The terms ' Justice’ ‘Equality' ‘Liberty' are considered as the basic principles of Indian
constitution which does not require any further explanations. Article 14 provides for equality,
whereas article 21 provides for liberty. However, even after 73 years of Republic India, a
question arises whether these rights are protected or not. Before reaching an answer to this
question, it is important to discuss the status of LGBT community in India. For many decades
the Lesbian, Gay, Bisexual and Transgender rights has been a debate in our country. With a
view to protect the rights of the LGBT community, the supreme court of India in the case of
Navtej Singh v Union of India, decriminalised the act of homosexuality which was an offence
under section 377 of Indian Penal Code. The government of India has also passed ‘The
transgender persons (protection of rights) bill in 2018.Even after these efforts by the
government, LGBT community is still deprived of their fundamental rights. India does not
recognize homosexual marriage and they are deprived of their right to get marital status. So
this paper is an effort to discuss the constitutional efforts taken for protecting the
fundamental rights of LGBT community, its shortcomings and their current status in India.
