RS. 30:2171 et seq., and the regulations adopted thereunder and under the authority of the 1984 Hazardous and Solid Waste Amendments (HSWA) to the Resource Conservation and Recovery Act (RCRA) to Clean Harbors Colfax, LLC (hereafter called the Permittee) to treat and store hazardous waste at the facility Jocated in Colfax, Louisiana, at latitude 31° 34° 05" N and longitude 92°34' 21" W. For the purposes of this permit, the “Administrative Authority" shall be the Secretary of the Louisiana Department of Environmental Quality or his/her designee. ‘The Permittee must comply with all terms and conditions of this permit. This permit consists of the conditions contained herein and the applicable regulations contained in the Louisiana Administrative Code, Title 33, Part V, Subpart I (LAC 33:V.Subpart 1). Applicable regulations are those which are in effect on the effective date of issuance of this permit. This permit is based on the assumption that the information provided to LDEQ by the Permittee is accurate. Further, this permit is based in part on the provisions of Sections 206, 212, and 224 of the HSWA of 1984, which modify Section 3004 and 3005 of RCRA. In particular, Section 206 requires corrective action for all releases of hazardous waste or constituents from any solid waste management unit at a treatment, storage, or disposal facility seeking a permit, regardless of the time at which waste was placed in such unit. Section 212 provides authority to review and modify the permit at any time. Any inaccuracies found in the submitted information may be grounds for the termination, modification, revocation, and reissuance of this permit (see LAC 33:V.323) and potential enforcement action, The Permittee ‘must inform the LDEQ of any deviation from or changes in the information in the application which would affect the Permittee’s ability to comply with the applicable regulations or permit conditions. This permit shall be effective as off Pagat 29, 2628 , and shall remain in effect wi Que 29,2053. unless revoked, reissued, modified or terminated in accordance with \C 33:V.343 and 705 of the Louisiana Hazardous Waste Regulations. The Administrative Authority may issue any permit for a duration that is less than the maximum term of ten (10) years and the term shall not be extended beyond the maximum duration by modification in accordance with LAC 33:V.315. Provisions of this permit may be appealed in writing pursuant to LA. R.S. 30:2024(A) within 30 days from receipt of the permit. Only those provisions specifically appealed will be suspended by a request for hearing, unless the Secretary elects to suspend other provisions as well. PERMIT PREAMBLE AND GENERAL LEGAL REQUIREMENTS, LA. DEFINITION OF TERMS, SEVERABILITY, TRANSFER OF PERMIT ‘This permit is issued to Clean Harbors Colfax, LLC, hereinafter referred to as the Permittee, by the Louisiana Department of Environmental Quality (LDEQ) under authority of the Louisiana Hazardous Waste Control Law, R.S. 30:2171 et seg.. and the regulations adopted thereunder and by the U.S. Environmental Protection Agency (USEPA) under authority of the 1984 Hazardous and Solid Waste Amendments (HSWA) to the Resource Conservation and Recovery Act (RCRA). For permit purposes, “administrative authority” shall mean the Secretary of the Department of Environmental Quality, or his/her designee. For any HSWA provisions for which the Stat is not authorized, the U.S. Environmental Protection Agency shall be the administrative authority. Compliance for purpose of enforcement. Compliance with this permit and LAC 33:V.Subpart I constitutes compliance, for purposes of enforcement, with RCRA Subtitle C of RCRA, HSWA, and Chapter 9 of the Louisiana Environmental Quality ‘Act (Act), except for those requirements not included in the permit which become effective by statute; are promulgated under LAC 33:V.Chapter 22 restricting placement of hazardous wastes in or on the land; or are promulgated under LAC 33:V.Chapter 43 Subchapiers Q, R, and V limiting air emissions. This permit is conditioned upon full compliance with all applicable provisions of the Louisiana Hazardous Waste Control Law, R.S. 30:2171 et. seq., and the regulations adopted thereunder. However, compliance with the terms of this permit does not constitute a defense to any ord under Section 3013 or Section 7003 of RCRA, or under Section 106 (a) of the Comprehen: Compensation, and Liability Act of 1980 (CERCLA) {42 U.S.C. 9606 (a)} issued or any action brought fe Environmental Response, Definition of terms, All terms contained in this permit shall have meaning as defined in the Louisiana Administrative Code (LAC 33:V Subpart 1) unless otherwise stated herein. Terms not