Whereas Supreme Court C.M.A. No. “ xxxxx” field in the Hounourable Supreme
Court Challanging the imposition of infrastructure Cess @1.25% on the value of
imported goods.

AND WHEREAS: The Honourable supreme cout of in the aforesaid C.M.A.

No.”xxxxx” filed by M/s. company name with address has directed to furnish a bank
guarantee covering the disputed amount of cess involved in this case.

Now in consideration of alloiwingthe release of the consignments imported from

time to time for purspose carriage of goods by road with in the province of Sindh,
we the bank Bank Name + address do here by un-conditionally undertake to pay an
amount of PKR 10.000 (M) (Pakistani Rupees Ten Million only) to the Director
Excise & Taxation (Taxes-II) Karachi, if the honourable supreme court decided that
the cess imported under the S.M.D.I.C, 2017 was lawfull and validity imposed.

We hererby further undertake and agree the as soon as the said Director, Excise and
Taxation, (Taxes-II) Karachi, demand in writing the said Guarantee amount from us
upon decision of the houndable supreme court, we the bank will forthwith pay the
said sum of PKR 10,000,000 (Pakistani Rupees Ten Million only) with our reffering
to “company name” with in 2-days from receipt his demand alongwith certified copy
of the judgment of the hounable supreme court and or without any objection or delay
of any nature.

against our specific request in favor of “The Director Excise and Taxation Office Sea
port Karachi”. As you know that our import business is increasing rapidly & current
value of said BG is Rs.100.000 (M). Now concern department E.T.O Karachi require
induction of attached paragraph in said BG amounting Rs.100.000 (M).

So you are requested to kindly issue said addendum urgently enabling us to

arrange clearance of import consignments from port.
