Article 1: Introduction ‫ ﻣﻘﺪﻣﺔ‬:1 ‫ﺍﻟﻤﺎﺩﺓ‬
This Service Contract is prepared in accordance with the regulations, bylaws and decisions issued by the ‫ُ ﻭﻓﻲ ﺣﺎﻟﺔ‬،‫ﺗﻢ ﺍﻋﺪﺍﺩ ﻫﺬﺍ ﺍﻟﻌﻘﺪ ﻭﻓﻖً ﺍ ﻟﻸﻧﻈﻤﺔ ﻭﺍﻟﻠﻮﺍﺋﺢ ﻭﺍﻟﻘﺮﺍﺭﺍﺕ ﺍﻟﺼﺎﺩﺭﺓ ﻣﻦ ﻫﻴﺌﺔ ﺍﻻﺗﺼﺎﻻﺕ ﻭﺗﻘﻨﻴﺔ ﺍﻟﻤﻌﻠﻮﻣﺎﺕ‬
CITC, in case of conflict between the terms and conditions herein and the terms and conditions outlined in ‫ﻭﺟﻮﺩ ﺕَ ﻋﺎﺭﺽ ﺑﻴﻦ ﺍﻟﺸﺮﻭﻁ ﻭﺍﻷﺣﻜﺎﻡ ﺍﻟﻮﺍﺭﺩﺓ ﻓﻲ ﻫﺬﺍ ﺍﻟﻌﻘﺪ ﻭﺍﻟﺸﺮﻭﻁ ﻭﺍﻷﺣﻜﺎﻡ ﺍﻟﻤﻮﺿﺤﺔ ﻓﻴﺄﻱ ﻣﻦ ﺍﻷﻧﻈﻤﺔ ﺃﻭ ﺍﻟﻠﻮﺍﺋﺢ‬
any of the regulations, bylaws or decisions issued by the CITC, then the terms and conditions of the CITC ‫ ﻭﺕُ ﺵ ً ﻛِّﻞ ﻫﺬﻩ ﺍﻟﻤﻘﺪﻣﺔ‬،‫ ﺗﺴﻮﺩ ﺃﺣﻜﺎﻡ ﻭﺷﺮﻭﻁ ﻫﻴﺌﺔ ﺍﻻﺗﺼﺎﻻﺕ ﻭﺗﻘﻨﻴﺔَ ﺍﻟﻤﻌﻠﻮﻣﺎﺕ‬،‫ﺃﻭ ﺍﻟﻘﺮﺍﺭﺍﺕ ﺍﻟﺼﺎﺩﺭﺓ ﻋﻦ ﺍﻟﻬﻴﺌﺔ‬
shall prevail. This introduction shall constitute an integral part of this Contract and shall be read and .‫ﺟﺰﺀ َ ﺍ ﻻ ﻳﺘﺠﺰﺃ ﻣﻦ ﻫﺬﺍ ﺍﻟﻌﻘﺪ ﻭﺕُ ﻗﺮ َّ ﺀ ﻭﺕُ ﻑَ ﺳﺮ ﻣﻌﻪ‬

Article 2: Definitions ‫ ﺍﻟﺘﻌﺮﻳﻔﺎﺕ‬:2 ‫ﺍﻟﻤﺎﺩﺓ‬


2.1 “Company” refers to Integrated Telecom Mobile Company Ltd “SALAM Mobile”, a Saudi limited lability ‫ ﻭﻫﻲ ﺷﺮﻛﺔ ﺳﻌﻮﺩﻳﺔ ﺫﺍﺕ ﻣﺴﺆﻭﻟﻴﺔ‬،(‫ ﺷﺮﻛﺔ ﺍﻻﺗﺼﺎﻻﺕ ﺍﻟﻤﺘﻜﺎﻣﻠﺔ ﺍﻟﻤﺘﻨﻘﻠﺔ ﺍﻟﻤﺤﺪﻭﺩﺓ )ﺳﻼﻡ ﻣﻮﺑﺎﻳﻞ‬:"‫ "ﺍﻟﺸﺮﻛﺔ‬1-2
company registered under the laws of the Kingdom of Saudi Arabia under commercial registration number ‫( ﻭﻣﺮﺧﺼﺔ ﻣﻦ ﻫﻴﺌﺔ‬1010691908) ‫ﻣﺤﺪﻭﺩﺓ ﻣﺴﺠﻠﺔ ﺑﻤﻮﺟﺐ ﺃﻧﻈﻤﺔ ﺍﻟﻤﻤﻠﻜﺔ ﺍﻟﻌﺮﺑﻴﺔ ﺍﻟﺴﻌﻮﺩﻳﺔ ﺑﻤﻮﺟﺐ ﺳﺠﻞ ﺗﺠﺎﺭﻱ ﺭﻗﻢ‬
(1010691908) and licensed by CITC to provide virtual mobile telecommunications services. .‫ﺍﻻﺗﺼﺎﻻﺕ ﻭﺗﻘﻨﻴﺔ ﺍﻟﻤﻌﻠﻮﻣﺎﺕ ﻟﺘﻘﺪﻳﻢ ﺧﺪﻣﺎﺕ ﻣﺸﻐﻞ ﺷﺒﻜﺎﺕ ﺍﻻﺗﺼﺎﻻﺕ ﺍﻟﻤﺘﻨﻘﻠﺔ ﺍﻻﻓﺘﺮﺍﺿﻴﺔ‬
2.2 “Customer” refers to the legal, natural or authorized person above 15 years old that has subscribed to ‫ ﺗﺸﻴﺮ ﺇﻟﻰ ﺍﻟﺸﺨﺺ ﺍﻟﻘﺎﻧﻮﻧﻲ ﺃﻭ ﺍﻟﻄﺒﻴﻌﻲ ﺃﻭ ﺍﻟﻤﺮﺧﺺ ﻟﻪ ﺍﻟﺬﻱ ﺍﺷﺘﺮﻙ ﻓﻲ ﺃﻱ ﻣﻦ ﺍﻟﺨﺪﻣﺎﺕ ﺍﻟﺘﻲ‬:"‫ "ﺍﻟﻌﻤﻴﻞ‬2-2
any of the Services provided by the Company, and has accepted these terms and conditions through an
‫ ﻭﻭﺛﻖ ﻣﻮﺍﻓﻘﺘﻪ ﻋﻠﻰ ﻫﺬﻩ ﺍﻟﺸﺮﻭﻁ ﻭﺍﻷﺣﻜﺎﻡ ﻣﻦ ﺧﻼﻝ ﺭﺳﺎﻟﺔ ﻧﺼﻴﺔ‬،‫ ﻋﺎﻣﺎ ﻓﺄﻛﺜﺮ‬15 ‫ﺗﻘﺪﻣﻬﺎ ﺍﻟﺸﺮﻛﺔ ﻭﻳﺒﻠﻎ ﻣﻦ ﺍﻟﻌﻤﺮ‬

2.3 “CITC” refers to the Communications and Information Technology Commission. .(‫ﻗﺼﻴﺮﺓ ﺗﺤﺘﻮﻱ ﻋﻠﻰ ﺭﺍﺑﻂ ﻟﻬﺬﺍ ﺍﻟﻌﻘﺪ ﺃﻭ ﻣﻦ ﺧﻼﻝ ﻗﻨﻮﺍﺕ ﻣﺼﺎﺩﻗﺔ ﺍﻟﻬﻮﻳﺔ )ﻧﻔﺎﺫ‬
2.4 “Contract” refers to these terms & conditions and any other annexes attached to or referenced in this ."‫ "ﺍﻟﻬﻴﺌﺔ" ﺗﺸﻴﺮ ﺍﻟﻰ "ﻫﻴﺌﺔ ﺍﻻﺗﺼﺎﻻﺕ ﻭﺗﻘﻨﻴﺔ ﺍﻟﻤﻌﻠﻮﻣﺎﺕ‬3-2
Contract that governs the relationship between the Company and the Customer. ‫ "ﺍﻟﻌﻘﺪ" ﻳﺸﻴﺮ ﺇﻟﻰ ﺍﻟﺸﺮﻭﻁ ﻭﺍﻷﺣﻜﺎﻡ ﺍﻟﻮﺍﺭﺩﺓ ﻫﻨﺎ ﻭﺃﻳﺔ ﻣﻼﺣﻖ ﺃﺧﺮﻯ ﻣﺮﻓﻘﺔ ﺃﻭ ﻣﺸﺎﺭ ﺇﻟﻴﻬﺎ ﻓﻲ ﻫﺬﺍ ﺍﻟﻌﻘﺪ ﻭﺍﻟﺘﻲ‬4-2
2.5 “Commitment Period” refers to the minimum period which the Customer shall remain subscribed to .‫ﺗﺤﻜﻢ ﺍﻟﻌﻼﻗﺔ ﺑﻴﻦ ﺍﻟﺸﺮﻛﺔ ﻭﺍﻟﻌﻤﻴﻞ‬
the Service. Any termination of a Service during the Commitment Period shall be subject to penalties ‫ ﻭﻳﺨﻀﻊ ﺃﻱ ﺇﻧﻬﺎﺀ‬،‫ "ﻓﺘﺮﺓ ﺍﻻﻟﺘﺰﺍﻡ" ﺗﺸﻴﺮ ﺇﻟﻰ ﺍﻟﺤﺪ ﺍﻷﺩﻧﻰ ﻟﻠﻔﺘﺮﺓ ﺍﻟﺘﻲ ﻳﺴﺘﻤﺮ ﻓﻴﻬﺎ ﺍﻟﻌﻤﻴﻞ ﻣﺸﺘﺮﻛًﺎ ﻓﻲ ﺍﻟﺨﺪﻣﺔ‬5-2
detailed under article 6 of this Contract. .‫ﻟﻠﺨﺪﻣﺔ ﺧﻼﻝ ﻓﺘﺮﺓ ﺍﻻﻟﺘﺰﺍﻡ ﻟﻠﺸﺮﻭﻁ ﺍﻟﻤﻔﺼﻠﺔ ﺑﻤﻮﺟﺐ ﺍﻟﻤﺎﺩﺓ ﺍﻟﺴﺎﺩﺳﺔ ﻣﻦ ﻫﺬﺍ ﺍﻟﻌﻘﺪ‬
2.6 “Service/s” refers to any of the products and/or services requested by the Customer and provided by ‫ﺃﻭ ﺍﻟﺨﺪﻣﺎﺕ ﺍﻟﺘﻲ ﻳﻄﻠﺒﻬﺎ ﺍﻟﻌﻤﻴﻞ ﻭﺍﻟﺘﻲ ﺗﻘﺪﻣﻬﺎ ﺍﻟﺸﺮﻛﺔ ﺑﻤﻮﺟﺐ‬/‫ﺍﻟﺨﺪﻣﺎﺕ" ﺗﺸﻴﺮ ﺇﻟﻰ ﺃﻱ ﻣﻦ ﺍﻟﻤﻨﺘﺠﺎﺕ ﻭ‬/‫ "ﺍﻟﺨﺪﻣﺔ‬6-2