defined by the LAC 33:V.Subpart 1 shall have their customary meaning as found in current version of Webster's English dictionary. Off-site Waste Management. The Permittee is authorized to receive, treat, or store hazardous waste from off-site sources. Permittee must inform the generator in writing (except where the Permittee is also the generator) that the Permittee has appropriate permits for, and shall aceept the waste to be shipped by the generator. The Permittee must keep a copy of this ‘written notice as part of the operating record as required by LAC 33:V. S27. ‘Accurate Information. This permit is based upon information submitted in the permit application, all subsequent amendments, and the applicant's certification that such information is accurate and that all facilities were or will be constructed and operated as specified in the application. The Permittee’ failure in the application or during the permit issuance process to disclose fully all relevant facts at any time may be cause for termination or modification of this permit in accordance with LAC 33:V.323.B.2 and. ‘New or Amended Regulations Subsequent to Permit Issuance. All regulation citations are defined as being the regulation in effect on the permit issuance date. New and/or amended regulations are not included as permit requirements until permit ‘modification procedures specified in LAC 33:V.321, 322, andior 323 are completed. ‘Severability. Permit conditions are severable and, if any permit provision or application of any permit provision to any circumstance is held invalid, the application of such provision to other circumstances and the remainder ofthis permit shall not be affected thereby. Page 1 of 43 ‘Permit Transfers. This permit may be transferred to a new owner or operator only if it is modified or revoked-and-reissued Pursuant to LAC 33:V.309.L.4, 321.B, and LAC 33:1.Chapter 19. The Permittee’s failure to notify the new owner or operator ‘of LAC 33:V.Subpart | and LAC 33:1.Chapter 19 requirements in no way relieves the new owner or operator of his obligation to comply with all applicable requirements. MODIFICATION, REVOCATION-AND-REISSUANCE, AND TERMINATION OF PERMIT In accordance with LAC 33:V.309.F, a request filed by the Permittee for @ permit modification, revocation-and-reissuance, termination, or the notification of planned changes or anticipated noncompliance on the part of the Permittee, does not stay the applicability or enforceability of any permit condition. Ifthe administrative authority tentatively decides to modify or revoke-and-reissue a permit under LAC 33:V.321.C. ot 323, a draft permit shall be prepared incorporating the proposed ‘changes. The administrative authority may request additional information and, inthe case of a modified permit, may require submission of an updated permit application. Failure to comply with any permit condition, including information submittals, constitutes a violation of the permit and may justify enforcement action, permit amendment, termination, revocation, suspension, or denial of a permit renewal application. Falsification of any submitted information may justify termination of this permit (LAC 33:V.323.B33) Page 2 of 43 LC. SCHEDULE OF COMPLIANCE. Failure to comply with any item in the ‘Schedule of Compliance’ is a violation of the Permit unless a permit modification or \writen request for extension is approved by the administrative authority 1.C.1. Within 90 days ofthe issuance of this permit, the Permittee shall submit a plan to establish a comprehensive community outreach program to engage with local communities on permitting activities, operations alerts and to work with the community on significant and/or sensitive events. The program shall include activities for understanding citizens’ concems, sharing facility information, and addressing impacts to communities 1L.C.2. Permittee shall permanently cease all Open Burn/Open Detonation (OB/OD) thermal treatment operations no later than 180 days after notice ofthe final permit is received by the Permittee. For 180 days after notice ofthe final permit is received by the Permittee, the thermal treatment operations by OB/OD shall be limited in capacity, as specified, and limited to the specific waste streams identified in this permit. Permittee shall submit a notification of closure for the OB/OD thermal treatment nit (including the pad, pans and all associated equipment) within 30 days afte cessation of operation of the OB/OD. ‘unit. Within one year ofthe issuance of this permit, the Permittee shall submit a revised Part A/I and applicable revised plans {as a permit modiication(s), in accordance with LAC 33:V.321.C. 1LC.3. The design and construction of the Contained