PRELIMINARY & GENERALS


The term "as described" used in the description for measured
work shall mean "as described in Specification to All Trades".
Where so described, item of work shall be read in conjunction
with the relevant items in Specification to All Trades.

ACCESS TO AND WITHIN SITE
The Contractor must ascertain the actual condition for being
materials, labour and plant to and within the site. Further, he
shall provide and maintain all necessasry temporary roads,
walkways, cross-overs stagings, bridges, surface water drains,
culverts and internal access for the construction of works and
clear away same on completion of the works.

Attention is also hereby drawn that the Contractor will have to
share with other Contractors the use of common access and
approach roads to transport his materials, labour and plant etc. to
the site and no claims will be considered on the ground of
hindrance obstructions experienced due to the presence of other
Contractors being employed on or around the site.

2 MAINTENANCE OF COMMON ACCESS AND APPROACH


ROADS
The tenderer shall allow here for the cost of maintenance of all
roads, tracks, etc. used by him for access to and from the site.

3 VISIT OF THE SITE


The Contractor shall before tendering visit the site of the
proposed works and shall ascertain for himself the following.-
the nature, character and conditions of the site and the sub-soil
upon which the works are to be carried out.
local conditions.
the means of access facilities to transport and movement of
materials, labour and plant to and wiihin the site.
the extend of workinq space available.
conditions affecting labour and materials, the storage of Included
materials, posationing of sheds, stores, site offices and plant.
the location of existing services including electrical cables, water
mains and telephone lines.
the nearest point which electricity and water can be connected.
any other information necessary for computing the tenders.

Any claims on the grounds of lack of knowledge of any aforesaid

4 SITE INSPECTION & SETTING OUT


lmmediately before taking possession of the site and before
commencing any work, the Contractor shall check actual levels
and dimensions against those shown on the drawings and
immediately inform the Engineer in the event of any alleged
discrepancy:-

The Contractor shall allow for engaging a licensed Land Surveyor


to carry out a site survey before work commences, to establish
boundaries, sport levels and setting out the works as required by
the Engineer. The drawing shall be cerlified by the licensed
surveyor.

5 TRIAL HOLES
The Contractor shall excavate all trial holes as directed by the
Engineer and shall perform all soil bearing tests to determine the

bearing capacity of the soil. The Contractor shall allow and
provide all the necessary equipment to carry out this test.

6 EXISTING SERVICES
The Contractor shall take all necessay steps to ascertain the
exact positions of existing cables, pipes, ducts, sewers, service
mains and the like and shall uphold, protect and maintain the
same during excavation and make good or pay for making good
all damage thereof and any consequential damage or loss arising
oul of such damage. lncluded

ln cases where the services are to be temporarily terminated or


diverted, the Contractor shall give the necessary notices to the
appropriate Authorities and arrange for the work to be carried out
and pay all charges in connection therewith.

7 SEQUENCE OF WORK
The Engineer may, at his discretion direct the Contractor to give
priority to certain works or order the Contractor to do certain lncluded
works first.

8 PROGRAMME OF WORK
The Contractor shall submit as required, sufficiently detailed
works programme in triplicate showing the order or sequence tn
which he proposes to carry the various parts of the works, and to
the best of his knowledge the anticipated times for completion of lncluded
work including Prime Cost programme by the Engineer is
necessary.
It will be revised thereafter, as it is necessary when further
information becomes available but the Contractor shall not depart
from it and will be held responsible for the satisfactory progress
and completion of the works in accordance with the Condition of
Contract

A further copy shall be retained at the site office and the progress
of works be kept up{odate by the Contractor. ln addition, the
Contractor rs also required to list detail of all plant, tools and
vehicles which he intends to employ on the work.
Submission of programmes will not relieve the Contractor of his
obligations to apply in writing for instructions as required by the
Conditions of Contract. The receipt of programmes will neither
affect the Contract completion date nor relieve the contractor of
his responsibility to complete the work by this date. lncluded

and if the Engineer so instructed, the Contractor must arrange at
no extra cost for work to be done on overtime basis, increase in
manpower, plant and equipment to accelerate the work.