.‫ﻫﺬﺍ ﺍﻟﻌﻘﺪ‬
2.7 “SMS” or “Short Message Service” means a text messaging service component of most telephone,
internet, and mobile device systems. ‫ "ﺧﺪﻣﺔ ﺍﻟﺮﺳﺎﺋﻞ ﺍﻟﻘﺼﻴﺮﺓ" ﺗﻌﻨﻲ ﺃﺣﺪ ﻣﻜﻮﻧﺎﺕ ﺧﺪﻣﺔ ﺍﻟﺮﺳﺎﺋﻞ ﺍﻟﻨﺼﻴﺔ ﻟﻤﻌﻈﻢ ﺃﻧﻈﻤﺔ ﺍﻟﻬﺎﺗﻒ ﻭﺍﻹﻧﺘﺮﻧﺖ ﻭﺍﻷﺟﻬﺰﺓ‬7-2
2.8 “Taxes” refers to the value added tax which shall be added to the Customer bill in accordance with the .‫ﺍﻟﺠﻮﺍﻟﺔ‬
prevailing tax laws in KSA. ‫ "ﺍﻟﻀﺮﺍﺋﺐ" ﺗﺸﻴﺮ ﺇﻟﻰ ﺿﺮﻳﺒﺔ ﺍﻟﻘﻴﻤﺔ ﺍﻟﻤﻀﺎﻓﺔ ﺍﻟﺘﻲ ﻳﺠﺐ ﺇﺿﺎﻓﺘﻬﺎ ﺇﻟﻰ ﻓﺎﺗﻮﺭﺓ ﺍﻟﻌﻤﻴﻞ ﻭﻓﻖً ﺍ ﻷﻧﻈﻤﺔ ﺍﻟﻀﺮﺍﺋﺐ‬8-2
2.9 “Device/s” refers to communication equipment or any part thereof owned by the Company or any of its .‫ﺍﻟﺴﺎﺋﺪﺓ ﻓﻲ ﺍﻟﻤﻤﻠﻜﺔ ﺍﻟﻌﺮﺑﻴﺔ ﺍﻟﺴﻌﻮﺩﻳﺔ‬
contractors and used to make the Service available to the Customer. ‫ﺍﻷﺟﻬﺰﺓ" ﻳﺸﻴﺮ ﺇﻟﻰ ﻣﻌﺪﺍﺕ ﺍﻻﺗﺼﺎﻝ ﺍﻟﻤﻤﻠﻮﻛﺔ ﻟﻠﺸﺮﻛﺔ ﺃﻭ ﺃﻱ ﻣﻦ ﻣﻘﺎﻭﻟﻴﻬﺎ ﻭﺍﻟﻤﺴﺘﺨﺪﻣﺔ ﻟﺘﻘﺪﻳﻢ ﺍﻟﺨﺪﻣﺔ‬/‫ "ﺍﻟﺠﻬﺎﺯ‬9-2
2.10 “Device Discount Program” refers to a Device subsidy program offered by the Company that allows .‫ﻟﻠﻌﻤﻴﻞ‬
the Customer to receive a discounted or free Device subject to subscribing to the respective program as ‫ "ﺑﺮﻧﺎﻣﺞ ﺍﻟﺨﺼﻮﻣﺎﺕ ﻋﻠﻰ ﺍﻷﺟﻬﺰﺓ" ﻳﺸﻴﺮ ﺇﻟﻰ ﺑﺮﻧﺎﻣﺞ ﺩﻋﻢ ﺍﻷﺟﻬﺰﺓ ﺍﻟﺬﻱ ﺗﻘﺪﻣﻪ ﺍﻟﺸﺮﻛﺔ ﻭﺍﻟﺬﻱ ﻳﺴﻤﺢ ﻟﻠﻌﻤﻴﻞ‬01-2
defined in the Request Form.
.‫ﺑﺎﻟﺤﺼﻮﻝ ﻋﻠﻰ ﺟﻬﺎﺯ ﻣﺨﻔﺾ ﺃﻭ ﻣﺠﺎﻧﻲ ﻳﺨﻀﻊ ﻟﻼﺷﺘﺮﺍﻙ ﻓﻲ ﺍﻟﺒﺮﻧﺎﻣﺞ ﺍﻟﻤﻌﻨﻲ ﻛﻤﺎ ﻫﻮ ﻣﺤﺪﺩ ﻓﻲ ﻃﻠﺐ ﺍﻻﺷﺘﺮﺍﻙ‬
2.11 “Permitted Postpaid Package” refers to the postpaid Service packages available for subscription with
or without the Device Discount Program offered from time to time by the Company. ‫ "ﺍﻟﺒﺎﻗﺔ ﺍﻟﻤﻔﻮﺗﺮﺓ ﺍﻟﻤﺴﻤﻮﺡ ﺑﻬﺎ" ﺗﺸﻴﺮ ﺇﻟﻰ ﺑﺎﻗﺎﺕ ﺍﻟﺨﺪﻣﺔ ﺍﻟﻤﻔﻮﺗﺮﺓ ﺍﻟﻤﺘﺎﺣﺔ ﻟﻼﺷﺘﺮﺍﻙ ﻣﻊ ﺃﻭ ﺑﺪﻭﻥ ﺑﺮﻧﺎﻣﺞ‬11-2
.‫ﺍﻟﺨﺼﻮﻣﺎﺕ ﻋﻠﻰ ﺍﻷﺟﻬﺰﺓ ﺍﻟﺬﻱ ﺗﻘﺪﻣﻪ ﺍﻟﺸﺮﻛﺔ ﻣﻦ ﻭﻗﺖ ﻵﺧﺮ‬