Burn Chamber System (CBCS) shall be certified by a Louisiana licensed professional engineer, verifying that the construction of the unit was built in conformity with the conditions of the permit. A Request to Perform Initial Inspection, according to LAC 33:¥,703,B.4., shall be submitted to the administrative authority ‘The Permittee shall submit monthly construction reports describing the completed and current activities atthe site from the beginning of the construction period until the construction certification is submitted to the administrative authority. The reports shall be submitted to the Office of Environmental Services and the appropriate LDEQ Regional Office. These reports shall include, ata minimum, the following information: 1. a.summary of construction activities to date; the percentage of work completed to date; the current status ofthe work; details regarding the work scheduled to occur in the next reporting period; details ofthe work successfully completed since the last report; ‘weather conditions for the reporting period and impacts, if any; details regarding any quality control or quality assurance problems encountered: and any additional information requested by the administrative authority Page 3 of 43 1.C4, Requirements of the Open Burning/Open Detonation Thermal Treatment. General Conditions for Open Burning and Open Detonation (OB/OD) 1.C.4.bi The conditions related to treatment of hazardous waste shall be limited to the units listed in LC.4.a and the waste listed in Table A. 1.C.4.baii, The Permittee shall maintain the thermal treatment pans and concrete thermal treatment pads according 1 the design specifications, operational specifications, maintenance requirements, applicable permit conditions, ‘manufacture’s specifications and inspection plan, 1.C.4.baii, The Permittee must maintain the necessary elevations and slope of the thermal treatment containment area to prevent run-on and run-off. 1.C.4.b.iv. The Permittee may thermally treat by OB/OD those hazardous wastes listed in the Waste Analysis Plan; and in Table A for 180 days after notice of the final permit is received by the Permittee. 1.C.4.b.v. The Permittee is prohibited from treating all non-explosive wastes by OB/OD. 180 days after notice Of the final permit is received by the Permittee, those wastes specified in Condition I.C.4.h. shall be prohibited from being treated by OBIOD. 1.C.4.b.vi. The Permittee shall maintain the thermal treatment unit to minimize the possibility of fire, explosion, ‘or any unplanned, sudden or non-sudden releases of hazardous waste constituents to air, soil, or surface water that ‘might threaten human health or the environment in accordance with LAC 33:V.1S11.B and Condition 1LC.22. 1.C.4.b.vii. Three ambient air monitoring stations shall monitor all thermal treatment units for air emissions during the period the OB/OD unit remains operational. Air monitoring reports shall be submitted to the Office of Environmental Assessment, Air Planning and Assessment Division for review quarterly and a final report shall be submitted within 90 days from the receipt of the final laboratory analytical reports for the monitoring period. ‘The three ambient air monitoring stations shall sample every 6 days; the sampling duration is 24 hours. Samples are collected during no burning and during burning for OB/OD.. After cessation of the OB/OD operations ambient ‘ir monitoring will not be required during the closure of the OB/OD unit and not during the construction of the BCs. The constituents for air monitoring are as follows: PM25 PMIO Metals PAHs Dioxin/Furans ‘VOCs 1.C.4.b.viii. The Permittee shall manage accumulated precipitation and shall control and contain run-on and run- off in accordance with LAC 33:V.1503.B.2 and LAC 33:V.2111.B.4-6. lll run-on and run-off shall be collected and treated in the on-site wastewater treatment system in accordance with the LPDES Permit, Page $ of 43 L.C.4.¢. OB/OD Operation, Inspection, and Maintenance L.C.A.e4. The Permittee shall at all times properly operate and maintain the thermal treatment pans, conerete thermal treatment pads and thermal treatment slab and associated structures in accordance with all applicable regulations, permit conditions and maintenance schedule. Proper operation and maintenance includes, but is not limited to, effective performance, proper operations, thermal treatment slab area structure, protection of human health and the environment, adequate operator staffing and training, and adequate laboratory and process controls, including appropriate quality assurance/quality control procedures in accordance with LAC 33:V.309.E.1 1511.B, 3203 and 3205. LCA. The Permittee shall