‫وﺗﺘﺠﺪد ﻟﻤﺪة أو ﻟﻤﺪد ﻣﻤﺎﺛﻠﺔ ﻣﺎﻟﻢ ﻳﺸﻌﺮ أﺣﺪ اﻟﻄﺮﻓﻴﻦ اﻷﺧﺮ ﺧﻄﻴًﺎ‬
The contract will be renewed for a similar period .‫( ﻳﻮﻣًﺎ ﻣﻦ ﺗﺎرﻳﺦ اﻧﺘﻬﺎء اﻟﻌﻘﺪ‬30)‫ﺑﻌﺪم رﻏﺒﺘﻪ ﻓﻲ اﻟﺘﺠﺪﻳﺪ ﻗﺒﻞ‬
unless one of the two parties informs the other in
writing of his unwillingness to renew the contract 30
days before the contract expires.

The second party is subject to a trial period of 0 days ‫ ﻳﻮﻣًﺎ ﺗﺒﺪأ ﻣﻦ ﺗﺎرﻳﺦ‬0 ‫ﻳﺨﻀﻊ اﻟﻄﺮف اﻟﺜﺎﻧﻲ ﻟﻔﺘﺮة ﺗﺠﺮﺑﺔ ﻣﺪﺗﻬﺎ‬
starting from the date of commencing work, during ‫ﻣ ﺒﺎ ﺷ ﺮ ﺗ ﻪ ﻟ ﻠ ﻌ ﻤ ﻞ و ﻻ ﻳ ﺪ ﺧ ﻞ ﻓ ﻲ ﺣ ﺴﺎ ﺑ ﻬﺎ إ ﺟﺎ ز ة ﻋ ﻴ ﺪ ي ا ﻟ ﻔ ﻄ ﺮ‬
which Eid al-Fitr and Eid al-Adha holidays and sick ‫و ا ﻷ ﺿ ﺤ ﻰ و ا ﻻ ﺟﺎ ز ة ا ﻟ ﻤ ﺮ ﺿ ﻴ ﺔ و ﻳ ﻜ ﻮ ن ﻟ ﻠ ﻄ ﺮ ﻓ ﻴ ﻦ ا ﻟ ﺤ ﻖ ﻓ ﻲ إ ﻧ ﻬﺎ ء‬
leave are not included in the calculation. Both parties ‫ ﻣﺎ ﻟ ﻢ ﻳ ﻨ ﺺ ا ﻟ ﻌ ﻘ ﺪ ﻋ ﻠ ﻰ أ ﺣ ﻘ ﻴ ﺔ أ ﺣ ﺪ ﻫ ﻤﺎ ﻓ ﻲ‬، ‫ا ﻟ ﻌ ﻘ ﺪ ﺧ ﻼ ل ﻫ ﺬ ه ا ﻟ ﻔ ﺘ ﺮ ة‬

party to terminate.

Working days and hours ‫أ ﻳﺎ م و ﺳﺎ ﻋﺎ ت ا ﻟ ﻌ ﻤ ﻞ‬

The working days are set as 48 hours per week, and ‫ ﺳﺎﻋﺔ اﺳﺒﻮﻋﻴًﺎ وﻳﻠﺘﺰم اﻟﻄﺮف اﻷول ﺑﺄن‬48 ‫ﺗﺤﺪد أﻳﺎم اﻟﻌﻤﻞ ﺑـ‬
the first party is obligated to pay the second party an ‫ﻳﺪﻓﻊ ﻟﻠﻄﺮف اﻟﺜﺎﻧﻲ أﺟﺮًا اﺿﺎﻓﻴًﺎ ﻋﻦ ﺳﺎﻋﺎت اﻟﻌﻤﻞ اﻹﺿﺎﻓﻴﺔ‬
additional wage for the overtime hours equal to the .‫ ﻣﻦ أﺟﺮه اﻷﺳﺎﺳﻲ‬٪٥٠ ‫ﻳﻮازي أﺟﺮ اﻟﺴﺎﻋﺔ ﻣﻀﺎﻓًﺎ إﻟﻴﻪ‬
hourly wage plus 50% of his basic wage.

The obligations of the first party ‫ا ﻟ ﺘ ﺰا ﻣﺎ ت ا ﻟ ﻄ ﺮ ف ا ﻷ و ل‬

The first party pays the second party a basic fee of 400.00 ‫ﻳﺪﻓﻊ اﻟﻄﺮف اﻷول ﻟﻠﻄﺮف اﻟﺜﺎﻧﻲ أﺟﺮًا أﺳﺎﺳﻲ ﻗﺪره‬

‫ ﺗﻮﻓﻴﺮ ﺳﻜﻦ ﻣﻨﺎﺳﺐ ﻃﻮال ﻓﺘﺮة اﻟﻌﻘﺪ‬.1
1. Provide adequate housing throughout the ‫ ﺗﻮﻓﻴﺮ وﺳﻴﻠﺔ ﻣﻮاﺻﻼت ﻣﻨﺎﺳﺒﺔ ﻣﻦ ﻣﻘﺮ ﺳﻜﻨﻬﻢ إﻟﻰ ﻣﻘﺮ‬.2

leave of 21 days, and the first party determines its ‫ﻣ ﺪ ﻓ ﻮ ﻋ ﺔ ا ﻷ ﺟ ﺮ و ﻳ ﺤ ﺪ د ا ﻟ ﻄ ﺮ ف ا ﻷ و ل ﺗﺎ ر ﻳ ﺨ ﻬﺎ ﺧ ﻼ ل ﺳ ﻨ ﺔ ا ﻻ ﺳ ﺘ ﺤ ﻘﺎ ق‬
dates during the year of entitlement according to ‫وﻓﻘًﺎ ﻟﻈﺮوف اﻟﻌﻤﻞ ﻋﻠﻰ أن ﻳﺘﻢ دﻓﻊ أﺟﺮ اﻻﺟﺎزة ﻣﻘﺪﻣ ِﺎ ﻋﻨﺪ‬
work conditions, provided that the leave wage is paid ‫ا ﺳ ﺘ ﺤ ﻘﺎ ﻗ ﻬﺎ و ﻟ ﻠ ﻄ ﺮ ف ا ﻷ و ل ﺗ ﺄ ﺟ ﻴ ﻞ ا ﻻ ﺟﺎ ز ة ﺑ ﻌ ﺪ ﻧ ﻬﺎ ﻳ ﺔ ﺳ ﻨ ﺔ‬
in advance when it is due, and the first party has to ‫ ﻳﻮﻣًﺎ ﻛﻤﺎ ﻟﻪ ﺑﻤﻮاﻓﻘﺔ اﻟﻄﺮف‬90 ‫اﺳﺘﺤﻘﺎﻗﻬﺎ ﻟﻤﺪة ﻻ ﺗﺰﻳﺪ ﻋﻦ‬
postpone the leave after the end of the year of ‫اﻟﺜﺎﻧﻲ ﻛﺘﺎﺑًﺔ ﺗﺄﺟﻴﻠﻬﺎ إﻟﻰ ﻧﻬﺎﻳﺔ اﻟﺴﻨﺔ اﻟﺘﺎﻟﻴﺔ ﻟﺴﻨﺔ اﻻﺳﺘﺤﻘﺎق‬
entitlement for a period not exceeding 90 days, and . ‫و ذ ﻟ ﻚ ﺣ ﺴ ﺐ ﻣ ﻘ ﺘ ﻀ ﻴﺎ ت ﻇ ﺮ و ف ا ﻟ ﻌ ﻤ ﻞ‬
with the consent of the party Second, in writing, to
postpone it to the end of the year following the year
of entitlement, according to the requirements of work
conditions.

