(The term/expression “OWNER” and “TENANT” shall mean and include their respective heirs, legal representative, administrators, executors, successors and assignees etc.) WHEREAS the OWNER is the absolute owner of the premises 70/2 A4S Whistling Woods, Harohalli Village, Yelahanka, Nagenahali, Bangalore 560064 more fully described in the schedule at the end of this agreement and hereinafter called the “Schedule Premises” residential purpose and whereas the TENANT has agreed to take the said portion of the schedule premises on rental basis under the following terms and conditions: NOW THIS AGREEMENT WITNESS AS FOLLOWS: - 1, RENT: That the TENANT shall pay monthly rent of Rs.20,000/-(Rupees Twenty Thousand Only) payable in advance on Ist day or before the 5® day of every English Calendar month. There will be an accrual to the Rent amount, if there is any increase in the Building/Apartment maintenance charges which will be borne solely by the Tenant. 2. DEPOSIT: a, The TENANT has paid Rs.30,000/- (Rupees Thirty Thousand) on 27" January 2023 and a sum of Rs.70,000/- (Rupees Seventy Thousand) on = 29" January 2023 totaling a sum of Rs.1,00,000/- (Rupees One Lakh COTA? jonly) to the OWNER as an advance by way of security deposit, but the os same will be refunded at the time of vacating the schedule premises _ Without any interest . The deposit shall be held by the Owner, free of interest during the sontirjuance of the Rental Period and is adjustable against rental dues, if is shall be refunded to the Tenant the day; the Tenant vacates the any. ¢. There would be no deductions for Painting charges from the Deposit when the Tenant vacates the Scheduled Premises. As the Tenant had requested that they did not require the Scheduled Premises to be freshly painted before they occupied it on the 29" of Jan 2023. However, the Owner is entitled to make deductions from this deposit for arrears in rent, electricity, water charges unpaid, cleaning charges and any damages done to the SCH PREMISES as agreed by the rental agreement, e DURATION: That the duration of the lease period shall be for a period of Eleven Months commencing from 1" February 2023 even though the tenant moved in to the SCHEDULED PREMISES on 29" January 2023. 4, ELECTRICITY CHARGES AND WATER CHARGES: The Electric Charges and the Water Charges will be paid by the TENANT directly to the concemed departments as per the bills received without fail. 5. NATURE OF USE PERMITTED: The TENANT shall use the schedule premises for residential purpose only and kept the premises in good and tenantable condition. The TENANT should adhere to the Apartment Bylaws and not use the scheduled Premises for any unlawful purposes likely to endanger the building. 6. SUBLET: That the TENANT shall not sublet, underlet or part with the possession of the schedule premises without any written consent of the OWNER. 7. REARING OF PETS: Rearing of pets is permitted within the premises. ‘Tha Tehant shall keep the Scheduled Premises in a fit and proper state 2 subject th normal wear and tear by day-to-day use. ¢. INSPECTION AND ENTRY: The Owner and/or his/her representative shall be entitled to enter the Schedule Premises, with prior appointment, to inspect the same to satisfy himself/herself that the premises is being used in accordance with the terms of the tenancy. 11. REPRESENTATION: PROVIDED ALWAYS THAT whenever such an interpretation would be requisite to give fullest scope and effect legally possible, for any covenant or contract herein contained the expression ‘OWNER’ shall mean and include his heirs, legal representatives, successors and assigns and the expression TENANT’ shall mean & include his heirs & legal representatives only. pJ2- EIEN: The Owner is the absolute owner of the Scheduled Premises and has vomplete lien and possession of the property at all times, The Tenant srini'v«‘has ndvlien or right over the Scheduled Premises at any point in time to payee! morteae, loan, sell, rent-out, lease-out, modify, build or destroy all and/or any portion of the property. SMNIFICATION: The Owner indemnifies the Tenant over any legal iSpites related to the property. 14, LIABILITY: That if the Schedule Property, mentioned supra, or any part thereof be destroyed or damaged by fire (not caused by any wilful act or negligence) OR earthquake, tempest, flood, lightning, violence of any army or mob or enemies of the country or by any other irresistible force so as to render the Schedule property unfit for the purpose for which the same are let, either party shall have the option to forthwith terminate this rental agreement notwithstanding notice period provided in the Agreement. Upon this all the refundable securities shall be refunded immediately subject to any deductions/ adjustments under this Rental Agreement. The Owner shall not be responsible or liable for any theft, loss, damage or destruction of any property of the Tenant or of any other person lying in the Schedule Property nor for any bodily injury or harm to/death of any person in the Schedule property from any cause whatsoever. 1S, JURISDICTION: This Rental Agreement is subject to the exclusive courts of Bangalore jurisdiction only. Registration Charges will be bome equally by the Owner and the Tenant. 16. ADDITIONAL FITTINGS: a. The Tenant may add any additional fittings as he may choose to however, he shall not make any structural modifications of any permanent nature without the permission of the Owner. At the end of the Rental period or its termination, the Owner shall permit the Tenants at their own cost to remove and take away such fittings without disfiguring or damaging the premises. b. The owner has also provided the Tenants with additional electrical fittings and furiture’s all listed out in ANNEXURE-A. Damaging, Removing, remodeling or defacing any of these additional fittings provided by the Owner would result in withholding the security deposit, in order to cover for losses incurred. 17. HANDING OVER THE PREMISES: The Tenant shall deliver back the ZT Vacant possession of the scheduled premises inclusive of all the electrical /SO '” fitings and the furniture's as listed out in ANNEXURE-A at the end of © «1 the rental agreement or in earlier termination if any, in good and tenable conditions, subject to their natural wear and tear only to the Owner and no fone else.
