MARION COUNTY SHERIFF'S OFFICE To: ‘SHERIFF BILLY WOODS FROM: Inspector Sergeant Lauren Miley DATE: June 26, 2023 SUBJECT: INMATE DEATH REVIEW (AR23-117) ‘On June 20, 2023, the Office of Professional Standards conducted a review regarding the death of Inmate Scott Leslie Whitley Ill, MCSO220FF023572.The purpose ofthis review was to convene and evaluate all pertinent reports to determine if current policies and Procedures were followed, identify any training gaps, and to make recommendations for Changes jn policies or procedures when appropriate. On November 25, 2022, Inmate Whitley became unresponsive during a use of force in Alpha Pod, Echo Section of the Marion County Jail. Inmate Whitley had been recently housed in administrative confinement due to attempts to escape from his cell and for engaging in acts of agaression toward staff members. At approximately 0700 hours, Inmate Whiley refused to cooperate with @ cell inspection and refused to comply with orders to submit to hand restraints Detention deputies deployed pepper spray and Electronic Disabling Devices (EDD) in an cffort to gain compliance, but were unsuccessful. Ultimately, a group of seven detention deputies were involved in subduing Inmate Whitley and he was secured in hand restraints and leg irons. Once secured, he was removed from his cell, where he was found to be unresponsive, Lifesaving efforts were made by multiple detention deputies and jal medical staff however, Inmate Whitley was transported via ambulance to Advent Health Ocala and pronounced deceased, ‘The Florida Department of Law Enforcement investigated Inmate Whitley's death and forwarded the results of their investigation to the State Attorney's Office for review. Fifth Judicial Circuit State Attorney Wiliam Gladson reviewed the FOLE reports as well as the report from the medical examiner regarding the cause and manner of death. It was determined that no criminal laws were violated, and no further action would be taken by the State Attorney's Office. During the review, the board reviewed the relevant Body-Worn Camera videos, jal videos, discussed the incident, and the findings of the FDLE investigation. Conclusion ‘After careful review of the facts and the available video, the board determined that the involved deputies conducted themselves appropriately and there were no policy violations. ommendations ‘The board discussed implementing more hands-on defensive tacts training. Additionally, the board agreed a policy should be created specifically for the use of spit masks.