The first party is obligated to provide medical care to ‫ﻳ ﻠ ﺘ ﺰ م ا ﻟ ﻄ ﺮ ف ا ﻷ و ل ﺑ ﺘ ﻮ ﻓ ﻴ ﺮ ا ﻟ ﺮ ﻋﺎ ﻳ ﺔ ا ﻟ ﻄ ﺒ ﻴ ﺔ ﻟ ﻠ ﻄ ﺮ ف ا ﻟ ﺜﺎ ﻧ ﻲ ﺑﺎ ﻟ ﺘ ﺄ ﻣ ﻴ ﻦ‬


the second party with health insurance in accordance ‫اﻟﺼﺤﻲ وﻓﻘًﺎ ﻷﺣﻜﺎم ﻧﻈﺎم اﻟﻀﻤﺎن اﻟﺼﺤﻲ اﻟﺘﻌﺎوﻧﻲ‬
with the provisions of the Cooperative Health
Insurance Policy

the General Organization for Social Insurance ‫ا ﻻ ﺟ ﺘ ﻤﺎ ﻋ ﻴ ﺔ ﺣ ﺴ ﺐ أ ﻧ ﻈ ﻤ ﺘ ﻬﺎ‬

recruitment/transfer, the residency fee, the work ‫ﺧ ﺪ ﻣﺎ ﺗ ﻪ إ ﻟ ﻴ ﻪ و ر ﺳ ﻮ م ا ﻹ ﻗﺎ ﻣ ﺔ و ر ﺧ ﺼ ﺔ ا ﻟ ﻌ ﻤ ﻞ و ﺗ ﺠ ﺪ ﻳ ﺪ ﻫ ﻤﺎ و ﻣﺎ ﻳ ﺘ ﺮ ﺗ ﺐ‬

of occupation, exit and return fees, and the return ‫و ﺗ ﺬ ﻛ ﺮ ة ﻋ ﻮ د ة ا ﻟ ﻄ ﺮ ف ا ﻟ ﺜﺎ ﻧ ﻲ إ ﻟ ﻰ ﻣ ﻮ ﻃ ﻨ ﻪ ﺑﺎ ﻟ ﻮ ﺳ ﻴ ﻠ ﺔ ا ﻟ ﺘ ﻲ ﻗ ﺪ م ﺑ ﻬﺎ‬
ticket for the second party to his home by the same ‫ﺑ ﻌ ﺪ ا ﻧ ﺘ ﻬﺎ ء ا ﻟ ﻌ ﻼ ﻗ ﺔ ﺑ ﻴ ﻦ ا ﻟ ﻄ ﺮ ﻓ ﻴ ﻦ‬

The first party is obligated to pay the expenses of ‫ﻳ ﻠ ﺘ ﺰ م ا ﻟ ﻄ ﺮ ف ا ﻷ و ل ﺑ ﻨ ﻔ ﻘﺎ ت ﺗ ﺠ ﻬ ﻴ ﺰ ﺟ ﺜ ﻤﺎ ن ا ﻟ ﻄ ﺮ ف ا ﻟ ﺜﺎ ﻧ ﻲ و ﻧ ﻘ ﻠ ﻪ‬
preparing the body of the second party and ‫إ ﻟ ﻰ ا ﻟ ﺠ ﻬ ﺔ ا ﻟ ﺘ ﻲ أ ﺑ ﺮ م ﻓ ﻴ ﻬﺎ ا ﻟ ﻌ ﻘ ﺪ أ و ا ﺳ ﺘ ﻘ ﺪ ا م ا ﻟ ﻤ ﻮ ﻇ ﻒ ﻣ ﻨ ﻬﺎ ﻣﺎ ﻟ ﻢ‬
transporting it to the party in which the contract was ‫ﻳ ﺪ ﻓ ﻦ ﺑ ﻤ ﻮ ا ﻓ ﻘ ﺔ ذ و ﻳ ﻪ د ا ﺧ ﻞ ا ﻟ ﻤ ﻤ ﻠ ﻜ ﺔ أ و ﺗ ﻠ ﺘ ﺰ م ا ﻟ ﻤ ﺆ ﺳ ﺴ ﺔ ا ﻟ ﻌﺎ ﻣ ﺔ‬
concluded or bringing the employee from it unless he . ‫ﻟ ﻠ ﺘ ﺄ ﻣ ﻴ ﻨﺎ ت ا ﻻ ﺟ ﺘ ﻤﺎ ﻋ ﻴ ﺔ ﺑ ﺬ ﻟ ﻚ‬
is buried with the consent of his relatives inside the
Kingdom or the General Organization for Social
Insurance is obligated to do so.

The obligations of the second party ‫ا ﻟ ﺘ ﺰا ﻣﺎ ت ا ﻟ ﻄ ﺮ ف ا ﻟ ﺜﺎ ﻧ ﻲ‬

To perform the work entrusted to him in accordance ‫أن ﻳﻨﺠﺰ اﻟﻌﻤﻞ اﻟﻤﻮﻛﻞ إﻟﻴﻪ وﻓﻘًﺎ ﻷﺻﻮل اﻟﻤﻬﻨﺔ ووﻓﻖ ﺗﻌﻠﻴﻤﺎت‬
with the principles of the profession and according to ‫ا ﻟ ﻄ ﺮ ف ا ﻷ و ل إ ذ ا ﻟ ﻢ ﻳ ﻜ ﻦ ﻓ ﻲ ﻫ ﺬ ه ا ﻟ ﺘ ﻌ ﻠ ﻴ ﻤﺎ ت ﻣﺎ ﻳ ﺨﺎ ﻟ ﻒ ا ﻟ ﻌ ﻘ ﺪ أ و‬
the instructions of the first party if there is nothing in ‫ا ﻟ ﻨ ﻈﺎ م أ و ا ﻵ د ا ب ا ﻟ ﻌﺎ ﻣ ﺔ و ﻟ ﻢ ﻳ ﻜ ﻦ ﻓ ﻲ ﺗ ﻨ ﻔ ﻴ ﺬ ﻫﺎ ﻣﺎ ﻳ ﻌ ﺮ ﺿ ﻪ ﻟ ﻠ ﺨ ﻄ ﺮ‬
these instructions that contradicts the contract, order
or public morals and there is nothing in their
implementation that puts him at risk