3.1 The Company reserves the right to determine the credit limit of the Customer based on his monthly ‫ ﺣﺪﻭﺩ ﺍﻻﺋﺘﻤﺎﻥ ﻭﻣﺒﻠﻎ ﺍﻟﺘﺄﻣﻴﻦ‬:3 ‫ﺍﻟﻤﺎﺩﺓ‬
average consumption or as deemed appropriate by the Company. In case the Customer reaches his credit
limit, the Company has the right to suspend the Service. Customer agrees to pay any amount exceeding the ‫ ً ﺗﺤﺘﻔﻆ ﺍﻟﺸﺮﻛﺔ ﺑﺤﻘﻬﺎ ﻓﻲ ﺗﺤﺪﻳﺪ ﺣﺪ ﺍﻻﺋﺘﻤﺎﻥ ﻟﻠﻌﻤﻴﻞ ﺑﻨﺎﺀ ﻋﻠﻰ ﻣﺘﻮﺳﻂ ﺍﺳﺘﻬﻼﻛﻪ ﺍﻟﺸﻬﺮﻱ ﺃﻭ ﺣﺴﺒﻤﺎ ً ﺗﺮﺍﻩ ﺍﻟﺸﺮﻛﺔ‬1-3
credit limit, and an excess fee up to 10% of the credit limit in case the Customer requested the Company to ‫ ﻭﻳﻮﺍﻓﻖ ﺍﻟﻌﻤﻴﻞ ﻋﻠﻰ‬،‫ ﻳﺤﻖ ﻟﻠﺸﺮﻛﺔ ﺗﻌﻠﻴﻖ ﺍﻟﺨﺪﻣﺔ‬،‫ ﻭﻓﻲ ﺣﺎﻟﺔ ﻭﺻﻮﻝ ﺍﻟﻌﻤﻴﻞ ﺇﻟﻰ ﺍﻟﺤﺪ ﺍﻻﺋﺘﻤﺎﻧﻲ ﺍﻟﺨﺎﺹ ﺑﻪ‬،‫ﻣﻨﺎﺳﺒﺎ‬
resume the Service after its suspension due to exceeding the credit limit. ‫ﻣﻦ ﺍﻟﺤﺪ ﺍﻻﺋﺘﻤﺎﻧﻲ ﻓﻲ ﺣﺎﻝ ﻃﻠﺐ ﺍﻟﻌﻤﻴﻞ ﻣﻦ‬٪ 10 ‫ ﻭﺭﺳﻮﻡ ﺍﺿﺎﻓﻴﺔ ﺗﺼﻞ ﺇﻟﻰ‬،‫ﺳﺪﺍﺩ ﺃﻱ ﻣﺒﻠﻎ ﻳﺘﺠﺎﻭﺯ ﺍﻟﺤﺪ ﺍﻻﺋﺘﻤﺎﻧﻲ‬
3.2 The Customer agrees to provide the Company with any information or data it requests for establishing, .‫ﺍﻟﺸﺮﻛﺔ ﺍﺳﺘﺌﻨﺎﻑ ﺍﻟﺨﺪﻣﺔ ﺑﻌﺪ ﺗﻌﻠﻴﻘﻬﺎ ﺑﺴﺒﺐ ﺗﺠﺎﻭﺯ ﺍﻟﺤﺪ ﺍﻻﺋﺘﻤﺎﻧﻲ‬
auditing, or administering his account. The Customer also authorizes the Company to obtain and collect ‫ ﻛﻤﺎ‬،‫ ﻳﻮﺍﻓﻖ ﺍﻟﻌﻤﻴﻞ ﻋﻠﻰ ﺗﺰﻭﻳﺪ ﺍﻟﺸﺮﻛﺔ ﺑﺄﻱ ﻣﻌﻠﻮﻣﺎﺕ ﺃﻭ ﺑﻴﺎﻧﺎﺕ ﺗﻄﻠﺒﻬﺎ ﺍﻟﺸﺮﻛﺔ ﻹﻧﺸﺎﺀ ﺣﺴﺎﺑﻪ ﺃﻭ ﺗﺪﻗﻴﻘﻪ ﺃﻭ ﺇﺩﺍﺭﺗﻪ‬2-3
information related to him or his accounts from the Saudi Credit Bureau (“SIMAH”) or any other company ‫ﻳﻔﻮﺽ ﺍﻟﻌﻤﻴﻞ ﺍﻟﺸﺮﻛﺔ ﻟﻠﺤﺼﻮﻝ ﻋﻠﻰ ﺍﻟﻤﻌﻠﻮﻣﺎﺕ ﺍﻟﻤﺘﻌﻠﻘﺔ ﺑﻪ ﺃﻭ ﺑﺤﺴﺎﺑﺎﺗﻪ ﻣﻦ ﺍﻟﺸﺮﻛﺔ ﺍﻟﺴﻌﻮﺩﻳﺔ ﻟﻠﻤﻌﻠﻮﻣﺎﺕ‬
that provides the same service.
3.3 The Customer acknowledges that the Company may disclose and/or share Customer’s information or .‫ﺍﻻﺋﺘﻤﺎﻧﻴﺔ )ﺳﻤﺔ( ﺃﻭ ﺃﻱ ﺷﺮﻛﺔ ﺃﺧﺮﻯ ﺗﻘﺪﻡ ﻧﻔﺲ ﺍﻟﺨﺪﻣﺔ‬
data or account information with SIMAH or with any other agency approved by Saudi Arabian Monetary ‫ ﺃﻭ ﻣﺸﺎﺭﻛﺔ ﻣﻌﻠﻮﻣﺎﺕ ﺍﻟﻌﻤﻴﻞ ﺃﻭ ﺑﻴﺎﻧﺎﺗﻪ ﺃﻭ ﻣﻌﻠﻮﻣﺎﺕ ﺍﻟﺤﺴﺎﺏ ﻣﻊ ﺳﻤﺔ ﺃﻭ‬/‫ ﻳﻘﺮ ﺍﻟﻌﻤﻴﻞ ﺑﺄﻧﻪ ﻳﺠﻮﺯ ﻟﻠﺸﺮﻛﺔ ﺍﻻﻓﺼﺎﺡ ﻭ‬3-3
Agency (SAMA). .(‫ﻣﻊ ﺃﻱ ﺟﻬﺔ ﺃﺧﺮﻯ ﻣﻌﺘﻤﺪﺓ ﻣﻦ ﻣﺆﺳﺴﺔ ﺍﻟﻨﻘﺪ ﺍﻟﻌﺮﺑﻲ ﺍﻟﺴﻌﻮﺩﻱ )ﺳﺎﻣﺎ‬
3.4 Customer agrees to pay an insurance deposit either upon electronically accepting this Contract or ‫ ﺣﺴﺒﻤﺎ ﺗﺮﺍﻩ ً ﺍﻟﺸﺮﻛﺔ‬،‫ ً ﻳﻮﺍﻓﻖ ﺍﻟﻌﻤﻴﻞ ﻋﻠﻰ ﺳﺪﺍﺩ ﻣﺒﻠﻎ ﺗﺄﻣﻴﻦ ﺇﻣﺎ ﻋﻨﺪ ﻗﺒﻮﻝ ﻫﺬﺍ ﺍﻟﻌﻘﺪ ﺇﻟﻜﺘﺮﻭﻧﻴﺎ ﺃﻭ ﺃﺛﻨﺎﺀ ﺳﺮﻳﺎﻧﻪ‬4-3
during its validity, as may be deemed appropriate by the Company in order to protect its rights, which shall ‫ ﻓﻲ ﺣﺎﻟﺔ ﻭﺟﻮﺩ ﻣﺒﺎﻟﻎ ﻏﻴﺮ ﻣﺘﻨﺎﺯﻉ‬-‫ ﺃ‬:‫ ﻭﺍﻟﺘﻲ ﺗﺸﻤﻞ ﻋﻠﻰ ﺳﺒﻴﻞ ﺍﻟﻤﺜﺎﻝ ﻻ ﺍﻟﺤﺼﺮ ﺍﻟﺤﺎﻻﺕ ﺍﻟﺘﺎﻟﻴﺔ‬،‫ﻣﻨﺎﺳﺒﺎ ﻟﺤﻔﻆ ﺣﻘﻮﻗﻬﺎ‬
include but not limited to the following cases: a. There are undisputed and unpaid amounts due for ‫ ﻓﻲ ﺣﺎﻟﺔ ﺗﺨﻠﻒ ﺍﻟﻌﻤﻴﻞ ﺳﺎﺑﻖً ﺍ ﻋﻦ ﺳﺪﺍﺩ ﻓﻮﺍﺗﻴﺮ‬-‫ﻋﻠﻴﻬﺎ ﻭﻏﻴﺮ ﻣﺪﻓﻮﻋﺔ ﻭﻣﺴﺘﺤﻘﺔ ﺍﻟﺴﺪﺍﺩ ﻣﻦ ﺍﻟﻌﻤﻴﻞ ﻟﻠﺸﺮﻛﺔ؛ ﺃﻭ ﺏ‬
payment by the Customer to the Company; b. The Customer have defaulted previously in paying bills to the ‫ ﻓﻲ ﺣﺎﻝ ﻛﺎﻥ ً ﺍﻟﻌﻤﻴﻞ ﻋﻤﻴﻼ ً ﺟﺪﻳﺪﺍ ﻟﻴﺲ ﻟﻪ ﺳﺠﻞ ﻣﺘﺎﺡ ﻟﺪﻯ‬-‫ﺍﻟﺸﺮﻛﺔ ﺃﻭ ﻛﻤﺎ ﻳﺘﻀﺢ ﻣﻦ ﺗﺎﺭﻳﺨﻪ ﺍﻻﺋﺘﻤﺎﻧﻲ ﻓﻲ ﺳﻤﺔ؛ ﺃﻭ ﺝ‬
Company or as evident in his credit history at SIMAH; or c. The Customer is a new Customer with no history .‫ﺍﻟﺸﺮﻛﺔ‬
available with the Company.
3.5 The Company reserves the right to deduct any unpaid due amounts payable by the Customer in ‫ ﺗﺤﺘﻔﻆ ﺍﻟﺸﺮﻛﺔ ﺑﺤﻘﻬﺎ ﻓﻲ ﺧﺼﻢ ﺃﻱ ﻣﺒﺎﻟﻎ ﻣﺴﺘﺤﻘﺔ ﻏﻴﺮ ﻣﺪﻓﻮﻋﺔ ﻭﺍﺟﺒﺔ ﺍﻟﺴﺪﺍﺩ ﻣﻦ ﺍﻟﻌﻤﻴﻞ ﻭﻓﻖً ﺍ ﻟﻬﺬﺍ ﺍﻟﻌﻘﺪ ﻣﻦ‬5-3
accordance with this Contract from the insurance deposit. .‫ﻣﺒﻠﻎ ﺍﻟﺘﺄﻣﻴﻦ‬

