Attendance Policy - Drivers

Overview
To fulfill our obligations to our customers, and in fairness to all employees, drivers are expected
to report to work when scheduled. Schedule adherence and regular attendance are essential to
the proper operation of Hub Group. This Policy outlines attendance and schedule adherence
requirements, as well as provides progressive discipline for accountability.

Scope
This Policy applies to all drivers.

Attendance Requirements
The normal workweek for drivers consists of five (5) days, up to fourteen (14) hours per day, in
compliance with Department of Transportation ("DOT") regulations. Hub Group is committed to
complying with state and federal laws and compliance with the federal Hours of Service ("HOS")
rules and regulations will always take precedence over other scheduling issues. Hub Group will
not require or permit any driver to operate a commercial vehicle outside the HOS rules.

Workdays and shifts are established by management and assigned based on business and
operational needs while considering driver requests, length of service and other factors where
possible.

While Hub Group recognizes that occasional unexcused absences or tardiness are inevitable,
excessive absenteeism, tardiness, and failure to adhere to schedule are not acceptable and
may result in corrective action up to and including termination.

Hub Group has developed a point-based attendance system to manage absenteeism, tardiness,
and schedule adherence ("Point System"). The points can be assigned through any combination
of absences, tardiness, and schedule adherence variances, all of which have assigned point
values. Drivers are subject to progressive discipline after obtaining four (4) points as outlined
below.

Point System
Local management is responsible for tracking and monitoring driver attendance and time entry,
using the following points system:

2 Points Unexcused Absence

½ Point Schedule Adherence – Minor


On site clock in 30 – 60 minutes before or after scheduled start time
Departure prior to completing planned workload without manager permission

1 Point Schedule Adherence – Major

Schedule Adherence Example – Scheduled Start Time – 6:00am:

An unexcused absence is any absence that is not properly approved by a manager or is not
otherwise protected by applicable law, including but not limited to, FMLA, ADA, USERRA and
related local laws. Such laws only protect absences if the driver has complied with the notice
and application requirements and has properly been approved.

Schedule adherence refers to:

(i) arriving on site within the 30-minute window before or after the driver's scheduled start time
and clocking in accordingly. It is not acceptable to clock in from another geographical location -
drivers must be on site in the allotted window. Drivers who choose to arrive at the site more than
30 minutes before their scheduled start time must not clock in until the 30-minute window.

(ii) a driver that arrives more than 30 minutes past the scheduled start time that has an
excused tardy will not receive points. An excused tardy is when a driver receives approval by
a manager for the tardy or when the tardy is protected by applicable law.

(ii) leaving work before completing the driver's planned workload for the day without specific
permission from management unless the early departure is protected by applicable law.

Notification Requirements
(i) In the event of an unplanned absence or tardy, drivers are responsible for notifying
management directly no less than two (2) hours prior to the scheduled start time, unless unable
to do so for supported medical reasons. If unable to reach management, drivers are responsible
for leaving a message for management that includes contact information for the driver. Failure
to properly notify management per this policy may result in additional disciplinary action.
Moreover, proper notification in and of itself does not excuse an absence or tardy that is not
otherwise excused.

(ii) If a driver fails to report to work and fails to notify management for two (2) consecutive days,
the driver will be subject to termination based on voluntary job abandonment barring any
medical justification for the lack of notification and the absences.

(iii) If a driver is absent for three (3) or more consecutive days for medical reasons (physical
and/or mental), per Hub Group driver safety policy, the driver will be required to provide
authorization to return to work from a treating medical provider. This is also true for FMLA or
other medical leaves of absence.

(iv) Drivers must record all absences in HCM, whether planned or unplanned, approved or

unapproved. Recording an absence does not in and of itself make it approved/excused.

Discipline
Points are tracked on a rolling twelve-month period. An accumulation of four (4) points in a
twelve-month period will commence the progressive disciplinary process which will proceed as
follows:

4 points Verbal Warning


8 points Written Warning
10 points Final Written Warning
12 points Termination

Points and discipline do not apply if driver is absent or tardy for a legally protected reason with
the proper supporting documentation.

This progressive discipline system only applies to attendance-based discipline. Drivers may be
subject to additional and/or more severe discipline for other reasons regardless of the driver's
status on attendance points.

Other Terms and Conditions


This policy does not create an employment contract between the Company and drivers. Drivers
remain "at will" employees of Hub Group.

Hub Group maintains the right to modify or cancel this policy at any time.

Hub Group complies with all laws and to the extent that anything in this policy conflicts with
applicable law, the law shall govern.