To take adequate care of the tools and tasks assigned ‫أ ن ﻳ ﻌ ﺘ ﻨ ﻲ ﻋ ﻨﺎ ﻳ ﺔ ﻛﺎ ﻓ ﻴ ﺔ ﺑﺎ ﻷ د و ا ت و ا ﻟ ﻤ ﻬ ﻤﺎ ت ا ﻟ ﻤ ﺴ ﻨ ﺪ ة إ ﻟ ﻴ ﻪ‬


to him and the raw materials owned by the first party ‫و ا ﻟ ﺨﺎ ﻣﺎ ت ا ﻟ ﻤ ﻤ ﻠ ﻮ ﻛ ﺔ ﻟ ﻠ ﻄ ﺮ ف ا ﻷ و ل ا ﻟ ﻤ ﻮ ﺿ ﻮ ﻋ ﺔ ﺗ ﺤ ﺖ ﺗ ﺼ ﺮ ﻓ ﻪ أ و‬
placed at his disposal or in his custody and to return to ‫ا ﻟ ﺘ ﻲ ﺗ ﻜ ﻮ ن ﻓ ﻲ ﻋ ﻬ ﺪﺗ ﻪ وأ ن ﻳ ﻌ ﻴ ﺪ إ ﻟ ﻰ ا ﻟ ﻄ ﺮ ف ا ﻷ و ل ا ﻟ ﻤ ﻮا د ﻏ ﻴ ﺮ‬
the first party the non-expendable materials ‫اﻟ ﻤ ﺴﺘ ﻬﻠ ﻜ ﺔ‬

To provide assistance and support without requiring ‫أن ﻳﻘﺪم ﻛﻞ ﻋﻮن وﻣﺴﺎﻋﺪة دون أن ﻳﺸﺘﺮط ﻟﺬﻟﻚ أﺟﺮًا إﺿﺎﻓﻴًﺎ ﻓﻲ‬
additional pay in cases of dangers threatening the ‫ﺣﺎ ﻻ ت ا ﻷ ﺧ ﻄﺎ ر ا ﻟ ﺘ ﻲ ﺗ ﻬ ﺪ د ﺳ ﻼ ﻣ ﺔ ﻣ ﻜﺎ ن ا ﻟ ﻌ ﻤ ﻞ أ و ا ﻷ ﺷ ﺨﺎ ص‬
safety of the workplace or the persons employed in it. ‫اﻟ ﻤ ﻮ ﻇ ﻔﻴ ﻦ ﻓﻴ ﻪ‬

To undergo any medical examinations required by the ‫أن ﻳﺨﻀﻊ وﻓﻘًﺎ ﻟﻄﻠﺐ اﻟﻄﺮف اﻷول ﻟﻠﻔﺤﻮص اﻟﻄﺒﻴﺔ اﻟﺘﻲ ﻳﺮﻏﺐ‬
first party before or during joining the work to verify ‫ﻓ ﻲ إ ﺟ ﺮ ا ﺋ ﻬﺎ ﻋ ﻠ ﻴ ﻪ ﻗ ﺒ ﻞ ا ﻻ ﻟ ﺘ ﺤﺎ ق ﺑﺎ ﻟ ﻌ ﻤ ﻞ أ و أ ﺛ ﻨﺎ ء ه ﻟ ﻠ ﺘ ﺤ ﻘ ﻖ ﻣ ﻦ ﺧ ﻠ ﻮ ه‬
that he/she is free from occupational or communicable ‫ﻣ ﻦ ا ﻷ ﻣ ﺮ ا ض ا ﻟ ﻤ ﻬ ﻨ ﻴ ﺔ أ و ا ﻟ ﺴﺎ ر ﻳ ﺔ‬
diseases

After the end of the contract, the second party is ‫ﻳ ﻠ ﺘ ﺰ م ا ﻟ ﻄ ﺮ ف ا ﻟ ﺜﺎ ﻧ ﻲ ﺑ ﺄ ن ﻻ ﻳ ﻘ ﻮ م ﺑ ﻌ ﺪ ا ﻧ ﺘ ﻬﺎ ء ا ﻟ ﻌ ﻘ ﺪ ﺑ ﻤ ﻨﺎ ﻓ ﺴ ﺔ‬


obligated not to compete with the first party for a ‫ ﺳ ﻨ ﺔ و ذ ﻟ ﻚ ﻓ ﻲ أ ي ﻣ ﻜﺎ ن ﻣ ﻦ ﻣ ﻨﺎ ﻃ ﻖ‬2 ‫ا ﻟ ﻄ ﺮ ف ا ﻷ و ل ﻟ ﻤ ﺪ ة‬
period of 2-year anywhere in ‫ﻣﻨﺎﻃﻖ اﻟﻤﻤﻠﻜﺔ اﻟﻌﺮﺑﻴﺔ‬ ‫ا ﻟ ﻤ ﻤ ﻠ ﻜ ﺔ ا ﻟ ﻌ ﺮ ﺑ ﻴ ﺔ ا ﻟ ﺴ ﻌ ﻮ د ﻳ ﺔ ﻓ ﻴ ﻤﺎ ﻳ ﺘ ﻌ ﻠ ﻖ ﺑ ﻌ ﻤ ﻞ ا ﻟ ﻌ ﻮ ا ز ل ا ﻟ ﺤ ﺮ ا ر ﻳ ﺔ‬

The second party is obligated not to divulge the ‫ﻳ ﻠ ﺘ ﺰ م ا ﻟ ﻄ ﺮ ف ا ﻟ ﺜﺎ ﻧ ﻲ ﺑ ﻌ ﺪ م إ ﻓ ﺸﺎ ء أ ﺳ ﺮ ا ر ا ﻟ ﻄ ﺮ ف ا ﻷ و ل ﺑ ﻌ ﺪ ا ﻧ ﺘ ﻬﺎ ء‬


secrets of the first party after the end of the work ‫ ﺳ ﻨ ﺔ و ذ ﻟ ﻚ ﻓ ﻲ أ ي ﻣ ﻜﺎ ن ﻣ ﻦ ﻣ ﻨﺎ ﻃ ﻖ‬2 ‫ﻋ ﻘ ﺪ ا ﻟ ﻌ ﻤ ﻞ ﺧ ﻼ ل ﻣ ﺪ ة‬
contract during the period of 2-year anywhere in ‫ا ﻟ ﻤ ﻤ ﻠ ﻜ ﺔ ا ﻟ ﻌ ﺮ ﺑ ﻴ ﺔ ا ﻟ ﺴ ﻌ ﻮ د ﻳ ﺔ ﻓ ﻴ ﻤﺎ ﻳ ﺘ ﻌ ﻠ ﻖ ﺑ ﻌ ﻤ ﻞ ا ﻟ ﻌ ﻮ ا ز ل ا ﻟ ﺤ ﺮ ا ر ﻳ ﺔ‬

work ethics while at work, and at all times abides by ‫ﺟ ﻤ ﻴ ﻊ ا ﻷ و ﻗﺎ ت ﻳ ﻠ ﺘ ﺰ م ﺑﺎ ﻷ ﻧ ﻈ ﻤ ﺔ و ا ﻷ ﻋ ﺮ ا ف ا ﻟ ﻌﺎ د ا ت و ا ﻵ د ا ب ا ﻟ ﻤ ﺮ ﻋ ﻴ ﺔ‬

the rules, customs, norms and ethics in force at the ‫ﻓ ﻲ ا ﻟ ﻤ ﻤ ﻠ ﻜ ﺔ ا ﻟ ﻌ ﺮ ﺑ ﻴ ﺔ ا ﻟ ﺴ ﻌ ﻮ د ﻳ ﺔ و ﻛ ﺬ ﻟ ﻚ ﺑﺎ ﻟ ﻘ ﻮ ا ﻋ ﺪ و ا ﻟ ﻠ ﻮ ا ﺋ ﺢ‬
Kingdom of Saudi Arabia, as well as the rules, ‫و ا ﻟ ﺘ ﻌ ﻠ ﻴ ﻤﺎ ت ا ﻟ ﻤ ﻌ ﻤ ﻮ ل ﺑ ﻬﺎ ﻟ ﺪ ى ا ﻟ ﻄ ﺮ ف ا ﻷ و ل و ﻳ ﺘ ﺤ ﻤ ﻞ ﻛﺎ ﻓ ﺔ‬
regulations and instructions in force at the first party ‫ا ﻟ ﻐ ﺮ ا ﻣﺎ ت ا ﻟ ﻤﺎ ﻟ ﻴ ﺔ ا ﻟ ﻨﺎ ﺗ ﺠ ﺔ ﻋ ﻦ ﻣ ﺨﺎ ﻟ ﻔ ﺘ ﻪ ﻟ ﺘ ﻠ ﻚ ا ﻷ ﻧ ﻈ ﻤ ﺔ‬
and bears all the financial penalties resulting from his
violation of these regulations

