Fax no. 2650 9896, Dated 15.17.2022 Faxno. 2877 0745 Date + 0EC ay Total Pages 3+ Encl Simplified Temporary Land Allocation No. TTP 38 (“STLA-TTP 38”) for Works Site to Water Supplies Department Contract No. 13/WSD/20 ‘Term Contract for Risk-based Improvement of Water Mains ~ New Territories East Replacing aged water mains Location: Tap Mun and Ko Lau Wan, Sai Kung North Approval is now hereby given for the temporary allocation to you of the area of Government land near Tap Mun and Ko Lau Wan, Sai Kung North (excluding any private lot, public road or street and any land allocated to other departments) shown on the attached plan in Appendix I? for the captioned project, subject to the following ‘engineering conditions and the special condition(s) as contained in Appendix IT: - (@ __Thesite is allocated to you for the period from 19.12.2022 to 18.12.2024 only. (i) The area shown on the attached plan shall not be used for any purpose other than the works site in connection with the captioned project. (ii) Excavation within the site in connection with the aforesaid purposes is permitted, (iv) Nossite formation or general disturbance of existing site conditions shall be undertaken without the prior consent in writing of the appropriate authority. Site investigations may be undertaken without such written approval. () No drain or nullah, water pipe, sewer, cable or any other existing site ‘works or installations whatsoever on the site shall be interfered with without the written consent of the appropriate authority who shall impose such conditions regarding removal, diversion or reinstatement elsewhere as may be required and paid for as part of the project. (vi) Damage or obstruction caused to any nullah, drain, water main, cable or other installation within or adjoining the site shall be made good at the cost of the project and to the satisfaction of the appropriate authority. (vii) Any damage done to adjoining public roads shall be made good to the satisfaction of the appropriate authority and paid for as part of the project. (viii) All storm or rain water from the site including any access road thereto shall be conveyed to the sea or the nearest stream course, catchpit, channel or storm water drain. All temporary and permanent works shall be paid for from the project vote and carried out in such a manner that no damage or nuisance is caused by storm water or rain water to adjacent @&) &) (xi) (xii) (xiii) Giv) (xv) (vi) (xvii) property and any claims arising out of damage or nuisance caused by storm water or rain water shall be paid for at the cost of the project. Application should be made direct to the appropriate authority should any water supply or drainage connection be required, and if'a connection can be made, it shall be paid for as part of the project. No right of ingress or egress to or from the site for the passage of motor vehicles will be permitted except with the consent of AC for T/NT, TD and subject to any conditions he may impose. No structure shall be erected on the site other than those as may be required to facilitate the use and enjoyment of the area for the approved user and authorised by the District Lands Officer. Immediately upon handing over the site, adequate fencing or other works shall be carried out to the satisfaction of the District Lands Officer and at the cost of the project to prevent illegal occupation of or dumping on the site. No trees growing on the site shall be interfered with or removed without the prior written consent of the District Lands Officer who may in granting consent impose such conditions as to replanting as he may deem appropriate. All necessary steps shall be taken to protect the general environment, landscape and plants within and adjoining the site. ‘You shall handle all complaints and enquiries and implement measures to address valid concems raised by the public in relation to the use and occupation of the site as appropriate. You shall erect and maintain within the site close to the ingress point to the site for the passage of motor vehicles or, if no such ingress point is available, a prominent location a sign clearly showing the name of the allocatee, the use of the site or the nature of the project to be carried out on the site together with the telephone number and the facsimile number of the officer to whom members of the public may contact should they wish to lodge any complaints or make any enquiries relating to the site. On completion of construction or at the expiry or cancellation or sooner determination of the allocation, the site or any part thereof shall be handed back free of structures and debris and cleared of all occupation. in a condition to the satisfaction of the District Lands Officer who may require the site to be reinstated and fenced to his satisfaction at the cost of the project. ‘You shall be responsible to identify appropriate maintenance party and obtain an agreement from the party concemed on the future ‘maintenance responsibilities of any completed works prior to the site or any part thereof to be handed back to the District Lands Officer, All reasonable measures shall be taken to prevent deterioration of the general environment by the suppression of noise, dust, smells and the discharge of any effluent, rubbish, debris etc, whatsoever from the site. (xviii) You should also provide a set of coloured photos (size 4R in hardcopy) showing the site/alignment in full from different angles: (a) Before commencement of works (within one month); and (b) After completion of works (within one month). 2 This allocation is made without prior circulation to other Goverment departments and is subject to your satisfying the requirements of any other necessary departments. If any other department raises an objection to the proposed allocation, the allocation may be suspended pending consideration of such objection or query and may be withdrawn if any objection is upheld or may be amended as appropriate. 3. In the interests of a more efficient allocation process, no formal allocation plan will be prepared, A copy of plan showing the works limit is attached to this memorandum. 4, Grateful if copy addressees would consider this allocation. Otherwise, you need to fully comply with the requirements as stipulated under Works Bureau Technical Circular (WBTC) No. ° 9/2001 "Procedures for Gazetting under the Foreshore and Sea-bed (Reclamations) Ordinance (Chapter 127)" before the commencement of works.