operate and maintain the thermal treatment area to minimize air emissions and adverse effects on human health and the environment in accordance with LAC 33:V.3203, LC.A.eiii, The Permittee shall operate and maintain a precipitation cover for the thermal treatment pans and conerete thermal treatment pads when precipitation is imminent and at the end of the operational day. L.C.A.c.iv. The Permittee shall inspect the thermal treatment unit in accordance with the Inspection Plan referenced in Table | of this permit. The Permittee shall complete the following as part ofthese inspections: 1.C.4.c.v. The Permittee shall thoroughly inspect the thermal treatment unit (which includes the 20 thermal treatment pans and concrete thermal treatment pads) and associated equipment and/or structures for leaks and/or spills. The leak and/or spills shall be cleaned immediately upon discovery. 1.C.4.e.vi. The Permittee shall inspect the thermal treatment unit's concrete slab each operating day and shall repair any cracks, chips, broken concrete, and damage, accordingly: 1) Small cracks shall be monitored and repaired no less than quarterly; 2) Breaks and cracks deeper than the surface (c., up to three inches in depth) shall be repaired within 48 hours; and 3) Significant damage to the slab area that could potentially impact the soil, or has the potential to further result in a threat to the environment shall be taken out of service until repairs are made. The thermal treatment pans and conerete pads shall be inspected before each thermal treatment or burm/detonation event. L.C.A.e.vii Thermal treatment units that are damaged and must be replaced shall be decontaminated prior to disposal. The thermal treatment units sent for repair shall be decontaminated prior to repair. L.C.4.c.vii, The inspection schedules and maintenance and repair records shall become part of the operating record and shall be made available at all reasonable times to the administrative authority in accordance with Condition 1.C.11. L.C.4.e.ix. Visual inspections are to be conducted after each thermal treatment to ensure no releases or spills of untreated wastes are outside of the containment areas or treatment process areas have occurred. LC.4.e.x. The Permittee shall keep a record of all repairs and/or replacements to the unit(s) and associated equipment. The repair and/or replacement record shall be completed within one working day of the date the unit ‘was placed back into service. This record shal be part ofthe operating record for this Permit and available at the facility at all times for review and inspection by the administrative authority and in accordance with Conditions TLC.11 and I1L3. At minimum, the record shall include the following information: L.C.4.e-x(a) The date the damage was discovered 1.C.4.c.x.(b) The pans, pad andlor slab or associated equipment (e.g., thermal treatment pad, cover, tc.) that is repaired or replaced, including any other appropriate descriptive identities: LC4.c.x.(6) The type of maintenance or repair (small, moderate or significant) see Condition VBS. 1.C.4.c-x.(4) The date the unit, area and/or equipment, was taken out of service: Page 6 of 43 1.C.4.¢.x.(e) The date maintenance, repair or replacement was completed; 1.C.4.e.x (Q) The name of person(s) conducting the maintenance, repair or replacement; 1.C.4.e.1.(g) Any other pertinent information associated with the maintenance, repair or replacement; 1.C.4.6.x.(h) The date the unit(s) was placed back into service; and 1.C.4.¢.x.() Photographs of the damage and repairs shall be included in the operating record, LC.A.e-xi The thermal treatment area (including 30 feet from the treatment unit) shall be inspected after each bburn event for any ejected material and/or untreated waste, and the thermal treatment pad will be inspected each ‘operating day for leaks, spills, and cracks. All ejected untreated waste, previously characterized in accordance with LC4.g.xvi, shall be re-treated based on the characterization prior to initial treatment, and any ejected non- hhazardous waste material shall be collected for proper disposal 1.C.4.c.xii. The Permittee shall visually inspect residues remaining after treatment in order to ensure no untreated ‘waste remains. All ash residue shall be managed in accordance with this permit and in accordance with the Ash Management Plan in the approved WAP in Table 1 of this permit. Page 7 of 43 1.C.A.. Specific Operating Conditions for OB/OD. L.C.4.d.i, The Permittee must observe the movement of the plume created by a detonation/bum event. The ‘observer shall be positioned so that they are able to observe when the plume is moving toward the South, in the direction of the local community. 