Dear [ ],

Please be informed that there is an ongoing investigation against you for alleged violations of the
provisions of the Labor Code of the Philippines, the Revised Penal Code, and of the policies of the
Company, the details of which are set forth below. In light of this, you are hereby placed under
preventive suspension for a period of ten days from receipt of this notice effective immediately.
During the said period, you are prohibited from entering the store premises without prior written
consent of the employer.

We have received multiple complaints against you in your capacity as [ ] of the Store which are
grounds for the termination of your employment with the Company. Management has also noted
violations of the provisions of the Labor Code of the Philippines, the Revised Penal Code, and of the
Company’s policies. These complaints and violations have been verified through CCTV footage and
witnesses. Set forth below are some of these complaints and violations:

Please note that these cited violations are just causes for the termination of your employment with
the Company pursuant to Article 297 of the Labor Code of the Philippines, which reads:

Art. 297. Termination by employer.  An employer may terminate an employment for any of
the following causes:

a. Serious misconduct or willful disobedience by the employee of the lawful orders of his
employer or representative in connection with her work;

c. Fraud or willful breach by the employee of the trust reposed in him by his employer or
duly authorized representative;

Further, please note that some of the violations set forth above may constitute Qualified Theft
under Article 310 in relation to Article 308 of the Revised Penal Code which is punishable by fine
and/or imprisonment.

In light of the foregoing, you are hereby given the opportunity to submit a written explanation in
response to the allegations set forth above within five days from receipt of this notice. You are also
invited to a meeting with the officers of the Company at 11:00 AM on 24 July 2023 at [ ] to give
you the opportunity to defend yourself and to explain your side of this incident.
Please note that failure to submit the said written explanation and/or attend the meeting with the
period provided shall constitute a waiver on your part and shall constrain the management of the
Company to decide this matter based on the records at hand.