Article 4: Customer’s Obligations ‫ ﺍﻟﺘﺰﺍﻣﺎﺕ ﺍﻟﻌﻤﻴﻞ‬:4 ‫ﺍﻟﻤﺎﺩﺓ‬


4.1 The Customer agrees to provide the Company with information or documentation which may be ،‫ ﻳﻮﺍﻓﻖ ﺍﻟﻌﻤﻴﻞ ﻋﻠﻰ ﺗﺰﻭﻳﺪ ﺍﻟﺸﺮﻛﺔ ﺑﺎﻟﻤﻌﻠﻮﻣﺎﺕ ﺃﻭ ﺍﻟﻮﺛﺎﺋﻖ ﺍﻟﺘﻲ ﻗﺪ ﺗﻜﻮﻥ ﻣﻄﻠﻮﺑﺔ ﻹﺟﺮﺍﺀ ﺍﻟﺘﺤﻘﻖ ﻣﻦ ﻫﻮﻳﺔ ﺍﻟﻌﻤﻴﻞ‬1-4
required to conduct an identification check of the Customer, which shall be done through the Ministry of
Interior portal “Absher” or through the Identity Authentication Management (IAM). Customer accepts the ‫ ﻳﻘﺒﻞ ﺍﻟﻌﻤﻴﻞ ﺍﻟﺘﺤﻘﻖ ﻣﻦ‬،(‫ﻭﺍﻟﺬﻱ ﻳﺘﻢ ﻣﻦ ﺧﻼﻝ ﺑﻮﺍﺑﺔ ﻭﺯﺍﺭﺓ ﺍﻟﺪﺍﺧﻠﻴﺔ "ﺃﺑﺸﺮ" ﺃﻭ ﻣﻦ ﺧﻼﻝ ﻗﻨﻮﺍﺕ ﻣﺼﺎﺩﻗﺔ ﺍﻟﻬﻮﻳﺔ )ﻧﻔﺎﺫ‬
validation of identification by receiving an SMS to the individual number associated with the Customer’s ‫ ﺳﺘﺤﺘﻮﻱ ﺍﻟﺮﺳﺎﻟﺔ ﻋﻠﻰ ﺭﻣﺰ‬،‫ﺍﻟﻬﻮﻳﺔ ﻣﻦ ﺧﻼﻝ ﺗﻠﻘﻲ ﺭﺳﺎﻟﺔ ﻧﺼﻴﺔ ﺇﻟﻰ ﺭﻗﻢ ﺍﻟﺠﻮﺍﻝ ﺍﻟﻤﺮﺗﺒﻂ ﺑﺤﺴﺎﺏ ُ ﺃﺑﺸﺮ ﺍﻟﺨﺎﺹ ﺑﺎﻟﻌﻤﻴﻞ‬
Absher account. The SMS will contain an authentication code, which will then be followed by the terms & ‫ﺍﻟﻤﺼﺎﺩﻗﺔ ﺍﻟﺬﻱ ﺳﻲ َﺗﺒﻊ ﺑﻌﺪ ﺫﻟﻚ ﺑﺎﻟﺸﺮﻭﻁ ﻭﺍﻷﺣﻜﺎﻡ ُ ﺑﺎﻹﺿﺎﻓﺔ ﺇﻟﻰ ﻋﻘﺪ ﺍﻟﺨﺪﻣﺔ ﺍﻟﺬﻱ ﺳﻲ َﺭﺳﻞ ﻣﻦ ﺧﻼﻝ ﺭﺍﺑﻂ ﺇﻟﻰ‬
condition as well as the Contract of the Service, which shall be sent through a link to the registered mobile .‫ﺭﻗﻢ ﺍﻟﻬﺎﺗﻒ ﺍﻟﺠﻮﺍﻝ ﺍﻟﻤﺴﺠﻞ ﻭﻋﻨﻮﺍﻥ ﺍﻟﺒﺮﻳﺪ ﺍﻹﻟﻜﺘﺮﻭﻧﻲ‬
number and email address. ‫ ﻻ ﻳﺠﻮﺯ ﻟﻠﻌﻤﻴﻞ ﺍﺳﺘﺨﺪﺍﻡ ﺍﻟﺨﺪﻣﺔ ﺃﻭ ﺍﻟﺴﻤﺎﺡ ﺑﺎﺳﺘﺨﺪﺍﻣﻬﺎ ﺃﻭ ﺇﺟﺮﺍﺀ ﺃﻱ ﺗﻌﺪﻳﻼﺕ ﻋﻠﻰ ﺍﻷﺟﻬﺰﺓ ﻭﺍﻟﻤﻌﺪﺍﺕ ﻭﺍﻟﺒﺮﺍﻣﺞ ﺫﺍﺕ‬2-4
4.2 The Customer shall not use or allow the use of the Service or make any modifications to the Devices, ‫ﺍﻟﺼﻠﺔ ﺑﻤﺎ ﻳﻨﺘﻬﻚ ﻗﻮﺍﻧﻴﻦ ﻭﺃﻧﻈﻤﺔ ﺍﻟﻤﻤﻠﻜﺔ ﺍﻟﻌﺮﺑﻴﺔ ﺍﻟﺴﻌﻮﺩﻳﺔ ﺃﻭ ﻳﻨﺘﻬﻚ ﺷﺮﻭﻁ ﻫﺬﺍ ﺍﻟﻌﻘﺪ ِّ ﺃﻭ ﺍﻷﻏﺮﺍﺽ ﺍﻟﺘﻲ ﺥٌ ﺹ َﺻﺖ‬
equipment and related software in violation of the laws and regulations of the Kingdom of the Saudi Arabia ‫ ﻭﻳﺘﺤﻤﻞ ﺍﻟﻌﻤﻴﻞ ﻣﺴﺆﻭﻟﻴﺔ ﺃﻱ ﺍﺳﺘﺨﺪﺍﻡ ﻏﻴﺮ ﻗﺎﻧﻮﻧﻲ ﻟﻠﺨﺪﻣﺔ ﻭﺟﻤﻴﻊ ﺍﻟﻌﻮﺍﻗﺐ ﺫﺍﺕ ﺍﻟﺼﻠﺔ ﺑﻤﺎ ﻓﻲ ﺫﻟﻚ‬،‫ﻣﻦ ﺃﺟﻠﻪ‬
or in violation of the terms of this Contract or for the purposes for which it has been allocated. The .‫ﺍﻟﻐﺮﺍﻣﺎﺕ‬
Customer shall be responsible for any unlawful use of the Service and all related consequences including
penalties. .‫ ﻻ ﻳﺠﻮﺯ ﻟﻠﻌﻤﻴﻞ ﺍﺳﺘﺨﺪﺍﻡ ﺍﻟﺨﺪﻣﺔ ﻷﻏﺮﺍﺽ ﺍﻟﺘﺴﻮﻳﻖ ﺃﻭ ﺍﻟﺪﻋﺎﻳﺔ‬3-4
4.3 The Customer shall not use the Service for marketing or advertising purposes. .‫ ّ ﻳﺘﻌﻴﻦ ﻋﻠﻰ ﺍﻟﻌﻤﻴﻞ ﺳﺪﺍﺩ ﻣﺒﻠﻎ ﺍﻟﺘﺄﻣﻴﻦ ﻭﺃﻱ ﻣﺒﺎﻟﻎ ﺃﺧﺮﻯ ﻣﺴﺘﺤﻘﺔ ﻓﻲ ﺍﻟﺘﻮﺍﺭﻳﺦ ﺍﻟﺘﻲ ﺗﺤﺪﺩﻫﺎ ﺍﻟﺸﺮﻛﺔ‬4-4
4.4 The Customer shall pay the amount of the insurance deposit and any other due amounts on the dates ‫ ﺍﻟﺴﻤﺎﺡ ﻟﻤﻮﻇﻔﻲ ﺍﻟﺸﺮﻛﺔ ﺍﻟﻤﺼﺮﺡ ﻟﻬﻢ‬،‫ ﻓﻲ ﺣﺎﻟﺔ ﻗﻴﺎﻡ ﺍﻟﺸﺮﻛﺔ ﺑﺘﻮﻓﻴﺮ ﺃﺟﻬﺰﺓ ﻟﺘﻮﻓﻴﺮ ﺍﻟﺨﺪﻣﺔ‬،‫ ّ ﻳﺘﻌﻴﻦ ﻋﻠﻰ ﺍﻟﻌﻤﻴﻞ‬5-4
specified by the Company. ‫ﺑﺎﻟﺪﺧﻮﻝ ﺇﻟﻰ ﺍﻟﻤﺒﺎﻧﻲ ﺃﻭ ﺍﻟﻤﻮﺍﻗﻊ ﺍﻟﺘﻲ ﻳﺸﻐﻠﻬﺎ ﺍﻟﻌﻤﻴﻞ ﺃﻭ ﺗﻜﻮﻥ ﺗﺤﺖ ﺳﻴﻄﺮﺗﻪ ﻭﺍﻟﺒﻘﺎﺀ ﻓﻲ ً ﻫﺬﻩ ﺍﻟﻤﻮﺍﻗﻊ ﺇﻟﻰ ﺍﻟﺤﺪ‬
4.5 The Customer shall, in the event that the Company provides Devices for the provision of the Service, .‫ﺍﻟﻤﻄﻠﻮﺏ ﻷﻱ ﻏﺮﺽ ﻣﻦ ﺍﻷﻏﺮﺍﺽ ﺍﻟﻤﺘﻔﻖ ﻋﻠﻴﻬﺎ ﻭﺍﻟﻤﺴﻤﻮﺡ ﺑﻬﺎ ﻭﻓﻘﺎ ﻷﻧﻈﻤﺔ ﻭﻟﻮﺍﺋﺢ ﻭﻗﺮﺍﺭﺍﺕ ﺍﻟﻬﻴﺌﺔ‬
allow the Company’s authorized personnel to enter into premises or sites occupied by the Customer or ‫ ﺑﻤﺎ ﻓﻲ ﺫﻟﻚ ﺃﻱ ﺣﻘﻮﻕ‬،‫ ّ ﻳﺘﻌﻴﻦ ﻋﻠﻰ ﺍﻟﻌﻤﻴﻞ ﺍﻻﻣﺘﺜﺎﻝ ﻟﺸﺮﻭﻁ ﺗﺮﺍﺧﻴﺺ ﺍﻟﺒﺮﺍﻣﺞ ﺍﻟﻤﺴﺘﺨﺪﻣﺔ ﻓﻲ ﺍﻷﺟﻬﺰﺓ ﻭﺍﻟﻤﻌﺪﺍﺕ‬6-4
under his control and to remain in such locations to the extent required for any of the agreed and permitted ‫ﻣﻠﻜﻴﺔ ﻓﻜﺮﻳﺔ ﺫﺍﺕ ﺻﻠﺔ ﺃﻭ ﺃﻱ ﺣﻘﻮﻕ ﺃﺧﺮﻯ ﻣﻄﻠﻮﺑﺔ ﻟﺘﻮﻓﻴﺮ ﺃﻱ ﺧﺪﻣﺎﺕ ﺃﻭ ﺗﺜﺒﻴﺖ ﺃﻭ ﺍﺳﺘﺨﺪﺍﻡ ﺃﻱ ﻣﻌﺪﺍﺕ ﻓﻲ ﻣﺒﺎﻧﻲ ﺍﻟﻌﻤﻴﻞ‬
purposes in accordance with the regulations, bylaws and decisions of the CITC. .‫)ﺑﻤﺎ ﻓﻲ ﺫﻟﻚ ﺃﺟﻬﺰﺓ ﻭﻣﻌﺪﺍﺕ ﺍﻻﺗﺼﺎﻻﺕ( ﺧﻼﻝ ﻛﺎﻣﻞ ﻣﺪﺓ ﺗﻘﺪﻳﻢ ﺍﻟﺨﺪﻣﺔ ﻣﻦ ﺍﻟﺸﺮﻛﺔ‬
4.6 The Customer shall comply with the terms of the software licenses used in the Devices and equipment,
including any related intellectual property rights or any other rights required to provide any Services, .‫ ﻻ ﻳﺠﻮﺯ ﻟﻠﻌﻤﻴﻞ ﺗﺄﺟﻴﺮ ﺍﻟﺨﺪﻣﺔ ﺃﻭ ﻣﺸﺎﺭﻛﺘﻬﺎ ﺃﻭ ﺇﻋﺎﺩﺓ ﺑﻴﻌﻬﺎ ﺃﻭ ﺍﻟﺘﻨﺎﺯﻝ ﻋﻨﻬﺎ ﺑﺪﻭﻥ ﻣﻮﺍﻓﻘﺔ ﺧﻄﻴﺔ ﻣﺴﺒﻘﺔ ﻣﻦ ﺍﻟﺸﺮﻛﺔ‬7-4
installation or use of any equipment at Customer premises (including communications Devices and .‫ ّ ﻳﺘﻌﻴﻦ ﻋﻠﻰ ﺍﻟﻌﻤﻴﻞ ﺇﺷﻌﺎﺭ ﺍﻟﺸﺮﻛﺔ ﺑﺄﻱ ﺗﻐﻴﻴﺮﺍﺕ ﻓﻲ ﺍﻟﻤﻌﻠﻮﻣﺎﺕ ﺍﻟﻤﻘﺪﻣﺔ ﻣﻦ ﺍﻟﻌﻤﻴﻞ ﻓﻮﺭ ﺗﻐﻴﺮﻫﺎ‬8-4
equipment) during the entire Service provision duration by the Company. ‫ ﺗﻜﻮﻥ ﺍﻟﺸﺮﻛﺔ ﻫﻲ ﺍﻟﻤﺎﻟﻜﺔ ﻷﻱ ﺃﺟﻬﺰﺓ ﺗﻤﻨﺢ ﻟﻠﻌﻤﻴﻞ ﺑﻤﻮﺟﺐ‬،‫ ﻣﺎ ﻟﻢ ﻳﺮﺩ ﻧﺺ ﺑﺨﻼﻑ ﺫﻟﻚ ﻓﻲ ﻋﻘﺪ ﺍﻟﺨﺪﻣﺔ ﺫﻱ ﺍﻟﺼﻠﺔ‬9-4
4.7 The Customer may not rent, resell or assign the Service without the prior written consent of the ‫ﻫﺬﺍ ﺍﻟﻌﻘﺪ ﻭﻳﻜﻮﻥ ﻟﻬﺎ ﺍﻟﺤﻖ ﻓﻲ ﺍﺳﺘﺮﺩﺍﺩ ﻫﺬﻩ ﺍﻷﺟﻬﺰﺓ ﺍﻟﻤﻘﺪﻣﺔ ﻭﻗﺖ ﻧﻬﺎﻳﺔ ﻫﺬﻩ ﺍﻟﺨﺪﻣﺔ ﺃﻭ‬

‫ ﻳﻮﺍﻓﻖ ﺍﻟﻌﻤﻴﻞ ﻋﻠﻰ ﺍﻻﺷﺘﺮﺍﻙ ﻓﻲ ﺧﺪﻣﺔ "ﺍﻟﺴﺪﺍﺩ ﺍﻟﻔﻮﺭﻱ" ﻻﺳﺘﺨﺪﺍﻡ ﺍﻹﻧﺘﺮﻧﺖ ﺑﻌﺪ ﺍﺳﺘﻬﻼﻙ ﻣﺰﺍﻳﺎ َ ﺑﻴﺎﻧﺎﺕ‬01-4
4.8 The Customer shall notify the Company of any changes in the information provided by the Customer by .‫ﺍﻻﺷﺘﺮﺍﻙ ﻟﻠﺨﺪﻣﺔ ﺍﻟﻤﺸﺘﺮ ً ﻛﺔ ﺑﺎﻟﻜﺎﻣﻞ ﺑﻨﺎﺀ ﻋﻠﻰ ﺍﻟﺘﻌﺮﻓﺔ ﺍﻷﺳﺎﺳﻴﺔ ﻟﻠﺨﺪﻣﺔ‬
its authorized representatives. ‫ ﻳﻤﻜﻦ ﻟﻠﻌﻤﻴﻞ ﻋﺮﺽ ﺍﻻﺷﺘﺮﺍﻙ ﻣﻦ ﺧﻼﻝ ﺗﻄﺒﻴﻖ ﺍﻟﻬﺎﺗﻒ ﺍﻟﺠﻮﺍﻝ ﺃﻭ ﺍﻟﺨﺪﻣﺔ ﺍﻟﺬﺍﺗﻴﺔ ﺃﻭ ﺧﺪﻣﺔ ﺍﻟﻌﻤﻼﺀ ﻋﺒﺮ ﺍﻻﺗﺼﺎﻝ‬11-4

4.10 The Customer agree to subscribe to "Pay As You Go" for the Internet usage after the subscribed data

benefits for subscribed Service is fully consumed based on the basic tariff of the Service.