Approval of the first party deducting the prescribed ‫ا ﻟ ﻤ ﻮ ا ﻓ ﻘ ﺔ ﻋ ﻠ ﻰ ا ﺳ ﺘ ﻘ ﻄﺎ ع ا ﻟ ﻄ ﺮ ف ا ﻷ و ل ﻟ ﻠ ﻨ ﺴ ﺒ ﺔ ا ﻟ ﻤ ﻘ ﺮ ر ة ﻋ ﻠ ﻴ ﻪ ﻣ ﻦ‬


percentage from the monthly wage for participation ‫ا ﻷ ﺟ ﺮ ا ﻟ ﺸ ﻬ ﺮ ي ﻟ ﻼ ﺷ ﺘ ﺮ ا ك ﻓ ﻲ ا ﻟ ﻤ ﺆ ﺳ ﺴ ﺔ ا ﻟ ﻌﺎ ﻣ ﺔ ﻟ ﻠ ﺘ ﺄ ﻣ ﻴ ﻨﺎ ت‬
in the General Organization for Social Insurance ‫ا ﻻ ﺟ ﺘ ﻤﺎ ﻋ ﻴ ﺔ‬

Expiration or Termination of The Contract ‫ا ﻧ ﺘ ﻬﺎ ء ا ﻟ ﻌ ﻘ ﺪ أ و إ ﻧ ﻬﺎ ء ه‬

This contract ends with the expiry of its term in the ‫ﻳ ﻨ ﺘ ﻬ ﻲ ﻫ ﺬ ا ا ﻟ ﻌ ﻘ ﺪ ﺑﺎ ﻧ ﺘ ﻬﺎ ء ﻣ ﺪ ﺗ ﻪ ﻓ ﻲ ا ﻟ ﻌ ﻘ ﺪ ﻣ ﺤ ﺪ د ا ﻟ ﻤ ﺪ ة أ و ﺑﺎ ﺗ ﻔﺎ ق‬


fixed-term contract or with the agreement of the two ‫اﻟﻄﺮﻓﻴﻦ ﻋﻠﻰ اﻧﻬﺎﺋﻪ ﺑﺸﺮط ﻣﻮاﻓﻘﺔ اﻟﻄﺮف اﻟﺜﺎﻧﻲ ﻛﺘﺎﺑًﺔ‬
parties to terminate it, provided that the second party
agrees in writing

The first party has the right to terminate the contract ‫ﻳ ﺤ ﻖ ﻟ ﻠ ﻄ ﺮ ف ا ﻷ و ل ﻓ ﺴ ﺦ ا ﻟ ﻌ ﻘ ﺪ د و ن ﻣ ﻜﺎ ﻓ ﺄ ة أ و إ ﺷ ﻌﺎ ر ﻟ ﻠ ﻄ ﺮ ف‬


of the second party without award, notice or ‫ا ﻟ ﺜﺎ ﻧ ﻲ أ و ﺗ ﻌ ﻮ ﻳ ﻀ ﻪ ﺷ ﺮ ﻳ ﻄ ﺔ إ ﺗﺎ ﺣ ﺔ ا ﻟ ﻔ ﺮ ﺻ ﺔ ﻟ ﻠ ﻄ ﺮ ف ا ﻟ ﺜﺎ ﻧ ﻲ ﻓ ﻲ إ ﺑ ﺪ ا ء‬
compensation according to the cases mentioned in ‫أﺳﺒﺎب ﻣﻌﺎرﺿﺘﻪ ﻟﻠﻔﺴﺦ وذﻟﻚ ﻃﺒﻘًﺎ ﻟﻠﺤﺎﻻت اﻟﻮاردة ﻓﻲ اﻟﻤﺎدة‬
Article (eighty) of the work system, provided that the ‫) ا ﻟ ﺜ ﻤﺎ ﻧ ﻮ ن ( ﻣ ﻦ ﻧ ﻈﺎ م ا ﻟ ﻌ ﻤ ﻞ‬
second party is given the opportunity to express
reasons for his opposition to the termination.

The second party has the right to leave work and ‫ﺣ ﻖ ﻟ ﻠ ﻄ ﺮ ف ا ﻟ ﺜﺎ ﻧ ﻲ ﺗ ﺮ ك ا ﻟ ﻌ ﻤ ﻞ و إ ﻧ ﻬﺎ ء ا ﻟ ﻌ ﻘ ﺪ د و ن إ ﺷ ﻌﺎ ر ا ﻟ ﻄ ﺮ ف‬


terminate the contract without notifying the first ‫اﻷول ﻣﻊ اﺣﺘﻔﺎﻇﻪ ﺑﺤﻘﻪ ﻓﻲ اﻟﺤﺼﻮل ﻋﻠﻰ ﻛﺎﻓﺔ ﻣﺴﺘﺤﻘﺎﺗﻪ ﻃﺒﻘًﺎ‬
party while retaining his right to obtain all his dues ‫ﻟ ﻠ ﺤﺎ ﻻ ت ا ﻟ ﻮ ا ر د ة ﻓ ﻲ ا ﻟ ﻤﺎ د ة ) ا ﻟ ﺤﺎ د ﻳ ﺔ و ا ﻟ ﺜ ﻤﺎ ﻧ ﻮ ن ( ﻣ ﻦ ﻧ ﻈﺎ م ا ﻟ ﻌ ﻤ ﻞ‬
according to the cases mentioned in Article (eighty-
first) of the work system.

End of Service Reward ‫ﻣ ﻜﺎ ﻓ ﺄ ة ﻧ ﻬﺎ ﻳ ﺔ ا ﻟ ﺨ ﺪ ﻣ ﺔ‬

Upon termination of the contractual relationship by ‫ﻳ ﺴ ﺘ ﺤ ﻖ ا ﻟ ﻄ ﺮ ف ا ﻟ ﺜﺎ ﻧ ﻲ ﻋ ﻨ ﺪ إ ﻧ ﻬﺎ ء ا ﻟ ﻌ ﻼ ﻗ ﺔ ا ﻟ ﺘ ﻌﺎ ﻗ ﺪ ﻳ ﺔ ﻣ ﻦ ﻗ ﺒ ﻞ‬