1.C.4.d.i. If the observer determines that the plume has crossed the property fence line toward the South, the ‘observer shall immediately contact the Operational Supervisor or the Supervisor's alternate. The Permittee shall ‘not commence another detonation/burn event until the plume has dissipated and until meteorological conditions are met. L.C.4.d.ii, Thermal treatment operations shall be limited to daylight hours only between 8 a.m. and 5 p.m. Monday through Saturday, which includes the treatment and inspection after the cool-down period. The physical preparation and transportation of wastes to the thermal treatment unit may occur outside of the 8 a.m. to S p.m. timeframe, in preparation forthe thermal treatment. L.C.4.d.v. The Permittee shal allow sufficient cool-down periods (including smoldering duration) following each thermal treatment to allow the ash to be handled safely. The cool-down period shall be documented on the daily burn logs 1.C.4.d.v. Characteristic hazardous wastes must no longer exhibit reactive and explosive properties prior to removal of residuals from the thermal treatment pans. All hazardous wastes that may have been ejected or did ‘not detonate/bur in the intial treatment shall be re-treated. L.C.4d.vi_ The Permittee shall operate and maintain the precipitation covers/etractable roofs in a manner that will minimize the accumulation of precipitation within each thermal treatment pan and respective concrete pad, Precipitation covers/retractabe roofs shall be placed over each thermal treatment unit when precipitation is anticipated and at the end of the operational day. L.C.4.d.vii, The Permittee shall maintain a record of all waste thermally treated in the operating record, L.C.4.d.vili, Ash and/or residues from the thermal treatment units shall be managed in accordance Ash Management Plan in the approved WAP, Table I of this permit, LC4.d.ix. The Permittee shall operate the thermal treatment units in accordance with LAC 33:V.3203 and 3205 and the folowing requirements: LCA.ai (a). The Permittee shall not dispose of or treat any liquid hazardous waste on or in the ground. 1.C.4.d.ix.(b) All activities related to open burning shall be performed only in the designated areas. LC.A.d.ix(c) Waste may be placed in the thermal treatment unit(s) only when a thermal treatment event is planned within the next four hours or by the end of the operating day, whichever is less. Page 8 of 43 L.C.4.¢. Meteorological Restrictions for OB/OD The Permittee shall not initiate open detonation or open burning during the following meteorological conditions: 1.C.4.ei Wind speeds at the thermal treatment area are greater than ten miles per hour based on the on-site meteorological station. Electrical storms are present within a three-mile radius of the facility Precipitation is occurring at the facility LCA.e.iv. Heavy, dense cloud cover or fog is observed within one-quarter mile of the facility. L.C.4..v. Flooding conditions have been reported by the local weather sources that have caused roads and bridges approaching the facility to be submerged or closed and prevent vehicles from traveling through. C4. Thermal Treatment Feed Limitations for OB/OD. ‘The Permittee shall thermally treat only quantities of waste tothe thermal treatment unit(s) that do not exceed the waste feed limitations given below: LLCA.Ei. The Permittee shall not thermally treat more than 561,700 pounds per year NEW or 410 pounds per hour [NEW of hazardous waste per nine-hour day (8 a.m. 0 5 p.m.) Monday through Saturday. 1.C.A.fii 180 days after notice ofthe final permit is received by the Permittee, the Permittee shal cease all OB/OD activities. Permittee shall submit a notification of closure for the OB/OD unit (including the pad, pans and associated equipment) within 30 days after cessation of operation ofthe OB/OD unit. Page 9 of 43 L.C.4.g. Operating Record for OB/OD L.C4.g.i. The operating record shal include the date and time, the duration ofthe thermal treatment, the quantity. the type of waste treated, any waste re-treated, and the removal and disposal of ash resulting from the thermal treatment. L.C4.gii, Highly volatile and flammable liquids shall not be used to facilitate thermal treatment. Number 2 diese! fuel oil is acceptable or another fuel sources that is protective of human health and the environment. 1.C.4.giil. The waste will be placed in the thermal treatment pans and when necessary to facilitate the thermal treatment, the waste will be soaked with diesel fuel (a low volatile slow burning fuel). 