Service Rule - Preparation of panel of Deputy Tahsildars
— Application of Rule Reservation - Amendments to Rule
6 of TNRSS Rules ~ Instructions issued - Regarding

2. Connected records
The District Collector, Theni vide letter 1" cited has sent proposals in
respect of one Directly Recruited Assistant seeking clarifications as to
inclusion of his name in the carry forward vacancy for the list of Deputy
Tahsildar as per the amendment issued in Rule 6 of Tamil nadu Revenue
Subordinate Service Rules vide Gazette No. 17 dated 04.05.1988.
2) Further it is brought to the notice of Principal Secretary /
Commissioner of Revenue Administration by some of the District Revenue
Officers during the Review Meeting of District Revenue Officers’ held on
10.11.2017 that the District Revenue Units are drawing Deputy Tahsildar
panel without applying Rule of Reservation of appointments for Directly
Recruited Assistants by following Rule 6 of TNRSS published in the
Government website and wherein there is a provision that Rule of Reservation
is not applicable to the Upper Division Clerk.
3) The relevant rules and records have been carefully examined.
4) The Rule 6 of Tamil nadu Revenue Subordinate Service Rules as in
the Tamil Nadu Government website is as reproduced below.“6. RESERVATION OF APPOINTMENTS:-
Subject to the provision of Rule 5(d), the rule of reservation of
appointments (General Rule 22) shall apply to the category of Deputy
Tahsildars in each District at the time of Selection for inclusion in the list
(G.O. Ms. No. 1256, Revenue, dated 20.06.1977)
(with effect from 20.06.1977)
Provided that this rule shall not apply to the appointment to the
said category of Deputy Tahsildars if any person who was recruited to
the Madras Ministerial Service as an Upper Division Clerk in the
Revenue Department for Employment as Probationary Revenue
Inspector".
5) The portion of amendment to special Rules for Tamil nadu Revenue
Subordinate Service in Tamil Nadu Government Gazette No.17 dated
04.05.1988 is as extracted below
“AMENDMENT TO SPECIAL RULES FOR TAMILNADU REVENUE
SUBORDINATE SERVICE
(G.O.Ms No. 660, Revenue 19" April 1988, Chithirai 7. Vibhava,
Thiruvalluvar Andu 2019)
No, SRO, B 150 /88 - In exercise of the powers conferred by the
| proviso to Article 309 of the Constitution of India and in supersession of
the Revenue Department Notification No. SRO - B 30 (a) of 1984,
published in Part ~ Ill Section 1 (b) of the Tamil Nadu Government
Gazette, Extraordinary dated 30” January 1984, the Governor of Tamil
Nadu hereby makes the following amendment to the special rules for the
Tamil Nadu Revenue Subordinate Service (Section 28 in Volume II of
the Tamil Nadu Services Manual 1970)
2. The amendment hereby made shall be deemed to have come into
force on and from the 20" June 1977.AMENDMENT
In the said special rules, for Rule 6, the following rule shall be
substituted, namely:
“6. Reservation of appointments — Subject to the provisions of rule 5 (d),
the rule of reservation of appointments (General Rule 22) shall apply to
the category of Deputy Tahsildars in each District at the time of selection
for inclusion in the list.”
6) It is clearly established from the above amendment dated
04.05.1988 that Rule of Reservation of appointment shall apply to the
category of Deputy Tahsildars in each District at the time of selection for
inclusion in the list of Deputy Tahsildar irrespective of the fact whether they
belong to Promotee Assistant category or Directly Recruited Assistant
category.
5) Accordingly, the District Collectors are hereby instructed to apply the
Rule of Reservation, as in force as of now, to the category of Directly
Recruited Assistants also, at the time of selection for inclusion in the list of
Deputy Tahsildars in accordance with the amendments issued to Special
Rules for Tamil nadu Revenue Subordinate Service Rule vide Tami Nadu
Government Gazette No. 17, dated 04.05.1988 without any deviation.
