AFFIDAVIT
I, LLANOS, GHALDIN REY C., Filipino, of legal age, married, and a resident of
Napolan, Pagadian City, Philippines, after being sworn in accordance with law, depose
and state:

That I am a passenger of a Toyota Grandia Van registered in the name of PROVINCE OF

ZAMBOANGA DEL SUR;

That on December 13, 2011 at around 12:45 AM, while I was riding and seated in the
front seat of the above-mentioned van traversing the from Labangan, Zamboanga del Sur
on our way to Pagadian City, the driver happened to pass through the north diversion
road at Barangay Bulatok which leads to Pagadian City;

While we were going near the Integrated Bus and Jeepney Terminal (IBJT) of Pagadian
City, the Driver reduced speed as the area was foggy then the van climbed the last uphill;

When the van we were in was about to make the last climb and before we could reach the
IBJT, I suddenly saw in front of us wall which was later on discovered to be a parked
trailer truck in the middle of the highway with no early warning device and no brake
lights at all and the tail portion thereof was covered with mud;

All of a sudden, our van then hit the parked Trailer truck. The impact was so strong that
it caused enormous damage to the van and to the passengers therein;

As a result of the incident, I suffered a broken leg and some if not all of my companions
also suffered fractured bones in different parts of their body;

Immediately after the impact, I forcibly moved my body from the wrecked front portion
of the van and cried for help. I saw two persons running towards the trailer truck and
then the truck sped away;

That as a result of the incident, the vehicle I was driving sustained damage in its back and
rear right portion thereof;

That the said incident was witnessed by many persons including the driver of the van and
many of my companions and has been duly documented in the Blotter of the Traffic
Division of the Pagadian City Police Station;

That upon inquiry with the Traffic Investigator, it was discovered that the said person
driving the motorcycle is RUEL S. MUCALLON of Carangan, Ozamis City;
That RUEL S. MUCALLON was driving his Trailer Truck without any Driver’s License
as of the time of the incident and that the truck he was driving has no break lights and
signal lights, both in violation of the traffic rules and regulations;

That I am executing this Affidavit to attest to the truth of the foregoing and in support of
charges for "RECKLESS IMPRUDENCE" against the driver of the said Trailer Truck or
for whatever other action that may be filed against the driver and/or registered owner of
the said vehicle for the medical expenses of my injuries sustained;