Article 5: Charges and Fees ‫ ًﻳﻮﻣﺎ ﻣﻦ ﺗﺎﺭﻳﺦ ﺇﺻﺪﺍﺭ ﺍﻟﻔﺎﺗﻮﺭﺓ ﺫﺍﺕ‬60 ‫ ﻳﺤﻖ ﻟﻠﻌﻤﻴﻞ ﺍﻟﺘﻘﺪﻡ ﺑﺎﻋﺘﺮﺍﺽ ﺇﻟﻰ ﺍﻟﺸﺮﻛﺔ ﻋﻦ ﺃﻱ ﺃﺧﻄﺎﺀ ﻓﻲ ﺍﻟﻔﺎﺗﻮﺭﺓ ﺧﻼﻝ‬4-5
5.1 All charges and/or fees payable under this Contract shall be inclusive of Taxes. .‫ ﻳﻮﻣﺎ ﻣﻦ ﺗﺎﺭﻳﺦ ﺍﻟﻔﺎﺗﻮﺭﺓ ﺩﻭﻥ ﺍﻋﺘﺮﺍﺽ ﺗﻌﺘﺒﺮ ﺍﻟﻔﺎﺗﻮﺭﺓ ﻣﻘﺒﻮﻟﺔ ﻣﻦ ﺍﻟﻌﻤﻴﻞ‬60 ‫ ﻭ ﻓﻲ ﺣﺎﻝ ﻣﺮﻭﺭ‬،‫ﺍﻟﺼﻠﺔ‬
5.2 The Company shall bill the postpaid Service charges and Taxes every Gregorian calendar month. ‫ ﻳﺘﻌﻬﺪ ﺍﻟﻌﻤﻴﻞ ﺑﺴﺪﺍﺩ ﺟﻤﻴﻊ ﺍﻟﻤﺒﺎﻟﻎ ﻏﻴﺮ ﺍﻟﻤﺘﻨﺎﺯﻉ ﻋﻠﻴﻬﺎ ﻛﻤﺎ ﻫﻮ ﻣﻮﺿﺢ ﻓﻲ ﺳﺠﻼﺕ ﺍﻟﺸﺮﻛﺔ ﺑﻐﻀﺎﻟﻨﻈﺮ ﻋﻦ ﻃﺮﻳﻘﺔ‬5-5
5.3 Customer undertakes, to pay the Service fees, establishment or connection fees and any additional .‫ﺃﻭ ﺍﻟﻬﻮﻳﺔ ﺍﻟﻔﻌﻠﻴﺔ ﻟﻠﻤﺴﺘﺨﺪﻡ‬/‫ﺍﺳﺘﺨﺪﺍﻣﻬﺎ ﻭ‬
services fees as selected by the Customer within 30 days of the date of invoice. .‫ ﻟﻠﺸﺮﻛﺔ ﺍﻟﺤﻖ ﻓﻲ ﺗﻀﻤﻴﻦ ﺍﻟﻤﺒﺎﻟﻎ ﺍﻟﻤﺴﺘﺤﻘﺔ ﺍﻟﺴﺎﺑﻘﺔ ﻏﻴﺮ ﺍﻟﻤﺘﻨﺎﺯﻉ ﻋﻠﻴﻬﺎ ﻓﻲ ﺍﻟﻔﺎﺗﻮﺭﺓ ﺍﻟﺤﺎﻟﻴﺔ‬6-5
5.4 The Customer has the right to file an objection to the Company for any errors/omissions in an invoice

Article 6: Contract Term, Suspension and Termination ‫ ﻣﺪﺓ ﺍﻟﻌﻘﺪ ﻭﺗﻌﻠﻴﻘﻪ ﻭﺇﻧﻬﺎﺋﻪ‬:6 ‫ﺍﻟﻤﺎﺩﺓ‬
6.1 The term of this Contract shall be valid and enforceable for the Commitment Period (the “Initial Term”) ‫ ﺗﻜﻮﻥ ﻣﺪﺓ ﻫﺬﺍ ﺍﻟﻌﻘﺪ ﺳﺎﺭﻳﺔ ﻭﻧﺎﻓﺬﻩ ﺧﻼﻝ ﻓﺘﺮﺓ ﺍﻻﻟﺘﺰﺍﻡ ﺍﻟﺘﻲ ﺗﺒﺪﺃ ﻓﻲ ﺗﺎﺭﻳﺦ ﺗﻨﺸﻴﻂ ﺍﻟﺨﺪﻣﺔ ﻭﺗﺴﺘﻤﺮ ً ﻟﻠﻤﺪﺓ ﺍﻟﻤﺤﺪﺩﺓ‬1-6
which shall commence on the service activation date. This Contract term shall renew automatically for an ‫ ﻭﺗﺠﺪﺩ ﻣﺪﺓ ﺍﻟﻌﻘﺪ ﺗﻠﻘﺎﺋﻴﺎ ﻟﻔﺘﺮﺍﺕ ﻣﺴﺎﻭﻳﺔ ﻟﻔﺘﺮﺓ ﺍﻻﻟﺘﺰﺍﻡ )ﻭﻳﺸﺎﺭ ﺇﻟﻰ ﻛﻞ ﻓﺘﺮﺓ ﻣﻨﻬﺎ ﺑﺎﺳﻢ "ﻣﺪﺓ‬،‫ﻓﻲ ﺑﻴﺎﻧﺎﺕ ﺍﻻﺷﺘﺮﺍﻙ‬

this Contract. ‫ ﻳﻤﻜﻦ ﻟﻠﻌﻤﻴﻞ ﺇﻧﻬﺎﺀ ﺍﻟﺨﺪﻣﺔ ﻓﻲ ﺃﻱ ﻭﻗﺖ ﻋﻦ ﻃﺮﻳﻖ ﺍﻻﺗﺼﺎﻝ ﺑﺨﺪﻣﺔ ﺍﻟﻌﻤﻼﺀ ﺃﻭ ﺯﻳﺎﺭﺓ ﺃﺣﺪ ﻣﻘﺮﺍﺕ ﺍﻟﺒﻴﻊ ً ﺍﻟﺘﺎﺑﻌﺔ ﻟﻠﺸﺮﻛﺔ‬2-6
6.2 The Customer subject to Article 6.3 below and in accordance with the regulations, bylaws and decisions
‫ﻭﻓﻘﺎ ﻻﺣﻜﺎﻡ ﺍﻟﻔﻘﺮﺓ ﺍﻟﺜﺎﻟﺜﺔ ﻓﻲ ﺍﻟﻤﺎﺩﺓ ﺍﻟﺴﺎﺩﺳﺔ ﻭﻭﻓﻖً ﺍ ﻟﻸﻧﻈﻤﺔ ﻭﺍﻟﻠﻮﺍﺋﺢ ﻭﺍﻟﻘﺮﺍﺭﺍﺕ ﺍﻟﺼﺎﺩﺭﺓ ﻋﻦ ﻫﻴﺌﺔ ﺍﻻﺗﺼﺎﻻﺕ‬
issued by the CITC may terminate the Service any time by calling customer care or visiting a Salam retail
shop. .‫ﻭﺗﻘﻨﻴﺔ ﺍﻟﻤﻌﻠﻮﻣﺎﺕ‬
6.3 In case of termination of the Service by the Customer or the Company in accordance Article 6.2 or ‫ ً ﺇﺫﺍ ﺃﻧﻬﻰ ﺍﻟﻌﻤﻴﻞ ﺍﻟﺨﺪﻣﺔ ﻭﻓﻖً ﺍ ﻟﻠﻔﻘﺮﺓ ﺍﻟﺜﺎﻧﻴﺔ ﻓﻲ ﺍﻟﻤﺎﺩﺓ ﺍﻟﺴﺎﺩﺳﺔ ﺃﻭ ﺃﻧﻬﺖ ﺍﻟﺸﺮﻛﺔ ﺍﻟﺨﺪﻣﺔ ﻭﻓﻘﺎٌ ﻟﻠﻔﻘﺮﺓ ﺍﻟﺨﺎﻣﺴﺔ‬3-6
Article 6.5 respectively prior to the end of the Commitment Period, the Customer shall be obliged to pay ‫ ﻓﺈﻥ ﺍﻟﻌﻤﻴﻞ ﻣﻠﺰﻡ ﺑﺴﺪﺍﺩ ﺍﻟﺮﺳﻮﻡ ﻋﻦ ﺍﻟﻤﺪﺓ ﺍﻟﻤﺘﺒﻘﻴﺔ ﻣﻦ ﻓﺘﺮﺓ ﺍﻻﻟﺘﺰﺍﻡ‬، ‫ﻓﻲ ﺍﻟﻤﺎﺩﺓ ﺍﻟﺴﺎﺩﺳﺔ ﻗﺒﻞ ﻧﻬﺎﻳﺔ ﺍﻟﻤﺪﺓ ﺍﻷﻭﻟﻴﺔ‬
the fees for the remaining term of the Commitment Period at the time of termination as stipulated in this ‫ ﻭﻳﺸﻤﻞ ﺇﻧﻬﺎﺀ ﺍﻟﻌﻤﻴﻞ ﻟﻠﺨﺪﻣﺔ ﻧﻘﻞ ﺍﻟﺮﻗﻢ ﺇﻟﻰ ﻣﺸﻐﻞ ﺁﺧﺮ‬.‫ﻓﻲ ﻭﻗﺖ ﺍﻹﻧﻬﺎﺀ ﺣﺴﺒﻤﺎ ﻫﻮ ﻣﻨﺼﻮﺹ ﻋﻠﻴﻪ ﻓﻲ ﻫﺬﺍ ﺍﻟﻌﻘﺪ‬
Contract. For the avoidance of doubt, termination of the Service by the Customer shall include porting the .‫ﺃﻭ ﻧﻘﻞ ﺍﻟﺮﻗﻢ ﺇﻟﻰ ﻋﻤﻴﻞ ﺁﺧﺮ‬
number to another operator or transfer the number to another customer. ‫ ﻭﻳﺘﻌﻴﻦ‬،‫( ﺷﻬﺮﺍ ﺇﺫﺍ ﺗﺤﺪﺩ ﺫﻟﻚ ﻓﻲ ﺗﻔﺎﺻﻴﻞ ﺍﻟﺨﺪﻣﺔ‬12)‫ ﻳﺤﻖ ﻟﻠﻌﻤﻴﻞ ﻃﻠﺐ ﺗﻌﻠﻴﻖ ﺍﻟﺨﺪﻣﺔ ﻟﻤﺪﺓ ﺃﻗﺼﺎﻫﺎ ﺍﺛﻨﻰ ﻋﺸﺮ‬4-6
6.4 The Customer has the right to request the suspension of the Service for a maximum of (12) months if ‫ﻋﻠﻴﻪ ﺳﺪﺍﺩ ﺭﺳﻮﻡ ﺍﻟﺘﻌﻠﻴﻖ ﺍﻟﻤﺤﺪﺩﺓ ﻟﻬﺬﻩ‬
indicated in the details of the Service, and shall pay the recurring suspension fees for this period. . ‫ﺓ‬ ‫ﺮ‬ ‫ﺘ‬ ‫ﻔ‬ ‫ﻟ‬ ‫ﺍ‬
‫ ﻳﺠﻮﺯ ﻟﻠﺸﺮﻛﺔ ﺗﻌﻠﻴﻖ ﺃﻭ ﺇﻧﻬﺎﺀ ﺍﻟﺨﺪﻣﺔ ﻭﻓﻖً ﺍ ﻟﻸﻧﻈﻤﺔ ﻭﺍﻟﻠﻮﺍﺋﺢ ﻭﺍﻟﻘﺮﺍﺭﺍﺕ ﺍﻟﺼﺎﺩﺭﺓ ﻋﻦ ﺍﻟﻬﻴﺌﺔ ﻓﻲ ﺃﻱ ﻣﻦ ﺍﻟﺤﺎﻻﺕ‬5-6
6.5 The Company may suspend or terminate the Service in accordance with the regulations, bylaws and
decisions issued by the CITC in any of the following cases: :‫ﺍﻟﺘﺎﻟﻴﺔ‬
6.5.a) The Customer’s failure to provide the insurance deposit referred to in Article (3). .‫ﺃ( ﺇﺫﺍ ﻟﻢ ﻳﺴﺪﺩ ﺍﻟﻌﻤﻴﻞ ﻣﺒﻠﻎ ﺍﻟﺘﺄﻣﻴﻦ ﺍﻟﻤﺸﺎﺭ ﺇﻟﻴﻬﺎ ﻓﻲ ﺍﻟﻤﺎﺩﺓ ﺍﻟﺜﺎﻟﺜﺔ‬-5-6
6.5.b) The Customer’s failure to abide by the terms of payment according to the details of the Service .(‫ ﻓﺘﺮﺓ ﺍﻻﻟﺘﺰﺍﻡ‬/‫ﺏ( ﺇﺫﺍ ﻟﻢ ﻳﻠﺘﺰﻡ ﺍﻟﻌﻤﻴﻞ ﺑﺸﺮﻭﻁ ﺍﻟﺴﺪﺍﺩ ﻭﻓﻖً ﺍ ﻟﺘﻔﺎﺻﻴﻞ ﺍﻟﺨﺪﻣﺔ )ﺍﻟﺮﺳﻮﻡ ﺍﻟﺸﻬﺮﻳﺔ ﻭ‬-5-6
(Monthly Fees and/or Commitment Period). ‫( ﻳﻮﻣﺎ ﻣﻦ ﺗﺎﺭﻳﺦ‬25) ‫ﺝ( ﺇﺫﺍ ﻟﻢ ﻳﺴﺪﺩ ﺍﻟﻌﻤﻴﻞ ﺍﻟﻔﻮﺍﺗﻴﺮ ﻓﻲ ﻣﻮﺍﻋﻴﺪ ﺍﺳﺘﺤﻘﺎﻗﻬﺎ؛ ﺷﺮﻳﻄﺔ ﻣﺮﻭﺭ ﺧﻤﺴﺔ ﻭﻋﺸﺮﻳﻦ‬-5-6
6.5.c) The Customer’s failure to pay the invoices within their due dates; provided that twenty-five (25) days ‫ ﻳﺤﻖ ﻟﻠﺸﺮﻛﺔ ﺃ( ﻣﺒﺎﺷﺮﺓ ﺍﻹﺟﺮﺍﺀﺍﺕ‬،‫( ﻳﻮﻣﺎ ﻣﻦ ﺗﺎﺭﻳﺦ ﺍﺳﺘﺤﻘﺎﻗﻬﺎ‬40) ‫ ﻭﻓﻲ ﺣﺎﻝ ﺗﺄﺧﺮ ﺳﺪﺍﺩ ﺍﻟﻔﻮﺍﺗﻴﺮ ﻋﻦ ﺃﺭﺑﻌﻴﻦ‬،‫ﺍﻻﺳﺘﺤﻘﺎﻕ‬

