07.07.2012 The deceased husband of the Opposite Party attended the ENT Out Patient
18.07.2012 Department (OPD) of Medical College & Hospital, Kolkata.

18.07.2012 The deceased husband of the Opposite Party attended the ENT Out Patient
Department (OPD) of Medical College & Hospital, Kolkata. The patient
was advised to visit Endocrinology Department for specialist opinion. But
he did not follow it.
18.07.2012 – The deceased patient was advised twice for pre-anaesthetic check-up
31.10.2012 (PAC) as per the OPD Patient Card but he failed to appear for the same. He
did not turn up before the ENT OPD for a long period and did not take
prescribed medicines regularly.
10.11.2012 Deceased patient was referred to dental OPD but he ignored the advice.
28.11.2012 The deceased patient was admitted to “free bed” No. M-2 of Ezra Building
(ENT Inpatient Department) at Medical College and Hospital, Kolkata,
College Street.
10.12.2012 The deceased patient was operated after due consultation with relevant
Departments. The 6 hours long operation was successful under supervision
of Dr. S Mukherjee, H.O.D. ENT.
11.12.2012 The condition of the deceased patient had deteriorated. Despite all efforts
by the Hospital Staff, the patient expired at about 07.25 AM.

Further upon the complaint of the Opposite Party about the alleged medical
negligence an Enquiry Committee was set up that found that there was no
apparent negligence on part of night shift doctor.

The appellant aggrieved by the impugned order is seeking a suitable remedy for this Hon’ble
Commission.
Hence the present Appeal.
