The “doctrine of discovery” is not part of the teaching of the Catholic Church. Historical research clearly demonstrates that the papal documents in question, written in a specific historical period and linked to political questions, have never been considered expressions of the Catholic faith. La “doctrine de la découverte” ne fait pas partie de I'enseignement de I'Eglise catholique. La recherche historique démontre clairement que les documents pontificaux en question, rédigés a une période historique spécifique et liés 4 des questions politiques, n'ont jamais été considérés comme des expressions de la foi catholique. Des déclarations nombreuses et répétées de I'Eglise et des papes défendent les droits des peuples autochtones. Par exemple, dans la Bulle Sublimis Deus de 1537, le Pape Paul Ill a écrit : “Nous définissons et déclarons [...] que [, ...] lesdits Indiens et tous les autres peuples qui seront découverts plus tard par les chrétiens, ne doivent en aucun cas étre privés de leur liberté ou de la possession de leurs biens, méme s'ils ne sont pas de foi chrétienne ; et qu'ils peuvent et doivent, librement et légitimement, jouir de leur liberté et de la possession de leurs biens ; ils ne doivent en aucun cas étre réduits en esclavage; si le contraire se produit, cela sera nul et sans effet”. 9. Plus récemment, la solidarité de I'Eglise avec les peuples autochtones a donné lieu a un fort soutien du Saint- Siége aux principes contenus dans la Déclaration des Nations Unies sur les Droits des Peuples Autochtones. La mise en ceuvre de ces principes améliorerait les conditions de vie et contribuerait 4 protéger les droits des peuples autochtones, ainsi qu’a faciliter leur développement dans le respect de leur identité, de leur langue et de leur culture. Fiel al mandato recibido por Cristo, la Iglesia catélica se esfuerza por promover la fraternidad universal y el respeto de la dignidad de todo ser humano. 2. Por este motivo, en el curso de la historia los Papas han condenado los actos de violencia, opresi6n, injusticia social y esclavitud, entre ellos los cometidos contra las poblaciones indigenas. Ha habido numerosos ejemplos de obispos, sacerdotes, religiosos, religiosas y fieles laicos que han dado su vida en defensa de la dignidad de esos pueblos. 3. Al mismo tiempo, el respeto por los hechos de la historia exige el reconocimiento de la debilidad humana y de los fallos de los discipulos de Cristo en cada generacién. Muchos cristianos han cometido actos de maldad contra las poblaciones indigenas, por los cuales los Papas recientes han pedido perdén en numerosas ocasiones. 4. En nuestros dias, un dialogo renovado con los pueblos indigenas, sobre todo con los que profesan la fe catdlica, ha ayudado a la Iglesia a comprender mejor sus valores y sus culturas. Como ha subrayado el Papa Francisco, sus sufrimientos constituyen una fuerte llamada a abandonar la mentalidad colonizadora y a caminar junto con ellos, en el respeto reciproco y en el didlogo, reconociendo los derechos y los valores culturales de todos los individuos y los pueblos. A este respecto, la Iglesia esta comprometida en acompaniar a los pueblos indigenas y en promover esfuerzos encaminados a promover la reconciliaci6n y la sanaci6n. 5. En este contexto de escucha a los pueblos indigenas, la Iglesia ha visto la importancia de afrontar el concepto denominado “doctrina del descubrimiento”. El concepto juridico de “descubrimiento” ha sido debatido por las potencias coloniales desde el siglo XVI y ha encontrado una expresi6n particular en la jurisprudencia del siglo XIX, en los tribunales de diferentes paises, segtin la cual el descubrimiento de tierras por parte de los colonos concedia el derecho exclusivo de extinguir, mediante la compra o la conquista, el titulo o la posesién de dichas tierras por parte de las poblaciones indigenas. Algunos estudiosos han sostenido que la base de la llamada “doctrina” se encuentra en diversos documentos papales, como las bulas Dum Diversas (1452), Romanus Pontifex (1455) e Inter Caetera (1493). 