9 PROGRESS REPORT
The Contractor shall prepare and submit to the Engineer daily
progress reports for the works at weekly intervals. The works
shall be including those of Nominated Sub-Contractor and Lump
indicating the number of workmen employed, materials and sum

goods delivered, the extend and type of plant employed, weather


conditions and generally the progress of the works.
Report shall be also included with all S-Curves, Safety briefing,
Tool Box meeting, Progress Pictures and Delivery Orders.

10 PROGRESS PHOTOGRAPHS (DIGITAL)


Provide the Engineer with four (4) sets of postcard size coloured
progress photographs of each of the proposed works taken from
two approved positions on the first day of each month throughout Lump

11 LEMBAGA PEMBANGUNAN INDUSTRI PEMBINAAN


The Contractor shall allow for and shall comply with all the
requirements as set out in the Act. The Contractor is to obtain all
necessary permits and certificate of registration and shall pay all
levies and fees etc as required by Lembaga Pembangunan
lndustri Malaysia.
The Contractor shall comply to part Vlll of the Lembaga
Pembangunan lndustri Pembinaan Malaysia Act 1994 and the
Construction lndustry (Levy Collection) Regulations 1996 and

supervisory and administrative staff for the proper execution of Lump

16 INSURANCE
16.1 Contractors's All Risks
The Contractor's attention is specially drawn to his responsiblities
under Clause 22 and 23 of the Conditions of Contract for Works
of Civil Engineering Construction (FlDlC 4th Edition 1987).

The Contractor shall effect and maintain a "Contractor's All Risks Lump

the Contractor during this period shall be limited to any loss or
damage caused by him in the course of the operation carried out
for the purpose of complying with the obligations under the
Defects Liability clause of the contract

17 WORKMEN'S COMPENSATION OR INSURANCE


The Contractor shall allow here for and as a condition precendent
to the commencement of any work under this contract take out at
his own expenses with an insurance company to be approved by
the Employer in writing a policy or policies to indemnify the
Contractor and the Employer including for this purpose, the

The Contractor shall ensure that the policy taken should cover at
least 15% of Contract Sum for Estimated total salaries, wages
and other money earnings.

The Contractor will not be required to take out any Workmen's


Compensation lnsurance Policy under Clause 24 hereof if the
workers employed in the Works are liable for coverage under the
Employee's Social Security Act, 1969. ln such a case the
Contractor shall regjster his employees and contribute under the
Social Security (SOCSO) Scheme in the places where the
Scheme is implemented and comply with the propvisions of the
said Act. The Contractor shall submit the Code Number and
Social Security Numbers of all the workers on site to the
Engineer for checking.

The Contractor shall make payment of all contributions from time


to time on the first day on which the same ought to be paid and
until the completion of his Contract and it shall be the duty of the
Contractor to produce to the Engineer contribution cards or
stamp vouchers as evidence of payment of such contribution,
whether demanded or not.

lf any default is made by the Contracor in complying with the


terms of this Clause, the Employer or the Engineer on its behalf
may without prejudice to any other remedy available to
withhold an amount from any money which would otherwise be
due to the Contractor under this Contract and which in the
opinion of the Engineer will satity any claims for compensation by
workmen that would have been borne by SOCSO Scheme had
the Contractor not made default in maintaaning the contribution,
and/or
pay such contributions as have become due and remain unpaid
and deduct the amount of such contributions from any monies

Nothing in this Condition shall be construed to take away or to


waive or in any manner to modify the right of the Employer to be
indemnified by the Contractor under Clause 24 in respect of all
compensation, costs and other expenses whatsoever which by
reason of the Contractor's default or otherwise become payable

The Contractor shall provide all necessary labour, plant and tools
for the proper and efficient execution of the works. He shall
provide for all transport for labour and for the movement of plant
and equipment to and from site.