the first party, or with the agreement of the two ‫ا ﻟ ﻄ ﺮ ف ا ﻷ و ل أ و ﺑﺎ ﺗ ﻔﺎ ق ا ﻟ ﻄ ﺮ ﻓ ﻴ ﻦ أ و ﺑﺎ ﻧ ﺘ ﻬﺎ ء ﻣ ﺪ ة ا ﻟ ﻌ ﻘ ﺪ أ و ﻧ ﺘ ﻴ ﺠ ﺔ‬
parties, or with the end of the contract period, or as a ‫ﻟﻘﻮة ﻗﺎﻫﺮة ﻣﻜﺎﻓﺄة ﻗﺪرﻫﺎ أﺟﺮ ﺧﻤﺴﺔ ﻋﺸﺮ ﻳﻮﻣًﺎ ﻋﻦ ﻛﻞ ﺳﻨﺔ ﻣﻦ‬
result of force majeure, the second party is entitled to ‫ا ﻟ ﺴ ﻨ ﻮ ا ت ا ﻟ ﺨ ﻤ ﺲ ا ﻷ و ﻟ ﻰ و أ ﺟ ﺮ ﺷ ﻬ ﺮ ﻋ ﻦ ﻛ ﻞ ﺳ ﻨ ﺔ ﻣ ﻦ ا ﻟ ﺘﺎ ﻟ ﻴ ﺔ‬
a reward of fifteen days' wages for each of the first ‫و ﻳ ﺴ ﺘ ﺤ ﻖ ا ﻟ ﻤ ﻮ ﻇ ﻒ ﻣ ﻜﺎ ﻓ ﺄ ة ﻋ ﻦ أ ﺟ ﺰ ا ء ا ﻟ ﺴ ﻨ ﺔ ﺑ ﻨ ﺴ ﺒ ﺔ ﻣﺎ ﻗ ﻀﺎ ه ﻣ ﻨ ﻬﺎ‬
five years and a month’s wage for each year of the ‫ﻓ ﻲ ا ﻟ ﻌ ﻤ ﻞ و ﺗ ﺤ ﺴ ﺐ ا ﻟ ﻤ ﻜﺎ ﻓ ﺄ ة ﻋ ﻠ ﻰ أ ﺳﺎ س ا ﻷ ﺟ ﺮ ا ﻷ ﺧ ﻴ ﺮ‬
following. The employee is entitled to a reward for
the parts of the year in proportion to what she/he
spent in work, and the remuneration is calculated on
the basis of the last wage

This contract is subject to the labor regulations and its ‫ﻳ ﺨ ﻀ ﻊ ﻫ ﺬ ا ا ﻟ ﻌ ﻘ ﺪ ﻟ ﻨ ﻈﺎ م ا ﻟ ﻌ ﻤ ﻞ و ﻻ ﺋ ﺤ ﺘ ﻪ ا ﻟ ﺘ ﻨ ﻔ ﻴ ﺬ ﻳ ﺔ و ا ﻟ ﻘ ﺮ ا ر ا ت‬


executive regulations and the decisions issued in its ‫اﻟﺼﺎدرة ﺗﻨﻔﻴﺬًا ﻟﻪ ﻓﻲ ﻛﻞ ﻣﺎﻟﻢ ﻳﺮد ﺑﻪ ﻧﺺ ﻓﻲ ﻫﺬا اﻟﻌﻘﺪ وﻳﺤﻞ‬
implementation in all cases where no provision is ‫ﻫ ﺬ ا ا ﻟ ﻌ ﻘ ﺪ ﻣ ﺤ ﻞ ﻛﺎ ﻓ ﺔ ا ﻻ ﺗ ﻔﺎ ﻗ ﻴﺎ ت و ا ﻟ ﻌ ﻘ ﻮ د ا ﻟ ﺴﺎ ﺑ ﻘ ﺔ ا ﻟ ﺸ ﻔ ﻬ ﻴ ﺔ ﻣ ﻨ ﻬﺎ‬
made in this contract. This contract replaces all ‫أ و ا ﻟ ﻜ ﺘﺎ ﺑ ﻴ ﺔ إ ن و ﺟ ﺪ ت‬
previous verbal or written agreements and contracts if
any.

are made in writing through the electronic ‫ا ﻟ ﺘ ﻮا ﺻ ﻞ ا ﻹ ﻟ ﻜ ﺘ ﺮ و ﻧ ﻴ ﺔ ﻓ ﻲ ﻣ ﻨ ﺼ ﺔ ﻗ ﻮ ى ﻟ ﻜ ﻞ ﻣ ﻦ ا ﻟ ﻄ ﺮ ﻓ ﻴ ﻦ و ﻳ ﻠ ﺘ ﺰ م‬
communication channels in the Qiwa platform for ‫ﻛ ﻞ ﻃ ﺮ ف ﻓ ﻲ ﺣﺎ ل ﺗ ﻐ ﻴ ﻴ ﺮ ه ﻟ ﻠ ﻌ ﻨ ﻮ ا ن ا ﻟ ﺨﺎ ص ﺑ ﻪ أ و ﺗ ﻐ ﻴ ﻴ ﺮ ا ﻟ ﺒ ﺮ ﻳ ﺪ‬
each of the parties. The address and email address ‫ا ﻻ ﻟ ﻜ ﺘ ﺮ و ﻧ ﻲ ﺑ ﺘ ﻌ ﺪ ﻳ ﻠ ﻪ ﻣ ﻦ ﺧ ﻼ ل ﻣ ﻨ ﺼ ﺔ ﻗ ﻮ ى وإ ﻻ ا ﻋ ﺘ ﺒ ﺮ ﻋ ﻨ ﻮا ن‬
registered in Qiwa platform will be considered legally ‫ا ﻟ ﻌ ﻨ ﻮ ا ن أ و ا ﻟ ﺒ ﺮ ﻳ ﺪ ا ﻻ ﻟ ﻜ ﺘ ﺮ و ﻧ ﻲ ا ﻟ ﻤ ﺴ ﺠ ﻞ ﻟ ﺪ ى ﻣ ﻨ ﺼ ﺔ ﻗ ﻮ ى ﻫ ﻤﺎ‬
applicable, and both parties are obligated to update .‫اﻟﻤﻌﻤﻮل ﺑﻬﻤﺎ ﻧﻈﺎﻣًﺎ‬
them on Qiwa platform in the event of any change.

