FINAL EXAM

INSTRUCTION: Read each question carefully. Write your answer in your exam

a sub-question under the same number may be written continuously on the
same page and on the immediately succeeding pages until the answer is
complete. Follow the numbering sequence of the Questionnaire in your

I.
May the executive department modify or set aside the judgment of the
court? If yes, what are the instances where the Executive department may
modify or set aside the judgement of the court. (5pts)

II.
Section 6 Article III of the 1987 Philippine Constitution provides that:

“The liberty of abode and of changing the same within the limits
prescribed by law shall not be impaired except upon lawful order of the
court. Neither shall the right to travel be impaired except in the interest of
national security, public safety, or public health, as may be provided by
law.”

The Municipality of Bagoinged passed an ordinance declaring local

lockdown or no-movement day every Saturday in the entire municipality. The
ordinance was passed to prevent the spread of the CoVID-19 virus in the area.
Per report of the Municipal Health Office, the municipality has reported zero
case, however, the nearby Municipality of Pulangi has reported several cases
and it keeps rising.

Considering the constitutional provision on non-impairment of the right

to travel, discuss if the ordinance is valid, constitutional, or not. (10pts)