6. La “doctrina del descubrimiento” no forma parte de la ensefanza de la Iglesia catdlica. La investigacion historica demuestra claramente que los documentos papales en cuestion, escritos en un periodo histdérico especifico y relacionados a cuestiones politicas, nunca han sido considerados expresiones de la fe catdlica. Al mismo tiempo, la Iglesia reconoce que estas bulas papales no reflejaban adecuadamente la igual dignidad y los derechos de los pueblos indigenas. La Iglesia también es consciente del hecho de que el contenido de estos documentos ha sido manipulado para fines politicos por las potencias coloniales que competian entre si, para justificar actos inmorales contra las poblaciones indigenas, realizados algunas veces sin oposicion de las autoridades eclesiasticas. Es justo reconocer estos errores, reconocer los terribles efectos de las politicas de asimilacion y el dolor experimentado por las poblaciones indigenas, asi como pedir perdén. Ademas, el Papa Francisco ha exhortado: «Que la comunidad cristiana no se deje contaminar nunca mas por la idea de que existe una cultura superior a otras y que es legitimo usar medios de coacci6én contra los demas». 7. El magisterio de la Iglesia sostiene, en términos inequivocos, el respeto debido a cada ser humano. Por tanto, la Iglesia catdlica repudia los conceptos que no reconocen los derechos humanos intrinsecos de los pueblos indigenas, comprendida la que se ha dado a conocer legal y politicamente como “doctrina del descubrimiento”. 8. Numerosas y recurrentes declaraciones de la Iglesia y de los Papas sostienen los derechos de los pueblos indigenas. Por ejemplo, en la bula Sublimis Deus de 1537, el Papa Pablo III escribid: «Determinamos y declaramos [...] que dichos Indios, y todas las gentes que en el futuro los cristianos llegasen a conocer, aunque vivan fuera de la fe cristiana, pueden usar, poseer y gozar libre y licitamente de su libertad y del dominio de sus propiedades, que no deben ser reducidos a servidumbre y que todo lo que se hubiese hecho de otro modo es nulo y sin valor.» 9. Mas recientemente, la solidaridad de la Iglesia con los pueblos indigenas ha dado lugar al apoyo decidido de la Santa Sede a los principios contenidos en la Declaracion de las Naciones Unidas sobre los Derechos de los Pueblos Indigenas. La implementacién de tales principios mejoraria las condiciones de vida y ayudaria a proteger los derechos de los pueblos indigenas, ademas de facilitar su desarrollo en un modo que respete su identidad, lengua y cultura. Como sublinhou o Papa Francisco, os seus sofrimentos constituem um forte apelo para se abandonar a mentalidade colonizadora e caminhar lado a lado com eles, no respeito mutuo e no dialogo, reconhecendo os direitos e os valores culturais de todos os individuos e povos. A este respeito, a Igreja compromete-se a acompanhar os povos indigenas e a promover esforcgos destinados a favorecer a reconciliagao e a cura. 5. Foi neste contexto de escuta dos povos indigenas que a lgreja sentiu a importancia de abordar o conceito denominado como «doutrina da descoberta». O conceito juridico de «descoberta» foi debatido pelas poténcias coloniais a partir do século XVI e encontrou particular expressao na jurisprudéncia dos tribunais de varios paises do século XIX, segundo a qual a descoberta de terras pelos colonos conferia um direito exclusivo de extinguir, por meio de compra ou conquista, o titulo ou a posse destas terras pelas populagdes indigenas. Alguns estudiosos argumentam que a base da mencionada «doutrina» se encontra em varios documentos papais, como as Bulas Dum Diversas (1452), Romanus Pontifex (1455) e Inter Caetera (1493). 6. A «doutrina da descoberta» nao faz parte do ensinamento da Igreja Catolica. A Igreja esta consciente também do facto que o contetido destes documentos foi manipulado com fins politicos pelas poténcias coloniais em competigao para justificar atos imorais contra as populagdes indigenas, as vezes realizados sem oposigdo das autoridades eclesiasticas. E justo reconhecer estes erros, consciencializar-se dos efeitos terriveis das politicas de assimilagao e do sofrimento vivido pelas populagées indigenas, e pedir perdao. Além disso, o Papa Francisco exortou: «Nunca mais a comunidade crista podera deixar-se contagiar pela ideia de que uma cultura seja superior as outras, ou que seja legitimo recorrer a meios de coagao dos outros». 7. Em termos inequivocos, o magistério da Igreja sustenta o respeito devido a todo o ser humano. Por conseguinte, a Igreja Catdlica repudia os conceitos que nao reconhecem os direitos humanos inerentes aos povos indigenas, incluindo a doutrina que ficou conhecida, legal e politicamente, como a «doutrina da descoberta». 8. Numerosas e repetidas declaragdes da Igreja e dos Papas defendem os direitos dos povos indigenas. Mais recentemente, a solidariedade da Igreja com os povos indigenas suscitou um forte apoio da Santa Sé aos principios contidos na Declaragao das Nagées Unidas sobre os Direitos dos Povos Indigenas.