Additional Terms ‫ﺑ ﻨ ﻮ د ا ﺿﺎ ﻓ ﻴ ﺔ‬

1. The second party is entitled to paid annual leave 21 ‫ ﻳﺤﻖ ﻟﻠﻄﺮف اﻟﺜﺎﻧﻲ إﺟﺎزة ﺳﻨﻮﻳﺔ ﻣﺪﻓﻮﻋﺔ اﻷﺟﺮ ﺗﻘﺪر ﺑِـ‬.1
of 21 calendar days for each year, and the second ‫ﻳ ﻮ ﻣﺎ ﺗ ﻘ ﻮ ﻳ ﻤ ﻴﺎ ﻋ ﻦ ﻛ ﻞ ﺳ ﻨ ﻪ و ﻳ ﺘ ﻢ ا ﺳ ﺘ ﺤ ﻘﺎ ق ﻫ ﺬ ه ا ﻻ ﺟﺎ ز ه ﺑ ﻌ ﺪ‬
party is entitled to annual leave after every two ‫ﻛ ﻞ ﺳﻨﺘﻴ ﻦ ﻋ ﻤ ﻞ‬
working years. ‫ ﻳﺠﻮز ﻟﻠﻄﺮف اﻟﺜﺎﻧﻲ اﺧﺘﻴﺎر أﺧﺬ‬،‫ ﺑﻌﺪ ﻣﻮاﻓﻘﺔ اﻟﻄﺮف اﻷول‬.2
2. Subject to the approval of the First Party, the ‫إ ﺟﺎ ز ﺗ ﻪ ﻓ ﻲ أ ﻳﺎ م ﻣ ﺤ ﺪ د ة ﻣ ﻦ ﺧ ﻼ ل ﺗ ﻘ ﺪ ﻳ ﻢ إ ﺷ ﻌﺎ ر ﻛ ﺘﺎ ﺑ ﻲ‬
Second Party may elect to take leave on specified ‫ﻟ ﻠ ﻄ ﺮ ف ا ﻷ و ل ﻗ ﺒ ﻞ ﺷ ﻬ ﺮ و ا ﺣ ﺪ ﻣ ﻦ ﺗﺎ ر ﻳ ﺦ ا ﻟ ﺴ ﻔ ﺮ ) ﺑﺎ ﺳ ﺘ ﺜ ﻨﺎ ء‬
days by giving written notice to the First Party at ( ‫ا ﻟ ﺤﺎ ﻻ ت ا ﻟ ﻄﺎ ر ﺋ ﺔ‬
least 1 month in advance from the date of travel ‫ ﻳﻘﻮم اﻟﻄﺮف اﻟﺜﺎﻧﻲ ﺑﺄداء اﻟﻤﻬﺎم اﻹﺿﺎﻓﻴﺔ اﻟﺘﻲ ﻳﺤﺪدﻫﺎ ﻟﻪ‬.3
(Emergency cases excluded ‫ إ ذا ا ﻋ ﺘ ﺒ ﺮ ا ﻟ ﻄ ﺮ ف ا ﻷ و ل ﻣ ﻦ‬، ‫ا ﻟ ﻄ ﺮ ف ا ﻷ و ل ﺑ ﺤ ﺴ ﺐ ﺗ ﻘ ﺪ ﻳ ﺮ ه‬
3. the Second Party shall perform additional duties, ‫و ﻗ ﺖ ﻵ ﺧ ﺮ أ ن ﻫ ﺬ ه ا ﻟ ﻤ ﻬﺎ م ﺗ ﺪ ﺧ ﻞ ﺿ ﻤ ﻦ ا ﺧ ﺘ ﺼﺎ ﺻﺎ ت ا ﻟ ﻄ ﺮ ف‬
as assigned by the First Party in its sole discretion ‫ا ﻟ ﺜﺎ ﻧ ﻲ أ و ا ﻟ ﻤ ﻬﺎ م ا ﻟ ﺘ ﻲ ﻳ ﺘ ﻮ ﻻ ﻫﺎ أ ﺻ ﺤﺎ ب ا ﻟ ﻜ ﻔﺎ ء ا ت ا ﻟ ﺬ ﻳ ﻦ‬
may assign to him, from time to time, which the .‫ﻳ ﺸ ﻐﻠ ﻮ ن ﻧ ﻔ ﺲ ا ﻟ ﻤﻨ ﺼ ﺐ‬
First Party considers within the Second Party's ‫ ﻳﺴﺘﺤﻖ اﻟﻄﺮف اﻟﺜﺎﻧﻲ ﺗﺬﻛﺮة ﻃﻴﺮان ﺑﺎﻟﺪرﺟﺔ اﻟﺴﻴﺎﺣﻴﺔ ﺣﺎل‬.4
qualifications or are ordinarily within the ‫ا ﺳ ﺘ ﺤ ﻘﺎ ﻗ ﻪ إ ﺟﺎ ز ة ﺳ ﻨ ﻮ ﻳ ﺔ إ ﻟ ﻰ ﺑ ﻠ ﺪ ه ﻛ ﻞ ﺳ ﻨ ﺘ ﻴ ﻦ‬
qualifications of persons performing such ‫ ﻳﺘﺤﻤﻞ اﻟﻄﺮف اﻟﺜﺎﻧﻲ ﻛﺎﻓﺔ ﺗﻜﺎﻟﻴﻒ اﻟﺴﻔﺮ اﻟﻤﺘﻌﻠﻘﺔ ﺑﺄي‬.5

4. He is entitled to an economy class airline ticket if ‫ﻟ ﻠ ﻤ ﺮا ﻓ ﻘ ﻴ ﻦ‬
he is entitled to an annual leave to a country for ‫ ﻳﺠﺐ ﻋﻠﻰ اﻟﻄﺮف اﻟﺜﺎﻧﻲ أن ﻳﻌﻴﺪ‬،‫ ﻋﻨﺪ اﻧﺘﻬﺎء ﻫﺬا اﻟﻌﻘﺪ‬.6

