URGENT MOTION FOR
RESETTING
(Re: Hearing scheduled on June 9, 2023)
Plaintiff PEOPLE OF THE PHILIPPINES, through the
undersigned Private Prosecutor, respectfully states:
1. The next hearing, for the continuation of the presentation of
the evidence for the prosecution, is scheduled on June 9, 2023, wherein
Ms. Maria Luz G. Acorda— business manager at Bank of the Philippine
Islands Pilar Village Branch—is supposed to continue testifying. To
recall, Ms. Acorda was supposed to be presented on April 24, 2023, but
the prosecution was constrained to move for a cancellation of the said
hearing as it learned that Ms. Acorda was on indefinite leave due to
medical reasons.
2. Upon correspondence with Ms. Acorda, the undersigned
was informed that she is still on her indefinite leave for medical reasons.
Nevertheless, Ms. Acorda will make herself available for the
continuation and termination of her presentation as witness, except on
June 9 and 16, and July 7, 2023, mostly by reason of the chemotherapy
regimen she is undergoing. Also, Ms. Acorda will not be available on
July 19, 2023 onwards since she will be travelling to the United States of
America where her treatment will be continued.3. _ In view of the circumstances, plaintiff respectfully requests
that the scheduled hearing for the continuation of the presentation of
the prosecution’s evidence on June 9, 2023 be reset to June 14, 19, or 21,
2023, or such other date which the Honorable Court would deem
convenient and practicable, except for Thursdays (because of the
unavailability of the public prosecutor).
4. This motion is not intended to delay the proceedings
whatsoever, but is necessitated solely by the reason above stated.
PRAYER
WHEREFORE, plaintiff PEOPLE OF THE PHILIPPINES
respectfully prays that the Honorable Court:
1 CANCEL the hearing scheduled on June 9, 2023 for the
presentation of the prosecution’s evidence;
2. RESET the same to June 14, 19, or 21, 2023, or such other
date which the Honorable Court would deem convenient
and practicable, except Thursdays;
Plaintiff prays for such further or other relief as may be deemed
just or equitable.