has the right to a) initiate legal proceedings or b) transfer the unsettled due amounts to any of the .‫ﺍﻟﺸﺮﻛﺔ ﻭﻓﻖً ﺍ ﻹﺷﻌﺎﺭ ﻱ َﺭﺳﻞ ﺇﻟﻰ ﺍﻟﻌﻤﻴﻞ‬
Customer’s other accounts held with the Company subject to a notification to the Customer.
‫ ًّ ﺩ( ﺇﺫﺍ ﺧﺎﻟﻒ ﺍﻟﻌﻤﻴﻞ ﺃﻳﺎ ﻣﻦ ﺍﻟﺒﻨﻮﺩ ﻭﺍﻟﺸﺮﻭﻁ ﺍﻟﻮﺍﺭﺩﺓ ﻓﻲ ﻫﺬﺍ ﺍﻟﻌﻘﺪ ﺃﻭ ﺍﻷﻧﻈﻤﺔ ﻭﺍﻟﻠﻮﺍﺋﺢ ﻭﺍﻟﻘﺮﺍﺭﺍﺕ ﺍﻟﺼﺎﺩﺭﺓ ﻣﻦ‬-5-6
6.5.d) The Customer’s violation of any of the terms and conditions listed herein or in the regulations,
bylaws and decisions issued by the CITC. .‫ﻫﻴﺌﺔ ﺍﻻﺗﺼﺎﻻﺕ ﻭﺗﻘﻨﻴﺔ ﺍﻟﻤﻌﻠﻮﻣﺎﺕ‬
6.5.e) The Company discovers that the Customer has provided false or misleading documents or ‫ ﻭﻟﻢ ﻳﺰﻭﺩ ﺍﻟﻌﻤﻴﻞ ﺍﻟﺸﺮﻛﺔ‬،‫ﻫـ( ﺇﺫﺍ ﺍﻛﺘﺸﻔﺖ ﺍﻟﺸﺮﻛﺔ ﺃﻥ ﺍﻟﻌﻤﻴﻞ ﻗﺪ ﻗﺪﻡ ﻣﺴﺘﻨﺪﺍﺕ ﺃﻭ ﻣﻌﻠﻮﻣﺎﺕ ﺧﺎﻃﺌﺔ ﺃﻭ ﻣﻀﻠﻠﺔ‬-5-6
information, and the Customer has failed to provide the Company with the updated/corrected documents .‫ﺍﻟﻤﺼﺤﺤﺔ‬/‫ﺑﺎﻟﻮﺛﺎﺋﻖ ﻭﺍﻟﻤﻌﻠﻮﻣﺎﺕ ﺍﻟﻤﺤﺪﺛﺔ‬
and information. .‫ﻭ( ﺇﺫﺍ ﻃﻠﺒﺖ ﻫﻴﺌﺔ ﺍﻻﺗﺼﺎﻻﺕ ﻭﺗﻘﻨﻴﺔ ﺍﻟﻤﻌﻠﻮﻣﺎﺕ ﺗﻌﻠﻴﻖ ﺃﻭ ﺇﻧﻬﺎﺀ ﺍﻟﺨﺪﻣﺔ‬-5-6
6.5.f) Upon CITC’s request for suspension or termination of the Service. ‫ ﻳﻜﻮﻥ ﺍﻟﻌﻤﻴﻞ ﻣﺴﺆﻭﻻ ﻋﻦ ﺳﺪﺍﺩ ﺃﻱ ﻣﺒﺎﻟﻎ‬،‫ ً ﻳﻮﺍﻓﻖ ﺍﻟﻌﻤﻴﻞ ﻋﻠﻰ ﺃﻧﻪ ﺑﻐﺾ ﺍﻟﻨﻈﺮ ﻋﻦ ﺗﻌﻠﻴﻖ ﺃﻭ ﺇﻧﻬﺎﺀ ﺍﻟﺨﺪﻣﺔ‬6-6
6.6 Customer agrees that regardless of the suspension or the termination of the Service, the Customer is .‫ﻣﺴﺘﺤﻘﺔ ﻟﻠﺸﺮﻛﺔ‬
responsible for paying any due amounts to the Company.