5. Second Party will incur and handle all Travel ‫ﻛ ﻤﺎ ﻳ ﺠ ﻮ ز ﻟ ﻠ ﻄ ﺮ ف ا ﻷ و ل ﺧ ﺼ ﻢ ﻗ ﻴ ﻤ ﺔ أ ي ﻣ ﻤ ﺘ ﻠ ﻜﺎ ت ﺗﺎ ﻟ ﻔ ﺔ أ و‬
expenses related to any additional dependents, ‫ﻣ ﺘ ﻀ ﺮ ر ة أ و ﻣ ﻔ ﻘ ﻮ د ة ﻣ ﻦ ﻗ ﺒ ﻞ ا ﻟ ﻄ ﺮ ف ا ﻟ ﺜﺎ ﻧ ﻲ و ا ﻟ ﺘ ﻲ ﻳ ﻤ ﺘ ﻠ ﻜ ﻬﺎ‬
including fees of dependents. ‫( ﻣﻦ ﻧﻈﺎم اﻟﻌﻤﻞ‬91) ‫ وﺗﻄﺒﻖ أﺣﻜﺎم اﻟﻤﺎدة‬،‫اﻟﻄﺮف اﻷول‬
6. Upon the termination of this Agreement, the ‫ و ﻋ ﻨ ﺪ ا ﻧ ﺘ ﻬﺎ ء ﻫ ﺬ ا ا ﻟ ﻌ ﻘ ﺪ و ﺗ ﺴ ﻮ ﻳ ﺔ‬. ‫ا ﻟ ﺴ ﻌ ﻮ د ي ﻓ ﻲ ﻫ ﺬ ا ا ﻟ ﺸ ﺄ ن‬
Second Party is required to return all property ‫ ﻳ ﻘ ﻮ م ﻛ ﻞ ﻣ ﻦ ا ﻟ ﻄ ﺮ ف ا ﻷ و ل و ا ﻟ ﻄ ﺮ ف‬، ‫ﻛﺎ ﻓ ﺔ ا ﻟ ﻤ ﺴﺎ ﺋ ﻞ ا ﻟ ﻌﺎ ﻟ ﻘ ﺔ‬
belonging to the First Party which is in his ‫ و ﺣ ﻴ ﻨ ﻬﺎ‬، ‫ا ﻟ ﺜﺎ ﻧ ﻲ ﺑ ﺘ ﻮ ﻗ ﻴ ﻊ ﻣ ﺨﺎ ﻟ ﺼ ﺔ ﻣ ﺘ ﺒﺎ د ﻟ ﺔ ﻋ ﻦ ﻛﺎ ﻓ ﺔ ا ﻟ ﻤ ﻄﺎ ﻟ ﺒﺎ ت‬
possession. The First Party may deduct value of . ‫ﻳ ﻘ ﻮ م ا ﻟ ﻄ ﺮ ف ا ﻷ و ل ﺑﺈ ﺻ ﺪ ا ر ﺷ ﻬﺎ د ة ﺧ ﺪ ﻣ ﺔ ﻟ ﻠ ﻄ ﺮ ف ا ﻟ ﺜﺎ ﻧ ﻲ‬
any property destroyed or damaged or lost by ،‫ ﻳﺤﻖ ﻟﻠﻄﺮف اﻷول إﻧﻬﺎء ﻋﻘﺪ اﻟﻄﺮف اﻟﺜﺎﻧﻲ ﻋﻠﻰ اﻟﻔﻮر‬.7
the Second Party which is owned by the First ‫و د و ن إ ﺷ ﻌﺎ ر ﻣ ﺴ ﺒ ﻖ و ﺑ ﻐ ﻴ ﺮ ﺗ ﻌ ﻮ ﻳ ﺾ ﻋ ﻦ ذ ﻟ ﻚ و د و ن أ ي ﺣ ﻖ‬
Party and provisions of article (91) of Saudi ‫ و ﻓ ﻲ‬، ‫ﻣ ﻦ ﺟﺎ ﻧ ﺐ ا ﻟ ﻄ ﺮ ف ا ﻟ ﺜﺎ ﻧ ﻲ ﻳ ﺆ د ي ﻓ ﻲ أ ي ﻣ ﻨ ﻔ ﻌ ﺔ أ ﺧ ﺮ ى‬
Labour Law shall apply in this concern. Upon the ‫أ ي و ﻗ ﺖ ﻃﺎ ﻟ ﻤﺎ أ ن ا ﻟ ﻄ ﺮ ف ا ﻟ ﺜﺎ ﻧ ﻲ ﺗ ﺤ ﺖ ﻓ ﺘ ﺮ ة ا ﻟ ﺘ ﺠ ﺮ ﺑ ﺔ أ و و ﻓ ﻖ‬
termination of this Agreement and the ‫( ﻣﻦ ﻧﻈﺎم اﻟﻌﻤﻞ‬80) ‫اﻟﻤﺎدة‬
settlement of all outstanding matters, the First ‫ ﻓﻲ ﺣﺎﻟﺔ ﺗﻢ اﻧﻬﺎء اﻟﻌﻘﺪ ﻣﻦ ﻗﺒﻞ أﺣﺪ اﻟﻄﺮﻓﻴﻦ ﻗﺒﻞ اﻧﻘﻀﺎء‬.8
Party and the Second Party will execute a mutual ‫ﻣ ﺪ ﺗ ﻪ د و ن ﺳ ﺒ ﺐ ﻣ ﺸ ﺮ و ع ﻳ ﺤ ﻖ ﻟ ﻠ ﻄ ﺮ ف ا ﻵ ﺧ ﺮ ﻣ ﻘﺎ ﺑ ﻞ ﻫ ﺬ ا‬
release of all claims, and the First Party will issue ‫ ا ذ ا ﻛﺎ ن ﻓ ﺴ ﺦ ا ﻟ ﻌ ﻘ ﺪ ﻣ ﻦ‬: ‫ﻀﺎ ﻳ ﺤ ﺪ د و ﻓ ﻖ ا ﻵ ﺗ ﻲ‬

a Service Certificate to the Second Party ‫ﻗ ﺒ ﻞ ا ﻟ ﻄ ﺮ ف ا ﻷ و ل ﻓ ﻴ ﻠ ﺘ ﺰ م ﺑ ﺄ ن ﻳ ﺪ ﻓ ﻊ ﻟ ﻠ ﻄ ﺮ ف ا ﻟ ﺜﺎ ﻧ ﻲ ﺗ ﻌ ﻮ ﻳ ﻀﺎ‬
7. The First Party has the right to terminate the. ‫ﻋ ﻦ ﻫ ﺬ ا ا ﻟ ﻔ ﺴ ﺦ ﻗ ﺪ ر ه ر ا ﺗ ﺐ ﺷ ﻬ ﺮ ا ﺳﺎ ﺳ ﻲ ﻓ ﻘ ﻂ ﻓ ﻲ ﺣﺎ ل ﺗ ﻢ‬
Second Party forthwith, without prior notice or ‫ا ﻧ ﻬﺎ ء ا ﻟ ﻌ ﻘ ﺪ ﻣ ﻦ ﻗ ﺒ ﻞ ا ﻟ ﻤ ﻮ ﻇ ﻒ ﻗ ﺒ ﻞ ا ﻧ ﺘ ﻬﺎ ء ﻣ ﺪ ﺗ ﻪ ﻷ ي ﺳ ﺒ ﺐ‬
pay in lieu of such notice and without any right ‫ﻣ ﻦ ا ﻻ ﺳ ﺒﺎ ب ﻳ ﺪ ﻓ ﻊ ﺗ ﻌ ﻮ ﻳ ﻀﺎ ﻟ ﺼ ﺤﺎ ب ا ﻟ ﻌ ﻤ ﻞ ا ﻟ ﻤ ﺘ ﺒ ﻘ ﻲ ﻣ ﻦ‬
on the part of the Second Party to any other (77) ‫ﻋﻘﺪه ﺣﺴﺐ اﻟﻤﺎدة‬
benefit, at any time while the Second Party is on ‫ ﻳﺘﻢ اﺣﺘﺴﺎب ﻣﻜﺎﻓﺄة ﻧﻬﺎﻳﺔ اﻟﺨﺪﻣﺔ ﻟﻠﻄﺮف اﻟﺜﺎﻧﻲ وﻓﻘﺎ‬.9
probation or according to Article (80) ‫ و ﻻ ﺗ ﻌ ﺘ ﺒ ﺮ أ ي ﻣ ﻜﺎ ﻓ ﺂ ت أ و‬، ‫ﻷ ﺣ ﻜﺎ م ﻧ ﻈﺎ م ا ﻟ ﻌ ﻤ ﻞ ا ﻟ ﺴ ﻌ ﻮ د ي‬
8. In the event that the contract is terminated by ‫ﺣ ﻮ ا ﻓ ﺰ أ و أ ي ﻣ ﺪ ﻓ ﻮ ﻋﺎ ت ﻣ ﺸﺎ ﺑ ﻬ ﺔ و ا ﻟ ﺘ ﻲ ﺑ ﻄ ﺒ ﻴ ﻌ ﺘ ﻬﺎ ﺗ ﺨ ﻀ ﻊ‬
one of the two parties before the expiration of ‫ ﺟ ﺰ ء ا ﻣ ﻦ أ ﺟ ﺮ ا ﻟ ﻄ ﺮ ف ا ﻟ ﺜﺎ ﻧ ﻲ ﻋ ﻨ ﺪ ﻣﺎ ﻳ ﺘ ﻢ‬، ‫ﻟ ﻠ ﺰ ﻳﺎ د ة و ا ﻟ ﻨ ﻘ ﺼﺎ ن‬
its term without a legitimate reason, the other . ‫ا ﺣ ﺘ ﺴﺎ ب ﻣ ﻜﺎ ﻓ ﺄ ة ﻧ ﻬﺎ ﻳ ﺔ ا ﻟ ﺨ ﺪ ﻣ ﺔ‬
party shall be entitled to compensation for this ‫ ﻳﻠﺘﺰم اﻟﻄﺮف اﻟﺜﺎﻧﻲ ﺑﺘﻨﻔﻴﺬ اﻟﻠﻮاﺋﺢ اﻟﺪاﺧﻠﻴﺔ اﻟﻤﻌﻤﻮل ﺑﻬﺎ‬.10

