EXECUTIVE ORDER No. 2022 – 33

“AN ORDER CREATING THE MUNICIPAL ENVIRONMENT AND NATURAL RESOURCES


COUNCIL (MENRC) AND TECHNICAL WORKING GROUP (TWG) IN THE MUNICIPALITY OF
MALAPATAN, AND PRESCRIBING THE DUTIES AND RESPONSIBILITIES AND PROVIDING
FUND THEREOF.”

WHEREAS, Section 3, paragraph (i) of R.A. 7160 otherwise known as the Local
Government Code of 1991, provides that the local government units shall share with the national
government the responsibility in the management and maintenance of ecological balance within
their territorial jurisdiction, subject to the provisions of this Code and national policies;

WHEREAS, Section 8 of DENR Administrative Order No.30 s. 1992 mandates the creation
of an Environment and Natural Resources Council (ENRC) consisting of appropriate LGU and
DENR officials and representatives from concerned agencies, professional and civic groups and
other NGOs as may be determined by the DENR and the concerned LGU;

WHEREAS, the ENRC shall review and recommend the implementation of programs and
projects and perform oversight functions on matters pertaining to environment and natural
resources;

WHEREAS, there is a need to create and organize the Municipal Environment and Natural
Resources Council (MNRC) and Technical Working Group to ensure that all environmentally-
related programs, projects and activities are implemented accordingly;

NOWTHEREFORE, I, SALWAY D. SUMBO, JR., by virtue of the powers vested upon me by


law as duly elected Municipal Mayor of Malapatan, Sarangani, do hereby organize the Municipal
Environment and Natural Resources Council of the Municipality of Malapatan, Sarangani as
follows:

SECTION 1. Creation of Municipal Environment and Natural Resources Council


(MENRC), Its Composition, Duties and Functions, and Administration.

A. Composition. The MENRC shall be composed of the following:

B. Duties and Functions. The Municipal Environment and Natural Resources Council
(MENRC) shall:

1) Act as the oversight and policy- making body on any matters pertaining to environment
and natural resources programs, projects and activities;
2) Conduct regular or special meetings on the date and venue prescribed by the members of
the Council;
3) Oversee the overall operations of the Technical Working Group;
4) Oversee the implementation of devolved and forest management functions and the
strengthening and institutionalizing DENR- DILG- LGU partnership;
5) Review and approve the Municipal Forest Land Use Plan, Municipal Environment and
Natural Resources Management Plan and other related environment and natural resources
plans and policies of the municipality;
6) Take the lead in the sustainable implementation of the Municipal Forest Land Use Plan,
Municipal Environment and Natural Resources Management Plan and other related
environment and natural resources plans and policies of the municipality;
7) Review, approve and endorse the proposed program, projects and activities (PPAs) with
Work and Financial Plan (WFP);
8) Determine and approve policies, institutional reforms, priority plans and programs to
ensure the attainment of the LGU’s vision, mission and objectives with respect to
environment and natural resources protection, conservation and wise utilization;
9) To mobilize the members and networks in support of forest protection and conservation
advocacies and activities;
10)To assist in facilitating conflict resolutions related to environment and natural resources;
11)Review and endorse development undertakings/interventions of various proponents
within the area and ensure consistency with the MENR Management Plan;
12)Review the implementation of different environment- related plans, programs, projects
and activities and perform monitoring and evaluation;
13)Recommend measures and safeguards against pollution and for preservation of the natural
ecosystems;
14)Facilitate the review and updating every three (3) years, or as the need arises, the
Municipal Forest Land Use Plan, Municipal Environment and Natural Resources
Management Plan and other environment and natural resources related plans and policies;
and
15)Perform other related functions.

C. Administration.

1) The Municipal Mayor shall serve as Chairperson of the Council, appoint other members and
preside the meeting;
2) The Council shall meet quarterly at a time and date determined by the Chairperson or by
its members; and
3) Members of the MENRC may designate permanent alternate representative.

SECTION 2. Creation of Technical Working Group (TWG), Its Composition, Duties and
Functions.

A. Composition. The Technical Working Group shall be composed of the following:

B. Duties and Functions of MENR Council Technical Working Group. The TWG shall:

1) Facilitate and coordinate the formulation of the Municipal Forest Land Use Plan, Municipal
Environment and Natural Resources Management Plan and other plans and policies
pertaining to environment and natural resources;
2) Coordinate with all barangays within the municipality in the collection of relevant data and
information necessary for the crafting of Municipal Forest Land Use Plan, Municipal
Environment and Natural Resources Management Plan and other plans and policies
pertaining to environment and natural resources;
3) Lead the organization and analysis of collected data and information as basis in crafting the
initial management objectives and strategies for ensuring the protection and conservation
of the environment and natural resources in the municipality;
4) Draft the Municipal Forest Land Use Plan, Municipal Environment and Natural Resources
Management Plan and other plans and policies pertaining to environment and natural
resources based on data analysis and the initial management objectives and strategies and
recommend its approval to the MENRC;
5) Facilitate consultations with different stakeholders to validate the draft Municipal Forest
Land Use Plan, Municipal Environment and Natural Resources Management Plan and other
plans and policies pertaining to environment and natural resources;
6) Monitor the implementation of the Municipal Forest Land Use Plan, Municipal
Environment and Natural Resources Management Plan and other plans and policies
pertaining to environment and natural resources and evaluate existing policies and
programs for the sustainable management of environment and natural resources;
7) Provide technical support and recommend guidelines and policies to MENRC to strengthen
the implementation of environment and natural resources related plans and policies;
8) Facilitate the conduct of Feasibility Studies (FS) or any studies related to environment and
natural resources management, protection and conservation among other; and
9) Provide such other functions, duties and responsibilities as may be necessary to implement
the programs, projects and activities and as directed by the council.

C. Expected Outputs of the Technical Working Group. The TWG, upon performance of
their duties and responsibilities, shall generate the following major outputs, among others:

1) Comprehensive environment and natural resources database of the municipality;


2) Consultations and workshops related to the preparation of the different plans and policies
related to environment and natural resources;

3) Policy notes and recommendations in support of the different plans and policies related to
environment and natural resources;
4) Municipal Forest Land Use Plan, Municipal Environment and Natural Resources
Management Plan; and
5) Monitoring and Evaluation Plan;

SECTION 3. The Secretariat. The Secretariat shall be the Office of the Municipal
Environment and Natural Resources tasked to coordinate, document, prepare agenda and
presentation materials and take minutes of meetings and activities of the MENRC as well as
follow- up actions taken or to be taken as agreed during meetings.

SECTION 4. Technical Assistance. The DENR-XII, Community Environment and Natural


Resources Office- Glan and the PENRO- Sarangani, DARPO- Malapatan, and NCIP- Sarangani shall
provide technical assistance to the council.

SECTION 5. Fund Support and Appropriation. The Municipality shall allocate funds and
resources charged to any available funding sources in support to the operational requirement of
the MENRC, TWG, program, projects and other related activities.

SECTION 6. Separability Clause. If any provision of this Order is declared invalid and
unconstitutional, all other provisions unaffected shall remain valid and subsisting.

SECTION 7. Repealing Clause. All provisions of previous Executive Orders which are
incompatible or inconsistent with the provisions of this Executive Order, are hereby deemed
repealed or modified accordingly.

SECTION 8. Effectivity Clause. This Order shall take effect immediately and shall be valid
until sooner revoked or amended.