Article 7: Limitation of Liability ‫ ﺗﺤﺪﻳﺪ ﺍﻟﻤﺴﺆﻭﻟﻴﺔ‬:7 ‫ﺍﻟﻤﺎﺩﺓ‬


7.1 The Company shall not be liable to the Customer in case of a force majeure event or any other reasons .‫ ﻟﻦ ﺗﻜﻮﻥ ﺍﻟﺸﺮﻛﺔ ﻣﺴﺆﻭﻟﺔ ﺃﻣﺎﻡ ﺍﻟﻌﻤﻴﻞ ﻓﻲ ﺣﺎﻟﺔ ﺣﺪﻭﺙ ﻗﻮﺓ ﻗﺎﻫﺮﺓ ﺃﻭ ﺃﻱ ﺃﺳﺒﺎﺏ ﺃﺧﺮﻯ ﺧﺎﺭﺟﺔ ﻋﻦ ﺇﺭﺍﺩﺗﻬﺎ ﺍﻟﻤﻌﻘﻮﻟﺔ‬1-7
beyond its reasonable control. ‫ﺑﻬﺎ ﻧﺘﻴﺠﺔ ﻟﺨﻠﻞ ﻓﻲ‬/‫ ﻟﻦ ﺗﻜﻮﻥ ﺍﻟﺸﺮﻛﺔ ﻣﺴﺆﻭﻟﺔ ﺃﻣﺎﻡ ﺍﻟﻌﻤﻴﻞ ﻋﻦ ﺃﻱ ﺧﺴﺎﺭﺓ ﺃﻭ ﺗﻠﻒ ﻟﻸﺟﻬﺰﺓ ﺃﻭ ﺍﻟﺒﻄﺎﻗﺔ ﺍﻟﺨﺎﺻﺔ ﺑﻪ‬2-7
7.2 The Company shall not be liable to the Customer for any loss or damage to Devices or his/her subscriber .‫ ﺃﻭ ﺗﻮﻗﻒ ﻓﻲ ﺃﻱ ﻣﻦ ﺍﻟﺨﺪﻣﺎﺕ ﺍﻟﻤﻄﻠﻮﺑﺔ‬،‫ ﺃﻭ ﺗﺄﺧﻴﺮ ﻓﻲ ﻭﻇﺎﺋﻔﻪ‬،‫ﻫﺎﺗﻔﻪ ﺍﻟﺠﻮﺍﻝ‬
identification module (SIM) card as a result of a defect in his mobile phone, delay in its functions, or ‫ ﻟﻦ ﺗﻜﻮﻥ ﺍﻟﺸﺮﻛﺔ ﻣﺴﺆﻭﻟﺔ ﻋﻦ ﺃﻱ ﻋﺪﻡ ﺍﺳﺘﻘﺮﺍﺭ ﺃﻭ ﻧﻘﺺ ﺃﻭ ﺍﻧﻘﻄﺎﻉ ﻓﻲ ﺍﻟﺨﺪﻣﺔ ﻧﺎﺗﺞ ﻋﻦ ﺗﻌﺪﻳﻞ ﺍﻟﺸﺒﻜﺔ ﻟﺘﺤﺴﻴﻦ‬3-7
stoppage in any of the requested Services.
‫ﺍﻟﺨﺪﻣﺔ ﺃﻭ ﺃﻱ ﺃﺧﻄﺎﺀ ﻧﺎﺗﺠﺔ ﻋﻦ ﺍﻟﺘﻐﻴﺮﺍﺕ ﺍﻟﻤﻨﺎﺧﻴﺔ ﺃﻭ ﺍﻟﺠﻐﺮﺍﻓﻴﺔ ﺑﺎﺳﺘﺜﻨﺎﺀ ﻣﺴﺆﻭﻟﻴﺘﻬﺎ ﻋﻦ ﺍﻋﺎﺩﺓ َ ﺍﻟﻤﺒﺎﻟﻎ ﺍﻟﻤﺎﻟﻴﺔ ﺍﻟﻤﺪﻓﻮﻋﺔ‬
7.3 The Company shall not be liable for any instability, shortage or interruption in the Service resulting from
adjusting the network to improve the Service or any faults resulting from climate or geographical changes .‫ﻟﻠﻌﻤﻴﻞ ﻋﻦ ﻓﺘﺮﺓ ﺍﻻﻧﻘﻄﺎﻉ ﺇﺫﺍ ﻛﺎﻥ ﻗﺪ ﺛُﺒﺖَ ﺍﻟﺘﺪﺧﻞ ﺍﻟﻤﺘﻌﻤﺪ ﻟﻠﺸﺮﻛﺔ‬
except for the financial reimbursements to the Customer for the subject interruption period if the deliberate
interference of the Company is proven. ‫ ﺇﻣﻜﺎﻧﻴﺔ ﻧﻘﻞ ﺭﻗﻢ ﺍﻟﻬﺎﺗﻒ ﺍﻟﺠﻮﺍﻝ‬:8 ‫ﺍﻟﻤﺎﺩﺓ‬
.‫ﺗﺘﻢ ﻋﻤﻠﻴﺔ ﻧﻘﻞ ﺭﻗﻢ ﺍﻟﻬﺎﺗﻒ ﺍﻟﺠﻮﺍﻝ ﻭﻓﻖً ﺍ ﻟﻸﻧﻈﻤﺔ ﻭﺍﻟﻠﻮﺍﺋﺢ ﻭﺍﻟﻘﺮﺍﺭﺍﺕ ﺍﻟﺼﺎﺩﺭﺓ ﻋﻦ ﻫﻴﺌﺔ ﺍﻻﺗﺼﺎﻻﺕ ﻭﺗﻘﻨﻴﺔﺍﻟﻤﻌﻠﻮﻣﺎﺕ‬
Article 8: Mobile Number Portability
Mobile Number Portability process shall be in accordance with the regulations, bylaws, and decisions issued
by the CITC. ‫ ﺑﺮﻧﺎﻣﺞ ﺍﻟﺨﺼﻢ ﻋﻠﻰ ﺍﻷﺟﻬﺰﺓ‬:9 ‫ﺍﻟﻤﺎﺩﺓ‬
‫ ّ ﻳﺘﻌﻴﻦ ﻋﻠﻰ ﺍﻟﻌﻤﻴﻞ )ﺇﺫﺍ ﻭﻗﻊ ﻋﻠﻴﻪ ﺍﻻﺧﺘﻴﺎﺭ( ﺳﺪﺍﺩ ﺍﻟﺴﻌﺮ ﺍﻟﻤﺨﻔﺾ ﻟﻠﺠﻬﺎﺯ ﺍﻟﻤﺨﺘﺎﺭ ﺑﻌﺪ ﻗﺒﻮﻝ ﺷﺮﻭﻁ ً ﻭﺃﺣﻜﺎﻡ ﻫﺬﺍ‬1-9
Article 9: Device Discount Program .‫ﺍﻟﻌﻘﺪ ﺇﻟﻜﺘﺮﻭﻧﻴﺎ‬
9.1 The Customer (if selected) shall pay the discounted price of the chosen Device after electronically ‫ ّ ﻳﺘﻌﻲ ً ﻥ ﻋﻠﻰ ﺍﻟﻌﻤﻴﻞ ﺍﻻﺷﺘﺮﺍﻙ ﻓﻲ ﺇﺣﺪﻯ ﺍﻟﺒﺎﻗﺎﺕ ﺍﻟﻤﻔﻮﺗﺮﺓ ﺍﻟﻤﺴﻤﻮﺡ ﺑﻬﺎ ﻟﻴﻜﻮﻥ ﻣﺆﻫﻼ ﻟﻼﺷﺘﺮﺍﻙ ﻓﻲ ﺑﺮﻧﺎﻣﺞ‬2-9
accepting the terms & conditions of this Contract. .‫ﺍﻟﺨﺼﻮﻣﺎﺕ ﻋﻠﻰ ﺍﻷﺟﻬﺰﺓ‬
9.2 The Customer shall subscribe to a Permitted Postpaid Package to be eligible to subscribe to the Device ‫ ﺗﺤﺘﻔﻆ ﺍﻟﺸﺮﻛﺔ ﺑﺤﻘﻬﺎ ﻓﻲ ﺗﻘﻴﻴﻢ ﺃﻫﻠﻴﺔ ﺍﻟﻌﻤﻴﻞ ﻭﻓﻖً ﺍ ﻟﺘﻘﺪﻳﺮﻫﺎ ﻟﻼﺷﺘﺮﺍﻙ ﻓﻲ ﺑﺮﻧﺎﻣﺞ ﺍﻟﺨﺼﻮﻣﺎﺕ ﻋﻠﻰ ً ﺍﻷﺟﻬﺰﺓ ﺫﻱ‬3-9
Discount Program. .‫ﺍﻟﺼﻠﺔ ﺑﻨﺎﺀ ﻋﻠﻰ ﺍﻟﺴﺠﻞ ﺍﻻﺋﺘﻤﺎﻧﻲ ﻟﻠﻌﻤﻴﻞ ﻣﻊ ﺍﻟﺸﺮﻛﺔ‬
9.3 The Company reserves the right to evaluate at its sole discretion the Customer’s eligibility to subscribe .‫ ﻻ ﻳﺠﻮﺯ ﻟﻠﻌﻤﻴﻞ ﺍﻻﺳﺘﻔﺎﺩﺓ ﻣﻦ ﺑﺮﻧﺎﻣﺞ ﺍﻟﺨﺼﻮﻣﺎﺕ ﻋﻠﻰ ﺍﻷﺟﻬﺰﺓ ﺃﻛﺜﺮ ﻣﻦ ﻣﺮﺓ ﺑﺎﺳﺘﺨﺪﺍﻡ ﻧﻔﺲ ﺭﻗﻢ ﺍﻟﻬﺎﺗﻒ ﺍﻟﺠﻮﺍﻝ‬4-9
to the subject Device Discount Program based on the Customer’s credit history with the Company. ‫ ﻭﻟﻦ ﺗﻜﻮﻥ ﺍﻟﺸﺮﻛﺔ ﻣﺴﺆﻭﻟﺔ‬،‫ ﻳﺨﻀﻊ ﺍﻟﺠﻬﺎﺯ ﺍﻟﺬﻱ ﺗﻢ ﺷﺮﺍﺅﻩ ﻟﺸﺮﻭﻁ ﺍﻟﻀﻤﺎﻥ ﺍﻟﺘﻲ ﺗﺤﺪﺩﻫﺎ ﺍﻟﺸﺮﻛﺔ ﺍﻟﻤﺼﻨﻌﺔ ﻟﻠﺠﻬﺎﺯ‬5-9
9.4 The Customer may not benefit from the Device Discount Program more than once under the same
mobile number. .‫ﻋﻦ ﺃﻱ ﺧﻄﺄ ﺃﻭ ﻋﻴﺐ ﻓﻲ ﺍﻟﺠﻬﺎﺯ‬
9.5 The purchased Device is subject to the warranty terms specified by the subject Device manufacturer. ‫ ﻭﻳﻤﻜﻦ ﺭﻓﻊ ﻫﺬﺍ ﺍﻟﻘﻴﺪ ﺭﻫﻦً ﺍ ﺑﺴﺪﺍﺩ ﺟﻤﻴﻊ‬،‫ ﻳﺤﻖ ﻟﻠﺸﺮﻛﺔ ﻗﺼﺮ ﺍﺳﺘﺨﺪﺍﻡ ﺍﻷﺟﻬﺰﺓ ﻋﻠﻰ ﺍﻟﺒﻄﺎﻗﺎﺕ ﺍﻟﺼﺎﺩﺭﺓ ﻣﻨﻬﺎ ﻓﻘﻂ‬6-9
The Company shall not be liable for any error or defect in the Device. .‫ﺍﻟﻤﺒﺎﻟﻎ ﺍﻟﻤﺴﺘﺤﻘﺔ ﻣﻦ ﺍﻟﻌﻤﻴﻞ‬
9.6 The Company have the right to limit the use of the Devices to its issued SIM cards only. This limitation .‫ﺍﻟﻤﺪﺓ ﺍﻻﻭﻟﻴﺔ‬/‫ﻏﻴﺮ ﻣﻔﻮﺗﺮ ﺑﺎﻹﺿﺎﻓﺔ ﺇﻟﻰ ﺑﺎﻗﻲ ﻗﻴﻤﺔ ﺍﻟﺠﻬﺎﺯ‬/‫ ﻳﺘﺤﻤﻞ ﺍﻟﻌﻤﻴﻞ ﻣﺴﺆﻭﻟﻴﺔ ﺗﺴﻮﻳﺔ ﺃﻱ ﻣﺒﻠﻎ ﻣﺴﺘﺤﻖ ﻣﻔﻮﺗﺮ‬7-9
can be lifted subject to the payment of all of the due amounts by the Customer.
9.7 The customer is liable to settle any outstanding billed/unbilled amount in addition to the remainder of

