CONTRACT TO SELL

KNOW ALL MEN BY THESE PRESENTS:

This Deed of Conditional Sale made and entered into by and between:

I, EMILY DIAZ, of legal age, Filipino, single and a resident of Sambag, Jaro,
Iloilo City, hereinafter called the FIRST PARTY/SELLER.

- and -

ANNABELLA CRUZ and ROBERTO CRUZ, both of legal age, married,


Filipinos and a resident of Brgy. Tigum, Pavia, Iloilo, hereinafter called the SECOND
PARTY/BUYERS.

WITNESSETH:

WHEREAS, The First Party/Seller/Guardian EMILY DIAZ is the duly judicially


appointed guardian of the registered owner/incompetent/ward Rolando Conjusta over the
herein described lot including improvements thereon and more particularly described as
follows:

The First Party/Seller/Guardian is desirous to sell the aforesaid lot including


improvements thereon to the Second Party/Buyers who accepted the same subject to the
following terms and conditions:

a. The price in the sale of the land including improvements thereon is


THREE MILLION PESOS (₱ 3,000,000.00) NET of the price in favor
of the Seller except the payment of the Capital Gains Tax and Real
Property Tax for one half year of 2022. Therefore, the Buyers shall be
in charge of payment of all the rest of the taxes and expenses
necessary for the transfer of title to the name of Buyers.

b. The parties agreed to utilize the subject lot including improvements


thereon covered by TCT No. 090-T-110756 covering Lot 2097-I-8-D-
4 of the Registry of Deeds of the Province of Iloilo. However, the
Second Party/Buyers agreed to pay the First Party /Seller/Guardian
whatever difference of the amount of the approve..

c. That the Second Party/Buyers shall solely shoulder all expenses and
taxes necessary for the transfer of title in their name except payment of
Capital Gains Tax and Real Property Tax for one half (1/2) year of
2022.

d. Insofar as the improvement standing on the said lot covered by Tax


Declaration No. 20-0007-00324 registered in the name of
ANNABELLA CRUZ and ROBERTO CRUZ with Market Value of
=P=80,000.00 with zero assessment and exempt from real property
tax, the said improvement pertaining to the share of the incapacitated
Rolando Conjusta is agreed to be part of the Contract To Sell, whereas
the share belonging to ANNABELLA CRUZ insofar as to the
improvement covered by the said tax declaration, the same is sold at
one (=P=1.00)peso price in favor of the Buyers by ANNABELLA
CRUZ and ROBERTO CRUZ, so that the lot including the
improvements thereon covered by the said Tax Declaration No.
20-0007-00324 hereto described to wit:
shall be incorporated as part of the Contract to sell over the land and
improvements thereon.

e. That the parties shall faithfully comply with all the terms and
conditions of this Contract to Sell.

IN WITNESS WHEREOF, we have hereunto set our hands and affixed our

where the acknowledgement is written and signed by the parties with their instrumental
