PREFACE

This report is an outcome of the four weeks internship programme conducted by


Institute of Legal Studies, Shri Ramswaroop Memorial University for the students of
ninth semester. Internship was done at Lucknow Bench o Hon'ble Allahabad High
Court, under Adv. Mr. Sanjay Singh. The main constituents of the project are the
report on cases observed at the Court and during the internship and the weekly report
of my work. I have tried my best to do justice with my activities and put it in black
and white with the same effort as I did it during the internship.

ACKNOWLEDGEMENT
First of all, I would like to thank the curriculum deciding authorities for having such
practical learning programme because after five months of theoretical learning of the
various subjects it is important for us as students to view its practical aspect too.
Further I would like to thank Dr. Sudhir Kumar (Dean of the Institute) for providing
me such a nice opportunity to observe the court proceedings and to understand the
practical applicability of the various laws which I had studied in the complete
semester. I would also like to sincerely thank Adv. Mr. Sanjay Singh, who, during
the complete internship helped in every possible way to make us understand the basic
procedure of court proceedings. His teaching method and the way he dealt with my
problems developed my interest in the court proceedings which is often considered to
be quite Interesting.

OBJECTIVE AS AN INTERN
1.) To understand the working method of court proceedings.
2.) To understand the practical application of law.

4.) To learn the art of drafting.
5.) To understand the basics of advocate-client interaction ASSIGNMENT

In the due course of the Internship, I gained in depth knowledge about court
proceedings, practical application of law, drafting skills etc.
My assignment included the following-
1.) Research on legal quarries and issues-
During the internship I was asked to research on various legal queries and
issues provided by sir in regard to various matter. My main task was to find
out cases laws, study legal framework of a particular issue.
2.) Drafting Assignment-
After the first week of internship I expressed my interest in learning drafting
to my sir then initially I was given some samples to understand how drafting is
done.

REACHERH WORK-
During the Internship I researched on the Section 8 of the Arbitration and
Conciliation Act,1996.
Section 8 of the Arbitration And Conciliation Act, 1996 is related to power of
Judicial Authority to refer the parties to the Arbitration.
In order that the judicial authority may refer the parties to the arbitration the
following condition must be fulfilled-
1. There should be a valid and subsisting arbitration agreement.
2. Application must claim under arbitration agreement.

In this case petitioner has evoked the Arbitration clause.
In this case it was said that for the purpose of present application ,that the parties to
the memorandum interested to have their dispute resolved by the arbitration and in
fact the petition has to be allowed.

HEMA KHATTAR V. SHIV KHERA,2017SC


In this case it was said that if in any case where there is an arbitration clause in the
agreement ,it is obligatory for the court to refer the parties to the arbitration.

Therefore it is clear that in an agreement between parties before the civil court
if there is clause for arbitration it is mandatory for the civil court to refer the dispute
to an arbitration.

In this case petitioner was stopped from appearing in selection process of
pharmacist. Petitioner have challenged the advertisement issued for the post of
pharmacist was cancelled after 6 years and cancellation was wholly illegal.
State Government says notification has been cancelled due to sudden change in
educational qualification
It was held that cancellation was illegal and absolute arbitrary because
candidates have all the educational qualification.