following: A- If the contract was terminated by ‫ا ﻟ ﺜﺎ ﻧ ﻲ ﺑ ﺄ ﻧ ﻪ ﻗ ﺪ أ ﻃ ﻠ ﻊ ﻋ ﻠ ﻰ ﻻ ﺋ ﺤ ﺔ ﺗ ﻨ ﻈ ﻴ ﻢ ا ﻟ ﻌ ﻤ ﻞ ﻟ ﺪ ى ا ﻟ ﻄ ﺮ ف‬
the first party, he shall be obligated to pay the ‫ا ﻷ و ل و أ ﻧ ﻪ ﻳ ﻠ ﺘ ﺰ م ﺑ ﻜ ﻞ ﻣﺎ و ر د ﻓ ﻴ ﻬﺎ‬
second party compensation for this termination ‫ ﻳﻌﺘﺒﺮ ﻫﺬا اﻟﻌﻘﺪ ﻛﺄن ﻟﻢ ﻳﻜﻦ ﻓﻲ ﺣﺎﻟﺔ ﺛﺒﻮت ﻋﺪم ﺻﺤﺔ أي‬.11

In the event that the contract is terminated by ‫ ﺑ ﺴ ﺒ ﺐ‬- ‫ و ﻟ ﻴ ﺲ ﻟ ﻠ ﻄ ﺮ ف ا ﻟ ﺜﺎ ﻧ ﻲ‬، ‫ا ﺳﺎ ﺳ ﻬﺎ إ ﺑ ﺮ ا م ﻫ ﺬ ا ا ﻟ ﻌ ﻘ ﺪ‬
the employee before the expiry of its term for ) ، ‫ أ ي ﻣ ﻦ ا ﻟ ﻤ ﺴ ﺘ ﺤ ﻘﺎ ت ا ﻟ ﻤ ﻨ ﺼ ﻮ ص ﻋ ﻠ ﻴ ﻬﺎ ﻓ ﻲ ا ﻟ ﻌ ﻘ ﺪ‬- ‫ذ ﻟ ﻚ‬
any reason, he shall pay compensation to the ‫و ﻳ ﻌ ﺘ ﺒ ﺮ ﻣﺎ ﺳ ﺒ ﻖ أ ن ﺻ ﺮ ف ﻟ ﻪ ﻣ ﻨ ﻬﺎ ﻣ ﻘﺎ ﺑ ﻞ ﻣﺎ ﻗ ﺪ ﻣ ﻪ ﻣ ﻦ ﻋ ﻤ ﻞ‬
employer for the remainder of his contract (
according to Article (77) ‫ ﻛﻤﺎ‬، ‫ ﻳﺠﻮز ﺗﻜﻠﻴﻒ اﻟﻄﺮف اﻟﺜﺎﻧﻲ ﺑﺎﻟﻌﻤﻞ ﺳﺎﻋﺎت إﺿﺎﻓﻴﺔ‬.12
9. The Second Party's end of service benefits will be ‫ﻳ ﺠ ﻮ ز ﺗ ﻜ ﻠ ﻴ ﻔ ﻪ ﺑﺎ ﻟ ﻌ ﻤ ﻞ ﻓ ﻲ أ ﻳﺎ م ا ﻟ ﻌ ﻄ ﻞ ا ﻟ ﺮ ﺳ ﻤ ﻴ ﺔ‬
calculated in accordance with the provisions of ‫ ﺗﻌﺘﺒﺮ ﻟﻮاﺋﺢ وأﻧﻈﻤﺔ وﺗﻌﻠﻴﻤﺎت اﻟﻄﺮف اﻷول ﺟﺰءًا ﻣﻜﻤًﻼ‬.13

other similar payments which by their nature are ‫ا ﻟ ﻌ ﻤ ﻞ و ا ﻟ ﻌ ﻤﺎ ل ا ﻟ ﺴ ﻌ ﻮ د ي و ﻧ ﻈﺎ م ا ﻟ ﺘ ﺄ ﻣ ﻴ ﻨﺎ ت ا ﻻ ﺟ ﺘ ﻤﺎ ﻋ ﻴ ﺔ‬
subject to increase and decrease shall not be ‫ ﻳﺘﻢ ﺗﺒﺎدل اﻟﻤﺨﺎﻃﺒﺎت اﻟﻤﺘﻌﻠﻘﺔ ﺑﻬﺬا اﻟﻌﻘﺪ إﻣﺎ ﺑﺘﺴﻠﻴﻤﻬﺎ‬.14

10. The second party is obligated to implement the ‫وﺗﻌﺘﺒﺮ ﻣ ُﻨﺘﺠﺔ ﻷﺛﺎرﻫﺎ اذا ﺑﻠﻐﺖ ﺑﺎﻟﻄﺮﻳﻘﺔ اﻟﻤﺬﻛﻮرة‬
internal regulations applicable to the first party ‫ ﻳﺘﺠﺪد اﻟﻌﻘﺪ ﻟﻤﺪة ) ﺳﻨﺘﻴﻦ ( ﻣﺎﻟﻢ ﻳﺸﻌﺮ أﺣﺪ اﻟﻄﺮﻓﻴﻦ اﻷﺧﺮ‬.15
in effect at the time of signing. The second party ‫( ﻳﻮﻣًﺎ ﻣﻦ ﺗﺎرﻳﺦ‬30)‫ﺧﻄﻴًﺎ ﺑﻌﺪم رﻏﺒﺘﻪ ﻓﻲ اﻟﺘﺠﺪﻳﺪ ﻗﺒﻞ‬
also acknowledges that he has seen the work . ‫ا ﻧ ﺘ ﻬﺎ ء ا ﻟ ﻌ ﻘ ﺪ‬
organization regulation of the first party and
that he is committed to everything contained
therein
11. This contract is considered null and void in the
event that any of the data provided by the
second party on the basis of which this contract
was concluded is proven incorrect, and the
second party does not - because of that - any of
the dues stipulated in the contract, (what was
previously paid to him is considered
consideration his work)
12. The second party may be assigned to work
overtime, and may be assigned to work on
official holidays
13. The rules, regulations, and instructions of the
first party are considered an integral part of this
contract unless stipulated in it, and the two
parties are subject to the Saudi Labor and
Workers Law and the Social Insurance Law
14. Correspondences related to this contract are
exchanged either by handing them in exchange
for proof of receipt, or by registered mail, e-mail,
or via the second party's WhatsApp, and they are
considered to produce their effects if they are
communicated in the aforementioned way
15. The contract shall be renewed for a period of
(two years) unless one of the other parties
notifies the other in writing of his unwillingness
to renew it prior to (30) days from the expiry
date of the contract.

This contract was exported electronically and is ‫ﺗﻢ ﺗﺼﺪﻳﺮ ﻫﺬا اﻟﻌﻘﺪ اﻟﻜﺘﺮوﻧﻴًﺎ وﻳﺘﺎح اﻟﻮﺻﻮل ﻟﻪ ﻟﻜﻞ ﻣﻦ اﻟﻄﺮﻓﻴﻦ‬