Article 10: Terms and conditions for mobile network coverage ‫ ﺳﻴﺘﻢ ﺗﻘﺪﻳﻢ ﺧﺪﻣﺎﺕ ﺍﻟﺸﺮﻛﺔ ﺍﻟﻤﻘﺪﻣﺔ ﺑﻤﻮﺟﺐ ﻫﺬﺍ ﺍﻟﻌﻘﺪ ﻋﻠﻰ‬،‫ ﻳﻘﺮ ﺍﻟﻌﻤﻴﻞ ﺑﺄﻧﻪ ﻣﺎ ﻟﻢ ﻳﺮﺩ ﻧﺺ ﺑﺨﻼﻑ ﺫﻟﻚ‬2-01
10.1 The Customer acknowledges that the Service is provided using Mobile Telecommunications Company ‫ ﻭﺳﺘﺨﺘﻠﻒ ﺳﺮﻋﺎﺕ ﺍﻟﺘﺤﻤﻴﻞ ﻭﺍﻟﺘﻨﺰﻳﻞ ﺍﻟﻔﻌﻠﻴﺔ ﺣﺴﺐ‬،‫ﺃﺳﺎﺱ ﺑﺬﻝ ﺃﻗﺼﻰ ﺟﻬﺪ ﻭﻗﺪ ﺗﺨﻀﻊ ﻟﻨﺴﺐ ﺍﻟﺘﻨﺎﻓﺲ ﺍﻟﻤﻌﻤﻮﻝ ﺑﻬﺎ‬
Saudi Arabia’s (“Zain”) infrastructure. .‫ﺿﻐﻂ ﺍﻹﺳﺘﺨﺪﺍﻡ ﻭﺗﻮﺍﻓﺮ ﺍﻟﺸﺒﻜﺔ‬
10.2 The Customer acknowledges that unless otherwise stated, Company’s Services offered under this ‫ ً ﻳﻘﺮ ﺍﻟﻌﻤﻴﻞ ﺑﺄﻧﻪ ﺳﻴﺘﻢ ﺗﻘﺪﻳﻢ ﺍﻟﺨﺪﻣﺔ ﺑﻨﺎﺀ ﻋﻠﻰ ﺗﻐﻄﻴﺔ ﺷﺒﻜﺔ ﺍﻟﻬﺎﺗﻒ ﺍﻟﺠﻮﺍﻝ ﺍﻟﻤﺘﺎﺣﺔ ﻭﻓﻖً ﺍ ﻟﺨﺮﻳﻄﺔ ﺍﻟﺘﻐﻄﻴﺔ‬3-01
Contract will be delivered on a best effort basis and may be subject to applicable contention ratios. Actual .‫ﺍﻟﻤﻨﺸﻮﺭﺓ ﻟﻠﺸﺮﻛﺔ‬
upload and download speeds will vary depending on congestion and network availability.
10.3 The Customer acknowledges that the Service will be provided based on the available mobile network
coverage in accordance with the Company’s published coverage map. ‫ ﺃﺣﻜﺎﻡ ﻋﺎﻣﺔ‬:11 ‫ﺍﻟﻤﺎﺩﺓ‬
‫ ﻭﻳﻮﺍﻓﻖ ﻋﻠﻰ ﺍﻻﻟﺘﺰﺍﻡ ﺑﺠﻤﻴﻊ ﺍﻟﺸﺮﻭﻁ ﻭﺍﻷﺣﻜﺎﻡ ﺍﻟﻮﺍﺭﺩﺓ‬،‫ ﻳﻘﺮ ﺍﻟﻌﻤﻴﻞ ﺑﺄﻧﻪ ﻣﺆﻫﻞ ﻧﻈﺎﻣﺎ ﻭﺷﺮﻋﺎ ﻹﺑﺮﺍﻡ ﻫﺬﺍ ﺍﻟﻌﻘﺪ‬1-11
Article 11: General Provisions .‫ﻫﻨﺎ‬
11.1 The Customer acknowledges that he is legally competent to conclude this Contract, and agrees to ‫ ﻳﺤﻖ ﻟﻠﺸﺮﻛﺔ ﺗﺒﺎﺩﻝ ﺍﻟﻤﻌﻠﻮﻣﺎﺕ ﺍﻻﺋﺘﻤﺎﻧﻴﺔ ﺍﻟﺨﺎﺻﺔ ﺑﺎﻟﻌﻤﻴﻞ ﻣﻊ ﺟﻬﺎﺕ‬،‫ ﺇﺫﺍ ﻟﻢ ﻳﻠﺘﺰﻡ ﺍﻟﻌﻤﻴﻞ ﺑﺴﺪﺍﺩ ﻗﻴﻤﺔ ﺍﻟﺨﺪﻣﺎﺕ‬2-11
abide by all the terms and conditions contained herein. .‫ﺍﻻﺋﺘﻤﺎﻥ ﻣﺜﻞ ﺳﻤﺔ‬
11.2 Should the Customer be in a position where he is unable to pay for the services, the Company has the ‫ ﺗﻘﺪﻳﻢ ﺍﻟﻨﺰﺍﻉ ﺇﻟﻰ ﻫﻴﺌﺔ ﺍﻻﺗﺼﺎﻻﺕ ﻭﺗﻘﻨﻴﺔ‬،‫ ﻓﻲ ﺣﺎﻟﺔ ﻧﺸﻮﺀ ﻧﺰﺍﻉ ﺃﻭ ﺧﻼﻑ ﺑﻤﻮﺟﺐ ﻫﺬﺍ ﺍﻟﻌﻘﺪ‬،‫ ﻳﺤﻖ ﻟﻠﻌﻤﻴﻞ‬3-11
right to exchange the credit information of the Customer with credit bureaus such as SIMAH. .‫ﺍﻟﻤﻌﻠﻮﻣﺎﺕ ﺇﺫﺍ ﻟﻢ ﻳﺘﻢ ﺍﻟﺘﻮﺻﻞ ﺇﻟﻰ ﺣﻞ ﻣﻊ ﺍﻟﺸﺮﻛﺔ‬
11.3 The Customer shall have the right, in case of a dispute or a disagreement arising under this Contract, ‫ ً ﻳﺤﻖ ﻟﻠﺸﺮﻛﺔ ﻣﺮﺍﺟﻌﺔ ﺷﺮﻭﻁ ﻭﺃﺣﻜﺎﻡ ﻫﺬﺍ ﺍﻟﻌﻘﺪ ﻭﻓﻘﺎ ﻟﻸﻧﻈﻤﺔ ﻭﺍﻟﻠﻮﺍﺋﺢ ﻭﺍﻟﻘﺮﺍﺭﺍﺕ ﺍﻟﺼﺎﺩﺭﺓ ﻋﻦ ﻫﻴﺌﺔ ﺍﻻﺗﺼﺎﻻﺕ‬4-11
to submit the dispute to the CITC if an amicable resolution wasn’t reached with the Company. .‫ﻭﺗﻘﻨﻴﺔ ﺍﻟﻤﻌﻠﻮﻣﺎﺕ‬
11.4 The Company shall have the right to revise the terms and conditions of this Contract in accordance ‫ ﺗﻠﺘﺰﻡ ﺍﻟﺸﺮﻛﺔ ﺑﺎﻟﺤﻔﺎﻅ ﻋﻠﻰ ﺳﺮﻳﺔ ﻣﻌﻠﻮﻣﺎﺕ ﺍﻟﻌﻤﻴﻞ ﻭﻳﻘﺮ ﺍﻟﻌﻤﻴﻞ ﻭﻳﻮﺍﻓﻖ ﻋﻠﻰ ﺃﻧﻪ ﻳﺠﻮﺯ ﻟﻠﺸﺮﻛﺔ ً ﺍﻟﻜﺸﻒ ﻋﻦ‬5-11
with the regulations, bylaws and decisions issued by the CITC.
.‫ﻣﻌﻠﻮﻣﺎﺕ ﺍﻟﻌﻤﻴﻞ ﺃﻭ ﺗﻔﺎﺻﻴﻞ ﺍﺳﺘﺨﺪﺍﻡ ﺍﻟﺨﺪﻣﺔ ﺑﻨﺎﺀ ﻋﻠﻰ ﻃﻠﺐ ﻫﻴﺌﺔ ﺍﻻﺗﺼﺎﻻﺕ ﻭﺗﻘﻨﻴﺔ ﺍﻟﻤﻌﻠﻮﻣﺎﺕ ﺃﻭ ﺃﻱ ﺟﻬﺔ ﻣﺨﺘﺼﺔ‬
11.5 The Company commits to maintain the confidentially of the Customer’s information and the Customer
acknowledges and agrees that the Company may reveal Customer information or the details of usage of ‫ ﻓﻲ ﺣﺎﻟﺔ ﻭﺟﻮﺩ ﺃﻱ ﺗﻌﺎﺭﺽ ﺑﻴﻦ ﺍﻷﺣﻜﺎﻡ ﺍﻟﺼﺎﺩﺭﺓ ﺑﺎﻟﻠﻐﺔ ﺍﻟﻌﺮﺑﻴﺔ ﻭﺍﻷﺣﻜﺎﻡ ﺍﻟﺼﺎﺩﺭﺓ ﺑﺎﻟﻠﻐﺔ ﺍﻹﻧﺠﻠﻴﺰﻳﺔ ُ ﻟﺸﺮﻭﻁ ﻭﺃﺣﻜﺎﻡ‬6-11
the Service upon the request of CITC or any competent authority. .‫ ﻱ َﻋﻤﻞ ﺑﺎﻷﺣﻜﺎﻡ ﻓﻲ ﻧﺴﺨﺘﻬﺎ ﺍﻟﻌﺮﺑﻴﺔ‬،‫ﻫﺬﺍ ﺍﻟﻌﻘﺪ‬
11.6 In case of any discrepancy between the Arabic and English provisions of the terms and conditions of ‫ ﻳﻘﺮ ﺍﻟﻌﻤﻴﻞ ﺑﻤﻮﺟﺒﻪ ﺃﻥ ﺍﻟﻤﻌﻠﻮﻣﺎﺕ ﺍﻟﺸﺨﺼﻴﺔ ﺍﻟﻤﻘﺪﻣﺔ ﻣﻦ ﻗﺒﻠﻪ ﺻﺤﻴﺤﺔ ﻭﺩﻗﻴﻘﺔ؛ ﻭﻓﻲ ﺣﺎﻝ ﺛﺒﻮﺕ ً ﺃﻥ ﺃﻳﺎ ﻣﻦ‬7-11
this Contract, the Arabic text shall prevail. .‫ ﻳﺘﻌﻬﺪ ﺍﻟﻌﻤﻴﻞ ﺑﺈﺑﻼﻍ ﺍﻟﺸﺮﻛﺔ ﺑﻬﺬﺍ ﺍﻟﺘﻨﺎﻗﺾ‬،‫ﺍﻟﻤﻌﻠﻮﻣﺎﺕ ﻏﻴﺮ ﺻﺤﻴﺤﺔ ﺃﻭ ﻏﻴﺮ ﺩﻗﻴﻘﺔ‬
11.7 The Customer hereby declare that the personal information provided are true and accurate; In the
event it is established that any of the information are incorrect or inaccurate, the Customer undertake to
inform the Company of such discrepancy.