20 SITE OFFICE AND TEMPORARY BUILDINGS
The Contractor shall erect and install a 40 foot Heavy Duty type
office cabin (container) which shall be used site staff use and for
site discussions. The floor is made of 18 mm plywood (WPF G1)
reinforced with 50 mm x 75 mm steel rectangular hollow section
and top finished with Vinyl sheet. The roof is covered wtth 1.0
mm metal sheets reinforced by 25 mm c 50 mm steel rectangular
hollow section. The wall external is covered with 1.0 mm
corrugated metal sheet c/w painting while the internal wall
finishing is laid with 12 mm Gypsum board. The ceiling finish is
laid with suspended ceiling. The window is 4' (W) x 3' (H) NA

22 EXISTING ROADS
The Contractor shall diverts as required all drains and other
walerways encountered during the progress of the works. Where
such diversions are temporary, the Contractor shall subsequently
reinstate to the approval of the Engineer.
The Contractor shall take over and maintain all the new roads
and shall be responsible for any damage to existing roads, kerbs,
drains, crossing, culverts, etc. caused by his workmen, vehicle or
plant or that of Nominated Sub-Contractors and Nomrnated
Suppliers, approaching or leaving the site and to maintain, repair
and reinstate the aforesaid to their original conditions to the
satisfaction of the Engineer for alternatively to bear the cost of lncluded
such maintenance and restoration as a deduction from any
money due to or become due to the Contractor under his
Contract.

The Contractor shall verify with the Authorities whether any


restriction exists on the free passage at any time of vehicles,
plant, or his workmen approaching or leaving the site, and shall

23 MATERIALS AND GOODS
Notwithstanding materials of Malaysian origin must be used to
the exclusion of imported materials, materials and goods
throughout the works shall be the best of their descrjbed kinds
and shall conform to the relevant current requirements of the
British Standards wherever applicable.
The materjals of Malaysian origin, are to be used where
applicable by the Contractor to the exclusion of imported
materials and he shall allow for this special requirements in this
tender. ln no circumstances will the Contractor be permitted to
use imported malerials unless the Engineer is satisfied that
certain of the materials are unavailable or the local materials of
sub-standard specification.
lf the Contractor fails for any reason to supply any materials
which he has contracted to supply or if he fails to supply any such lncluded
materials in sufficient time to enable the Contract to be completed
by the agreed date for completion, then in either even the
Employer may supply any portion, or all of such materials the
cost in respect there of to be borne by the Contractor shall be.

24 BASIS OF ORDERING MATERIALS


The Contractor shall order the correct type and quantity of
materials or fitting by working out these from the drawings. All
dimensions must be checked and verified by the Contractor on lncluded
srte before ordering.
The Contractor shall place his orders for materials and goods at
the earliest possible date after signing the contract and will be
held responsible for any delay occasioned through and failure to
do so. All order for materials or goods to be presented to the
Engineer for inspection as necessary.

The Contractor is not allowed to alter or amend any of the
description of materials unless expressly provided to the contrary.

25 WORKMANSHIP
All workmanship related to the permanent shall be skilled in so
far as the work required in the opinion of the Engineer. The
standard of workmanship shall be the best obtainable in the lncluded
region and to the requirement of British Standard Code of
practice.

29 SIGNBOARD
The Contractor is to provide and fix in a position to be determaned
by the Engineer a framed signboard size of required design and
wordings. The Contractor shall also pay all fees as required by Lump

30 ORDERING MATERIALS
The Contractors shall place his orders for specified materials at
the earilest possible date after notification of acceptance of

The Contractor shall not enter into any agreement for the supply

39 ANTI.POLLUTION MEASURES
The Contractor shall make adequate provision by spraying,
hosing, erecting screens or other suitable methods as directed by

40 PROTECTION OF ADJOINING PROPERTIES


The Contractor shall carry out the Works in such a manner so as
to avoad causing damage to adjoining, adjacent and subjacent
properties. He will be liable for and must indemnify the Employer

