guidelines whenever foreign entities request to visit a PDL: a. Any individual claiming to be an embassy official or employee who wants to Visit a citizen of the country he/she represents must present proof of his/her official capacity such as a valid identification card, mission order, and the like, before he/she may be allowed to visit the concerned PDL. b. If the PDL to be visited by such embassy official/representative is not a citizen of the country he/she represents, a clearance must first be obtained from the Regional Intelligence Division. b.1 Submitting a letter request to the Regional Director (Attn: Regional Intelligence Division) stating the purpose of the visit and the identity and background of the PDL to be visited. Furnishing the Warden of the said letter for subsequent endorsement to the Operations Division through the Regional Director with attached proof of legitimacy of the requesting party. c. If the purpose of the visit, interview of research may affect the outcome/ disposition of the pending criminal case of the PDL, a clearance t2 conduct the activity issued by the court where the case is pending shall also be attached to the letter request to be submitted by Operations Division. d. The Operations Division may seek the assistance of the Regional Intelligence Division (RID) if it deemed necessary, such as when there is doubt on the legitimacy of the requesting party. e. If the visit is the purpose of research, the Operations Division may require the submission of the survey form/questionnaire and route the same to the Program and Development Division (PDD), Investigation and Prosecution Division, Regional Intelligence Division (RID) and other concerned offices for comment. Any findings, shall be communicated with the requesting party. f. If the visiting individual/s is representing an international organization such as the European Union or any organ of the United Nations, and the like, Section 2 (f) of Republic Act 7438, provides that a PDL shall be allowed visits or conferences by any international non-govermental organization provided that said organization is duly accredited by the Office of th President. Therefore, prior to his/her visit to a PDL, he/she must obtain te following requirements: f.1. Accreditation of his/her organization from of the Office of the President; and f.2. Clearance from the Operations Division observing the above-mentioned procedure prior to the proposed visit. 4g. After obtaining the required accreditation and clearance, the sarne should be furnished by the requesting entity to the concerned Warden, through the Regional Office, prior to the visit. h. Upon arrival in the jail, authorized visitor/s must present a valid proof of his/ her official capacity before he/she may be allowed to vist the PDL. i. Ifthe foreign visitor is a private individual and the visit is personel, the Visitor Management Officer shall first determine whether such individual is included by the PDL in the list of authorized visitors he/she subrnitted upon ‘commitment in the jail. Otherwise, the requested visit may be cl2nied unless the visit is consented by the PDL and is subjected to jail’s security procedures. j. In all cases, the consent of the PDL subject of the interview must first be obtained before allowing entry of the foreign entities inside the jail. 4, For guidance and strict compliance.
