Republic of the Philippines ENERGY REGULATORY COMMISSION ERC BAC RESOLUTION NO. 26, Series of 2020 ‘A Resolution Recommending the Approval of the Proposed “annual Procurement Plan for Fiscal Year 2020 — ‘Supplement No. 6” WHEREAS, on 08 January 2020, the Honorable Commission, as the Head of the Procuring Entity (HoPE), approved the Annual Procurement Plan (APP) for Fiscal Year (FY) 2020 for the purpose of procuring projects, activities and programs, as contained therein, of the Energy Regulatory Commission (ERC); WHEREAS, Section 7.2, Rule IL of the 2016 Revised Implementing Rules and Regulations (R-IRR) of Republic Act No. 9184, otherwise known as the Government Procurement Reform Act (GPRA), states that: “No procurement shall be undertaken unless it is in accordance with the approved APP, including the approved changes thereto. The APP must be consistent with the duly approved yearly budget of the Procuring Entity and shall bear the approval of the HoPE or second-ranking official designated by the HoPE to act on his behalf.”; WHEREAS, Section 7.4 Rule II of the said R-IRR further provides that: “Changes to the individual Project Procurement Management Plan (PPMP) and the consolidated APP may be undertaken every six (6) months or as often as may be required by the HoPE.
