SUBJECT : Investigation Report re: on Carnapping Incident, Kayquit,


Indang, Cavite

I. AUTHORITY

1) VI of the C, PNP on May 27, 2021, directing this Unit to conduct an


investigation in the car napping incident in Kayquit, Indang, Cavite.

II. MATTERS TO BE INVESTIGATED

2) To determine the facts and circumstances surrounding the carnapping


incident in Barangay Kayquit, Indang, Cavite;

3) To identify the names of the suspects, the group to which they belong
and provide evidence of their guilt; and

4) To file a criminal complaint against the suspects, if evidence warrants.

I. FACTS OF THE CASE

1.) On May 27, 2023, at about 3:00 PM, PSSg Aizelle Olimberio, Duty
Desk PNCO of this Unit, received a personal complaint from one, KYLE NUESTRO,
22 years old, Single, and residing at 259 San Miguel Street, Poblacion 1, Indang,
Cavite stating that a carnapping incident occurred at Barangay Kayquit, Indang,
Cavite, that transpired at about 1:00 PM, which was perpetrated by 2 identified
suspects who was seen intentionally waiting for the victim to leave, took the
motorcycle and fled towards different directions. (Spot Report is hereto attached as
TAB “A”)
2.) The responding policemen of this HPG Unit led by PLT Dina Lee Go
immediately responded to the crime scene. At first, our policemen break down to
know the whole incident since the commission of the crime leaves no trace at first to
conduct the corresponding investigation.

3.) In an interview with one named Nenita Pinaglaba, the owner of the Lola
Nena’s Eatery near the apartment, she disclosed that there was a suspicious-looking
person wearing a blue T-shirt, and white shorts while he was accompanied by
another suspect wearing a blue striped sando and black shorts surreptitiously
pushing the motorcycle away from the vicinity. (Sinumpaang Salaysay is hereto
attached as TAB “B”)
4.) On the other side of the street, there was CCTV footage that captured
the events of the said incident. The owner of the CCTV immediately cooperated to
assist the police authorities in their investigation. Accordingly, as was shown to the
witness, she positively identified that the said persons are her regular customers who
eat lunch in her local eatery. After the incident, the culprits went and fled in different
directions using the motorcycle that they took. The owner of the surveillance camera
immediately cooperated and provided us with a copy of the CCTV footage to help in
the investigation. (Copy of the CCTV Footage submitted by the owner/witness are
hereto attached as TAB “C”)

5.) On May 29, 2023, at around 11:00 AM, through a phone call, the store
attendant informed the victim that the suspect has returned and is currently eating in
their store. Upon arriving at the eatery, the victim noticed that it was the very same
person in the CCTV footage who took the vehicle. As he was about to approach and
confront him regarding my motorcycle, he noticed something protruding in his right
waistline resembling a knife. The victim stepped back and called the police.
Immediately, the police arrived and apprehended the suspects and was brought to
the Police Station. The Affidavit of Apprehension is herewith attached as TAB “D”,
the recovery of the said motorcycle at the residence of John Madlangbayan in
Indang, Cavite. Extract a copy of the police blotter is herewith attached as TAB “E”.

6.) At about 11:15 AM, elements of the HPG Team once again led by PLT
Dina Lee Go, together with the arresting officer Michael Tabayoyong as well as other
apprehending officers namely Patrolman Jake Lang and Police Corporal Sherwin
Magnata arrived in the area of the incident to conduct a follow-up investigation.

7.) According to our interview with the witness she was able to identify and
point out the pictures of the suspects based on the Rogue’s Gallery that we showed
her: Nenita Pinaglaba (Owner of the Local Eatery, Witness, Owner of the CCTV
Footage) – she pointed out a certain JOHN MADLANG BAYAN aka JUAN and
MARCO PINAGSAMPAY aka BENTONG.

IV. FINDINGS/DISCUSSION

8.) The issue to be resolved is to determine the facts and circumstances


surrounding the carnapping incident in Barangay Kayquit, Indang, Cavite. Based on
the documentary at hand, there was a carnapping that happened at the said
barangay at 1:00 o’clock in the afternoon. It involved two men with their knives and
wearing a blue T-shirt, and white shorts while another suspect wears a blue striped
sando and black shorts who, with intent to monetary gain and took the motor vehicle.

9.) During the course of the investigation, it was discovered that there was
a witness and CCTV Footage near the location of the incident. The witness did not
even take steps to stop the culprits or immediately call the police for possible arrest
of the suspects. This constitutes a clear violation of the New Anti-Carnapping Law or
known as Republic Act no. 10883 which the law provides the following provisions:

Section 3. Who are guilty of carnapping. — Any person who is


found guilty of carnapping shall, regardless of the value of the motor
vehicle taken, be punished by imprisonment for not less than twenty
(20) years and one (1) day but not more than thirty (30) years, when
the carnapping is committed without violence against or intimidation of
persons, or force upon things; and by imprisonment for not less than
thirty (30) years and one (1) day but not more than forty (40) years,
when the carnapping is committed by means of violence against or
intimidation of persons, or force upon things; and the penalty of life
imprisonment shall be imposed when the owner, driver, or occupant of
the carnapped motor vehicle is killed or raped in the commission of
the carnapping.

10) It was Kyle Nuestro of Brgy. Poblacion 2 San Miguel Street, Indang,
Cavite who initiated to file a criminal complaint regarding his missing motor vehicle.
Upon the recovery of the said motorcycle, it was found that the motorcycle was badly
damaged and modified.

V. CONCLUSION

11.) Based on the foregoing facts and documents at hand, it was


established that the carnapping incident carries out by two suspects namely: JOHN
MAGDLANGBAYAN aka JUAN and MARCO PINAGSAMPAY aka BENTONG and
they willfully and feloniously carried away the motorcycle from the place where it is
parked.

12.) It was also established that Kyle Nuestro with the help of the store
attendant Nenita Pinaglaba successfully cooperate with responding police authorities
causing them to the straightforward identification and possible tracking down of the
fleeing suspects as well as for the direct report to tell the police authorities on the
amount of motorcycle stolen. Therefore, suspects were apprehended on the day
they were seen once again in the local eatery.

I. RECOMMENDATION

13.) WHEREFORE, it is recommended the following precautionary


measures so that this kind of incident does not happen again:

a) Providing adequate information for motorists on parking


availability. Motorists should not expect abundant and free parking
but find only limited parking or must spend time searching for a
proper parking place, especially in a safe and secure place.
b) There should be at least a relative raising in the requirements
for parking spaces, demand such as the use of zoning one side of
the street for only parking.
c) Motorists shall be vigilant by always keeping in mind to lock car
doors and windows while travelling or while parked.
d) Be aware of the Carnapping Cases in a place you are about to
get to, by always keeping emergency contact numbers handy and
by avoiding leaving valuables inside the vehicle to preclude the
temptation of future perpetrators.