1.C.A.giv. The Permittee shall not treat high explosives containing initiators of any description. L.CA.g.v. The Permitiee shall not mix bulk explosives for treatment. LCA.g.vi. Access to communications or alarm systems shall be available to all personnel prior to and during treatment operations in accordance with LAC 33:V.1511E.1-2 LLCA.g.vii. The reactive wastes in the thermal treatment pans shall only be remotely ignited. 1LC..gsviil. The number of thermal treatment pans will be no more than ten per burn and/or detonation event. LC.4gix. Thermal treatment pans | through 20 shall thermally treat characteristic waste and/or listed waste for reactivity only. The Permittee shall ensure that the distance from the OBVOD, to the property of others are in accordance with LAC 33:\.4533, as identified in Condition IIL16. Due to the minimum distance being less than 1,250 feet to the property line for thermal treatment in pans | through 3 and I! through 13, the maximum amount cof waste treated shall be no more than 100 pounds per hour net explosive weight (NEW). LC.4.g.x. Residues resulting from the thermal treatment are accumulated in containers (roll-off boxes) must be covered and stored in the truck staging/parking area to protect from precipitation and wind. If analytical results indicate that the material is hazardous it will be labeled and stored for less than 90 days in accordance with Condition IIL Metal casings from the thermal treatment that are accumulated in containers (roll-off boxes) shall be covered and stored in the truck staging/parking area to protect from precipitation and wind, The metals will be stored for no more than 90 days, L.C.Agaxi. The Permittee shall cover the thermal treatment pans during the transport from the pad for storage and/or disposal after treatment. LLC.A.gaxii The thermal treatment pans and pads shall remain at a distance of no less than 40 feet from one another. L.C4g.iit. The concrete pads and the thermal treatment area shall be maintained to adequately prevent residue and debris from contaminating the surrounding area and surface water in accordance with LAC 33:V.3203. The thermal treatment area shall be inspected after each thermal treatment (including detonation) for damage, cracks, and broken conerete, in accordance with this permit. 1.C.4.g.xiv. Ash residue shall be collected within 24 hours ofthe thermal treatment by methods described in the approved WAP. The Permittee shall determine if the residue meets the definition of a hazardous waste by methods described in the approved WAP and Condition II of this permit. The waste residue shall be stored in approved containers with compatible waste. L.C.4.g.xv. The ash residue from the thermal treatment of wastes will be handled in accordance with the approved ‘Ash Management Plan in the WAP in Table | of this permit. The Permittee shall inspect the thermal treatment area each operating day and shall record the results of the inspection record in accordance with Condition I1.C.11 of this permit. L.CAkii, The Permittee shall sample and analyze, each roll-off box of ash residue using the Toxicity ‘Characteristic Leaching Procedure (TCLP). Permittee shall obtain three samples from each roll-off container as follows:_1) atthe surface at one end of the container; 2) at the middle of the container at medium depth; and 3) near the bottom at the opposite end of the container, in accordance with the approved WAP at least quarterly. Permittee shall maintain the results of sampling and analysis, as required by Condition II.1 and in the operating record as required by Condition IC. 11 1.C.4.kiii, The Permittee shall report any releases from the thermal treatment area within 24 hours, ifthe release threatens human health or the environment (soil air, groundwater, or surface water). LCAAL Closure: At closure for the OB/OD thermal treatment unit (including the pad, pans and all associated equipment) the Permittee shall adhere to the procedures detailed in the closure plan (referenced in Table 1) and the requirements of LAC 33:V.3207 or upon review and approval ofa revised closure plan. Within 90 days of cessation of the OB/OD, and in accordance with LAC 33:V.3S11.B, the Permittee shall submit a revised closure plan for closure of the OB/OD thermal treatment area that identifies steps to perform partial and final closure at any point during the active life ofthe facility. The closure plan must include: a description of how the unit will be closed in accordance with the closure performance standards (including groundwater and surface water); an estimate of the maximum inventory of hazardous waste on-site over the active life ofthe facility; methods used during partial and final closure including, but ‘not limited to, methods for removing, transporting, treating, sorting or disposing of all hazardous waste; and, a detailed
