Amended Amounts 2022 To 2023 - Practical Guide To Labour Law 1
In terms of section 6(3) the Minister has determined the threshold amount as R224 080 – 48
with effect 1 March 2022. See, for example, page 54 in Practical Guide, 9th edition.
In terms of Schedule 1 of the NMWA the national minimum wage is R23 – 19 per hour. The
prescribed minimum wage is also applicable to farm and domestic workers.
Workers on expanded public works programmes are entitled to R12-75 per hour (Sch 1).
Learners under learnership agreements in terms of the Skills Development Act are entitled to
allowances contained in Schedule 2 of the NMWA. The allowances depend on the NQF level
of a learner’s education and training and the number of credits already earned and range
between R349 - 04 and R2 036 - 00 per week.

Employees earning below the BCEA threshold amount may refer unfair discrimination matters
to the CCMA for arbitration after a failed conciliation. That threshold amount is now R224 080
– 48. See page 104 in Practical Guide, 9th edition.
All employees are entitled to compensation if the prescribed requirements are met, but up to
the threshold determined by the Minister. The amount is R506 473 from 1 March 2021 until 28
February 2022 and R529 264 from 1 March 2022 until 28 February 2023. See bottom of page