41 PROTECTION OF EXISTING PUBLIC AND PRIVATE

42 KEEPING SITE DRY


The Contractor shall be responsible for keeping the whole of the
Works well drained and free from all water (including rain, storm,
spring and running water and water below the Water Table
Levels and the Contractor is to ascertain for himself the water

times to ensure that, so far as practicable all work is carried out

50 SAMPLES

samples shall be submitted for approval at the earliest possible
date after acceptance of tender and before any order bulk

All samples which are approved will indicate the standards to be
maintained in the execution of the works and shall be so marked
and retained by the Engineer. In cases where samples are
rejected, further samples must be provided until they are lncluded
approved.
All samples submitted shall be free of charqe.
Where reference is made to trade names or manufacturer's
catalogue numbers, the Contractor may use materials or goods
similar and equal in standard to those described only if
specifically approved by the Engineer in writing.

51 PRESS STATEMENTS
The Contractor, his workmen or agents will not make any public
or press statement of any form or description which are
exasperative and detrimental to the intests of the Employer,

for any damage caused by his carries or workmen to any of these

54 LEAVES WORKS PERFECT


On completion of the works and before the issue of the

condition to the satisfaction of the Engineer and shall ensure that
the work of the Nominated Sub-Contractor is handed over in a
like condition such operations shall include but not be limited to
the following:-
Remove all debris, rubbish and surplus materials etc. from the
site and leave the works clean and tidv
All plant, appliances, apparatus or equipment are to be removed
as quickly as possible and conveyed away from the site at the
sole cost of the Contractor. All services and leads, iemporary
buildings, sheds, barriers, etc. are to be disconnected,

dismantled, taken down and removed. All holes, trenches,
excavations and distrubed areas in connection with the plant,
sheds etc. are to be filled in a proper manner, levelled of an
closely turfed and the sjte left in a clean and orderly condition.

55 MAKING GOOD DEFECTS
The Engineer shall glve the Contractor due notice of his
intentionsto carry out inspections during the Defects Liability
Period and the Contractor shall arrange for a responsible
representative to be present at the time and dates nominated by
the engineer.
This representative shall render all necessary assistance and
take note of all matters and things to which his attention is lncluded
directed by the Engineer.
The Contractor shall make arTangements with the Employer
(through the Engineer) and give reasonable notice of the precise
dates of access to the various parts of the works for the purpose
of making good defects and inform the Engineer when remedial
works to the various parts are completed.

56 PRESERVATION OF EARTH SLOPES


The Contractor shall take all necessary precautions to preserve
all earth slopes both existing ie. slopes already existing on the
site at the time of the slte being handed over to the Contractor
and new slopes formed and constructed by the Contracor under
the contract.
He shall construct adequate temporary water courses and drains lncluded
and take other necessary steps to prevent slips from occuring.
Should slips occur due to the Contractor's neglect to take
necessary precautions to preserve the earth slopes, he shall at
his own expense make good such slips to the entare satisfaction
of the Engineer.
The Contractor shall make daily inspection of the earth slopes
and more often if he deems it necessary or is so instructecd by
the Engineer. He shall record the results of his inspections in the
Site Book. ln the event of slips occuring or in the opinion of the
Contractor, may possible occur, the Contractor shall immediately
report to the Engineer who shall gtve the necessary instructions

58 PERFORMANCE BOND

mosquito and pay all charges as may be required by the Local
Authority concerned for any antimalaria measures taken.

60 WORKING HOURS

on site, but he shall comply with all current Bye-laws, Rules and
Regualtions affecting work and labour and also the
National/Public Holidays etc. of the state. The Contractor shall
also note that there may be residence, Mosque, Schools,
Hospital, Offjces and the like at close take these into lncluded
consideration whilst performing work which may be a cause of
public disturbance.

To this end, the Engineer may require work to be stop at certain


time, adjust the contractor's working time and no claims wil be
